The December 7,1982 regular city Council meeting was called to
order at 7:33 p.m.by Mayor Joseph A Neubauer.Brian J.Redshaw
was present and taking minutes.A roll call was taken and all
councilmen were present.
The following guests were also present:Don Baker,Mr &Mrs Ken
Hopper,Gary Netzger,Dean Snyder,Pam Hamilton,Luke Gruber,
Nick Gruber,Beth Dalbey,Don Henson,Diana Erickson,Linda
McKean,Bob Christianson,Chet Chedester,Bob Applegate,Rev

Moved by Jansma,second by Christianson,to approve the minutes
of November 16,1982 as presented.Carried 5 to O.
Moved by Oetting,second by Jansma,to approve the November
treasurer's report.Carried 5 toO.

Action on item {f6--0rdinance 2020 was deferred until legal counsel
arrived.
Luke Gruber,captain of the First'Responder~,spoke to the City
Council regarding the acquisition of two pieces of extrication
equipment ..The Hurst (Jaws of Life)tool could be acquired at
$3850.00.The accompanying RAM equipment would cost either
$914.00 or $1000.00 depending on the size purchased.Action on
this item was deferred until item {flO--FY 83-84 Fire Protection
Agreement.
The Rev.John Winkler represented the City Facilities Committee
before the City Council.He reported the results of 3 committee
meetings and requested guidance from the Council regarding the
next step the committee ought to take.
Moved by Jansma,second by Rees,to authorize the City Facilities
Committee to have the responsibility and authority to contact an
architectural firm to determine the preliminary cost estimates
for a new City complex with the understanding being that this
would,in no way,obligate the City financially.The Mayor called
for a roll call vote as follows:

The City Administrator,Brian Redshaw,presented a proposed FY
82-83 Street Construction program as outlined by the Streets
Committee.
Moved by Christianson,second by Rees,to accept this program
as the official street construction program for FY 82-83 and
transmit the same to the Department of Transportation.Carried
4 to l--Oetting voting No.
,The proposed Ordinance 2020,as prepared by City attorney,Paul
Huscher,was considered at this time.Northwestern Bell Telephone
Co representative,Don Baker,was also present.
,Councilman Scott introduced an ,Ordinance entitled "ORDINANCE 2020--
AN ORDINANCE GRANTING UNTO NORTffiJESTERN BELL TELEPHONE COMPANY,
A CORPORATION,ITS SUCCESSORS AND ASSIGNS,THE RIGHT,FRANCHISE,
AND PRIVILEGE FOR A PERIOD OF TWENTY-FIVE (25)YEARS FROM AND
AFTER THE ADOPTION AND APPROVAL HEREOF,TO ACQUIRE,CONSTRUCT,
OPERATE AND MAINTAIN IN THE CITY OF WAUKEE,IOWA,THE NECESSARY
,FACILITIES FOR THE OPERATION OF A GENERAL TELEPHONE SYSTEM;TO
.USE AND OCCUPY THE PUBLIC STREETS,HIGHWAYS,AVENUES,ALLEYS,
BRIDGES AND PUBLIC PLACES FOR SUCH PURPOSES:AND PRESCRIBING
THE TERMS AND CONDITIONS THEREOF.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.That Northwestern Bell Telephone Company,
a coporation,its successors and assigns,be and it is hereby
granted and vested with the right,franchise and privilege
for a period of twenty-five (25)years from and after the
adoption and approval hereof,as provided by law,to acquire,
construct,operate and maintain in the City of Waukee,Iowa,
the necessary facilities for the operation of a general
telephone system;and to construct and maintain along,upon,
.across and under the streets,highways,avenues,alleys,
bridges and public places the necessary fixtures and equipment
.for such purpose.

Section 2.This franchise shall not be exclusive and shall
not restrict in any manner the right of the City Councilor any
other governing body of the City in the exercise of any regulatory
power which it may now have,or hereafter be authorized or per-
mitted,by the laws of the State of Iowa.This franchise does not
confer the power to appropriate and condemn private property upon
Northwestern Bell Telephone Company.
Section 3.If,during the term of this franchise ordinance,
there shall be enacted by the Iowa General Assembly,a valid
statute granting to cities that regulatory authority over the
construction,operation,and maintenance of electric transmission
lines which is currently exercised by the Iowa State Commerce
Commission,then Northwestern Bell Telephone Company shall
construction,operate and maintain its general telephone system
in the City of Waukee in accordance with regulations of the City
adopted pursuant to such statute.
Section 4.

