RESOLUTION 19-448
APPROVING AGREEMENT AND EASEMENTS RELATED TO THE NW LOTH STREET
IMPROVEMENT PROJECT, WEST HICKMAN ROAD TO NW DOUGLAS PARKWAY
[RICHARD L. PETERSEN REVOCABLE TRUST AND CLAIRE B. PETERSEN
REVOCABLE TRUST]
IN THE NAME AND BY THE A UTHORITY OF THE CITY OF WA UKEE, IOWA
WHEREAS, the City of Waukee, Dallas County, State of Iowa, is a duly organized Municipal
Organization; AND,
WHEREAS, the City has been in discussion with specific property owners regarding the conveyance of
certain property interests necessary for construction of the NW 10`" Street Improvement Project, West
Hickman Road to NW Douglas Parkway; AND
WHEREAS, the discussions have resulted in an agreement and easements that City Staff believes are in
the best interest of the City to approve.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Waukee, Iowa, that the
Agreement, Trustee Warranty Deed, Individual Trustee's Affidavits, Public Sanitary Sewer Easement,
Public Facilities and Use Easement and Temporary Construction Easement by and between the City of
Waukee, Richard L. Petersen Revocable Trust and Claire B. Petersen Revocable Trust is hereby
approved.
BE IT FURTHER RESOLVED that the Mayor is authorized to execute any and all documents to
effectuate the closing on behalf of the City, and that the City Clerk shall cause the originals to be
recorded upon the properties by submitting the original to the Dallas County Recorder with the
appropriate recording fees.
Passed by the City Council of the City of Waukee, Iowa, and appr ved this the 9`' day of
December, 2019.
