Guest and staff at this meeting were:Steven Venard,Roger Buffington, Dennis Snyder,Richard Applegate,Beth Dalbey,Bob Applegate,Jack Inman,Wayne McKinney,Terry Jilek,Jim Broderick,Marguerite Jordan, Don Henson,Ben Phillips,Jim Berner,Art Spencer,Jim Higgs,Mark Casey,Judy Henson,Paul Huscher,Brian Redshaw,and Ann Ford. Moved by Barrett,second by Hinkson,to correct the minutes of April 10 to insert "2'high continuous concrete II regarding the proposed median on Walnut Street.Carried 4 to l--Rees voting no. Jack Inman and Steve Venard of Inman Construction presented the preliminary plats of Mary Ann Estates--Plats 1 and 2,for approval. Roger Buffington gave 3 suggestion regarding this plat: 1)sidewalks on east side of 4th Street 2)permit from D.O.T.for highway access 3)present buildings on Lot 1 encroach on building setback He also discussed with the Council about water mains,drainage,sewer, and fire protection and recommended approval of preliminary plat #2. Moved by Hinkson,second by Barrett,to approve preliminary plat #1 of Mary Ann Estates.Carried 5 to O. Moved by Stork,second by Barrett,to approve preliminary plat #2 of Mary Ann Estates.Carried 5 to O. Wayne McKinney represented Cheryl Septer in a discussion with the Council on water drainage onto Cherry Street from her property on which a ditch had been filled in during construction work. ---..- Moved by Rees,second by Wilson,to have Mrs.Septer repair the property.Carried 5 to O. Moved by Rees,second by Wilson,to approve the following specific- ations for the above project for completion within 60 days: 1)install 2-10"corrigated tubes under driveways 2)ditch to be dug out &tapered off to match west property 3)intake and sod to be put in to alleviate this problem Carried 5 to O. An exotic animal ordinance from West Des Moines was reviewed by the Council.Paul Huscher was instructed to draw up an ordinance on exotic animals for Waukee. The proposed median on Walnut Street was discussed.Paul Huscher presented a proposed ordinance on prohibiting driving left of center of Walnut Street.No action was taken on this proposed ordinance. Moved by Rees,second by Barrett,to expunge the motion in the April 10 minutes of construction on a median on Walnut Street.Carried 4 to O--Wilson abstaining. May 8---cont ,217 ORDINANCE NO.2037 AN ORDINANCE TO AMEND CHAPTER 202,WAUKEE MUNICIPAL CODE, ESTABLISHING RATES FOR GAS FUP~ISHED USERS BY THE MUNICIPAL GASWORKS DISTRIBUTION SYSTEM BY THE CITY OF WAUKEE,IOWA,by including a provision for the installation of gas meter extensions at the expense of property owners where the meter is inaccessible to the meter reader. BE IT ORDAINED by the Council of the City of Waukee: Section 1.Chapter 202 is amended by inserting after Section 202.2 the following paragraph and renumbering Sections 202.3,202.4,202.5 and 202.6,to 202.4,202.5,202.6 and 202.7 respectively: 202.3 Installation of Gas Meter Extensions. When in the opinion of the City Clerk,a meter is inaccessible to the reader because of location,prohibited entry due to animals or barriers,or any other reason,the City Clerk may cause to be installed a gas meter extension and shall charge the cost of said gas meter extension and the installation thereof to the user. Section 2. effect after its required by law. It was moved by Councilman Rees,and seconded by Councilman Hinkson,that the Ordinance entitled:Ordinance jf2037--"AN ORDINANCE TO AMEND CHAPTER 202,WAUKEE MUNICIPAL CODE,ESTABLISHING RATES FOR GAS FURNISHED USERS BY THE MUNICIPAL GASWORKS DISTRIBUTION SYSTEM BY THE CITY OF WAUKEE,IOWA"be now put upon its final passage and adoption.The Mayor put the question on the final passage and adoption of said Ordinance,and the roll being called,the following named Councilmen voted: Ayes: Nays: Hinkson,Barrett,Wilson,Rees,Stork None recorded Whereupon,the Mayor declared said Ordinacne duly adopted and passed, and signed his approval to said Ordinance. The water connection ordinance was discussed.Objections on changing this ordinance,making property owners responsible for the entire service lines to the mains instead of up to the stopbox,as written in the present ordinance,was heard. Councilman Hinkson introduced an Ordinance entitled:"AN ORDINANCE TO AMEND CHAPTER 211.11,WAUKEE,MUNICIPAL CODE,REGULATIONS GOVERNING MUNICIPAL WATER SYSTEM CONNECTIONS AND SERVICES" The Mayor asked for a motion for the Clerk to read the ordinance. There being no motion,the Water Connection Ordinance proceedings were dropped. A proposed digging ordinance was presented. 