The Waukee council met in @ecial session on June 8,1973 with Mayor
Boone presiding and the following councilmen present:Cappe,Kramer,
Jones,Blessing.This meeting was called to have CPADan Gardiner
present the town audit to the council.
Mr Gardiner presented his comments.One copy of audit to be sent in
to State.

Movedby Kramer,second by Blessing,to receive lind file the town
audit.Carried 4 to O.
Movedby Kramer,second by Jones,to approve claim for $1,019.60 to
Dan Gardiner for audit.Carried Ii to O.
The council discussed drainage going south across Mrs Paullins ground.
Movedby Carpe,second by Jones,to pay Mrs Paullin $1500.00 per acre
for 8.01 acres of ground.Carried 4 to O.

The regular council meeting was held on June 11,1973 with Mayor Boone
presiding and the following councilmen were present:Carpe,Kramer,
Jones and Blessing.Absent:vacancy
Mrs Porter met with the council regarding the btcycle ordinance and
sidewalks.
Movedby Blessing,second by Jones,to amend the bicycle ordinance.
Carried 4 to O.
Councilman Blessing introduced an Ordinance Resolution entitled:II

SECTION1.A.Is hereby amended by deleting said section and substituting
therefore the following:
A."Bicycle"the term 'bicycle'shall include every
device propelled by human power upon which any person
may'ride,have two tandem wheels either of which is
twenty (20)inches or over in diameter.
SECTION2.Section HI is hereby amended by deleting all of.said Section
18 and aubstd tuting therefore the following:
Section 18.Control wit.h hands or hands on handlebars.
The operator of a bicycle upon a public way
shall keep the same under contrel at all
times and at all tires during the eperation
shall have one or both hands upon the handle-
bars,and hands or feet engaged wi th the
braking device.

The comcil discussed Dave Albright's proposed sub-division south of
town on the Charles Jordan property where he asked about water.
The general feeling of the councd.L was that the Town of Waukee would be
interested in working with Mr Albright to provide services to his prop-
erty on the following terms:
1.The tOlm would require the volmtary annexataen of his property and
property between the town and his proerty so that the facilities would
be provided to to~m residents.The town would expect his assistance in
obtaining the petitions from the property owners between the town of
Waulooeand his proerty to inaugurate annexation proceedings.
2.He would be expected to install a 10 inch water aain from the exi.sti.ng
facilities of the town of Waukee to his proprty at his expense.
3.The t~of Waulreewould expect that he,dedicate the watermain to the
town of Waulooeso that it will maintain the waterline after its install.,.
atd.on and w.l.ll have the responsibility and control of the hookups to the
watermain.
4.The to~m of Waulooewould expect that he ob:llain the easements necessary
for utilities and these be assigned to the town.
Moved!by Carpe,second by Blessing that the following resolution was
adopted at the regnla:b meeting af tha TownComcil of the Towno!Waukee,
June 11,1973,at 7:30 p.m.at the TownHall in Waukee,Iowa:
WHEREAS,Central Iowa Regional Planning Commission in it's study Gf the
Des Moines Metropolitan Area Sanitary Sewer System fdlr Eastern Dallas
County,Waukee Area,in it's conclusions on pages 42 and 43 thereof re-
cites,'the proposed Racoon River tl'llIlk sewer will not serve the Waukee
area within the twenty-Year study period.Waukeewill have to provide
their own sewage treatment facilities for this period and as soon as
passi ble ,";and
WHEREAS,the Townof Waukee,Iowa,has now received a letter from Joseph
E.ObI',P.E.,Director Department of Environmental Quality,State of
Iowa,listing Waukee,Iowa,as one of the cOl1ll1lunitieslisted in which
the departmental staff has been directed not to approve any further
extensions or expansions of the dewer systems within the area or grant
any permits or approve any grant funds,
THEREFORE,BE IT RESOLVEDby the Town Council of the town of Waukee,
Iowa,that the attention of the Department of Environmental Quality
be Balled to the fact that the municipality of Waukee,Iowa,was not
included within the "area-wide treailloont system"referred tG in Mr.
Obr's letter,and should not penalized by the failure of the
other municipalities to agree on a treatment system when Waukee,by the ....
terms of the Regi onal Planning Commission's own study would not be
included within said system for at least twenty years.
