September 14,1982
The September regular City Council meeting was called to order
at 7:30 p.m.by Mayor Joseph A Neubauer.Minutes were taken
by Brian J Redshaw,City Clerk.A roll call was taken and all
councilmen were present except Jansma.
The following guests were present:Roger Anderson,Jerry McCullough,
Ben Phillips,Art Spencer,Bob Applegate,Scott Thomas,Roger
Buffington,Janice Jordan,Margaret "lJeir,Guy Blair,John Jordan,
Don Lamberti,Mike Manor,Chet Chedest.er,Kathy Kuhl,Sue McCleish,
Diana Erickson,Wi11i.s Forret,Dena Forret,Hari1yn Lickteig,Frank
Bailey,Luke Gruber and Jim Higgs.
Moved by Oetting,second by Rees,to approve the minutes of August
30.Carried 4 to O.
Janice Jordan spoke to the City Council regarding the rusty water
problem.Tracy Petty was not present.It was decided that a special
committee including Hayor Neubauer,Councilman Rees,and Councilman
Christianson would meet with the city's insurance agent,Doug Brickert,
to discuss insurance coverage on this matter.
Scott McIntyre of Kirkham,.Michae1,&Associates,discussed the
wastewater treatment facility plan with the City Council.He
discussed the various options available to Waukee for correcting
its sewer problems.The Mayor suggested the City Council hold
a special meeting on the water and sewer systems.
Chet Chedester represented the recreation committee before the City
Council.He discussed the results of the recreation committee
meeting held September 8 at Brenton Bank.The use of blacktop
at the high school for tennis courts and the construction of an
ice rink at the northwest corner of the high school property
was requested.
Hoved by Scott,second by Christianson,to approve the use of city
water for the ice skating rink with the cooperation of the Waukee
Volunteer Fire Dept.Carried 4 to O.
The Mayor appointed Gordon Christianson to act as the city represent-
ative to the recreation committee.
Luke Gruber,captain of the First Responders,indicated a need for
seven new pagers at the cost of $2333.00.He also indicated a need
of sending five members of the First Responders to ERT school at a
cost of $60.00 each and two members to EHT school at a cost of
$225.00 each.
Moved by Christianson,second by Oetting,to approve the expenditure
of $750.00 for First Responder training.Carried 4 to O.
Moved by Rees,second by Christianson,to approve the expenditure of
$2333.00 for seven pagers for the First Responders.Carried 4 to O.
Don Lamberti of 717 Ashworth Dr.spoke to the Council regarding the
construction of a trailer park on his property.The Council indicated
that the property was incorrectly zoned for this use as well as
some additional complications.

Guy Blair spoke to the Council regarding his proposed purchase of City
right-of-way at the corner of 5th St ,&Ashworth Drive.
Moved by Scott,second by Christianson,to set October 12,1982 at
7:30 p.m.as the date for hearing on the sale of public property and
publish same in the Dallas County News.Carried 4 to O.
Jack Jackson d/b/a The Golden Spur spoke to the Council regarding a
Class C liquor license,Sunday sales permit,and cigarette permit for
his business at 430 Highway 6.
Moved by Rees,second by Christianson,to approve a Class C liquor
license,Sunday sales permit,and cigarette permit for the Golden
Spur.Carried 4 toO.
A contract with Officer Rick Harney,prepared by City attorney Paul
Huscher,was presented to the Council for its consideration.
Moved by Oetting,second by Scott,to enter into an agreement with
Richard Harney.Carried 3 to 1.
Moved by Scott,second by Christianson,to approve the minutes of
August 10.Carried 4 to O.
Moved by Rees,second by Scott,to approve the August treasurer's
report as presented.Carried 4 toO.

Fire chief,Robert Applegate,sppke to the Council regarding the dis-
position of fire department funds.
Moved by Rees,second by Scott,that the following resolution be adopted:
RESOLUTION NO.7
BE IT RESOLVED,that the Waukee City Council voted that the monies on
deposit in the account of the Waukee Volunteer Fire Department shall
be deemed to be public funds and the property of the City of Waukee,Iowa.
That the City of Waukee,in consideration of services of the volunteer
firefighters,will pay to the Waukee Firemen's Association all the monies
on deposit .which will be considered to be payment for past services
to date and will not be public funds.
That future donations to the Waukee Volunteer Fire Department of the
City of Waukee,Iowa shall be public funds and shall be turned over
to the City Clerk of Waukee for accounting.
That the Waukee Firemen's Association will be paid an amount equal to
donations turned over to the City of Waukee through the Waukee Volunteer
Fire Department as consideration for the members of the Waukee Fire-
men's Association serving the City of Waukee in fighting fires and
such payments shall not be considered to be public funds.

