SECTION 2.Section 18 is hereby amended by deleting all of said Section 18 and substituting therefore the following: Section 18.Control with hands or hands on handlebars 0 The ope rater of a bicycle upon a public way shall keep the same under control at all times and at all times during the operation shall have one or both hands upon the handlebars I and hands or feet engaged with the braking device. Section 7.Removalof :Plates.No person shall remove any identification plate from a bicycle dup.ng·Mle period for which issli-ed except in theievent a bicycle is dismantled f0l;',repair or other'Wise and no longer used upon any streetorpublicwayin,tlieCity of lvaukee,Iowa. Section 8.Alteration of Serial Frame Number.It shall be unlawi'ul f'or any person to 'Willf'ully or maliciously remove,destroy,mutilate or alter!1:.he manu- facturer's serial f'rame numberonany bicycle registe:red pursuant tothEi provisions\...of'this ordinance. -Section 9.Alteration of Registration NumberiBlates.It shall be unlawful,' f'or any person to remove,destroy,mutilate or alter any registration nUmber plate during the period when such registration is Op<;lrative. Section 10.Duplicate License Plates.In the event of loss by the owner,of a license plate,a duplicate plate may be obillMnedfrom the Administrative Of'ficeruponapplicationandthepa;ymentof'twentY-f'ive(25)cents. Section 21.Parking.No person shall park a bicycle upon a street other' than upon the'sidewalk ,ina rack to support the'bicycle or againt abUilding or at the curb in sUch a manner as to afford the last obstruction to pedestrian traffic,or upon the parkirigareabetween the sidewalk and the !['oadway.' Section 22•.Clinging to Other Vehicl!,!s,'No person riding upon any bicycle on a street or public way shall attach the,,sameor himself to any moving' vehicle upon such way. Page 3 Section 23.Reckless Operation.No per:s:onshall operate a bicycle upon a public way at a speed greater than is reasonable and p:nndent under the condiiliions then existing and shall not operate the same in such a manner as to constitute a wilful or wanton disregard for the safety of person or property. Section 26.Saving Clause.If any action,provision,or part of this ordin~ ance shall be adjudged to be invalid or unconstitutuional,such adjudication shall not affect the validity of the ordinance as a whole,or any action,provision or part thereof not adjUdged invalid or unconstitutional. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WAUKEE/IOWA: Section 1.Definitions.Unless otherwise expressly stated or the context clearly indicates a different intention,the following terms shall/for the purpose of this ordinance/have the meanings defined in this section: A."Bicycle."The term "bicycle"shall include every device propelled by human power upon which any person may ride,having two tandem wheels either of which is over twenty (20l inches in diameter. B."Owner."The term "owner"shall be held to include minors who have the use and control of a bicycle with the knowledge and consent of their parent or guardian. Section 2.Registration Requirement.No person who resides within the city,or who regularly operates a bicycle within the corporate limits of said city,shall ride or propel a bicycle on any street,sidewalk or other public way unless such bicycle shall be registered with the Administrative Officer of the City of Waukee,lowa,or his duly appointed agent,as provided in this ordinance and has been issued a current identification plate which shall be securely attached thereto. Section 3.Condition Precedent.All bicycles submitted for registration shall be equipped as provided in this ordinance and the Administrative Officer shall refuse to register any bicycle found not to be so equipped or found to be in an unsafe mechanical condition. Section 4.Registration:Terms and Duration.It shall be the duty of each owner of a bicycle to make application on or before the last day of April for registration thereof to the Administrative Officer,duration of which shall extend for a two year period upon whence renewal of said application shall be due.Thereafter [if the bicycle complies with the provisions hereof, it shall be the duty of the Adrrrinistrati,ve Officer to issue an identification plate for the bicycle described in the application,which shall be securely fastened thereto,and to enter upon his records the name and address of the owner,a description of such bicycle by name or maker the frame number thereof,and the number of the identification plate issued. Section S.Registration Fee.A fee of fifty (SOl cents shall be charged by the City of Waukee I lowa ,for each bicycle registered. Section 6.Transfer of Ownership.Upon the sale or other transfer of a registered bicycle,the owner shall,upon proper application to the Administrative OfficerofleCityofWaukeeglowa[office,transfer his or her identification plate to the new owner. Section 7.Removal of Plates.No person shall remove any identification plate from a bicycle during the period for which issued except in the event a bicycle is dismantl~ for repair or otherwise and no longer used upon any street or public way in the City of Waukee, lowa'JJ . -2- 50 Section 8.Alteration of Serial Frame Number.It shall be unlawful for any person to willfu lIy or ma liciously remove,destroy,mutilate or alter the manufacturer's serial frame number on any bicycle registered pursuant to the provisions of this ordinance. Section 9.Alteration of Registration Number Plates.It shall be unlawful for any person to remove,destroy,mutilate or alter any registration number plate during the period when such registration is operative. Section 10.Duplicate License Plates.In the event of loss by the owner of a license plate,a duplicate plate may be obtained from the Administrative Officer upon application and the payment