Section 10 ADOPTIONS.The Town of Waukee,Iowa,elects by this resolution to
act under and be subject to the provisions of the following divisions,or parts of divisions
of Chapter 1088 of the Acts of the Sixty-Fourth Iowa General Assembly (1972)set forth
below as authorized by Division I,Section 9,of Chapter 1088 .•

Section 20 CORPORATE NAME.The Corporate name of the Town of Waukee,Iowa,
is changed to the City of Waukee,Iowa.All references to the Town of Waukee,Iowa in the
ordinances,resolutions,and other official papers and records are deemed to refer to the City
of Waukee.A II actions,proceedings,rights,or duties incumbent upon or due to the Town
of Waukee or its officers survive and must be prosecuted to a conclus ion ,A judgment or decree
against the Town of Waukee is enforceable against the City of Waukee or other party to the
action.An agreement by either party as the case may be.All assets,liabilities and rights of
the Town of Waukee are hereby transferred to the City of Waukee.

AN ORDINANCE AMENDING THE ORDINANCE RELATING TO THE SANITARY
SEWER DISTRICT OF WAUKEE,IOWA,PROVIDING FOR SEWER RENTAL AND REGULATING
CONNECTIONS WITH THE TOWN SANITARY SEWER SYSTEM,BY AMENDING SECTION
XXII THEREOF AS AMENDED.
BE IT ENACTED BY THE COUNCI L OF THE TOWN OF WAUKEE,IOWA:
SECTION .1.That Section XXII of the Ordinance relating to the sanitary sewer
district of Waukee,Iowa,providing for sewer rental and regulating connections with the
Town's sanitary sewer system,is hereby amended by deleting all of Section XXII and
inserting in leiu thereof the following:
SECTION XXII.UNLAWFUL DISCHARGE:
A.All storm,surface and ground water connections,including
foundation drainage to the sanitary sewer system are prohibited on all construction started
afterthe effective date of this amendment.
B.No owner or occupant of any new structu re sha II di scharge
or permit to be discharged into the sanitary sewers any substance which will clog the pipes,
produce explosive mixtures,destroy or materially damage the pipes or other joints,or interfer
unduly with the sewage disposal process 0
C.No owner or occupant of any existing building or structure shall
discharge or permit to be discharged into the sanitary sewers any surface water or other
substances which will clog the pipes,produce explosive mixtures,destroy or materially damage
the pipes or other joints,or interfer unduly with the sewage disposal process.
D.E very structure hereafter constructed having a basement with a
footing drain shall be equiped with a sump and sump pump so designed that no surface water or
ground water shall be discharged into the sanitary sewers:and said sump and sump pump shall

THE EXISTING FORM OF GOVERNMENT ON /~~11973.
Be It Enacted by the Counci I of the City of Waukee I Iowa:
Section 1,PUR POSE.The purpose of this ordinance is to provide for a charter
embodying the form of government existing on 1~1973,
Section 2,CHARTER,This ordinance may be cited as the Charter of the City of
Waukee I Iowa.
Section 3.FORM OF GOVERNME NT,The form of government of the City of Waukee I
Iowa,is the llJiayor-Counci I form of government.
Section 4.POWERS and DUTIES.The council and mayor and other city officers
have such powers and shall perform such duties as are authorized or required by state law and
by the ordinances I resolutions I rules,and regulations ofthe City of Waukee,Iowa.
Section 5.NUMBER and TERM OF COUNCIL.The council consists offive councilmen
elected at Iarqe,elected for terms of two years.
Section 6.TE R M OF MAY@R.The mayor is elected for a te rm of two years.
Section 7.COPIES ON FILE.The City Clerk shall keep an official copy of this
Charter on file with the official records of the City Clerk ,shall immediately file a copy with
the Secretary of State of Iowa ,and shall keep copies of the Charter available at the City Clerk's
office for public inspection.
Section 8 •WHEN EFFECTIVE.This ordinance is in effect after its final passage I
approval,and publication as required by law.

