A roll call was taken and the following named Councilmen were present: Hinkson,Barrett,Wilson,Rees and Stork.Absent:None. Moved by Wilson,second by Rees to accept the construction drawings of Waukee Estates Plat #1.Carried 5 to O. A Class C Liquor license was presented for approval for the establishment at 400 6th Street. Moved by Hinkson,second by Wilson to put the liquor license on the June 28 agenda.Voting was as follows; Ayes:Hinkson,Wilson,Rees Nays:None recorded. Abstain:Stork,Barrett Motion carried. Stork. Whereupon,the Mayor declared said Ordinance duly adopted and passed, and signed his approval to said Ordinance. A Gas Rate ordinance was presented,Walt Hinkson explained that the Utilities Committee recommends this ordinance which incorporates the PGA with the gas rates plus a 6%rate increase. Councilman Stork introduced Ordinance it 2040 -"AN ORDINANCE TO AMEND CHAPTER Sections 202.1 and 202.2,WAUKEE MUNICIPAL CODE,by amending Section 202.1 providing rates for gas furnished users by the municipal gasworks distribution system of the City of Waukee,Iowa,and by amending Section 202.2 to establish June 12,1984,as the date after which gas rate increases by Northern Natural Gas Company shall be passed on to the consumer." It was moved by Councilman Wilson and seconded by Councilman Stork,that the Ordinance #2040 be now read by the City Clerk.The Mayor put the question on the motion,and roll being called,the following named Council- men voted: AYES: NAYS: Barrett,Hinkson,Rees,Stork,Wilson. ORDINANCE #2040 AN ORDINANCE TO AMEND CHAPTER Sections 202.1 and 202.2,WAUKEE, MUNICIPAL CODE,by amending Section 202.1 providing rates for gas furnished users by the muni~ipa1 ga~works distrubution system of the City of Waukee, Iowa and by amendlng Sectlon 202.2 to establish June 12 1984 as the date after which gas rate increases by Northern Natural Gas Company shall be passed on to the consumer. BE IT ORDAINED BY the Council of the City of Waukee: 226 Section 1.Section 202.1 of Chapter 202 Waukee Municipal Code, establishing rates for gas furnished users by the municipal gasworks dis-' tribution system of the City of Waukee,Iowa,is amended by deleting therefrom the schedule as set out beneath the words "Firm Residential and Commercial"and inserting in lieu thereof the following: Monthly First 500 cu.ft.or less $3.29 Next 1500 cu.ft..83 CF Next 8000 cu.ft..61 CF Next 20,000 cu.ft.or over .59 CF Minimum monthly charge 3.29 Interruptible (Rate 2 )$.58 CF Section 2.Section 202.2 of Chapter 202 is hereby amended by deleting "April 23,1980,"and inserting in lieu thereof "June 12,1984." Section 3.Effective Date.This ordinance shall be in effect after its final passage,approval,and publication as required by law. Passed by the Council the 12th day of June,1984,and Approved this 12th day of June,1984". The U Turn Ordinance and Left Turn Ordinance was presented.Action was deferred until the June 28 meeting. Questions concerning swimming pools placed in driveways were considered. Definitions of swimming pools and wading pools was discussed.A depth of water 18"or above was decided upon as defining a swimming pool. The City Attorney will draw up an Ordinance to this effect. Councilman Rees introduced an Ordinance entitled "Ordinance if 2041, AN ORDINANCE TO AMEND CHAPTER 211,WAUKEE ,MUNICIPAL CODE,REGULATIONS GOVERNING MUNICIPAL WATER SYSTEM CONNECTTONS AND SERVICES,BY DECREAS- ING THE FEE PEID1IT FROM $50.00 to $15.00. ORDINANCE NO.20.41 AN ORDINANCE TO AMEND CHAPTER 211,WAUKEE,MUNICIPAL CODE, REGULATIONS GOVERNING MUNICIPAL WATER SYSTEM CONNECTIONS AND SERVICES, BY DECREASING THE FEE FOR PERMIT FROM $50.00 to $15.00. BE IT ORDAINED BY the Council of the City of Waukee: Section 1.Section 211.8 of Chapter 211 Waukee Municipal Code, regulations governing municipal water system connections and services, by deleting in the third line thereof,"$50.00"and inserting in lieu thereof "$15.00"so that the ordinance is amended to read as follows: 211.8.Fee for Permit.Before any permit is issued the person who makes the application shall pay $15.00 to the City Clerk to cover the cost of issuing the permit and supervising,regulating and ispecting the work. Section 2.Effective date.This ordinance shall be in effect after its final passage,approval,and publication as required by law. Passed and approved by the Council the 12th day of June,1984. A tapping fee of water mains was discussed.If City employees tap the water mains,a fee of $50.00 plus material was decided on and the City Attorney was directed to draw up and Ordinance to this effect. Moved by Hinkson,seconded by Barrett,to give gas customers a 30 day notice of rate increase.Carried 5 to O. Councilman Rees introduced an Ordinance entitled"ORDINANCE #2042 - AN ORDINANCE TO AMEND CHAPTER 501,WAUKEE MUNICIPAL CODE,TRAFFIC - USE OF STREETS,AN ORDINANCE DELETING SECTION 501.23,WAUKEE MUNCIPAL CODE,AND INSERTING IN LIEU THEREOF AN ORDINANCE PROHIBITING THE DRIVING OF MOTOR VEHICLES ON SIDEWALKS AND OTHER MUNICIPALLY OWNED PROPERTY EXCEPT THAT PORTION OF STREETS IMPROVED FOR PUBLIC TRAVEL,ALLEYS,AND AREAS SPECIFICALLY DESIGNATED FOR PARKING,INCLUDING MUNICIPAL PARKING LOTS AND PROHIBITING THE DRIVING OR PARKING OF MOTOR VEHICLES UPON PRIVATE PROPERTY EXCEPT BY THE CONSENT OF THE OWNER THEREOF. Whereupon,the Mayor declared said Ordinance duly adopted and passed, and signed his approval to said Ordinance. 