HomeMy WebLinkAbout1983-11-01-Regular Minutes174 November 1,1983 The November 1,1983 regular City Council meeting was called to order at 7:33 p.m.by Mayor Joseph A.Neubauer.Brian J.Redshaw,City Clerk/ Administrator,was present and taking minutes. A roll call was taken and the following named City Councilmen were present:Jansma,Oetting,Scott,Rees and Christianson. The following guests were also present:Howard Wilson,Don Henson, Paul Bryan,Jack Bryan,Frank Hoifeldt,John Grubb,Rick Huscher,Paul E Huscher,Barry A Bishop,Beth Dalbey,Bud Gray,Bob Heddinger,Terry Jilek,Joe Stork,S A Grubb,and Remo Nizzi. Moved by Scott,second by Christianson,to approve the October 18,1983 minutes as presented.Carried 5 to O. The first guest,Larry Stanley,was not present to discuss the issue of utility deposits. Bud Gray of Bud Gray Construction Co.appeared before the City Council to request a one-year extension of a performance bond on sidewalks for Co rene Acres Plat 10,which expired October 18,1983.Mr Gray indicated that his company would purchase the necessary bond rather than using the M.Peterson Construction Co. Moved by Scott,second by Jansma,to grant a one-year extension on the perf@rmance bond for Corene Acres Plat 10,making its new expiration date,October 18,1984.Carried 5 to O. A discussion was held concerning the elevation of a fire hydrant at the intersection of 2nd St.and Corene Ave.in Corene Acres Plat 10.Mr. Gray indicated that the Bud Gray Construction Company and Hawkeye Construction Co.would work jointly to raise this fire hydrant at their expense. A Zoning Change hearing was held as published in the Dallas County News. The proposal requested a change from R-4 to R-2 for a tract of land in the vicinity of 8th &Cherry Streets. The Mayor asked for any change from R-4 to R-2. received at this time. questions or objections to the proposed zoning No objections,either oral or written,were Councilman Jansma introduced Ordinance 1f2025 entitled "AN ORDINANCE ~ AMENDING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY LIMITS OF WAUKEE, IOWA,FROM R-t+(ROW DWELLING AND CONDOMINIlJM DWELLING DISTRICTY:-,TQ RO'.2 (ONE AND TTtJOFAMILY RESIDENT1KAL DISTRICT).AND PROVIDING FOR THE AMENDMENT OF THE OFJnCIAL ZONING MAP AND THE RE-PUBLICCATION OF SATID HAP TO REFLECT SUCH ZONING CHANGES. BE IT ORDAINED by the Council of the City of Waukee: Section 1.Property Re-zoned.The zoning of the following des- cribed real estate shall be changed from R-4 (Row Dwelling and Condo- minium mvelling District)to R-2 (One and Two Family Residential District): "Beginning at the SW corner of the SW!;;of the NW!;;of Section 33,Township 79 North,Range 26 West of the 5th P.M.,City of Waukee,Dallas County,Iowa;thence N 00°00"00"E along the west line of the NW!;;of said Section 33,639.90 feet to the south line of Cherry Street extended;thence,N 890 40'00"E along the south line of Cherry Street extended,716.00 feet to the east line of 8th Street;thence S 00°29'00" E along the east line of 8th Street extended,638.22 feet to the south line of the NW!;;of said Section 33; thence S 89"32'00"W along the south line of the NW!;;of said Section 33,721.40 feet to the point of beginning.Said tract of land being subject to and together with any and all easements of record.Said tract of land containing 10.54 acres +." Section 2. amended to reflect this change. The official zoning map shall be Section 3.Effective Date.This ordinance shall be in effect after its final passage,approval,and publication as re~uired by law. November l----cont 177 The City Administrator presented to the City Council copies of a traffic study on the intersection of Ashworth Dr.and University Ave.as conducted by Mr John T.Pearson of the Iowa Dept.of Transportation.The City Attorney,Paul Huscher,advised the Council that the County Attorney had requested a delay in the installation of a stop sign at this intersection pending more input into the discussion. Moved by Scott,second by Christianson,to approve the recommendations as outlined by the I.D.O.T.and direct the County Engineer to make the proper alterations in the signage.Carried 3 to 2--0etting and Jansma voting No. The City Administrator presented two applications for the renewal of Class C beer permits and Sunday sales privileges from the Waukee Emporium and Casey's General Stores,.Inc.He advised the Council that the proper applications have been received and the proper fees paid.He indicated that the Police Chief had not received any complaints about either of these establishments. Moved by Rees,second by Christianson,to approve Class C beer permits and Sunday sales privileges to the Waukee Emporium and Casey's General Stores,Inc.Carried 5 to O. Roger L.Buffington of Snyder &Associates presented various engineering items.He recommended that the City accept the work done on the 1983 street program and that liquidated damages not be pursued despite the work being completed after the extended September 15,1983 deadline. Moved by Oetting,second by Scott,to approve the change order in the amount of $1586.60 and make pay estimate #2 in the amount of $1427.94 to the order of Fort Dodge Asphalt Co.as recommended.Carried 5 to O. Roger Buffington presented the Council with the proposed changes to the Subdivision Ordinance as recommended by the Waukee Planning &Zoning Commission.The City Attorney indicated that the proposed changes would be included in a revised Subdivision Ordinance to be presented to the Council and considered at a later date. Moved by Christianson,second by Jansma,to approve the expenditure of $450.00 for the installation of lightning arrestors at City Hall. Carried 5 to O.
