A roll call was held and all Councilmen were present. Guests and staff at the meeting were:Frank Hoifeldt,Brian Redshaw, Don Henson,Paul Huscher,Dennis Snyder,James Ash,Darrell Crane, Jack Inman,Bill Inman,Joe Smith of Water Products Co.,Nick Gruber, Bob Applegate,Dick Applegate,Ben Phillips,Ken Hopper,Jim Berner, Mark Casey,Wayne McKinney,Ann Ford,Mark Miller,Craig Nelson,Bob Christianson,Don Dowling of Temple Construction,Steve Hawbaker, and Larry Phillips. A correction was made to the June 11 minutes to change the price of the John Deere mower from $7000.00 to $6450.00.Move.d by Gruber, second by Barrett,to approve the minutes of June 11 as corrected. Carried 5 to O. James Ash spoke to the Council regarding a proposed heliport in the Industrial Park.The area in question is zoned M-l and no mention is made of airports or heliports ...Mr.Ash requested that the Council include heliports in the M-l zoning district. Moved by Hinkson,second by Rees,to set July 26 at 7:30 p.m.as a hearing date for an amendment.to the zoning ordinance to add 'heliports' to the M-l zoning.Carried 5 to O. Bob Applegate,Fire Chief,spoke to the Council regarding the purchase of 100 watt radios from Decatur County at a cost of $700.00 each installed.The fire department would like to purchase 4 of these radios.The Council had no problems with the fire department purchas- ing these radios. Jack and Bill Inman requested final plat approval for Mary Ann Estates Plat 2.Paul Huscher advised the Council of responsibility of main- tenance,possible claim for indemnification by KCC and partial release of mortgage on property on which streets and easements lie.Mr. Inman advised that these documents,partial release of mortgage and abstract,will be delievered by July 10 •. Moved by Hinkson,second by Barrett,to approve Resolution No.36 RESOLUTION NO.36 RESOLUTION ACCEPTING MARY ANN ESTATES PLAT (2),A SUBDIVISION OF THE CITY OF WAUKEE,DALLAS COUNTY, ImJA. WHEREAS,Woodwright Construction Company has presented a final Plat (2)to Waukee Planning and Zoning Commission and the Waukee Planning and Zoning Commission has approved this Plat (2)on June 24,1985 and ,VHEREAS,the City of Waukee,at a regular council meeting on July 9,1985,approved final Plat (2),Mary Ann Estates,Waukee,Iowa, Dallas County. None were received.Councilman Stork requested a shrubbery fence be put between the rear of Christianson's property and the Co-op property. Councilman Barrett introduced an Ordinance entitled:"Ordinance No. 2050--AN ORDINANCE AMENDING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY LIMITS OF WAUKEE,IOWA,FROM C-2 (CENTRAL BUSINESS DISTRICT) TO R-4 (ROW DWELLING AND CONDOMINIUM DWELLING DISTRICT)AND PROVIDING FOR THE AMENDMENT OF THE OFFICIAL ZONING MAP AND THE REPUBLICATION OF SAID MAP TO REFLECT SAID ZONING CHANGE". ORDINANCE NO.2050 AN ORDINANCE AMENDING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY LIMITS OF WAUKEE,IOWA,FROM C-2 (CENTRAL BUSINESS DISTRICT) TO R-4 (ROW DWELLING AND CONDOMINIUM DWELLING DISTRICT)~TD PROVIDING FOR THE AMENDMENT OF THE OFFICIAL ZONING MAP AND THE REPUBLICATION OF SAID MAP TO REFLECT SAID ZONING CHANGE. BE IT ORDAINED by the Council of the City of Waukee: Section1.Property Rezoned. Section 3.Effective Date.This ordinance shall be in effect after its final passage,approval,and publication as required by law. A hearing was held as published in the Dallas County News to change bulk regulations from 30,000 to 20,000 sq.ft.in the R-4 zone.The Mayor asked for any questions or comments.None were received. Councilman Barrett introduced an Ordinance entitled:"Ordinance No. 205l--AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE,MUNICIPAL CODE, ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY CHANGING THE LOT AREA FOR A CONDOMINIUM DWELLING FROM 30,000 TO 20,000 SQUARE FEET". BE IT ORDAINED by the Council of the City of W~lkee: Section 1.Section 301.13C(1)of Chapter 301 Waukee Municipal Code,Zoning Ordinance of the City,is hereby amended by deleting the figure °30,000 square feet'and adding the words "20,000 square feet,'and shall read as follows: 30l.l3C(1)Lot Area:Row Dwellings -Lot area 15,000 square feet. Council member Gruber introduced a resolution entitled:"Resolution providing for the issuance of $50,000 General Obligation Water Bonds and providing for the levy of taxes to pay the same." Council member Gruber moved that said resolution be adopted, seconded by Council Member Hinkson.Whereupon,the Mayor put the question on the motion and the roll being called,the following named Council Members voted: Ayes: Nays: Gruber,Hinkson,Barrett,Rees,Stork None recorded Whereupon,the Mayor declared said resolution duly passed and adopted and signed approval thereto. RESOLTION NO.37 Providing for the issuance of $50,000 General Obligation Water Bonds and providing for the levy of taxes to pay the same 'l-JHEREAS,the City of Waukee,Iowa (the "City)has heretofore proposed to contract indebtedness and issue $50,000 General Obligation Water Bonds to provide funds to pay the cost,to that extent,of the construction,reconstruction,improvement,extension and equipping of the Municipal Watenvorks System of the City (hereinfafter referred to as the "Project")and has published notice of the proposed action and held a hearing