Heeting adjourned. .~. 14,1986 The regular meeting of the Waukee City Council was called to order at 7:30 p.m.by Hayor Gordon Chri<1tian<1on.on January 14,1986. A roll call was held and the following Councilmen were present: Brown,Tovrea,Gruber,Hoifeldt and Stork. Larry Clayton questioned the wording of Chapter 202.2 of the Waukee Municipal Code and suggested that the wording be changed to reflect what happens to rates if Northern Natural Gas decreases its prices. He also questioned the tax abatement ordinance in reference to industrial businesses.He felt the luring of commercial business to Waukee wo u Ld be more viable. Cris Burger asked the Council to pass an ordinance to make Waukee a 'Nuclear Free Zone'.Paul Huscher was directed to draw un an ordinace to be presented at the next regular meeting. A lengthy discussion was held concerning the intersection of University and Ashworth where a fatal traffic accident occured on January 6,1986.Frank Hoifeldt reported on the Public Safety Committee's recommendation which is to install a stop sign with flashers on University for west bound traffic and control flashers "over the intersection with red for east-west traffic and yellow for north-south traffic.C01TIffientsand questions were heard from guests. The Council determined they want a 4 way stop with flashers,speed bumps,and a possibility of reducing the speed to 45 mph from the City limits. Moved by Gruber,second by Tovrea,to take the recommendation of the 4 way stop with flashers to the County Supervisors.Carried 5 to O. Janua~y 14,1986~~~cont ORDINANCE NO.2058 AN ORDINANCE TO AMEND CHAPTER 111,WAUKEE,MUNICIPAL CODE, FTNANCES AND RECORDS OF THE CITY. BE IT ORDAINED by the Council of the City of Waukee: Section 1.Section 111.7 of Chapter 111 Waukee Municipal Code,Finances and Records of the City is hereby amended by deleting 111.7 and substituting in lieu thereof the following: 111.7.Purchasing-orders.All purchases of services, supplies and equipment shall be made only after issuance of a purchase order,and no invoice shall be accepted unless authorized by such an order.Purchases not exceeding five hundred ($500.00)may be made by the Clerk or those officials authorized by the clerk,but only on issuance of a spot purchase order in writing signed by the authorized officer.A copy of such spot purchase order must be delivered to the clerk within twenty-four (24)hours,week- ends and holidays excepted.All other purchases shall be valid only if a purchase order has been given in writing and signed by the clerk. Purchases from petty cash and continuing pur- chases from vendors awarded extended contracts by bid award shall be excepted.' Section 2. effect after its required by law. Since the stormwater detention question was covered adequately by the Subdivision Regulations,the ordinance was dropped. Councilman Stork introduced an ordinance entitled:Ordinance No. 2059--"AN ORDINANCE TO REQUIRE THAT PERSONS RESPONSIBLE FOR THE STORING,HANDLING AND TRANSPORTATION OF HAZARDOUS MATERIALS SHALL AT THEIR OWN COST CLEAN UP ANY SPILLS OF THOSE MATERIALS AND PROVIDING RE11EDIES FOR THE CITY TO CLEAN UP SPILLS IF THE RESPON- SIBLE PARTY FAILS TO DO SO,AND TO RECOVER THE COSTS FOR THE CITY". ORDINANCE NO.2059 AN ORDINANCE TO REQUIRE TlIAT PERSONS RESPONSIBLE FOR THE STORING,HANDLING AI1D TRANSPORTATION OF HAZARDOUS MATERIALS SHALL AT THEIR Oi~COST CLEAN UP ANY SPILLS OF THOSE MATERIALS AND PROVIDING REMEDIES FOR THE CITY TO CLEAN UP SPILLS IF THE RESPONSIBLE PARTY FAILS TO DO SO,AND TO RECOVER THE COSTS FOR THE CITY. BE IT ORDAINED by the Council of the City of Waukee: Section L THERE SHALL BE ADDED TO THE i'JAUKEEMUNICIPAL CODE,CHAPTER 220 AS FOLLOWS: Section 2.The Waukee Municipal Code is amended by adding the following sections to read as follows: HAZARDOUS SUBSTANCES 220.1 Purpose.In order to reduce the danger to public health,safety and welfare from the spills of hazardous sub- stances these regulations are promulgated to establish respon- sibility for the removal and clean up of spills within the city limits. 