Jim Higgs of Farmer's Co-op spoke to the council regarding natural gas
rates .for grain drying.
Moved by Rees,second by Scott,to table discussion on this issue until
the October 12 meeting.Carried 4 to O.
No discussion was held concerning the interior painting of the 200M
ground storage tank due to the receipt of only I bid on the project.
Councilman Rees introduced an Ordinance entitled:"Ordinance 2014--
AN ORDINANCE TO MillND CHAPTER 206,WAUKEE,MUNICIPAL CODE,Pro-
viding for the Appointment,Powers and Duties of a Board of Library
Trustees,by providing that the terms of members of such board shall
be 3 years rather than 6 years.
BE IT .ORDAINED by the Council of the City of Waukee:
Section L Section 206.4 A.of Chapter 206 Waukee Municipal Code,
providing for the appointment,powers,and duties of a Board of Library
Trustees,is hereby amended by substituting for the words "six (6)
years".in the second line thereof the words "three (3)years"so that
the ordinance is amended to read as follows:
206.5 Organization of the Board.
A.Terms of Office.All appointments to the board shall
be for three (3)years,except to fill vacancies.Each
term shall co=ence on July first.Appointments shall
be made every two (2)years of one-third of the total
number as near as possible,to stagger the terms.The
present incumbents are confirmed in their appointments
and terms.
It was moved by Councilman Christianson,and seconded by Councilman
Rees,that Ordinance 2014 be now read by the City Clerk.The Mayor
put the question on the motion,and the roll being called,the
following named Councilmen voted:

It was moved by Councilman Rees,and seconded by Councilman Christianson,
that the rule that an ordinmlce must be received and filed at two
meetings prior to the meeting when final action is taken or,if pub-
lished in summary,be received and filed at one meeting prior to the
meeting of final action,be dispensed with.The l1ayor put the qeustion
on the motion,and the roll being passed,the following named councilmen
voted:
Ayes:Oetting,Scott,Rees,Christianson
Nays:None recorded
Absent:Jansma
Whereupon,the Mayor declared the motion duly carried.
It was moved by Councilman Scott,and seconded by Councilman Christianson,
that Ordinance 2014 be now put upon its final passage and adoption.

Councilman Christianson introduced an Ordinance entitled:"Ordinance
2015--
AN ORDINANCE TO AMEND CHAPTER 501,WAUKEE,lillNICIPAL CODE,
Regulation to Traffic Upon the Use of the Streets of Waukee,Iowa,
and Providing Penalties,by amending the provisions for school stop
instructions.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Schedule B--School Stop Intersections following 501.22
is hereby amended by deleting the present text of subsection A,and
inserting in lieu thereof the following:
A.At the crosswalk 349.0 feet south of the South line
of Ashworth Drive on 4th Street controlling traffic
on 4th Street.

Scott,that Ordinance 2015 be now read by the City Clerk.The Mayor

N~ORDINANCE TO AMEND CHAPTER 212,WAUKEE,MUNICIPAL CODE,
Restriction of open burning within the City Limits of the City
of Waukee,Iowa by amending the ordinance to restrict open burning
on residential property.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 212.2 of Chapter 212 Waukee Municipal
Code,providing for the restriction of open burning within the
City Limits of the City of Waukee is hereby amended by inserting
in the second line after the word I.Imaterial"the words "on residential
property"so that the ordinance is amended to read as follows:
212.2 Open Burning.No person shall allow,cause,or
permit open burning of any material on residential
property within the limits of the City of Waukee,
Iowa,except for plant and vegetable matter originating
on the premises owned or leased by such person,except
for burning of paper residential waste or dwellings
of 4-family units or less,and except for recreational
fires defined herein.

Rees,that Ordinance 2016 be now read by the City Clerk.The Mayor

The City Clerk/Administrator advised the council that a voluntary
annexation petition had received from the Iowa Denartment of
Transportation for the south 33.0 feet of Section-27,Township
79 North,Range 26 West,SthPo'Mo It was a8reed that action on
voluntary annexation petitions would be deferred until the receipt
of the Iowa Power petition.
Moved by Scott,second by Oetting,to approve the Official Municipality
report for Municipal Streets and Parking for FY 81--82.Carried 4 to O.
Moved by Christianson,second by Scott,to approve the Project Status
report for FY 81-82.Carried 4 toO.
The City Clerk/Administrator requested input from the City Council
regarding the FY 82-83 Street Construction program which is due on
or before December 31,1982.
Moved by Christianson,second by Rees,not to lease a vehicle for the
City Administrator's use.A roll call vote was taken as follows:

The City Council agreed that Beggars Night would be October 30 from
6:00 p.m.to 8:00 p.m.

Meeting adjournedo
A special meeting of the Waukee City Council was called to order at 7:30 p.m.
by Mayor Joseph A Neubauer.Brian Redshaw was present and taking minutes.
A roll call was taken and all councilmen were present except Scott.
Moved by Christianson,second by Rees,to approve the minutes of September
14,1982.Carried 4 to O.
Moved by Jansma,second by Oetting,to approve the City Annual Financial
Report for FYE 6-30-82 and publish same in Dallas County News.Carried
4 to O.
Moved by Oetting,second by Jansma,to approve the street lighting pro-
posal for Corene Acres Plat 10 as presented by IPALCO.Carried 4 to O.
Roger L Buffington,city engineer,discussed with the City Council the
present capacities of the water and sewer systems 0 He also discussed
with the Council the various options open to the City regarding the
corrections needed on the systems.
The Council directed the City Administrator to draft a letter to Harold
Jensen of Jensen Company giving him 30 days to complete the lagoon
repair project.
Bids were received from 3 contractors regarding the interior and exterior
of the 200M ground storar,e tanko The Council deferred action until
spring of 1983.
Moved by Rees,second by Jansma,to approve the payment of $11,979.14 to
Watertower Paint and Repair Company as a final payment for the renovation
of the SOM elevated stora~e tank.Carried 4 to O.
