The regular council meeting was held on September 12,1977 with
Mayor Boone presiding and the following councilmen present:
Harry Copeland,Hugh Grandfield,Luke Gruber,and Dennis Thompson.
Absent:Ron Larson.
Moved by Copeland,second by Grandfield,to approve minutes as
read.Carried 4 to O.
Councilman Gruber introduced an Ordinance Resolution entitled:
AN ORDINANCE TO ESTABLISH THE SALARIES OF MUNICIPAL OFFICERS.
It was moved by Councilman Copeland,and seconded by Councilman
Grandfield that the Ordinance entitled:AN ORDINANCE TO ESTABLISH
THE SALARIES OF MUNICIPAL OFFICERS be now read by the Town Clerk.
The Mayor put the question on the motion,and the roll being called,
the following named councilmen voted:
Ayes:Gruber,Grandfield,Copeland,Thompson
Nays:None
Whereupon,the Mayor declared the motion duly carried.
AN ORDINANCE TO ESTABLISH THE SALARIES OF MUNICIPAL OFFICERS
Be it Enacted by the Council of the City of Waukee,Iowa:
Section 1.Councilmen.The salary of each councilman shall be
$10.00 for each meeting of the council,however any councilman
serving as mayor pro tern shall be paid $15.00 for the meeting
at which he serves as mayor pro tern.
Section 2.Mayor.The mayor shall received a monthly salary
of $80.00 per month.
Section 3.Other Officers.The compensation of all other officers
and employees shall be set by resolution of council.
Section 4.Repealer.All ordinances or parts of ordinances in
conflict with the provisions of this ordinance are hereby repealed.
Section 5.Severability.If any section,provision or part of
this ordinance shall be adjudged invalid or unconstitutional,such
adjudication shall not affect the validity of the ordinance as
a whole or any section,provision or part thereof not adjudged
invalid or unconstitutional.
Section 6.When effective.This ordinance shall be inCeffect
after its final passage,approval and publication as provided by
law.
Passed by the Council on the 12th day of September,1977 and
approved this 12th day of September,1977.
It was moved by Councilman Grandfield,and seconded by Councilman
Copeland,that the rule requiring an Ordinance to be read on three
separate day be dispensed with.The Mayor put the question on the
motion,and the roll being called,the following named councilmen

AN ORDINANCE DESIGNATING THE METHOD BY WHICH CANDIDATES FOR ELECTIVE
MUNICIPAL OFFICES SHALL BE NOMINATED
Be It Enacted by the Council of the City of Waukee,Iowa:
Section 1.Purpose.The purpose of this ordinace is to designate the
methods by which candidates for elective municipal offices in the City
of Waukee,Iowa shall be nominated.
Section 2.Nominating method to be used.For the 1977 municipal
election and in subsequent municipar-elections of the City of Waukee,Iowa,
all candidates for elective offices shall be nominated by the procedures
set forth in Chapter 45 of the 1973 Code of Iowa,as amended.
The method prescribed herein for nominating candidates shall remain
in effect until or unless changed by ordinance.
Section 3.Repea1er.A11 ordinances or parts of ordinances in conflict
with the provision of this ordinance are hereby repealed.
Section 4.Severability clause.If any section,provision or part
of this ordinance shall be adjudged invalid or unconstitutional,such
adjudication shall not affect the validity of the ordinacne as a whole
or any section,provision or part thereof not adjudged invalid or
unconstitutional.
Section 5.When effective.This ordinance shall be in effect after its
final passage,approval and publication as provided by law.

The Council took up and consider the proposed improvements and
extensions to the existing municipal waterworks system.
Council Member Luke Gruber introduced and read the following resolution
hereinafter set out entitled:"Resolution to provide for a notice
of hearing on proposed plans and specifications and proposed form
of contract for the construction of an Elevated Steel Water Storage
Tank for the municipal waterworks system,and the taking of bids
therfore",and moved its adoption,second by Council Member Harry
Copeland.After due consideration thereof by the Council,the Mayor
put the question upon the motion and the roll being called,the
following named Council Members voted:
Ayes:Luke Gruber,Harry Copeland,Hugh Grandfield,Dennis Thompson
Nays:None
Whereupon,the Mayor declared the said motion duly carried and the
said resolution adopted,as follows:
RESOLUTION
To provide for a notice of hearing on proposed plans and specif-
ications and proposed form of contract for the construction of an
Elevated Steel Water Storage Tank for the municipal waterworks
system and the taking of bids therefor
WHEREAS,the City of Waukee,Iowa,has heretofore established a
municpal waterworks system and it is necessary and desirable that
the said waterworks system be improved and extended and such improve-

