August 12,1986 The regular meeting of the Ivaukee City Council was called to order at 7:40 p.m.by Mayor Gordon Christianson. A roll call was taken and all Councilmen were present. The July 8 minutes were corrected to read, "South Dallas County Landfill---$2382.64" "26,438.15". in the bill presentation, Total bill presentation ··~~C. Moved by Stork,second by Gruber,to approve minutes,as corrected,of July 8 and 29.Carried 5 toO. Mayor Christianson asked the garbage haulers that were present to present proposals for city-wide hauling.Questions were fielded. Moved by Gruber,to ask the City Attorney to draft specifications for city-wide hauling by 1 hauler,.second by Br own ,Motion failed 1 to 4-- Gruber voting Yes.."" Individuals haulers will continue:to.haul garbage as in the past. The proposed parking restrictions of Northview was discussed at length. Tom Tovrea and other residents;living on Northview,gave reasons why there should not be parking restriction on both sides of Northview.Bob Barrett presented a petition from residents living on Northview opposing the parking restrictions.The petition was received and filed.No other aiscussion was held. Randy Foster addressed the Council regarding a proposed bike trail along the railroad tracks that may possibly be abandoned.Mark Ackelson also talked'to the Council about the proposed project.Gary Scott of the West Des Moines Park Commission talked regarding West Des Moines'plans to support acquisition of the railroad land for a bike traiL It was the Council's consensus,at this time,that they would be interested in getting more information regarding the bike trail. Bonnie Palmer,presirlent of the Library Board,presented the annual report.She also asked the a Library Administrator for 5 to 10 hours per week.The Council advised them that they needed more information on this before approval.She also introduced the Library Board members. Moved by Gruber,second by Tovrea,to approve the appointment of Donna Haxton and Wendy Hansen-Wagner to the Library Board for 3 year terms. Carried 5 to O. 78-August 12,'1986---cont Jim McKinney,representing Norman Hammen,talked to the Council regarding the purchase of land adjacent to Mr Hammen's property at 505-4th St.The Council wanted to do more research on this be- fore they consented to sell the property.This items will be put on the agenda for a special meeting on August 21.Brian Redshaw is to check and see if utilities go down the alley in question. Moved by Hoifeldt,second by Tovrea,to approve the Treasurer's report as presented.Carried 5 toO. The hearing on the proposed Public Site and Open Spaces ordinance could not be held until September 9 due to the time frame of publication. Hearings on other proposed amendments to the zoning ordinance will be held at that time as well. Moved by Brown,second by Hoifeldt,to set the hearing date for proposed ordinance amendments for September 9,1986 at 7:30 p.m.'Carried 5 to O. The hearing was held on the Communication Tower ordinance.The Mayor asked for questions or comments.John Winkler addressed the Council about what constitutes a tower,height limits and number of towers for each property.LeRoy Jessen and Bill Hays also spoke. Councilman Stork introduced an Ordinance entitled:"AN ORDINANCE GOVERN- ING THE CONSTRUCTION AND MAINTENANCE OF CO}fr1UNICATION TOWERS IN THE CITY OF WAUKEE,IOWA". It was moved by Councilman Hoifeldt,and seconded by Councilman Stork, that the Ordinance entitled:"AN ORDINANCE GOVERNING THE CONSTRUCTION AND MAINTENANCE OF COl1J'1UNICATIONSTOHERS IN THE CITY OF 1;ifAillZEE,IOWA" be now read by the City Clerk.The Mayor put the question on the motion, and the roll being called,the following named Councilmen voted: Ayes: Nays: Brown,tovrea,Gruber,Hoifeldt,Stork None recorded Whereupon,the Mayor declared the motion duly carried. The Clerk read the proposed ordinance for the first time as follows: AN ORDINANCE GOVERNING THE CONSTRUCTION AND MAINTENANCE OF COl1MUNICATION TOWERS IN THE CITY OF WAillZEE,IOHA. BE IT ORDAINED by the Council of the City 0 Maukee: Section 1.THERE SHALL BE ADDED TO THE WAUKEE MUNICIPAL CODE, CHAPTER 221 AS FOLLOWS: 221.1 Communication Towers.Communication Towers constructed in the City of Haukee,Iowa,shall meeting all of the requirements: a.Maximum tower height to be 65 feet from tip to ground level with an additional 5 feet for mast and antenna.Antenna and mast on the tower must conform to sound engineering practices.Guy wires.are to be installed per manufacturer's recommendations on applicable models. b.Guy wire supports and anchors are to be located one foot inside property boundaries or utility easement,and of design to conform to current methods recommended by manufacturer's specifications or other applicable requirements. c.An anti-climbing apparatus is to be installed to prevent unauthorized ascension on all communication towers except All Bank Vertical Antennas. d.Tower to be the height plus five feet angular distance from base to overhead lines or permanent neighboring domicile.Excep- tion:Towers with guy wires that are rated for collapsible distance, the collapsible distance plus five feet may be used. 80 August 12,1986---cont e.If the tower is located near a recreation area,shelter buildings will be consider as permanent domiciles. f.Each location is permitted one tower over 14 feet only. g.All towers shall be erected or maintained to the rear of the main building,except in those instances when the subject prop- erty is a cul-de-sac or corner lot where the side yard is larger than the rear yard in which case a permit may be requested for a side yard tower location, h.The tower is to be grounded per manufacturer's recommendations. i.All towers shall be constructed in compliance with the Uniform Building Code as amended. j.The certificate of a structural engineer shall be obtained and furnished to the City of Waukee,Iowa,by the person constr.ucsing a communication tower or the owner of the property on which the tower is located,showing compliance with this ordinance. 201.2.Penalty,Any person,firm or corporation violating any provisions of this ordinance shall be guilty of a simple misdem- eanor and upon conviction thereof shall be punished by a fine not ex- ceeding one hundred dollars ($100.00),.or imprisonment not exceeding thirty (30)days.Each day upon which such violation occurs after notice shall constitute a separate violation. 201.3.Severability.If any section,provlslon or part of this ordinance shall be adjudged invalud or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision or part thereof not adjudged invalid or unconstitutional • .Section 2,:,··Eff-ective-Date,This ordinance shall be in effect after its final passage,approval and publication as required by law. Frank Hoifeldt reported on the Personnel Committee's recommendations for employee benefits.After a lengthy discussion,this item was rescheduled for the September 9 meeting, Moved by Gruber,second by Tovrea,to award contract for FY 85-86 Street project to Grimes Asphalt and authorize the Mayor and Clerk to enter into the contract.Carried 5 toO. A gas rate decrease was discussed.The Utilities Committee is rec- ommending this decrease.After discussion,the Council rescheduled this item until the September 9 meeting. Sewer credits were discussed. Moved by Stork,second by Brown,to extend sewer 'cr edf't s ,as in the past,to people filling swimming pools once!each year.Carried 3 to 2--Gruber and Hoifeldt voting No. Roger Buffington gave an update on the water and sewer plans of action. Frank Hoifeldt gave the Public Safety report.He reported that Ken Hopper had given a written resignation effective September 1. Jerry Brown gave the Parks Committee report.