Be It Ordained by the Council ofthe Town of Waukee,Iowa:
Section 1.PURPOSE.Whereas there is no newspaper published within the corporate
limits of this town and publication of ordinances and certain other matters are permitted by
law to be posted in three public places,the Council desires to permanently designate these
three public places so that citizens of the town may readily ascertain the acts of counci I which
affect them without doubt as to place of notice.
Section 2.LISTING OF PLACES OF POSTING AND LENGTH OF NOTICE.The
three public places where public notice of ordinances and othermatters permitted to be posted
are to be displayed are:
Waukee Town Hall
United States Post Office,Waukee,Iowa
Brenton State Bank,Waukee,Iowa office
The town clerk is hereby directed to promptly post such ordinances and notices,and to leave
them so posted for not less than 10 days after the first date of posting,and he shall note the
first date of such posting on the copies of said ordinance,on the official copy of the ordinance,
and in the official ordinance book immediately followlnq the ordinance.
Section 3.REMOVING NOTICE,UNLAWFUL.Removal of a public notice by persons
other than the town clerk shall be a misdemeanor.Such removal before the 10 days have expired,
however,shall not affect the validity of the ordinance.
Section 4.EFFECTIVE DATE.This ordinance shall be in effect after its final passage,
approval,and publication as provided by law.

The regular council meeting was held October 15,1973 with Mayor Boone
presidi.ng and the follo,ling councilmen present:Jones,Gardiner,and
Carpa.Absent:Blessing and Kramer.
Minutes were approved as read.
The following citizens attended the council meeting regarding water
in basements on east end of Bel-Aire and WaukeeAvenues:George W
Stifel,Mrs Gery Susich,David Merryman,A L Sears,Don L Stigel,
Don Faust,Ruby Mertes,Rosemarie Volkmer,Nancy Honken,Mary Ann
Davenport,Kay Poldervaart,Donald Hill,Roger Points,Harold BisseU,
Rosalie Bissell,Carol Reagan,Mu:i:tel Points,Gregory Peiffer,Gale
Marvin,Jim Todd,NormanNeuerburg,Culver Johnson,Terry Kurtz,Rose
Singer,Rodney Singer,and Jim Berner.A lengthy discussion was
held on this subject.

Movedby Carpa,second by Jones,to award AID Insurance Companythe
contract for blanket insurance coverage for the Townof Waukee.
Carried 3 to O.
The water problem between the TO'illof Waukeeand Dr Charles Johnson was
discussed by the council at length and it was ,~to leave the
storm sewer as it now exists.Previous to thi~C\C Carpa made a motion to
pay $2000.00 to Dr Johnson for permanent waterway.The motion did not
carry due to no second.
The council authorized the clerk to pull the pump and do necessary repairs
that is to be done.
The metno sewer resolution was discussed by the council.The council
instructed the clerk to have a memberof the Regnonal Paanni.ng attend
a council meeting and discuss the resolution.
A letter from the county attorney was read by the clerk regarding water
overlhapping into the property owned by cemetary.
Mevedby Gardiner,second by Carpe,to approve a liquor permit for The
Vagabond and Pat McQueen.Carried 3 to O.
Movedby Jones,second by Carpe,to grant a class C beer parmit to the
WaukeeMeat Market.Carried 3 to O.
Movedby Jones,second by Carpe,to grant cigarette permits to The
Vagabond,Pat McQueen,and WaukeeMeat Market.Carried 3 to O.
The council received and filed a petition for no sidewalks in the
TOlmof Waukee.

On October 30,1973,the council of Waukee,Iowa,met in session fof the
purpose of a public hearing upon the budget estimate as published and the
detail submitted in support thereof.There was present a quorum as required
by law.
The council found that the notice of time and place of hearing had been pub-
lished at Adel,Iowa at the Dall:lasCounty News in accordance l,ith law and the
direction of the Counciland that the affidavit of publication was available to
file with ehe County Auditor.The council found that thenotice of time and
plance of hearing had been posted at the following location:Town Hall,
Library,and Fire Station in accordinance with the law and direction of
the Council.
The budget estimate was consider and taxpayer heard for and against said
estmmate as follows:NONE
After'hearing all taxpayers desiring to be heard,the Council approved and
adopted the budget as corrected by the Council and as stated in the Cer'tificate
of Budget Summary and accompanying detail and the resolution allocating app-
ropriations to the fund,programs and activities.
The vote on final adoption of the budget was as follows:
Ayes:Daniel Gardiner,Jack Carps,Harry Jones,George Kramer,Dr Ronald
Blessing and Bernard Boone,Mayor
Nays:None
The clerk was directed to fOrllard the adopted budget summary and certificate
of municipal corporation taxes to the county audi tWO'as provided by law.
