Meeting adjourned. / 16,1983 The August 16 regular City Council meeting was called to order at 7:30 p.m.C.D.T.by Mayor Joseph A.Neubauer.Brian J.Redshaw, City Clerk/Administrator,was present and taking minutes. A roll call was taken the following named councilmen were present: Jansma,Scott,Rees,and Christianson.Absent:Oetting. The following guests and staff were also present:David Reed, Ron Weaver,Jerry Alt,Barry Bishop,Beth Dalbey,Terry Jilek, Remo Nizzi,Roger Buffington,Tamie Hopper,Ken Hopper,Virginia Oetting,Loris Cross,John Grubb,Steve Grubb,Paul E Huscher. Remo Nizzi requested that the minutes be read orally. Moved by Jansma,second by Scott,to approve the August 2,1983 minutes as presented.Carried 3 to O--Christianson abstaining. Dennis Felt did not appear before the City Council. Officer Ken Hopper presented a drug display case to the City Council.His only request was that it be installed at a location which was available to the general public. Tom McClure was not present.at the meeting,but Brian Redshaw adVised the Council of his application for the Zoning Admt.nf.straco'r position. Moved by Rees,second by Christianson,to appoint Tom McClure as Zoning Administrator.Carried 3 to O--Jansma abstaining. Roger Anderson was not present at the meeting,but Brian Redshaw indicated Mr Anderson's concern that a vote had not been taken formally lifting the September 5 deadline for residency within the City limits. Moved by Rees,second by Christianson,to accept the following paragraph from the July 19 minutes: "Roger Anderson and Richard Harney both requested extension on their 60 day deadlines for residing within the City limits of Waukee.Mr Anderson indicated that he has been attempting to sell or rent his home in Panora but has failed to do so thus far. He assured the Council that he would move to town following the sale of his home.Mr Harney advised the Council that various financial responsibilities did not permit him to move to Waukee at this time,but in all probability he would establish residence within 7 months. Carried 4 to O. Moved by Jansma,second by Rees,to accept the July treasurer's report as presented.Carried 4 to O. 162 August l6---cont Jerry Alt,attorney for Steve &John Grubb,spoke to the Council regarding his clients'commitment to building single family dwellings or condominiums within the R-4 district.John &Steve Grubb also made statements in reference to the proposed Ordinance lf2023. A hearing for the proposed Ordinance #2023 and #2024 was held as published in the Dallas County News and circulated to the customers on the utility mailing list. Councilman Scott introduced an Ordinance entitled:"Ordinance #2023--An Ordinance to Amend Chapter 301,Waukee'Municipal Code, Zoning Ordinance of the City of Waukee,Iowa,by providing to treat an "R-4"bistrict as either "R-l"or "R-2"District" ORDINANCE lF2023 BE IT ORDAINED by the Counc{l of the City of Waukee: Section 1.Section 301.13 of Chapter 301 Waukee Municipal Code, Zoning Ordinance of the City,is hereby amended by adding thereto subsection E.as follows: E."R-l"or "R-2"Election.In any "R-4"District the owner may elect to treat the district as an "R-l"or "R-2"District; provided however,if Preliminary Plat approval is requested containing anyone or two family detached dwelling,then the entire district will be either an "R-l"District or an "R-2" District,and subj ect to the requirements of Section 301.10 and 301.11.Thereafter,no row dwellings or condominium dwellings may be built in said district. Section 2.Effective Date.This ordinance shall be in effect after its final passage,approval,and publication as required by law. It was moved by Councilman Jansma,and seconded by Councilman Christianson,that Ordinance #2023 be now read by the City Clerk. The Mayor put the question on the motion,and the roll being called, the foIbwing named Councilmen voted: Ayes:Jansma,Scott,Christianson Nays:Rees Absent:Oetting Whereupon,the Mayor declared the motion duly carried. Councilman Jansma introduced an Ordinance entitled:Ordinance #2024-- An Ordinance to Amend Chapter 301,Waukee Municipal Code,Zoning Ordinance of the City of Waukee,Iowa,by regulating the placement of buildings and structures other than mobile homes in "R-6"District. ORDINANCE #2024 AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE,Zoning Ordinance of the City of Waukee,Iowa,by regulating the placement of buildings and structures other than mobile homes in "R-6"District BE IT ORDAINED by the Council of the City of Waukee: Section 1.Section 301.15 of Chapter 301 Waukee Municipal Code, Zoning Ordinance of the City,is hereby amended by deleting therefrom subsection E.(4),and inserting in lieu-thereof the following: E.(4)The individual mobile home lot shall contain not less than four thousand two hundred seventy-five (4,275) square feet and shall measure at least forty.-five (45) by ninety-five (95)feet.Each lot shall have a front yard not less than twenty (20)feet in depth measured from the edge of the surfaced private street to the closest point of the mobile home.Side and rear yards shall be provided and maintained so as to provide a minimum separation at the nearest point between mobile homes,and other buildings and structures on adjoining lots,of at least ten (10)feet;however,side yards as so described shall not be less than five (5)feet, and rear yards as so described shall not be less than eight (8)feet,for any structure.No buildings or structures shall be placed within twenty (20)feet of the front lot line. It was moved by Councilman Jansma,and seconded by Councilman Christianson, that the rule that an ordinance must be received and filed at two meetings prior to the meeting when final action is taken or,if published in summary,be received and filed at one meeting prior to the meeting of final action,be dispensed with.The Mayor put the qeustion on the motion, and the roll being passed,the following named Councilmen voted: Ayes:Jansma,Scott,Rees,Christianson Nays:None recorded Absent:Oetting Whereupon,the Mayor declared the motion duly carried. It was moved fuy Councilman Scott,and seconded by Councilman Jansma,that the Ordinance \entitled:"Ordinance lt2024"be now put upon its final passage and adoption.The Mayor put the question on the final passage and adoption of said Ordinance,and the roll being called,the following named Councilmen voted: Ayes:Jansma,Scott,Rees,Christianson Nays:None recorded Absent:Oetting Whereupon,the Mayor declared said Ordinance duly adopted and passed, and signed his approval to said Ordinance. The City Council considered the matter of the City utility petition. There was discussion concerning Section 388.2 of the Code of Iowa. The discussion centered around the phrase "except a sanitary sewage system"and whether this applied to its sale to a private interest or acquisition by a utility board.Paul E Huscher,City Attorney, advised the Council that he would research the question and report back at the September 6 regular meeting. The item entitled "salary increase after probationary period"was considered by the City Council. Moved by Scott,to replace the following sentence under the "Starting Salaries"section of the Employee Handbook--"A $75.00 per month increase shall be granted after the successful completion of the 12 month pro- bationary period"with the following:"An increase in salary of $900.00 shall be granted after the successful completion of the 12 month probationary period for one year."Motion died for lack of a second. Various other questions arose concerning the Employee's Handbook. Moved by Christianson,second by Jansma,to direct the City maintenance personnel to haul broken concrete to the lagoon cells from a location 5 miles south of town as recommended by Councilman Rees.Carried 4 to O. Brian J Redshaw presented the Administrator's report. Moved by Scott,second by Jansma,to adjourn at 9:45 p.m.Carried 4 to O. Meeting adjourned.
