July 14th present. with Mayor Absent, Gilbert Stanley met ~lith the council regarding sidewalks in the town of Waukee. George Kramer and Ruby Mertes,representing the Centennial Committee,met with the cOlU1cil. Moved by Baer an~R~conded by Applegate to officially dedicate the new Wa~~ee Park during the centennial,September 6 and 7,1969.Carried. A delegation of citizens met with the council regarding the possibility of a curfew for the Town of Waukee.The complaints were that a lot of childrem were on the streets late at night disturbing the people. I Moved by Applegate seconded by Boone that during the school year,from 7 A~M.to 5 P.M.the street in front of the school on Locust between 5th and 6th st.be closed to tr·affic.Carried. Councilman Applegate introduced "A n ordinance prohibiting certain motor vehicle traffic over and across pUblic land owned by the Town of Waukee,Iowa,excnusive of streets and highways." It was moved by CounciL~an Boone and seconded by Councilman Baer that the Ordin- ance.resolution entitled"An ordinance prohibiting certain motor vehicle traffic over and across public Land owned by the 70wn of Waukee,Iow>,exclusive of streets and highways"be now read by the Clerk.The mayor then put the question on the motion,and the roll being called,the following councilmen voted aye--Applegate, Baer and Boone.Nays,None.Carried 3 to O.Whereupon,the mayor declared the motion carried. tt was moved by Councilman Baer and seconded by Councilman Applegate that the rule requiring the reading of ordinance entitled "An ordinance phohibiting certain motor vehicle traffic over and across public land owned by the Town of Waukee, Iowa,exclusive of streets and highways",three times be dispensed with.Carried.IItwasmovedbycouncilmanBooneandsecondedbycouncilmanAppl.egat.e that the ordinance entitled "An ordinance pnohibi'l;ing certain motor vehicle traffic over and across public land owned by the Town of Waukee,Iowa,exclusive of streets and highwav._,"be now put on final passage and adoption.The mayor put the question to the council and following voted Aye--Applegate,Baer and Boone.Nay, None.Whereupon the HaJTor declared said ordinance duly adopted and instructed the clerk to post same. OPJHNANCE NO.125 An ordinance prohibiting certain motor vehicle traffic over and across pUblic land owned by the Town of Waukee,Iowa,exclusi.ve of streets and hgghways. Be it enacted by the Council of ~h~T~wn of W,ukee,Iowa: SECTION 1.Definition.For use within this ordinance the following are defined: "Street or hi"hway"means the entire width bet.ween the property lines of every way or place of whatever nature when any part thereof is open to the use of the public,as a matter of right,for purposes of vehicular traffic. "Motor '[ehiele"me"ns every vehicle whjch is self-propelled but not including vehicles known as trackless trolleys which are propelled by electric power obtained I from overhead trolley wires,but not operated upon rails. ""PUblic lands"means 'th:;.tproperty wfuich is not an established street or high- way which is owned by the To~n of Waukee,Iowa,or which lies within the corporate limits of the T~ND of Waukee and is owned by any oth~r governmental subdivision or school district. SECTION 3.Penalty.Anyone violating any of the provisions of this ordinance shall,upon couviction,be subject to imprisonment not exceeding 30 days,or a fine not exceeding $100.00 or by both fine and imprison~ent. SECTION 4.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION 5.Saving clause.If any section,provision,or part of this ordinance shall be adjudged to be invalid or unconstitutional,such adjudication shall not affect the validity of this ordin~nce as a whole or any section,provision,or part thereof not adjudged invalid or unconstitmtional. SECTION 6.When Effective.This ordinance shall be in effect after it's final passag~,approval and publication as provided by law. Moved by Applegate seconded by Rees to approve the minutes as read.Carried. A delegation of citizens met with the council concerning the water backing up in their basements.A long discussion was held on this sUbject. Street bonds were sold with G 0 Bonds at 6%and special assessment bonds were sold at 5 %. Moved by Baer and seconded by Rees to h~ve a study made of the.Sanitary Sewer.Carried.
