August 28,1986
A special meeting of the Waukee City Council was called to order
on August 28,1986 at 7:05 p.m.by Mayor Gordon Christianson.
A roll call was taken and all Councilmen ;;,erepresent except
Tovrea.
Guests and staff present were:Terry Jilek,Roger Anderson,Leigh
David,Merle Rees,Dick Applegate,Dave Reed and Brian Redshaw.
Tovrea arrived at 7:18 p.m.
Moved by Brown,second by Gruber,to hire a 3r~-full-time maint-
aintence employee at a rate of $7.00 per hour with an effective
date of 10-1-86.The applications will be due by September 22
and the current pa~t-time position will be eliminated on September
30.Carried 5 to O.
Stand-by compensation was discussed by theCity Council.It was
agreed that the police department will be responsible "for gas
emergencies after being properly trained ;;dthin the next 2 weeks.
The Council agreed to discuss stand-by time for the police depart-
ment after receiving information on the number of hours involved
during the past year.They also discussed allowing comp time
in lieu of pay at the discretion of the police chief.

at 7:30 p.m.by lfayor pro tern Luke Gruber on September 9,1986.

Virginia Clark,representing the Library Board,spoke to the Council
regarding the position of Library Director.She requested 15 hours
per week at $6.00 per hour.

hearing in the amount of $2500.00 to provide for the
Library Director for September 30,1986 at 7:00 p.m.

Steve Spencer reported on the progress of the new shelterhouse.
The Council presented a certificate of appreciation to Mr.Spencer
for his work done on the project.Mr.Spencer commended Ted Torst-
enson,Crees Construction and Union Electrical Workers for their
volunteer work on the shelter house.
Doug Hammen represented Norman Hammen and discussed with the Council
the proposed sale of property adjacent to 505-4th St.No action was
taken.

SION ORDINANCE OF THE CITY OF WAUKEE,ImJA,BY PROVIDING FOR PUBLIC
SITE AND OPEN SPACES IN THE CITY OF WAUKEE,IOWA.
BE IT ORDAINED by the Council of the City of Haukee:
Section I,There shall be inserted as Article XI Sections
303.183,303.184,the following,and Sections XVI shall be renumbered
consecutively following said insertion:
ARTICLE XI
PUBLIC SITE AND OPEN SPACES
303.183 Purpose.This ordinance is enacted to insure that
land is properly located and preserved for use by the public for
park and recreational purposes in accordance with future community
growth;and to further insure that the cost of providing the park

and recreational sites and facilities necessary to serve the
additional residents brought into the community through sub-
division development may be most equitably apportioned on the
basis of the additional public requirements created by such
subdivision development.
303.184.Park Site Dedication,Re.servation or payment In-
Lieu-Of Dedication.As a condition of approval of a final plat
of subdivision or a site plat,each subdivider or developer shall
be required to dedicate land without cost to the City for park
and recreational purposes to serve the immediate and future needs
of the neighborhood,in accorqance with the fo~lowing criteria:
A.Park,Recreation Areas,and Open Space Dedication.In
the design of the SUBIDIVISON PLAT OR PLANNED UNIT DEVELOPMENT
(PUD).,dedication of land for parks and recreation areas shall be
required by the Planning and Zoning Commission and the City Council
of all subdivisions where sites are recommended by the Comprehensive
Plat or other governmental agency plans.
B.Dedication of Land for Park,Recreation Areas,,and Open
Space.The amount of larid or money required to be dedicated by
a subdivider pursuant to this Article shall be based on the net
area included in the subdivision (net area being all land includ-
ing streets,right-of-way,and public or private easements),det-
ermined by the following formula for all subdivisions larger than
five acres.The City and subdivider shall agree whether that ded-

agreed upon the location (If the land to be dedicated.If the City
and subdivider do not agree on location the two parties shall
appoint three appraisers to reach a consensus on the location.
The City shall appoint one appraiser,the subdivider shall appoint
one appraiser,and the third appraiser shall be chosen by "lot"
from a list of appraisers in the area.The decision of the apprais-
ers shall be binding on all parties.Costs of appraisers would be
equally divided between the City and the subdivider.
C.Payments in Lieu of Dedication.Where dedication is not
feasible or recommended by the Comprehensive Plat or other govern-
mental agency plans as determinted by the Planning and Zoning Comm-
ission arid City Council,the subdivider shal,in lieu of dedication,
pay to the City a fee equivalent to the value of the land required
for dedication.Such fee shall be based upon the land value in a
subdivided state.If the City and subdivider do not agree on price
of land,the two parties shall appoint three appraisers to reach
a consensus of the price of land.The City shall appoint one
appraiser,the subdivider shall appoint one appraiser,and the
third appraiser shall be chosen by "lot"from a list of MAU apprais-
ers in the area.The dicision of the appraisers shall be binding
on all parties.Costs for appraisers would be equally divided
between the City arid the subdivider.All funds received in lieu
'of land dedications shall be put in a trust fund to be used for
park development and recreation programs.
D.Payment Due on Subdivision of Five Acres or Less.On all
subdivisions five (5)acres or less in size,no dedication of land
shall be required.A fee rate of Four Hundred Dollars ($400.00)
per acre shall be assessed.On parts of an acre,the Four Hundred
Dollar ($400.00)fee shall be assessed in direct propostion to
percentage of,the partial acre.
E.Park Land Dedication Requirement.The amount of park
land dedication shall be dtermined by the following formula:

F.Major Thoroughfare Dedication.In the case of a major
thoroughfare lying within a proposed a proposed subdivision,the
subdivider may dedicate additional right-of-way in lieu of land
required for parks,recreational areas,or open psace upon agree-
ment by the Planning and Zoning Commission and City Council.The
area of such dedication shall be determined by the same method
as described in 305.2e.
G.Payment of Fees.Payment of fees and/or dedication of
land shall be concurrent with the approval of the final plat.
Section 2.Effective Date.This ordinance shall be in
effect after its final passage,approval and "publication as
required by law.

