CITY OF WAUKEE DALLAS COUNTY,IOWA AN ORDINANCE ESTABLISHING RATES AND CHARGES FOR THE USE OF SERVICES OF THE MUNICIPAL WATER SYSTEM OF WAUKEE,IOWA WHEREAS,the City of Waukee may by ordinance establish,impose, adjust and provide for the collection of rates to be charged for use of the services provided by the Municipal Water System, NOW,THEREFORE,BE IT ORDAINED by the City Council of the City of Waukee,in Dallas County,Iowa,as follows: Section 1.There shall be and there are hereby established rates and charges for the use of and for the service supplied by the Municipal Water System of the City of Waukee,based upon the meter readings of the amount of water consumed as follows: First gal.or $per month lesser amount per month (minimum monthly bill) Next gal.$per gal. Next gal.$per gal. Next gal.$per gal. Allover $per gal .. gal.per month Section 2.Bills for the rates and charges as herein established by the City shall be sent monthly.All bills shall be payable on the first day of the month following ~6f reading of the meters and shall be paid at the office of the ~JR of the City •.If any charge for the services of the system shall not be paid by the lOth day of the month in which it shall become due and payable,a delayed payment charge of percent (%)of the amount of the bill shall be added thereto and collected therewith<If any bills for the service of the water system shall remain unpaid after __days following the rendition of the bill therefor,the water supply for the building or premise affected shall be cut off and shall not be turned on again except on payment in full of the delinquent charges therefor,in addi- tion to the payment of a charge of $, -4- HERRICK,LANGDON,BELIN,HARRIS.LANGDON 8:HELMICK,LAWYERS,DES MOINES,IOWA Section 3.Applications for water service to a building shall be filed with the City Clerk upon a form to be supplied by the City. The application shall state the name of the applicant and the premises to be served.All applications filed after the commencement of the operation of the Municipal Water System shall be accompanied by a fee of $,payable to the of the City,for the connection. , Section 4.The owner of the premises served and the occupant thereof and the user of the water service shall be jointly and severally liable for the water service provided said building.A deposit of $shall be required from all tenants.Such deposit shall be applied to any bill for water service delinquent more than days.upon the termination of the use of the water service by that tenant for that building any balance of such deposit shall be returned to the tenant without interest. Section 5.It is hereby made the duty of the to render bills for water service and all other charges in connection therewith and to collect all moneys due therefrom. Section 9.All revenues and moneys derived from the operation of the water system shall be paid to and held by the separate and apart from all other funds of the City and all of said sums and all other funds and moneys incident to the operation of said system,as may be delivered to the ,shall be deposited in a separate fund and said shall administer said fund in every respect in a manner provided by the Code of Iowa and all other laws pertaining thereto. Section 7.The shall establish a proper system of accounts and shall keep proper records,books and accounts in which complete and correct entries shall be made of all transactions relative to the water system and at regular annual intervals the City Council shall cause to be made an audit by an independent audit concern of the books to show the receipts and disbursements of the water system. Section 8.All water shall be supplied through meters that ac- curately measure the amount of water supplied to any building.The City shall make a test of the accuracy of any water meter at any time when requested in writing.If it is found that such meter overruns to the extent of percent or more,the cost of the tests shall be paid by the City and a refund shall be made to the customer for overcharges collected since the last known date of accuracy but not for longer than months.If the meter is found to be accurate or slow or less than percent fast,the patron shall pay the reason- able costs of the tests. -5- HERRICK.LANGDON,BELIN.HARRIS.LANGDON &HELMICK.LAWYERS.DES MOINES.IOWA , Section 9.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 10.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Moved by Copeland,second by Gruber to approve minutes as read. Carried 5 to O. Moved by Gruber,seonnd by Grandfield to have Fall Festival at Centennial Park on the 18th &19th of September.Carried 5 to O. A D Smith met with the council regarding the Jay-Cees sponsoring a beer garden at the park during the Fall Festival on the 18th &19th of September.Attorney Paul Buscher to report back on legality of this matter. Robert Brelsford met with the council regarding future of the Lutheran church on the property off of East Street. Moved by Copeland,second by Larson,to increase Ron Vest's salary $75.00 per month effective June 1.Salary to be $775.00 per month.Carried 5 to O. MemBers of the Planning &Zoning Commission met with the council, Bill Inman and his representatives regarding developing the Dorthea Sloan property.Bill Inman,Jr.presented a tentative plan of this project.Inman to make changea and meet with the P &X at a later date. Time and one-half was discussed by the council and the new Supreme Court rule.The council agreed to pay time and one- half over 40 hours to employees. Councilman Copeland introduced an Ordinance entitled "An Ordinance establishing rate and charges for the use of services of the Municipal Water System,of the City of Waukee,Iowa". It was moved by Councilman Larson and seconded by councilman Thompson that the aforementioned be now received,placed on file,and read by the City Clerk.The Mayor Put the question on the motion and the roll being called,the following named Councilmen voted: Ayes:Copeland,Larson}Gruber,Grandfield,Thompson Nays:None Whereupon,the Mayor declared the motion duly carried and said Ordinance was received,placed and file,and read by the City Clerk for the 1st time.To be posted on three publicaplaces.
