The raise of the PGA on the gas bills was discussed.The Utilities
Committee recommended a 4~increase and it was implemented on the
January bills.Walt Hinkson,chairman of the Utilities Committee,
gave a report on the Committee meeting.
Moved by Hinkson,second by Wilson,to accept the 4~increase on
the PGA as recommended by the Utilities Committee.A roll call
vote was as follows:

Motion carried 3 to 1.

The regular meeting of the Waukee City Council was called to order on
February 14,1984 at 7:30 p.m.by Mayor Gordon Christianson.A roll
call was taken and the following named Councilmen were present:
Hinkson,Barrett,Wilson,Rees,and Stork.Absent:None.Ann Ford
was taking minutes.

Moved by Stork second by Wilson,to pay Motorola bill in the amount of
$939.00.Carried 5 to O.
Dena Forret of the Waukee Recreation Committee spoke to the Council
regarding the winter recreation program and the upcoming summer rec-
reation program.She request a check in the amount of $2100.00 as
allocated in the FY 83-84 budget for the winter and summer recreation
programs.She also reported on the progress for the proposed tennis
courts and indicated that available funding will be pursued.
Moved by Wilson,second by Barrett,to pay $2100.00 to the Waukee
Recreation Association for the winter and summer recreation programs
as allocated.Carried 5 to O.
Steve Grubb addressed the Council regarding Glenview Manor.He indic-
ated that they have moved forward in securing the easement for the
gravity flow sewer with June Andeberg and did not foresee any problems
with Lewis Baer or Remo Nizzi on their easements.He also spoke
regarding the installation of natural gas in the Glenview Manor
deve lopmen t .
The Council cited 303.167 of the Waukee Municipal Code which states
that the subdivider shall be responsible for installing natural gas
system within all new subdivisions.
Barry Bishop of Bishop Engineering also spoke to the Council regarding-
the possibility of the City's participation in helping out financially
with regard to easements,legal costs,etc.of Glenview Manor.
The Council will be holding a special meeting on February 21 and will
discuss these matters with John &Steve Grubb at that time.The
Grubbs were also advised to have costs on request for financial
participation from the City.
Ken Hopper spoke to the Council regarding the residency requirement for
City employees and ask for a possible revision in this requirement.

Leon Koeppel addressed the Council on the $25.00 water meter deposits
required before 1980.The City Clerk advised the Council that the
original records were not available so he knew who had paid these
deposits.
Moved by Hinkson,second by Barrett,to refund the $25.00 water meter
deposits paid prior to 1980 upon presentation of receipt or cancelled
check of deposit if the account has not been delinquent.Carried
4 to I--Stork voting no.It was also indicated that the deposits not
be paid until notice of this was put in the newsletter.
Margaret Drury,president of the Waukee Library Board,spoke to the
Council regarding expansion of the library.Jane Brown spoke about
the anticipated growth of the library and state recommendations for
libraries.

Comments for and against the City keeping the gas system were heard
from citizens.
A public meeting will be held on March 28 at the City Hall at 7:30 p.m.
The guest at this meeting will be the Executive Director of the Iowa
Association of Municipal Utilities,Barton D Rule.He will discuss
various aspect of the natural gas business.
Joe Stork gave the Parks &Recreation Committee report.
Moved by Rees,second by Wilson,to approve the expenditure of $1000.00
for materials for a wooden playground structure for the park to be
built by City employee,Roger Anderson.Carried 5 to O.
Councilman Rees introduced Ordinance #2032 entitled:"AN ORDINANCE
REGULATING PAWNBROKERS AND THE OPERATION OF PAWN SHOPS IN THE CITY
OF WAUKEE,IOWA".
It was moved by Councilman Hinkson,and seconded by Councilman Barrett,
that the Ordinance entitled:"AN ORDINANCE REGULATING PAWNBROKERS AND
THE OPERATION OF PAWN SHOPS IN THE CITY OF WAUKEE,IOWA"be now read
by the City Clerk.The Mayor put the question on the motion,and
the roll being called,the following named Councilmen voted:

ORDINANCE NO.2032
AN ORDINANCE REGULATING PAWNBROKERS AND THE OPERATION OF PAWN SHOPS
IN THE CITY OF WAUKEE,IOWA.
BE IT ORDAINED by the Council of the City of Waukee:

