A roll call was taken and all Councilmen were present. Guests and staff at this meeting were: Thomas,Roger Buffington,Tom Darnold, Chedester,Larry Crane,Jerry Jackson, and Ann Ford. Margaret Drury,Present of the Waukee Library Board,addressed the Council,giving the library report for FY 83-84. Moved by Stork,second by Rees,to approve the Treasurer's report. Carried 5 to O. Bids were received for the 1984 Street Project.The bids were opened and read as follows: Des Moines Asphalt E &H (Commercial Asphalt) Grimes Asphalt $60,400.95 $60,526.08 $55,505 ..38 The 1984 Slurrycote project was discussed.Fort Dodge Asphalt had been contacted and would do the work for the same unit price as last year at the approximate cost of $9984.400 Moved by Rees,second by Wilson,to award the contract for the 1984 Slurrycote project in the amount of $9884.40 to Fort Dodge Asphalt. Carried 5 to O. A prposed contract with the school for tennis courts was presented. The Council discussed this contract at some length and took no action at this point in the agenda. The street light proposal for Waukee Estates Plat #1 was discussed.1 light was proposed for 8 lots.No action was taken. Roger Buffington explained about the lagoon dredging project.He presented plans and specifications for the sludge storage cell.Walt Hinkson is to contact earth movers for this project. A proposed Gas Service Tariff was presented.The Council agreed that the portion of the tariff dealing with City employees installing thermocouples be deleted.The City Attorney is to make necessary changes to the gas ordinance. RESOLUTION NO ...23 RESOLUTION ADOPTING GAS SERVICE TARIFF. WHEREAS,Section 476.4,Code of Iowa,requires public utilities to file with the Iowa State Commerce Commission a tariff showing the rules and regulations under which services are furnished;and WHEREAS the City Council has undertaken a complete revision of its current gas tariff; NOW,THEREFORE,BE IT RESOLVED: That there is hereby adopted,to be effective September 1,1984, GAS TARIFF NO.2 which shall supersede GAS TARIFF NO.1,currently on file with the Iowa State Commerce Commission; That the City Clerk/Administrator is hereby designated as the issuing official whose name shall appear on each sheet of GAS TARIFF NO.2,and future amendments thereto,which shall have been approved by the City Council; That the City Clerk/Administrator shall maintain an official copy of the Gas Tariff for public inspection. RESOLUTION NO.24 RESOLUTION ADOPTING CHARGES AND CONDITION FOR SPECIAL OR NONRECURRING GAS UTILITY SERVICES. WHEREAS,The City Council has revised the service tariff for Waukee Municipal Utilities;and, WHEREAS,the City Council has chosen to adopt certain rate related conditions and charges by resolution,rather than by direct incorporation into the service tariff; 236 JULY 10==cont NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Waukee: That the following charges and conditions for services described in the Gas Tariff sections noted below are adopted: 1)INTEREST ON CUSTOMER DEPOSITS --See Section 3.2 (4). No interest shall be paid on customer deposits. 2)CHARGES FOR CERTAIN SERVICE CALLS--See Section 3.3 (9). Service calls for shutting off or relighting pilot lights at the customer's request shall be made without charge. 3)CHARGES FOR CUSTOMER REQUESTED METER TESTS--See Sub- section 3.3 (10). A charge of $10 shall apply to customer requested meter tests,where the meter is found to be within the allowable tolerance.A charge of $20 shall apply to referee tests,where the meter is found to be within the allowable tolerance'. 4)CHARGE FOR RETURNED CHECKS--See Subsection 3.3 (13). A charge of ten dollars ($10.00)shall be assessed for a check returned unpaid by the bank on which it was drawn, 5)CHARGES FOR RECONNECTION OF SERVICE--See Sections 3.4). A charge of fifty dollars ($50.00)shall apply at the time of reconnection when disconnection has :resulted from an act or ommission on the part of the customer or from nonpayment of a bill or deposit. That charges adopted herein shall take effect on September 1, 1984. That customers shall receive notice of these charges by publication in the newspaper of record not later than August 1, 1984. That a copy of this resolution shall be maintained for public inspection as an attachment to the utility's service tariff. Passed and adopted this 10th day of July,1984. Larry Crane and Jerry Jackson of the Waukee School Board arrived at this point in the meeting to speak with the Council regarding the tennis court contract.A lengthy discussion was held on the usage of courts by the school and the general public. RESOLUTION NO.25 A RESOLUTION ON THE MATTER OF CONSTRUCTING THE TENNIS COURTS. WHEREAS,The City of Waukee will transfer $12,500.00 to the Waukee Community School District to be used for the construction of two color-coded,fenced but not lighted tennis courts,and WHEREAS,the approximate expenditure of funds will occur as follows: Court Construction $18,961.00 Color Coding and Marking $2,900.00 Fees $1,000.00 1,800.00 Fencing &Charges in excess of City &School funds $5,138.00 -6,138.00 City &School funds Earmarked for Lutheran Aid Funds City &School funds Recreation Fund money Goes directly to D.M. Fence Total Construction Cost $29,299.00 Balance of funds remaining after construction to stay with the Recreation Committee. 