228 ORDINANCE NO.2042 AN ORDINANCE TO AMEND CHAPTER 501,WAUKEE,MUNICIPAL CODE, TRAFFIC -USE OF STREETS,AN ORDINANCE DELETING SECTION 501.23, WAUKEE MUNICIPAL CODE,AND INSERTING IN LIEW THEREOF AN ORDINANCE PROHIBITING THE DRIVING OF MOTOR VEHICLES ON SIDEWALKS AND OTHER MUNICIPALLY OWNED PROPERTY EXCEPT THAT PORTION OF STREETS IMPROVED FOR PUBLIC TRAVEL,ALLEYS,AND AREAS SPECIFICALLY DESIGNATED FOR PARKING,INCLUDING MUNICIPAL PARKING LOTS AND PROHIBITING THE DRIVING OR PARKING OF MOTOR VEHICLES UPON PRIVATE PROPERTY EXCEPT BY CONSENT OF THE OWNER THEREOF. BE IT ORDAINED by the Council of the City of Waukee: Section 1.Chapter 501.23,Waukee Municipal Code,is hereby deleted and there is-inserted in lieu thereof the following: 501.23 Vehicles Not To Be Driven on Sidewalks and other Munici- pally owned propoert and private property without consent of owner. No Driver of a motor vehicle shall drive a motor vehicle on sidewalks and other municipally owned property,except that portion of streets improved for public travel,alleys,and areas specifically designated for parking,including municipal parking lots;and no driver shall drive or park a motor vehicle on private property except by the consent of the owner thereof. Section 2.Effective Date.This ordinance shall be in effect after its final passage,approval,and publication as required by law. Passed by the Council the 12th day of June,1984,and approved this 12th day of June,1984. Applications for renewal of cigarette permits were received from Casey's Store,Golden Spur,Waukee Emporium,and Home Town Cafe. Moved by Barrett,seconded by Wilson,to approve the cigarette permits. Carried 5 to O. Roger Buffington of Snyder &Associates reported on the lagoon dredging project.Buffington was directed to devise a more detailed plan and firm up cost estimates.After a lengthy discussion,the engineer was authorized to get cost estimate on sludge pit and to submit standard specifications to the Iowa Dept.of Water,Air &Waste Management. (Mayor left at this point &Mayor Pro Tem took over the proceedings) Walt Hinkson reported on recommendations of Utilities Committee. They were as follows: 1.Cut delinquents to no more than 20 days after due date. 2.1.5%late charge. 3.No budget billing for those who are delinquent. 4.Increase in deposits. 5.Include PGA into rate schedule. A proposal was received from Public Power Services in the amount of $1000.00 to revise the tariff,make up an operation &maintenance manual,an emergency plan,damage prevention program._. Moved by Hinkson,seconded by Wilson,to approve the recommendations of the Utilities Committee after research by legal counsel and to hire Public Power Service for a maximum of $1000.00 to revise the tarrif.Carried 4 to 1 --Stork voting No.(Roll call vote.) Moved by Rees,seconded by Stork,to appoint Virginia Clark,Linda Mack and Sue Steele to the Waukee Library Board.Carried 5 to O. It was decided that Hannah Weil should work 2 extra hours per day during the summer months in the Library. The agreement with the Animal Rescue League was presented. Moved by Stork,seconded by Hinkson,to approve the agreement with the Animal Rescue League.A roll call vote was as follows: 229 AYES: NAYS: Wilson,Hinkson,Stork,Barrett. Rees. Motion carried 4 to 1. Merle Rees gave the Public Safety report. Brian Redshaw requested purchasing authorization for: 12 -5/8 X 3/4 water meters 4 -Rockwell 415 gas meters 6 -Rockwell 175 gas meters fittings for gas meters $496.20 $400.00 $300.00 $75.00 Moved by Hinkson seconded by Stork,to approve the above purchases. Carried 5 to O. Brian Redshaw gave the Administrator's report.He asked about mosquito spraying and the Council indicated no wish to do this at this point in time.He also reported on a Landfill meeting to be held June 14,his vacation,that proofs of City aerial photo had been received,and the problems with cell 2 of the lagoon and the wells. The Police department requested that a list of 2 or 3 qualified officers for fill-in be approved.No action was taken. Applications for part time temporary summer help was presented.The Council decided that the Clerk should use his discretion in this hiring. An extended discussion was held concerning the proposed aerial spraying for mosquito control. that the problem was serious. Moved by Stork,second by Barrett,to hire Campbell's Flying Service to do the aerial spraying for mosquito control at a cost of $1000.00.