Section 1.THERE SHALL BE ADDED TO THE WAUKEE MUNICIPAL
CODE,CHAPTER 214 AS FOLLOWS:
Section 2.Definition.Every person,firm,or corporation
who makes loans or advancements upon pawn,or deposit of personal
property,or who receives actual possession of personal property
as security for loans,with or without a mortgage,or a bill of
sale thereon,is a pawnbroker within the meaning of this chapter.
Section 3.License.
A.Application.Every person,firm,or corporation
wishing to be a pawnbroker,must apply for a
license at the office of the City Clerk of Waukee.
The application shall state the name and place
of residence of the person,firm,or the business
address of the corporation having an ownership
interest in the business to be transacted,the
place where the business is to be transacted,and
the date the license is requested,and the names,
addresses,and phone numbers of all individuals
having an ownership interest in said business,
including all persons having an ownership interest
in any firm or corporation operating said business.
B.License.The license shall state the date it is
issued,the time it will expire,and the names,
addresses,and phone numbers of all individuals
having an ownership interest in said business,
including all persons having an ownership interest
in any firm or corporation operating said business.
1.The fee for issuance of a license to engage in
the business as a pawnbroker shall be in the
amount of Two Hundred Dollars ($200.00)which
shall be tendered prior to the issuance of such
license.
2.A license issued under this Chapter shall be
valid and effective until January 1st of the
year following the year of issuance,and may
be renewed annually upon payment of the required
fee.Such license may be suspended or revoked
for any violation of the Waukee City Code,laws
of the State of Iowa,or the laws of the United
States.
3.Any person conducting several separate places of
business as a pawnbroker shall pay the license
fee and procure a license for each place.
Section 4.Records.
A.Every pawnbroker shall keep a book in which he shall
accurately and legibly,enter,in ink,in the English
language,at the time of purchasing of receiving any
personal property:
1.The name of the person from whom the property
is purchased or received and his place of business.
2.A particular,detailed,and accurate description
of each article;including serial number if available.
3.The estimated value of such article.
4.The amount paid,advanced or loaned.
5.The date and hour of the transaction.
6.The time when the articles is to be redeemed or
brought back.
7.Any mortgage or bill of sale taken or receipt upon
ticket given.

8.When,and by whom,an article was brought
back or redeemed.
9.When,to whom and how an article was dis-
posed of,if not redeemed.
B.The pawbroker's license and said book shall at
all times be open to examination by any Sheriff,
Deputy Sheriff,Police Officer or Constable.
Section 5.Violation.Any person shall be guilty
of a misdemeanor who shall:
A.Fail to keep such records.
B.Fail to make the required entries therein.
C.Intentionally or knowingly make any false or
illegible entry,or any entry which he has
reason to believe is untrue.
D.Fail to make the inquiries necessary to enable
him to make such entries or any of them.
E.Fail to produce his license or book when requested
by an officer having authority to examine it.
Section 5.Destroying,Disposing or Dismantaling of
Articles.No person purchasing or receiving any personal
property or article in the course of dealing as a pawnbroker
shall melt,dismantle,destroy,alter,or in any manner dis-
pose of such personal property,by sale or otherwise,within
15 days following the making of the record required in Section
4 of this Ordinance,except upon written permission from the
Chief of Police of Waukee.
Section 6.Purchases from Minors.No pawnbroker shall
purchase or receive any personal property from any minor
without first receiving the consent in writing from the
parent or guardian,a copy of which must be filed with the
Chief of Police of Waukee at the time of filing the report
required in this chapter.
Section 7.Concealing Articles To Prevent Identification.
No pawnbroker shall conceal,secrete,or destroy for the purpose
of concealing,any article purchased or received by him for the
purpose of preventing identification thereof by any officer or
any person claiming to own the same.
Section 8.Sales During Redemption Period.No pawnbroker
shall sell,alter,or otherwise dispose of any article during
the time any person has a right to buy back or redeem the same.
Section 9.Holding Articles of Clothing.All articles
of clothing taken in pawn or purchased outright shall be held
in the same condition in which they were received for fifteen
(15)days following,and during this period shall not be cleaned,
repaired,dyed or altered in any manner.
Section 10.Search for Stolen Property.Whenever any
police officer shall reasonable know that any pawnbroker has
in his/her possession or on his/her premises any stolen property,
he/she shall have the right and duty to enter and search the
premises of such person for such purposes of discovering stolen
property with or without a warrant.
Section 11.Examination of Premises by Officers.No
pawnbroker or any person shall refuse,or resist or attempt to
prevent any Sheriff,Deputy Sheriff,Constable or Police Officer,
with or without a warrant,from examining the premises occupied
by the pawnbroker for the purpose of discovering stolen property.
Section 12.Disposing of Stolen Goods or Goods for Which
There is Adverse Claim.No pawnbroker shall sell,or permit
to be redeemed,or otherwise dispose of any article which he