thereon,and thereafter determined to take addition action for the issuance of such bonds; NOW,THEREFORE,Be It Resolved by the City Council of the City of Waukee,Iowa,as follows: Section 1.That pursuant to Division III of Chapter 384 of the Code of Iowa,there are hereby authorized to be issued $50,000 negotiable General Obligation Water Bonds (the "Bonds"),in the denomination of $5,000 each,or any integral multiple thereof,to be dated the first day of June,1985.The Bonds shall become due and -- payable on June 1 in each of the respective years and in the principal amounts and bear interest at the respective rates as follows: Year of Interest Rate Amount Maturity Fer Annum $10,000 $10,000 $10,000 $10,000 $10,000 1987 1988 1989 1990 1991 6.40/', 6.75/', 7% 7.20% 7.40% July 9,1985---cont The City Clerk is hereby designated as the Bond Registrar and Paying Agent for the Bonds and may be hereinafter referred to as the "Bond Registrar"and the "Paying Agent". All of the interest on the Bonds shall be payable December 1, 1985,and semiannually thereafter on the first day of June and December in each year.The Bonds shall be executed on behalf of the City with the official manual or facsimile signature of the Mayor and attested by the official manual or facsimile signature of the City Clerk and shall have the City's seal impressed or printed thereon,and shall be fully registered bonds without interest coupons.In case any officer whose signature or the facsimile of whos e signature shall appear on the Bonds shall cease to be such officer before the delivery of such Bonds,such signature or such facsimile signature shall nevertheless be valid and sufficient for all purposes,the same as if he or she had remained in office until delivery.Principal of the Bonds shall be payable in lawful money of the United States of America to the registered owner or legal representative upon presentation and surrender of the Bond or Bonds at the office of the Paying Agent.Payment of interest on the Bonds shall be made to the registered owner appearing on the bond registration books of the City at the close of business on the fifteenth day of the month next preceding the interest payment date and shall be paid by check or draft mailed to the registered owner at the address shown on such registration books. The Bonds shall be fully registered as to principal and interest in the name of the owner on the registration books of the City kept by the Bond Registrar,and after such registration,payment of the principal and interest thereof shall be made only to the registered owner,his legal representatives or assigns.The Bonds shall be tranferable without cost to the registered owner thereof only upon the registration books of the City upon presentation to the Bond Registrar, together with either a written instrument of transfer satisfactory to the Bond Registrar duly executed by the registered owner or his duly authorized attorney or the assignment form thereon completed and duly executed by the registered owner or his duly authorized attorney.The record and identity of the owners of the Bonds shall be kept confidential as provided by Section 68A.7 of the Code of Iowa_ The Bonds shall not be valid or become obligatory for any purpose until the certificate of authentication thereon shall have been signed by the Bond Registrar. Section 2.That the form of Bonds shall be substantially as follows: (Form of Bond) UNITED STATES OF AMERICA STATE OF IOWA COUNTY OF DALLAS GENERAL CITY OF WAUKEE OBLIGATION WATER BOND No._$------ RATE MATURITY BOND DATE June 1,1985 The City of Waukee,in the County of Dallas,State of Iowa,for value received,promises to pay on the maturity date of this bond to or registered assigns,the principal sum of THOUSAND DOLLARS in lawful money of the United States of America upon presentation and surrender of this bond at the office of the City Clerk,Waukee,Iowa (hereinafter referred to as the "Bond Registrar"or the "Paying Agent") with interest of said sum,until paid,at the rate per annum specified above from the date of this bond,or from the most recent interest payment date on which interest has been paid,on June 1 and December 1 of each year,commencing December 1,1985.Interest on this bond is 298 July 9,1985---cont payable to the registered owner appearing on the bond registration books of the City at the close of business on the fifteenth day of the month preceding the interest payment date,and shall be paid by check or draft mailed to the registered owner at the address shown on such registration books. This bond shall not be valid or become obligatory for any purpose until the certificate of authentication hereon shall have been signed by the Bond Registrar. This bond is one of a duly authorized series of bonds issued by the City of Waukee,pursuant to and in strict compliance with the provision of Division III of Chapter 384 and Chapter 76 of the Code of Iowa,1985,and all laws amendatory thereof and supplementary thereto, and in conformity with a resolution of the City Council of the City duly passed,approved and recprded for the purpose of defraying the cost of the construction,reconstruction,improvement,extension and equipping of the 11unicipal Waterworks System of the City. This bond is fully negotiable but shall be fully registered