The Mayor advised the Council that Farmer's Co-op has started using propane for their grain drying operation on Friday,October 3rd. Baer Ag Supply had indicated a concern about switching to pro- pane if the current cost differential continues and they install vaporizers for their grain dryer. Moved by Gruber,second by Stork,to establish a new grain drying rate for the months of October and November for commercial vendors. The rate is to be reviewed annually and set at such a level to provide for a 10%net profit ratio to be determined by the City Administrator.Carried 5 toO. ORDINANCE NO.2071 AN ORDINANCE GOVERNING THE CONSTRUCTION AND MAINTENANCE OF Cm1MUNICATION TGlVERS IN THE CITY OF iVAUKEE,IOHA. BE IT ORDAINED by the Council of the City of Waukee: Section 1.THERE SHALL BE ADDED TO THE HAUKEE MUNICIPAL CODE,CHAPTER 221 AS FOLLO\iTS: 221.1 Communication Towers.Communication towers const- ructed in the City of Waukee,Iowa,shall meet all of the following requirements: a.Maximum tower height to be 65 feet from tip to ground level with an additional 5 feet for mast and antenna.Antenna and mast on the tower must conform to sound engineering practices.Guy wires are to be installed per manufacturer's recommenda- tions on applicable models. b.Guy wire supports and anchors are to be located one foot inside property boundaries or utility easement,and of deisgn to conform to current methods recommended by manufacturer's specifica- tions or other applicable requirements. c.An anti-climbing apparatus is to be installed to prevent unauthorized ascension on all cnmmunication towers except All Band.Vertical Antennas. d.Tower heigh plus five feet shall not exceed angular distance from base to overhead lines or permanent neighboring domicile.Exception:Towers with guy wires that are rated for collapsible distance, the collapsible distance plus five feet may be used. e.If the tower is-located near a recreation area, shelter buildings will be considered as permanent domiciles. f.Each location is permitted one tower over 14 feet only. 106 October 14,1986---cont g.All towers shall be erected or maintained to the rear of the main building,except in those instances when then subject propoerty is a cul-de-sac or corner lot where the side yard is larger than the rear yard in which case a permit may be requested for a side yard t owe r location.- h.The tower is to be grounded per manufacturer's recommend"tions. i.All towers shall be constructed in compliance with the Uniform Building Code as amended. j.A certificate of insurance shall be obtained and furnished to the City of Waukee,Iowa,by the person constructing a communication tower or the owner of the property on which the tower is located,showing compliance with this ordinance with 5200,000 liability coverage and a notarized affidavit by the ovmer showing the the tmver was installed per manufacturer's spec- ifications. 221.2 Penalty.Any person,firm or corporation violat- ing any provisions of this ordinance shall be guilty of a simple misdemeanor and upon conviction thereof shall be punished by a fine not exceeding one hundred dollars .($100.00),or imprisonment not exceeding thirtv (30)days. Each day upon which such violation occurs after notice shall constitute a separate violation. 221.3 Severability.If any section,provision or part of this ordinance shall be adjudged invalid or unconsti- tutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Section 2.Effective Date.This ordinace shall be in effect after its final passage,approval and publication as required by law. BE IT ORDAINED by the Council of the City of Waukee: Section 1.There shall be inserted as Article XI Sections 303.183,303.184,the following,and Sections formerly included as Articles XI,XII,XIII,XIV,XV and XVI shall be renumbered consecutively following said insert ion: ARTICLE XI PUBLIC SITE AND OPEN SPACES §303.183 Purpose.This ordinance is enacted to insure that land is properly located and preserved for use by the public for park and recreational purposes in accor- dance with fULure community growth;and to further insure that the cost of providing the park and recreational sites and facilities necessary to serve the additional residents brought into the community through subdivision development may be most equitably apportioned on the basis of the additional public requirements created by such subdivision development. §303.184.Park Site Dedication,Reservation or payment In-Lieu-Of Dedication.As a condition of approval of a final plat of subdi vis ion or a site plat, each subdivider or developer shall be required to dedicate ,land without cost to the City for park and recreational purposes to serve the immediate and future needs of the neighborhood,in accordance with the following criteria: A.Park,Recreation Areas,and Open Space Dedication.In the design of the SUBDI- VISION PLAT OR PLANNED UNIT DEVELOPMENT (PUD),dedication of land for parks and recreation areas shall be required by the Planning and Zoning Commission and the City Council of all subdivisions where sites are recommended by the Comprehensive Plat or other governmental agency planso B.Dedication of Land for Park,Recreation Areas,and Open Space.The amoun t of land or money required to be dedicated by a 112 subdivider pursuant to this Article shall be based on the net area included in the sUbdivision (net area being all land inclu- ding streets,right-of-way,and public or private easements),determined by the following formula for all subdivisions lar- ger than five acres.The City and subdivi- der shall agree whether that dedication shall be land or money.The City and sub- divider shall agree upon the location of the land to be dedicated.If the City and subdivider do not agree on location the two part ies shall appoin t three appraisers to reach a consensus on the location.The City shall appoin tone appra iser,the sub- divider shall appoint one appraiser,and the third appraiser shall be chosen by "lot" from a list of appraisers in the area.The decision of the appraisers shall be binding on all parties.Costs for appraisers would be equally divided between the City and the subdivider.
