A roll call was held and all Councilmen were present. Guests and staff at this meeting were:Paul Long and Mike Borland of villO-TV,Dick Applegate,Ben Phillips,Howar-d and Vivian Wilson, Eugene Dluhos,Tim Bloomquist and Allison Gillman of KCCI-TV,Don Hneson,Chris Burger,Betty Huscher,Roger Buffington,Henry Krohn, Randy Krohn,Gary Sindelar of Kirkham,Michael &Assoc.,Dan and David Keller,Marc Stiles,Chet Chedester,Larry Clayton,Bob Barrett,Scott Thomas,Brian Redshaw,Paul Huscher,and Ann Ford. Moved by Stork,second by Gruber,to approve the January 14 and 29 minutes as corrected.Carried 5 to O. The Nuclear Free Zone Ordinance was briefly discussed. It was moved by Councilman Hoifeldt,and seconded by Councilman Tovrea that the Ordinance No.2060--AN ORDINANCE TO BE KNOWN AS THE NUCLEAR HEAPONS FREE WAUKEE ORDINANCE"be now read by the,City Clerk. The Mayor put the question on the motion,and the roll being called, the following named Councilmen voted:(SEE TEXT BELOW) Ayes: Nays: Brown,Tovrea,Gruber,Hoifeldt,Stork None recorded Whereupon,the Mayor declared the motion duly carried. It was moved by Councilman Stork,and seconded by Councilman Hoifeldt, that the Ordinance entitled:Ordinance No.2060 "AN ORDINANCE TO BE KNOHN AS THE NUCLEAR lVEAPONS FREE WAUKEE ORDINANCE'.'be now put upon its final passage and adoption.The Mayor put the question on the final passage and adoption of said Ordinance,and the roll bei ~ called,the following named Councilmen voted: Ayes: Nays: Hoifeldt,Stork Brown,Tovrea,Gruber Whereupon,the Mayor declared said Ordinance duly failed "AN ORDINANCE TO BE KNOWN AS THE NUC:E.EARlVEAPONS FREE WAUKEE ORDINANCE" BE IT ORDAINED by the Council of the City of Waukee: Section 1.THERE SHALL BE ADDED TO THE WAUKEE MUNICIPAL CODE, CHAPTER 221 AS FOLLOWS: Section 2.The Waukee Municipal Code is amended by adding the following sections to read as follows: 221.1 Purpose.The purpose of this prdinance is to establish Waukee as a nuclear weapons free zone in which work on nuclear weapons is pr-ohLb Lt.ed ,- The people of Waukee find that the presence of nuclear weapons facilities within Waukee is in direct conflict with the maintenance of the community's public health,safety morals,economic well-being, and general welfare. 48 February 11,1986--cont 221.2.Prohibition of Nuclear Weapons Work.No person shall knowingly engage in work,within Waukee,for the purpose of which is the development,production,deployment,launching,maintenance or storage of nuclear weapons or components of nuclear weapons. 221.3.Definitions. A.PERSON means a natural person,as well as a corporation, institution,or other entity. B.NUCLEAR WEAPON is any device,the purpose of which is used as a weapon,a weapon prototype or a weapon test 'device,the intended detonation of which results from the energy released by fission and/or fussion reactions involving atominc nuclei.For the purposes of this Ordinance,"nuclear weaponfl includes the weapon's guidance,transportation,propulsion,triggering,and detonation systems. c.COMPOtffiTOF A NUCLEAR WEAPON is any device,radioactive or non-radioactive,designed to be installed in and contribute to the operation of a nuclear weapon. 221.4.Notification •.Upon adoption of this ordinance,the City Council of Waukee shall officially notify Waukee's Congress- ional Representatives and Senators,the President of the United States and the recognized leaders of the Soviet Union,Great Britain, France,the People's Republic of China,India and any further nuclear weapons states of the contents of this initiative. In addition,the City Council of liJaukeeshall instruct the appropriate city officials to post signs on major entrances to Waukee stating "Nuclear Heapons Free Zone"in a manner that conform with the standards set forth in the Federal H'i.ghwayAdministration's Manual on Uniform Traffic Control Devices for States and Highways. 221.5.Enforcement.Each violation of this Ordinance shall be punishable by up to 30 days imprisonment and a $100.00 fine. Residents of Waukee shall also have the right to enforce this ordinance by appropriate private civil actions for declaratory or injunctive relief.Reasonable attorney fees shall be awarded to a prevailing plaintiff in such litigation. 