contracted for and completed in accordance with the proposed plans and
specifications and form of contract prepared by Oakes Engineering Company,
Des Moines,Iowa,the City's Engineers,such proposed plans,specifications
and form of contract being on file with the Clerk and which improvements
and extensions are hereinafter referred to as the "Elevated Steel
Water Storage Tank Project"(and are sometimes hereinafter in this
resolution referred to as the "Project");and
Section 1.That the Project is necessary and desirable for the City
and it is in the best interests of the City to proceed toward the
construction of the Project.
WHEREAS,it is necessary to fix a time and place of public hearing on
the proposed plans,specifications and form of contract and estimated
cost of the Project and to advertise for sealed bids for the Project;
NOW,THEREFORE,Be It Resolved by the Council of Waukee,Iowa,as follows:
Section 2.That the 4th day of October,1977,at 7:30 p.m.,at City
Hall,in the City,is hereby fixed as the time and place of hearing on the
proposed plans,specifications and form of contract and estimated cost
of the Project,and also as the time and place of taking bids in connection
therewith.
Whereas,there has been presented to the City Council of the City of Waukee,
Dallas County,Iowa,and application for annexation pertaining to a
certain territory;and including the Chicago-Northwestern Railroad right-
of way;and
hereas,said petition is signed by one hundred percent of the property
owners within the bounderies of the territory to be annexed;and a
certified letter has been sent to the railroad company stating point of
annexation;and
Section 3.That the Clerk is hereby authorized and directed to give
notice of the aforementioned hearing and taking of bids by publication
of such notice in the Dallas County News,a newspaper of general circulation
in the City,which publication shall be made not less than four nor more
than twenty days prior to the time of the said hearing,all in conformity
with Chapters 362 and 384 of the Code of Iowa,1977,as amended.
Dick McAtee met with the council regarding finishing of the beer garden
behind the Old Bank.The council advised him to go to the Planning
and Zoning Committee and present his plan to them.
Moved by Gruber,second by Grandfield,that the petition from Harvey
and Geneva Burger be accepted.
RESOLUTION
Whereas,the procedures and requirements as outlined in the statutes of
the State of Iowa,as amended,have been complied with;and
Whereas,it is deemed advisable that said territory be annexed to the
City of Waukee,ZONED as Agricultural
Now therefore,be it resolved by the City Council of the City of Waukee

Dallas County,'Iowa,that the territory adjacent to the present corp-
orate limits including the railroad right-of-way to the City of Waukee,
and described as above be annexed to the City of Waukee,Dallas County,
Iowa
The above described territory including the railroad right-of-way
being shown in relation to the present boundary lines in the
City of Waukee by the plat attached hereto and by this reference
made a part of this resolution is hereby annexed.
Subject:Voluntary Annexation Application
Dear Sirs,
I,Harvey ~urger (husband)and Geneva Burger (wife),owners of
certain properties located in Section 34T79NR26 West of the 5th P.M.
Dallas County,Iowa,do hereby respectfully request of the City of
l.J:aukee,Dallas Coun t.y ,:Iowa,that said properties be petitioned for
Voluntary Annexation to the City of Waukee,Dallas County,Iowa.
The description of the property proposed for annexation is as follows:
"The SW J;;of the NWJ;;of Section 34T79NR26 West of the 5th P.M.Dallas
County,Iowa;and the NE J;;of the SWJ;;of said Section 34,lying North
of the Northerly Right-Of-Way of the Chicago-Northwestern Railroad,
as it is presently established;and the NWJ;;of the SWJ;;of said section
34,lying North of the Northerly Right-Of-Way Line of the Chicago-
Northwestern Railroad,as it is presently established,EXCEPT the
following described tract of land;commencing at the West J;;Corner
of Section 34T79NR26 West of the 5th P.M.Dallas County,Iowa,thence
SOo-OO'E,along the West Line of the SWJ;;of said Section 34,58.9 feet
to the Center Line of the Chicago-Northwestern Railroad tracks,as
presently established,thence S630-l7'E,along the Center Line of said

Beginning,thence NOo-OO'E,300.66 feet,thence N90o-00'W,200.0 feet,

All of the above described tract of land lies East of "East Road"
and North of the Northerly Right-Of-Way Line of the Chicago-North
western Railroad.
It is to be noted that the land proposed for annexation is adjacent to
and contiguious to the present City Limits of the City of Waukee,
and that proposed annexation,in the judgement of the present owners
and petitioners is in the best interest of the City of Waukee,Dallas
County,Iowa.
Therefore with the above fact in mind,and with these facts set forth
on the attached annexation plat,the Owners and Petitioners,Mr and
Mrs Haryey (Geneva)Burger,do hereby pray that the above described
property,adjacent to the present city limits of the City of Waukee,
Dallas County,Iowa,be annexed to said City of Waukee.
