Marge Orr and Mr.Eason met With t~e council regarding the budget for the library for the year 1967: Salary $1200;Supplies $200.00;Art rental $70.00;Books $1,000;Magazine subscriptions $25.00;Newspaper $5.66;making a total proposed budget of $2500.00. Moved by Johnston seconded by Leonard to purchase tools for Gas Dept.from Brown Supply.Approximate cost $600.00 quoted.Carried h to O. Moved by Leonard seconded by Meyer to adopt the Gas Code used by the Town of Woodbine.Carried 4 to O. The Clerk was ~nstructed to get bids on printing 500 books on Gas Code. Rola.nd Buechler and Phil Orr met with the Council regarding the Gas Insurance. Lee Felt met with the Council to discuss Group Insurance for the TownEmployees. Joe Casey discussed the Gas project. It rras moved by Councilman Leonard,and seconded by Councilman HOI're,that the Ordinance entitled:"Ordinance No.101.An Ordinance relating to and establishing rates for gas furnished users by the Municipal Gasworks Distribution System of the Town of Waukee,Iowa",be now read by the TownClerk.The Mayor put the question on the motion,and the roll being called,the following named Councilmen voted: Ayes:Howe,Leonard,Boone,and Meyer Nays:None (Johnston absent) Whereupon,the Mayor declared the motion duly carried. ORDIJW:CENO.101 An Ordinance relating to and establishinc rates for gas furnished users by the Municpal Gasworks Distribution System of the Town of Waukee,Iowa. WHEREAS,a Municipal GasworkS.Distribution System is owned and operated by the Town of Waukee~Iowa~and said Townis by law authorized to fix .the ratestobechargedusers01gasfur-m.shed by said plant and system;and 20 il1lEREAS,it is deemed advisable to provide rate schedules of charges for gas as hereinafter set out;now therefore IT IS ORDAll,JEDbythe Council of the Town of Waukee,in the Courrty of Dallas, State of Iowa,as follows: Section 1.That the monthly reates to be charged for gas furnished the users thereof within the corporate limits of said Townshall be and are estab- lished as follows: Firm Residential and Commerical Monthly First 400 Cu.Ft.or less per month Next 1600 Cu.Ft;used per month Next 8000 Cu.Ft.used per month Next 20,000 Cu.Ft.used per month Balance $1.00 .20/100 CF nO/lOO CF ~09/100 CF .08/100 CF In any month in which a user uses in excess of 250,000 Cu.Ft.of gas,the rate for that month will be .08/~CF for all gas used. The minimummonthly char-ge for gas supplied through a size S 1 meter shall be $1.00 per month.The minimum monthly charge for gas supplier'throlIgh a meter larger than a S 1 shall be $10.00 per month.Each meter shall be deemed a user for purpose of this ordinance.Charges for gas furnished interruptible users shall be fixed by contract between the Townof Waukeeand such user. Section 2.The said Townmay from time to time,by ordinance,change and readjust the foregoing rates to be charcedfor gas where it is deemed advisable in the judgement of the TownCouncil,with approval of outstanding bondholders of record. Section 3.All ordinances and resobtions or parts thereof in conflict herewith be and the same are hereby repealed to the extent only of such conflict. Section 4.This ordinance shall be in full force and effect from and after its final passage,adoption and approval by the TOlmCouncil and publication as provided by law. ORDINANCENO.102 An Ordinance regulating the Licensing,Impounding Immunization and Keeping of Dogs. Be it Enacted by the Council of the Town of WaQ~ee,Iowa: Section 1.Definitions.For use within this ordinance the following are&,fined: "Dogs"includes both male and female dogs whether altered or not; "At large"refers to any dog running otherwise than upon the premises of its owner when the dog is not attached to a leash held by a competent person, restrained Within a motor vehicle,or in an animal hospital or kennel; "Owner"includes any person,firm or corporation owning,harboring, sheltering or keeping a dog. Section 2.License.Every owner of a dog shall procure a dog license from the town cler],on or before the first day of April of each year.The annna),license fee shall be $1.00 for each dog.A penalty of $1.00 per month shall be assessed for failure to pay the license fee when due. Upon paymen~of the license'fee,the tm1n clerk shall issue to the owner a license which shall contain the name of the owner,his place of residence, and a description of the dog.The tmrn clerk shall keep a duplicate of eachlicenseissuedasapublicreoord. Upon issuance of the license,the town clerk shall deliver to the owner a metal tag stamped with the number of the license and 'the year for which it was issued.The license tag shall be securely fastened to a collar or harness Which shall be worn by the dog for which the license is issued.Any dog found running at large without the license tag attached to its collar or harness shall be deemedunlicensed. It shall be a violation of this ordinance for any m1ner to own or possess a dog Within the town of Waukee Without obtaining a license in COlipIiance withthissection. Section 3.Imrounization.Every owner of any dog over the age of three months shall,when procuring a dog license from the Town Clerk,present to the town clerk a certificate from a qualified doctor of veterinary medicine that such dog has had immunization against rabies;and such certificate-shall show the date of such immunization and the term of such immunization. If any dog for which a license has bren obtained shall not have attained the age of three months at the time of the licensing of such dog,the owner shall, not less than 10 days after such dog attains the age of three months secure immunization against rabies for such dog and present a certificate as required in this section to the town clerk who shall enter such certification in the recordsofthetown. It shall be a Violation of thi3 ordinance for any owner to own or possess a dog Within the Town of Waukee Without furnishing a certificate of immunizationagainstrabiesincomplianceWiththissection. Section 4.Kennel Dogs.Kennel dogs Which are kept or raised sole~r for the bona fide purpose of sale-and Which are kept under constan~restraint are notsubjecttotheprovisionsofth"s ordinance. Se.ction 5.Dogs disturbing the peace. 1.It shall be unlawful for an owner of a dog to allow or pel'lilitsuchdogtorunatlarge~" 2.It Shall be unlaWful for an owner of a dog to allow or permit such dog to pass upon the premises of another thereby caush~g damage to,or interferenceWith,the premises. 21 I 22 3.It shall be unlawful for an owner of a dog to allDw or permit such dog to cause serious annoyance or distl1rbance to any"person or persons by frequent and habitual howling,yelping,barking Dr otherwise. Section 6.Impounding•. 1.Any unlicensed dog found at large,or any licensed dog found at large L~violation of seotion 3 of this ordinance,shall be seized and impounded. 2.The owners of such licensed dogs shall be notified that upon pay- ment of impounding costs such dogs will be returned.If the impoundedlicensed I dogs are not recovered by their owners within five (5)days after notice,the dogs shall be disposed Df by the marshal. 3.Impoundedunlicensed dogs maybe recovered by the owner,upon proper identification,by pa"cmentof the license fee and impoundingcosts.If such dogs are not claimed within five (5)days after impounding,they shall be disposed of by the marshal. Seotion 9.SaVing Clause.If any seotion,provison,or part of this ordinanoe shall be adjudged to be invalid or uncDnstitutional,such adjudicatiDn shall not affect the validity of this ordinance as a whole or any section, pr-ov Ls i.on or part therDf not,adjudged invalid or unc onst.Lout.LonaL, Section 10.Wheneffective.This ordinance shall be in effect after its final passage,approval and publication as provided by law.