221.60 Severability.If any section,prov~s~on or part of this ordinance shall be adjudged invalid or unconstitutional,such adjud- ication shall not affect the validity of the ordinance as a whole or any section,provision or part thereof not adjudged invalid or un- constitutional. Section 3. after its final law. This plat extends Northview through to 6th Street and reduces the size of lots.They requested preliminary plat approval.The Council questioned the affect of these additional homes to the sewer system and regarding assurance that Northview will be extended to 6th Street. Moved by Stork,second by Tovrea,to approve preliminary plats 1 and 2 subject to the submission of a letter from Krohn Construction regard- ing the Northview extension to 6th Street.Carried 5 toO. Moved by Gruber,second by Stork,to approve a Class C liquor license and Sunday sales for the Hometown Cafe and Lounge.Carried 5 to O. ORDINANCE NO.2060 AN ORDINANCE TO AMEND CHAPTER 501,WAUKEE,MUNICIPAL CODE,REGULA- TION OF TRAFFIC UPON THE USE OF THE STREETS OF WAUKEE,IOWA,BY ADDING AS STOP INTERSECTIONS ASID-JORTHDRIVE AT UNIVERSITY AVENUE AND UNIVERSITY AVENUE AT ASHWORTH DRIVE. BE IT ORDAINED by the Council of the City of Waukee: Section 1.Section 501.18 of Chapter 501 Waukee Municipal' Code,Regulation of Traffic upon the use of the Streets of Waukee, Iowa,is amended by adding in Schedule A,Through Streets and Stop Intersections,the following: University Avenue from the East City Limits to Ashworth Drive. Section 2.Section 501.18 of Chapter 501 Waukee Municipal Code,Regulation ..of Traffic upon the use of the Streets of Waukee, Iowa,is amended by adding as a stop intersection on Ashworth Drive,its intersection with University Avenue so that the second paragraph of Sche.duly A of said 501.18 will read as follows: Ashworth Drive,from U.S.Highway No.6 at the west City Limits to the east City Limits,except at 6th Street,Fourth Street,East Street and University Avenue Section 3. after its final law. Councilman Stork introduced an Ordinance entitled:Ordinance No. 206l--AN ORDINANCE TO AMEND CHAPTER 502,vJAUKEE,MUNICIPAL CODE, PARKING REGULATIONS OF MOTOR VEHICLES WITHIN THE CORPORATE LIMITS OF THE CITY OF WAUKEE,IOWA,BY ESTABLISHING 15 MINUTE PARKING ON PORTIONS OF THE WEST SIDE OF FOURTH STREET,NO PARKING ON PORTIONS OF EAST STREET AND PORTIONS OF UNIVERSITY AVENUE IN THE CITY OF WAUKEE,IOWA. February l~,1986---cont BE IT ORDAINED,by the Council of the City of Waukee: Section 1.Section 502.3 of Chapter 502 Waukee Municipal Code, Parking Regulations 6f Motor Vehicles within the corporate limits of the City of Waukee,Iowa,is amended by inserting subparagraph "A"as follows: A.No parking on East Street from the South line of Ashworth Drive to the north line of University Avenue extended. and further amended by relettering all subsequent paragraphs thereof. Section 2.Section 502.3 of Chapter 502 Waukee 11unicipal Code, is further amended by adding to renumbered subsection "B"thereof the following: (3)September through May,Monday through Friday, 8:00 A.M.to 4:00 P.M.,15 minute parking shall be allowed on the west side of Fourth Street from a point 61 feet south of the south line of Locust Street to a point 150 feet south of the south line of Locust Street;and 15 minute parking shall be allowed on the west side of Fourth Street from a point 399 feet south of the south line of Locust Street to a point 454 feet south of the south line of Locust Street. Section 3.Section 502.4 of Chapter 502 Waukee Municipal Code is further amended by adding subparagraph "0"thereof to read as follows: O.No parking on the.south side of University Avenue between the east line of East Street and the west line of Ashworth Drive. Section 4.Effective Date.This ordinance shall be in effect after its final passage,approval and publication as required by law. The FY 86-87 fire agreements were discussed.Van Meter has given no response at this time and Walnut Township wrote a letter stating that 20¢would be the figure that they want.It was the Council's consensus to stay with the 22¢.A letter is to be sent to the townships regarding this intent and the deadline for response to be February 28,1986. A discussion was held on the FY 86-87 budget. There was no Public Safety report. Joe Stork gave a brief Utilities report,stating that they will meet on February 19 to discuss water and sewer rates.- Brian Redshaw gave the Administrator's report. March 3,1986 A special meeting of the Waukee City Council was called to order at 7:30 p.m.by Mayor pro tem,LukeJ.Gruber.Brian J Redshaw was present and taking minutes. A roll call was taken and the following present:Brown,Gruber,and Hoifeldt. and Mayor Gordon Christianson. named Councilmen were Absent:Tovrea,Stork This purpose of this meeting was to review the proposed FY 86-87 budget and set a date for public hearing. Mo ve d by Hoifeldt,second by Brmm,to set l1arch 11,1986 at 7:30 p.m. as the hearing date for the proposed FY 86-87 budget and for a hearing on FY 86-87 Federal Revenue Sharing expenditures.The City .clerk is hereby authorized to publish the notice of hearing in the Dallas County News for a budget in the amount of $1,371,816.