220.2 Definitions.For the purpose.of this chapter,these works have the following'meanings: A.HAZARDOUS WASTE means those waste which are included by the definition in 455B.4ll,subsection 3,paragraph a,Code of Iowa,and the rules of the Iowa Department of Water,Air and Waste Management. B.HAZARDOUS SUBSTANCE MEANS ANY SUBSTANCE AS DEFINED in 455B.38l,subsection 1,Code of Iowa. C.HAZARDOUS CONDITION means the same as set out in 455B.38l,subsection 1,Code of Iowa. D.PERSONS HAVING CONTROL OVER HAZARDOUS SUBSTANCE means the same as set out in 455B.38l,subsection 8,Code of Iowa.And the term f1person"shall include "corporation,partnership,firm,association,coop- erative or governmental agency of any kind". E.CLEAN UP means the same as set out in 455B.38l,sub- section 6,Code of Iowa. F.TREATMENT means a method,technique,or process,inc- luding neutralization,designed to change the physical, chemical,or biological character or composition of a hazardous substance so as to neutralize it or to render the substance nonhazardous,safe for transport, amenable for recovery,amenable for storage,or to reduce it in volume.Treatment includes any activity or processing designed to change the physical form or chemical composition of hazardous substance to render it nonhazardous. January 14,1986---cont 220.3 Clean Up Required.Whenever a hazardous condition is created by the deposit,injection,dumping,spilling,leaking or placing of a hazardous waste or substance,so that the hazardous substance or waste or a constituent of the hazardous waste or sub- stance may enter the environment or be emitted into the air or discharge into any waters,including ground waters,the responsible person shall cause the condition to be remedied by a clean up,as defined in the proceding section,as rapidly as feasible to an acceptable,safe condition.The costs of clean up shall be borne by the pe r sonuhavd.ng control over a hazardous substance.If the person having cont xo l over a hazar-dous substance does not cause the clean up to begin in a reasonable time,in relation to the hazard and circumstances of the incident,the city may proceed to procure clean up services and bill the responsible person.If the bill for those services is not paid within thirty (30)days the city attorney shall proceed to obtain payment by all legal means. If the cost of the clean up is beyond the capacity of the city to finance it,the authorized officer shall report to the council and immediately seek any state or federal funds available for said clean up. 220.4.Notifications.The first city officer or employee who arrives at the scene of an incident involving hazardous sub- stances,if not a peace officer,shall notify the police department which shall notify the proper state office in the manner established by the state. 220.5.Severability.If any section,prov~s~on or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision or part thereof not adjudged invalid or unconstitutional. Section 3.Effective date.This ordinance shall be in effect after its final passage,approval,and publication as required by law. A letter was received from Bruce Seymour of the Brenton State Bank. It was the Council's consensus to continue in the present arrangement with semi-annual statements to be provided in addition to free check- ing account for the 2 major accounts. Insulation for the fire station was discussed.The Council will 44 January 14,1986---cont meet on Saturday morning at 9:00 a.m.,January 18 to go to the fire station and check this Gut.Don Henson will get prices on insulation. The FY 86-87 fire agreements were discussed.The Council directed the Clerk to reduce the budget by the price of the air bags and send agreements to the townships for 22¢per one thousand dollars of assessed valuation,to be returned by January 31,1986. Pi.roll 'call was taken and the following named Councilmen were present: Brown,Tovrea,Hoifeldt,Gruber,and Stork.Absent:None. The following guests and staff were also present: Roger Buffginton,Dennis Snyder ,Dick Applegate, Clark,Bob Barrett,Ron Olson and Harry Copeland. Moved by Tovrea,second by Br01I1Il,to approve an expenditure of $3050.00 for signage,rumble strips and overhead flashers at the intersection of Ashworth and University.Carried 5 to O. Moved by Stork,second by Hoifeldt,to approve the following ordinance changes and have the City Attorney present them at the regular February meeting:- 1.Stop sign at Ashworth Driver and University Ave. 2.35 mph zone on Ashworth Drive 3.45 mph zone on University Avenue 4.15 minutes restricted parking on 4th Street. 5.One way zone on Park Road 6.35 mph zone on gravel 7.No parking on East Street as per drawing.