of twenty-five (25)cents. Section 11.Rental Agency.No rental agency for the rental of bicycles to the public shall offer any bicycle for rent unless aid bicycle shall first have been registered and the registration number plate attached thereto as provided in Section 41 and shall be equipped by such agency with lights and other safety equipment as is required by this ordinance and shall be kept in good and safe working order. Section 12.Lamps and Reflectors.Every bicycle shall be equipped with a lamp on the front exhibiting a white light,when used on the public ways of the City of Waukee,Iowa! at any time from sunset to sunrise and at such other times when conditions provide insufficient light to render clearly discernible persons and behicles on the highway at a distance of five hundred (500)feet ahead.Said lights shall be visible from a distance of at least three hundred (30m feet to the front.Such bicycle when so used shall display a lamp on the rear,exhibiting a red light visible from a distance of three hundred (300)feet to the rear 1 except that in lien thereof there may be used a red reflector mounted not less than twenty-four (24)inches and not more than forty-two (42)inches above the ground,which shall be visible at night from a distance of three hundred (300)feet to the rear:except that a red reflector which shall be visible at night from all distances up to three hundred (300)feet to the rear of said bicycle when said bicycle is directly in front of a motor vehicle displaying lawfully lighted head lamps. Section 13.Brakes;Every bicycle used upon the public ways of the City shall be equipped with a brake which will enable the operator to make tile braked wheel skid on a dry level pavement and which may be applied bringing the bicycle to a stop Without the brake locking the braked wheel. Section 14.Motor Vehicle Laws Applicable.Every person operating a bicycle upon the public ways of the City of Waukee!Iowa,shall be subject to the provisions of the traffic ordinances of said City and of the statutes of the State of Iowa applicable to the drivers of motor vehlcles ,except as to special regulations thereof and except as to those provisions of said ordinances and statutes which by their nature can have no application. Section 15.Obedience to Signals.Any person operating a bicycle shall obey the direction of official traffic signals/signs and other control devices applicable to other vehicles unless otherwise directed by a police officer and shall obey direction signs relative to turns permitted unless such person dismounts from the bicycle,in which event he shall then obey the regulations applicable to pedestrians. /.Section 16.Riding on Handlebars/etc./Prohibited.It shall be unlawful for lJe operator of any bicycle not built to transport two or more persons,when upon any public highway /Sidewalk or other public way /to carry any other person upon the handlebars/frame ~ other part thereof/or for any other person to so ride on such lb"ehicle. -3- Section 17.Carrying Packages.No person operating a bicycle upon a public ==-- way shall carry any package,bundle or article which prevents the rider from keeping at least one hand upon the hand lebars , Section 18.Control with Hand or Hands on Handlebars.The operator of a bicycle upon a public way shall keep the same under control at all times and at all times during the operation shall have one or both hands upon the handlebars and feet engaged with the braking device. Section 19.Emerging from Alley or Driveway.The operator of a bicycle emerging from an alley,driveway or building shall,upon approaching a sidewalk or the sidewalk ;area extending across any alleyway or driveway,yield the right-of-way to all pedestrians approaching on said sidewalk or sidewalk area and upon entering the roadway shall yield the right-of-way to all behicles approaching on said roadway. Section 20.Operation on Sldewalk ,Bicycles may be operated upon the public sidewalks in a careful and prudent manner and at a rate of speed not exceeding eight (8)miles per hour.Every person lawfully operating a bicycle upon a public sidewalk,when approaching a pedestrian or a toy veh icle,shall either dismount or give a clear right-of-way to the full extent of such sidewalk to said pedestrian or toy behicle ,and in overtaking such pedestrian or toy vehicle,shall give an audible signal before passing. Section 21.Parking.No person shall park a bicycle upon a street other than upon the sidewalk in a rack to support the bicycle or against a bulldlnq or at the curb in such a manner as to afford the least obstruction to pedestrian traffic,or upon the parking area between the sidewalk and the roadway. Section 22.Clinging to Other Vehicles.No person riding upon any bicycle on a street or public way shall attach the same or himself to any moving vehicle upon such way. Section 23.Reckless operation.No person shall operate a bicycle upon a public way at a speed greater than is reasonable and prudent under the conditions then existing and shall not operate the same in such a manner as to constitute a wilfu I or wanton disregard for the safety of persons or property. Section 24.Penalty.Anyone violating any of the provisions of this ordinance shall,upon conviction,be subject to a fine not exceeding one hundred <lOOJ dollars or be subject to imprisonment not exceeding th i rty (30l days. Section 25.Repealer.Ordinance No.passed and approved on the day of s 19 is hereby repealed and all ordinances or parts of "':"o:::rdrrin:::a:-:-n~cesinconflict with the provision of this ordinance is also repealed. Section 26.Saving Claif'se,If any action,provision or part of this ordinance shall be adjudged to be invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole,or any action,provision or part thereof not adjudged invalid or unconstitutional.