Jansma,that Ordinance 2020 be now read by the City Clerk.The
Mayor put the question on the motion,and the roll being called,

It was moved by Councilman Scott,and seconded by Councilman
Rees,that the rule that an ordinance must be received and filed
at two meetings prior to the meeting when final action is taken
or,if published in summary,be received and filed at one meeting
prior to the meeting of final action,be dispensed with.The
Mayor put the question on the motion,and the roll being passed,
the following named councilmen voted:

IVhereupon,the Mayor declared the motion duly carried.
It was moved by Councilman Jansma,and seconded by Councilman
Oetting,that Ordinance 2020 be now put upon its final passage
and adoption.The Mayor put the question on the final passage
and adoption of said Ordinance,and the roll being called,the
following named Councilmen voted:

Whereupon,the Mayor declared said Ordinance duly adopted and
passed,and signed his approval to said Ordinance.
Moved by Jansma,second by Christianson,to adopt the following
resolution:
RESOLUTION NO.16
BE IT RESOLVIDby the City Council of the City of Waukee,Iowa,
that a special election of the voters of said City be,and the same
is hereby called for the putpose of voting upon the question of .:,'-'"
granting a telephone franchise to Northwestern Bell Telephone
Company in accordance with the terms of ordinance number 20Z0,
passed by the City Council on the 7th day of December,1982,
and approved by the Mayor on the 7th day of December,1982,
and that there be submitted at said special election the question
of granting a telephone franchise to said Northwestern Bell
Telephone Company in accordance with the terms of said Ordinance,
and that the Mayor and Clerk of the City of Waukee,are hereby
authorized and directed to notify the County Commissioner of

Elections of this resolution calling for a special election.

M Erwin Jansma,the city council representative for the FY 83-84
Fire Protection agreement,reported on the meeting held with the
township trustees on November 23,1982.It was agreed by the
council members that the po,,!itionof $.28 per thousand dollars
valuation should be held firm.The next meeting with the trustees
will be held next Tuesday,December 14,1982 at 7:30 p.m.
Moved by Christianson,second by Scott,to purchase a Hurst
extrication tool in the amount of $3850.00.Carried 5 to O.
Moved by Jansma,second by Christianson,to direct the City Clerk
to prepare a budget amendment in this amount to be presented at
the December 21 regular council meeting.Carried 5 to O.
A letter from Officer Richard Harney was presented to the Council
by the City Administrator.
Moved by Rees,second by Scott,to approve a $7?00 per month
salary increase for Officer Harney.Carried 4 to 1--Christianson
voting No.
Mayor Joseph Neubauer advised the council that he was vetoing this
measure.The Mayor indicated that the reason for this veto was
the fact that the City was covering the cost of Officer Harney's
academy training and that this would give him additional career
mobility.The council has 30 days to attempt to override his veto.
Moved by Christianson,second by Oetting,to allow Officer
8 hours "c"time for both Columbus Day and Veteran's Day.

Moved by Oetting,second by Christianson,to pay Harney for extra
hours worked on weekends during his academy training.Motion failedoto5.

The council indicated that it was their desire for Officer Harney
to fulfill the representation that he made when he was hired which
was to move within the city limits of Waukee.

The December 21,1982 regular city Council meeting was called to
order at 7:37.p.m.by Mayor Joseph A.Neubauer.Brian J.Redshaw
was present and taking minutes.A roll call was'~aken and the
following named councilmen were present:Jansma,Oetting,Scott,
Rees,and Christianson.
The following guests were also present:Kenneth Stife1,Paul R.
Huscher,Ben Phillips,Cecil Reynolds,Bob Applegate,Jack Prewitt,
Ken Hopper,Doug Brickert,Roger Buffinp,;ton,Ray Clark,Beth Dalbey,
Chet Chedester,and Jane Brmvu.
Moved by Jansma,second by Scott,to approve the minutes of December
7,1982 as presented.Carried 5 to O.
Jane Brown,president of the Library Board,formally expressed her
appreciation to the city Council for allowing the library to be
open on Tuesday evenings from 6:30 to 8:30.She referenced various
statistics ,vhich indicate that this policy has improved circulation.
Doug Brickert of Hunter Insurance Agency discussed a volunteer