218 May8---cont Councilman Barrett introduced an Ordinance entitled:Ordinance #2038 "AN ORDINANCE PROHIBITING EXCAVATIONS UPON CITY PROPERTY EXCEPT UPON PERMIT ISSUED BY THE CITY FOR SUCH EXCAVATION". It was moved by Councilman Hinkson,and seconded by Councilman Rees,that the Ordinance entitled:Ordinance 1t2038--"AN ORDINANCE PROHIBITING EXCAVATIONS UPON CITY PROPERTY EXCEPT UPON PERMIT ISSUED BY THE CITY FOR SUCH EXCAVATIONS"be now read by the City Clerk.The Mayor put the question on the motion,and the roll being called,the following named Councilmen voted: Ayes: Nays: Hinkson,Barrett,Wilson,Rees,Stork None recorded Whereupon,the Mayor declared the motion duly carried. ORDINANCE NO.2038 AN ORDINANCE PROHIBITING EXCAVATIONS UPON CITY PROPERTY EXCEPT UPON PERMIT ISSUED BY THE CITY FOR SUCH EXCAVATION. BE IT ORDAINED by the Council of the City of Waukee: Section 1.THERE SHALL BE ADDED TO THE WAUKEE MUNICIPAL CODE,CHAPTER 206 AS FOLLOWS: Section 2.Permit Required for Excavation.It shall be unlawful for any person or persons,corporation or corporations, partnerships or associations other entities to excavate in,or remove or disturb any city sidewalk,curb or service in any city street,alley,sidewalk,public park,or other property of the city including public areas which have no such sidewalks,curbs or other hard surface,and city easements,unless such person or persons, corporatio or corporations,partnership or association or other business entity shall first have obtained a permit from the city authorizing such excavation. Section 3.Compliance with other Chapters.In no event shall any excavation be made for sanitary sewer installation, repair or maintenance except in compliance with Chapter 204, Waukee Municipal Code;nor shall any excavation be made for municipal water system connections,installation,repair or maintenance except in compliance with Chapter 211,Waukee Municipal Code. Section 4.Application for Permit.Anyone desiring to make application for a permit under the provisions of this ordinance shall submit a written application to the city clerk on a form provided by the city clerk and shall include written proof that all public utilities having cable,pipes and lines within the city,including city municipal utilities,have been adequately informed of any proposed excavation. Section 5.Surety Bond.No permit shall be issued for any excavation as provided herein until there has been filed with the Clerk of the city a bond with sureties acceptable to the city in the sum of $1,000.00 conditioned upon the full observance of city ordinances applicable to such excavation and that said applicant will indemnify the city for all losse&and damages sustained by reason of any negligence on the part of the permittee,his agents or employees while engaged in excavating or any costs sustained in enforcing the terms of the bond. Section 6.Restoration of Excavated Area.Whenever such excavation or removal is completed,such person shall forthwith restore any street,alley,sidewalk,curb,public park,or public place to same condition in which it was prior to the excavation. 219 May 8---cont Section 7.Protection of Excavated Area.No person~shall excavate OT leave.any such excavation without properly barracading :tae~sameo.a~d.,maintaining q.t:.onight.warning LLgh t.s .thareon ,;-'uponany pile of earth,plant,stone,.or building materials placed nearby. The building code on the height of buildings was discussed and it was decided to leave the ordinance as is. Stand by pay at $10.00 per call was discussed for people not employed by the City and Dave Reed. Moved by Rees,second by Stork,to pay $10.00 per call for gas emergency calls by the non-City employed standby people and Dave Reed.City personnel to be paid regular overtime if called out.Carried 5 to O. The sidewalk setback on Ashworth Drive was discussed.A property owner had requested to put in a sidewalk and requested a standard set- back on Ashworth.The City engineer is to look into this matter and find out where utilities are along Ashworth for the purpose of