237 July lO---cont WHEREAS,The school district has agreed to assume the responsibility for maintaining the courts after construction,and WHEREAS,The school district would want it understood that they could reserve~s the courts during the school hours,8:30 a.m.to 3:30 p.m. for a fourt week period during the months of April and May for physical edu-ation class use.Advance notice would be given and attempts made to post the courts in advance of this intended use,and WHEREAS,there are currently no plans for fielding an interscholastic tennis team,but a joint meeting between the City of Waukee and the Waukee Community School Board will be held to discuss mutual usage should this become a reality,and WHEREAS,at the present time the district has no plans to light the courts with district funds,and WHEREAS,any funds remaining upon completion of the courts will remain with the Recreation Committee as a start toward lighting these two courts, NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Waukee: That the above mentioned recommendatiorebe accepted and that the City of Waukee enter into contract with the Waukee Community School district for the construction of tennis courts and that a transfer of funds in the amount of $12,500.00 be made to the School district. After a review of the 1984 Street Project bids,Roger Buffington gave his report. Moved by Barrett,second by Stork,to award the contract for the 1984 Street Project to Grimes Asphalt and authorize the Mayor and Clerk to sign the contract subject to review by the City Attorney.Carried 5 to O. Open Burning was briefly discussed and no action was taken. Moved by Wilson,second by Rees,to have the Clerk read "AN ORDINANCE TO AMEND CHAPTER 501,WAUKEE,MUNICIPAL CODE,T~FIC -USE OF STREETS, PROHIBITING LEFT TURNS EXCEPT AT DRIVEWAYS,ALLEYS AND STREETS IN THE CITY OF WAUKEE,IOWA"for the 2nd time.A roll call vote was held as follows: Ayes: Nays: Hinkson,Barrett,Wilson,Rees,Stork None recorded Motion carried 5 to O. The Clerk read the above Ordinance for its second time. Moved by Rees,second by Wilson,to have the Clerk read "AN ORDINANCE TO AMEND CHAPTER 501,WAUKEE,MUNICIPAL CODE,T~FIC -USE OF STREETS, AN ORDINANCE PROHIBITING U-TURNS ON WALNUT STREET BETWEEN THE WEST SIDDE OF AHSOWRTH DRIVE AND THE EAST SIDE OF SIXTH STREET;6TH STREET BETWEEN THE SOUTH SIDE OF LOCUST AND THE NORTH SIDE OF ASHWORTH;ASHWORTH BETWEEN THE WEST SIDE OF 6TH STREET AND THE EAST SIDE OF 5TH STREET IN THE CITY OF WAUKEE,IOWA".A roll call vote was held as follows: Ayes: Nays: Stork,Rees,Wilson,Barrett,Hinkson None recorded Motion carried 5 to O. The Clerk read the above Ordinance for the second time. 238 July lO--cont No action was taken on renumbering the Ordinances at this time. Walt Hinkson gave the Utilities report.A discussion of putting a voltage strip chart on Well #2 now and Well #1 after it is repaired was held. Moved by Wilson,second by Rees,to put a voltage strip chart on both wells.Carried 5 to O. Merle Rees gave the Public Safety report. requirement was questioned.Brian Redshaw lished residence within the City limits at Rick Harney's residency reported that he had estab- 85 Bel-Aire Drive. The Mayor's report was given.He commended the Fire Department and the First Responders for the July 4th celebration. Merle Rees reported on the water problem on Kaylin Drive. Brian Redshaw gave the Administrator's report.He reported on the summer recreation program.A request was made for dome garbage can lids at an approximate cost of $36.00 each.The Council authorized the purchase of 6 of these lids.He also reported that Campbell Flying Service will also spray the trailer court for mosquitos at a charge of $150.00 more.The Council gave their approval for spraying the trailer court. The proposed dog runs at the police station was questioned.The main- tenance crew is to get started on it. August 7,1984 A special meeting of the Waukee City Council was held on August 7,1984 and was called to order at 7:32 p.m.by Mayor Gordon Christianson. A roll call was held and all Councilmen were present. Guests and staff at this meeting were:Lee Felt,Brian Redshaw,Roger Buffington,Paul Huscher,Don Henson,and Ann Ford. Lee Felt spoke to the Council regarding his garden spot on City property which will be destroyed due to the excavation work that will be done on the lagoon dredging project.He advised the Council of the plants, vegetables,and time he would lose as a result of this and gave an estimate of his loss at $660.00.Paul Huscher addressed the Council regarding his matter. Moved by Hinkson,second by Stork,to offer $300.00 to Lee Felt for damage to his garden.Carried 5 to O.Mr Felt accepted this offer. Walt Hinkson reported on meetings with earth movers and the following bids were submitted: Richards and Sons Steve Correll $25,000.00 $24,260.00 Moved by Stork,second by Hinkson,to in the amount of $24,260.00 for £lilf-rr-/ Carried 5 to O. accept the bid from Steve Correll moving for the sludge storage pit, The lagoon dredging project contract award was deferred until the August 14 meeting. The numbering of proposed homes in Glenview Manor was discussed.
