RESOLUTION NO._ Be It Resolved by the Council ofthe Town of Waukee,Iowa: Section 10 ADOPTIONS.The Town of Waukee,Iowa,elects by this resolution to act under and be subject to the provisions of the following divisions,or parts of divisions of Chapter 1088 of the Acts of the Sixty-Fourth Iowa General Assembly (1972)set forth below as authorized by Division I,Section 9,of Chapter 1088 .• Division Division II Division IV Division VII parts 1 and 2 thereof. Section 20 CORPORATE NAME.The Corporate name of the Town of Waukee,Iowa, is changed to the City of Waukee,Iowa.All references to the Town of Waukee,Iowa in the ordinances,resolutions,and other official papers and records are deemed to refer to the City of Waukee.A II actions,proceedings,rights,or duties incumbent upon or due to the Town of Waukee or its officers survive and must be prosecuted to a conclus ion ,A judgment or decree against the Town of Waukee is enforceable against the City of Waukee or other party to the action.An agreement by either party as the case may be.All assets,liabilities and rights of the Town of Waukee are hereby transferred to the City of Waukee. BE IT ENACTED BY THE COUNCI L OF THE TOWN OF WAUKEE,IOWA: SECTION .1.That Section XXII of the Ordinance relating to the sanitary sewer district of Waukee,Iowa,providing for sewer rental and regulating connections with the Town's sanitary sewer system,is hereby amended by deleting all of Section XXII and inserting in leiu thereof the following: SECTION XXII.UNLAWFUL DISCHARGE: A.All storm,surface and ground water connections,including foundation drainage to the sanitary sewer system are prohibited on all construction started afterthe effective date of this amendment. Be It Enacted by the Counci I of the City of Waukee I Iowa: Section 1,PUR POSE.The purpose of this ordinance is to provide for a charter embodying the form of government existing on 1~1973, Section 2,CHARTER,This ordinance may be cited as the Charter of the City of Waukee I Iowa. Section 3.FORM OF GOVERNME NT,The form of government of the City of Waukee I Iowa,is the llJiayor-Counci I form of government. Section 4.POWERS and DUTIES.The council and mayor and other city officers have such powers and shall perform such duties as are authorized or required by state law and by the ordinances I resolutions I rules,and regulations ofthe City of Waukee,Iowa. '/1 October 15,1973 The regular council meeting was held October 15,1973 with Mayor Boone presidi.ng and the follo,ling councilmen present:Jones,Gardiner,and Carpa.Absent:Blessing and Kramer. Minutes were approved as read. The following citizens attended the council meeting regarding water in basements on east end of Bel-Aire and WaukeeAvenues:George W Stifel,Mrs Gery Susich,David Merryman,A L Sears,Don L Stigel, Don Faust,Ruby Mertes,Rosemarie Volkmer,Nancy Honken,Mary Ann Davenport,Kay Poldervaart,Donald Hill,Roger Points,Harold BisseU, Rosalie Bissell,Carol Reagan,Mu:i:tel Points,Gregory Peiffer,Gale Marvin,Jim Todd,NormanNeuerburg,Culver Johnson,Terry Kurtz,Rose Singer,Rodney Singer,and Jim Berner.A lengthy discussion was held on this subject. Carried 3 to O. The water problem between the TO'illof Waukeeand Dr Charles Johnson was discussed by the council at length and it was ,~to leave the storm sewer as it now exists.Previous to thi~C\C Carpa made a motion to pay $2000.00 to Dr Johnson for permanent waterway.The motion did not carry due to no second. The council authorized the clerk to pull the pump and do necessary repairs that is to be done. The metno sewer resolution was discussed by the council.The council instructed the clerk to have a memberof the Regnonal Paanni.ng attend a council meeting and discuss the resolution. A letter from the county attorney was read by the clerk regarding water overlhapping into the property owned by cemetary. Mevedby Gardiner,second by Carpe,to approve a liquor permit for The Vagabond and Pat McQueen.Carried 3 to O. Movedby Jones,second by Carpe,to grant a class C beer parmit to the WaukeeMeat Market.Carried 3 to O. Movedby Jones,second by Carpe,to grant cigarette permits to The Vagabond,Pat McQueen,and WaukeeMeat Market.Carried 3 to O. October 30,1973 On October 30,1973,the council of Waukee,Iowa,met in session fof the purpose of a public hearing upon the budget estimate as published and the detail submitted in support thereof.There was present a quorum as required by law.