as to both principal and interest in the name of the owner on the booka.vof the City in the office of the Bond Registrar,after which no transfer shall be valid unless made on said books and then only upon presentation of this bond to the Bond Registrar,together with either a written instrument of transfer satisfactory to the Bond Registrar,duly executed by the registered owner or his duly authorized attorney,or the assignment form hereon completed and duly executed by the register- ed owner or his duly authorized attorney. The City,the Bond Registrar and the Paying Agent may deem and treat the registered owner hereof as the absolute owner for the purposes of receiving pyament of or on account of principal hereof, premium,if any,and interest due hereon and for all other purposes, and the Ciyt,the Bond Registrar,and the Paying Agent shall not be affected by notice to the contrary. And It is Hereby Certified and Recited that all acts,conditions, and things required by the laws and Constitution of the State of Iowa, to exist,to be had,to be done or to be performed precedent to and in the issue of this bond were and have been properly existent,had,done aad performed in regular and due form and time;that provision has been made for the levy of a sufficient continuing annual tax on all the taxable property within the City for the payment of the principal of and interest on this bond as the same will repectively become due; that the faith,credit,revenues,and resources and all the real and personal property of the City are irrevocably pledged for the prompt payment hereof,both principal and interest;and that the total indebtedness of the City including this bond does not exceed any constitutional or statutory limitations. July 9,1985---cont '299 Section 4.That as required by Chapter 76 of the Code of Iowa, and for the purpose of prividing for the levy and collection of a direct annual tax sifficient to pay the interest on the Bonds as it falls due,and also to pay and discharge the principal thereof at maturity,there be and there is hereby ordered levied on all the taxable property in the City in each of the years while the Bonds or any of them are outstanding,a tax sufficient for that purpose,and in furtherance of this provision,but not in limitation thereof,there be and there is hereby levied on all the taxable property in the City the following direct annual tax for collection in each of the following fiscal years,to-wit: For collection is the fiscal year beginning July 1,1986, sufficient to produce the net annual sum of $16,950; For collection in the fiscal year beginning July 1,1987 sufficient to produce thecnet annual sum of $12,835; For collection in the fiscal year beginning July 1,1988, sufficient to produce the net annual sum of $12,160; For collection in the fiscal year beginning July 1,1989, sufficient to produce the net annual sum of $11,460; For collection in the fiscal year beginning July 1,1990, sufficient to produce rhe.-net annual sum of $10,740. Section 5.That a certified copy of this resolution shall be filed with the County Auditor of Dallas County,and said Auditor/sball be and is hereby instructed to enter for collection and assess the tax hereby authorized,When annually entering such taxes for collection, the County Auditor shall include the same as a part of the tax levy for debt service fund purposes of the City and when collected,the pro- ceeds of the taxes shall be converted into the debt service fund of the City and set aside therein as a special account to be used solely and only for the payment of the principal of and interest on the Bonds hereby authorized and for no other purpose whatsoever. Section 6,That the interest or principal and both of them falling due in any year or years shall,if necessary,be paid promptly from current funds on hand in advance of taxes levied and when the taxes shall have been collected,reimbursement shall be made to such current funds in the sum thus advanced. Section 7,That the principal proceeds of the sale of the Bonds shall be devoted to and used with due diligence for paying the costs of the Project referred to in the preamble hereof for which the Bonds are hereby authorized to be issued.The City Council represents and certifies and covenants with the purchasers and owners of the Bonds from time to time outstanding that,so long as any of the Bonds remain outstanding,moneys on deposit in any fund or account in connection with the Bonds,whether or not "such moneys were derived from the proceeds of the sale of the Bonds or fro~any other sources,will not be used in any manner that would cause the Bonds to be arbitrage bonds under Section 103(c)of the Internal Revenue Code of 1954,as amended,and that regulations prescribed under that section.The City has not been notified of any listing or proposed listing of it by the Internal Revenue Service as a bond issuer whose arbitrage certifications may not be relied upon, Section B. herewith be and conflict.- That all resolutions or parts thereof in conflict the same are hereby repeaied to the extent of such Passed and approved this 9th day of July,1985. A hearing was held on bids for the 1985 Water Main Project. asked for any objections to the plans and specifications for Water Main Project,None were received.