ORDINANCE OF THE CITY OF HAUKEE,IOWA,BY AMENDING GENERAL REG-
ULATIONS,ACCESSORY BUILDINGS.
BE IT ORDAINED by the Council of the City of Haukee:
Section 1.Section 301.8 of Chapter 301 Haukee Municipal
Code,Zoning Ordinance of the City,is hereby amended by deleting
the paragraph Accessory Buildings and inserting in"lieu thereof
the following:
301.8 Accessory Buildings.No accessory building shall be
erected in any front yard,Accessory buildings shall be distanc-
ed at least two (2)feet from alley lines or easement lines,and
two (2)feet from the lot lines of adjoinging lots which are in
any "R"district,and on a corner lot they shall conform to the
set-back regulations on the side street;however,in no case shall
any-eave or overhang extend closer than twelve (12)inches to a
rear or side yard lines,or an easement line.Accessory building
must be erected separately from and a minimum horizontal distance
of six (6)feet from any building projection,and may not be conn-
ected by a breezeway or similar structure.If any unenclosed
balcony or unenclosed porch including any deck shall be construct-
ed within six (6)feet from any accessory building the adjacent
wall of said accessory building shall be not less than "a two (2)
hour fire wall.No unenclosed balcony or unenclosed porch or deck
shall be constructed closer than three (3)feet to any accessory
building.Any building so connected to the principal building
shall be considered a part of the said principal building and must
meet the space requirements thereof.An accessory building shall
not occupy more than thirty (30)per cent of the rear yard and
shall not exceed fourteen (14)feet in height in any "R"district.
This regulation shall not be interpreted to prohibit the construct-
ton of a four hundred forty (440)square foot garage on a minimum
rear yard.
Section 2.Effective Date.This ordinance shall be in effect

Building,is hereby amended by inserting after the word "used"
in the second line,the words "with,or"and·shall read as follows:
301.3 ACCESSORY BUILDING.Any structure designed and used,
or interided to be used,with,or for one of the "Accessory Uses"
listed in each of the .zone d districts as set out in this Ordinance.

CODE,CHAPTER 221 AS FOLLOWS:
221.1 Communication Towers.Communication towers constr-
ucted in the City of Waukee,Iowa,shall meet all of the follow-
ing requirements:

a.Maximum tower height to be 65 feet from tip to
ground level with an additional 5 feet for mast and antenna.
Antenna and mast on the tower 'must conform to sound engineering
practices.Guy wires are to be installed per manufacturer's
recommendations on applicable models.
b.Guy wire supports and anchors are to be located
one foot inside property boundaries or utility easement,and
of design to conform to current methods recommended by manufac-
turer's specifications or other applicable requirements.
c.An anti~climbing apparatus is to be installed
to prevent unauthorized ascension on all communication towers
except All Band Vertical Antennas.
d.Tower height plus ,five feet shall 'not exceedarigular dist-
ance from base to overhead lines or permanent neighboring
domicile.Exception:Towers with guy wires that are rated for
collapsible distance,the collapsible distance plus five feet
may be used.
'e.If the tower is located near a recreation area,
shelter buildings will be considered as permanent domiciles.
f.Each location is permitted one tower over 14 feet
only.
g.All otwers shall be erected or maintained to the
rear of the main building,except in those instances when the
subject prope~ty is a cul-de-sac or corner lot where the side
yard 'is larger than the rear yard in which case a permit may
be requested for a side yard tower location.
h.The tower is to be grounded per manufacturer's
recommendations.
i.All towers shall be constructed in compliance
with the Uniform Building Code as amended.
j.The certificate of a structural engineer shall
be obtained and furnished to the City of Waukee,Iowa;by the
person constructing a a communication tower or the owner of
the property on which the tower is located,showing compliance
wi th this ordinance.
221.2 Penalty.Any person,firm or corporation violating any
provisions of this ordinance shall be guilty of a simple mis-
demeanor and upon conviction thereof shall be punished by a
fine not exceeding one hundred dollars ($100.00),or imprisonment
not exceeding thirty (30)days.Each day upon which such
violation occurs after notice shall constitute a separate
violation.
221.3 Severability.If any section,prov~s~on or part of this
ordinance shall be adjudged invalid or unconstitutional,such
adjudication shall not affect the validity of the ordinance as
a whole'or any section,provision or part thereof not adjudged
invalid or unconstitutional.
Section 2.Effective Date.This ordinance shall be in
effect after its final passage,approval and publication as re-
quired by law.

used.
Note:Employee will pay for water and sewer costs for all
usage greater than 3,000 gallons per month.Employee must live
within the city limits of Waukee to qualify for this benefit.
D.Stand-by time converted at a rate of 4-1 which would be
converted to salary or time-off (regular rate)at the discretion
of the employee's supervisor.