setting a standard setback for sidewalks. The item of Library help was deleted from the agenda. Walt Hinkson gave the Utilities report.He reported on the progress on the pulling of Well 1,12.Delinquent utility accounts were also discussed. Roger Buffington reported on the lagoon dredging project and the 2 bids for doing this work.The City engineer is to look into the aspect of temporary storage area for a future lagoon cell and report back to the 220 May 8---cont at the May 24 meeting. Merle Rees gave the Public Safety report. Bob Barrett gave the Fire Department and First Responder report. Moved by Barrett,second by 1,;Ti1son,to set May 24,1984.at 7:30 p.m , for a budget amendment hearing and publish the notice in the Dallas County News.Carried 5 to O. A brief discussion was held on the results of the pressure check at the stop box at 660 Walnut which was OK. Teh Red Cross swimming lessons at Adel was considered. Moved by Hinkson,second by Barrett,to proceed with the Red Cross swimming lessons at Adel.Carried 5 to O. Moved by Stork,second by Barrett,to expend $2000.00 for fireworks from Rich Brothers.Carried 4 to l--Rees voting No. The following resolution was read by the Mayor: WHEREAS,The Municipal Clerk,oldest of public servants,is the hub around which revolves efficient and responsive local government; WHEREAS,as local government has grown in responsibility and importance through the centuries;so has the commission of the municipal clerk; WHEREAS,the Municipal Clerk provides a direct link between paste,present,and future by preserving records for posterity and implementing decision of the legislative body,all the time seeking better and more efficient ways to do these jobs; WHEREAS,the Municipal Clerk serves a direct link between the inhabitants of their city and their governments; WHEREAS,the accurate recording,careful safeguarding,and prompt retrieval of public records are vital functions,without which efficient and responsivelocal government could not exist; WHEREAS,Municipal Clerks follow a mandate to seek better and more efficient ways to perform those critical responsibilities in light of the rapid technological advances of today's world; and WHEREAS,in keeping with this mandate,Municipal Clerks also are dedicated to continuous professional education and training in order to stay abreast of those advances; NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR OF THE CITY OF WAUKEE,IOWA,that in recognition of the outstanding and vital services performed by Municipal Clerks,reflecting their dedication to public service for the community,the week beginning May 13,1984 is designated "Municipal Clerk's Week". One application had been received for the vacancy on the Planning &Zoning Commission. Moved by Hinkson,second by Barrett,to appoint Ruby Mertes to the Planning &Zoning Commission for a term of 5 years.Carried 5 to O. Brian Redshaw gave the Administrator's report. Moved by Hinkson,second by Rees,to purchase brooms for the street sweeper for $381.50.Carried 5 to O. Moved by Hinkson,second by Rees,to have Snyder &Associates reduce the size of the utility maps for an approximate cost of $300.00 Carried 5 to O. The Council directed the City Clerk to advertise in the newsletter for part time summer help. 221 May 8---cont Moved by Wilson,second by Rees,to lift period and retain as City Administrator. voting No. Brian Redshaw's probation ·Carried 4 to I--Stork Bob Barrett recommended a resolution commending Gordon Christianson, Joe Stork,and all City employees for:work done toward the bicycle races. Moved by Wilson,second by Rees,to adjourn at 12:02 a.m.Carried 5 to O. Meeting adjourned. May 24,1984 A special meeting of the Waukee City Council was held on May 24, 1984 and was called to order at 7:30 p.m.by Mayor Gordon Christianson. A roll call was taken and all Councilmen were present. Guests and staff at this meeting were:Remo Nizzi,Fred Marshall, Dena Forret,Roger Buffington,Brian Redshaw,and Ann Ford. Remo Nizzi spoke to the Council requesting the September 16 be designated as Hunger Walk Day.A dinner will be held September 15 at the Methodist Church.A committee meeting will be held June 14, and Mr Nizzi requested that a member of the Council attend this meeting. The Mayor proclaimed September 16 as "Hunger Walk Day".