has reason to believe has been stolen,or which is adversely
claimed by any person,which he has been notified not to sell,
release or otherwise dispose of by any Sheriff,Deputy Sheriff,
Police Officer or Constable,without first obtaining written
permission from the Chief of Police.
Section 13.Penalty.Violation of any of the provisions
of this Chapter shall be punishable by 3.0 days in jailor $100.00
fine or by both such fine and imprisonment.
Section 14.Severability.If any section,provision,or
part of this ordinance shall be adjudged to be invalid or un-
constitutional,such adjudication shall not affect the validity
of the ordinance as a whole or any section,provision or part
thereof not adjudged invalid or unconstitutional.
Section 15.Effective Date.This ordinance shall be in
effect after its final passage,approval,and publication as
required by law.
It was moved by Councilman Rees,and seconded by Councilman
Wilson,that the rule that an ordinance must be received and
filed at two meetings prior to the meeting when final action is
taken or,if published in summary,be received and filed at one
meeting prior to the meeting of final action,be dispensed with.
The Mayor put the question on the motion,and the roll being
passed,the following named Councilmen voted:

It was moved by Councilman Rees,and seconded by Councilman
Wilson,that the Ordinance entitled:"AN ORDINANCE REGULATING

WAUKEE,IOWA"be now put upon its final passage and adoption.
The Mayor put the question on the final passage and adoption of
said Ordinance,and the roll being called,the following named

Whereupon,the Mayor declared said Ordinance duly adopted and
passed,and signed his approval to said Ordinance.
Sidewalks in Plat 10 of Corene Acres was discussed.
Moved by Hinkson,second by Rees,to direct the City attorney to
draw up an agreement creating a cash bond,to be held in escrow
with interest going to Bud Gray Construction Co.in the amount
of $8500.00.Carried 5 to O.
The proposed FT 84-85 budget was discussed at length.The Council
had questions about various aspect of the proposed budget.
Gordon Christianson gave the Mayor's report.
Moved by Stork,second by Barrett,to purchase snow route signs at
a cost of approximately $66.00.Carried 5 to o.
Brian Redshaw gave the Administrator's report.
He was directed to advertise in the newsletter for volunteers
to help in the library.
The City Attorney was directed to draw up an amendment to Waukee
Municipal Code,Section 111.7,giving the City Administrator the
authority to purchase up to $200.00 maximum.The chairman of the
various committees are to be contacted by Mr Redshaw if an expend-
iture is needed in excess of $200.00.

Howard Wilson reported that June Andeberg had requested that the
Council be asked if she could develop her vacant lots if all re-
quirements are met.
Moved by Wilson,second by Hinkson,that June Andeberg would be
allowed to develop her vacant lots if all requirements are met
under the subdivision regulations and subject to P &Z approval.
Carried 5 to O.
Moved by Rees,second by Barrett,to adjourn at 1:30 a.m.

A special meeting of the Waukee City Council was called to order
at 7:33 p.m.on February 21,1984 by Mayor Gordon Christianson.
A roll call was taken and the following named Councilmen were
present:Barrett,Wilson,Rees,and Stork.Absent:Hinkson.
Hannah Weil was"taking minutes.
Guests at this meeting were:Ben Phillips,Jim Berner,Fred
Marshall,Frank Hoifeldt,Cheryl Vassilonikolidakis,Chet Chedester,
Barry A Bishop,Rev.Doug Lane,Joe GUisinger,Tom Darnold,
Stephen R Grubb,and Roger Lemons.Staff present were:Brian
Redshaw and Paul E Huscher.
Moved by Stork,second by Wilson,to approve the minutes of
February 14 as presented.Carried 4 to O.
The Mayor asked for comments for or against the Class C liquor
license and Sunday sales privilege for the Home Town Cafe &Lounge.
Rev.Doug Lane presented a petition containing 56 names in opposition.
Various other comments for and against this license were heard.
Moved by Rees,second by Barrett,to approve the Class C liquor
license and Sunday sales privilege for the Home Town Cafe &Lounge.
Carried 3 to O--Wilson abstaining.
