October 29,1986
A special meeting of the Waukee City Council was called to order
at 7:00 p.m.by Mayor pro tern,Luke Gruber.
A roll call was taken and the following Councilmen were present:
Brown,Tovrea,Gruber,Hoifeldt,and Stork.Absent:Mayor Gordon
Christianson.
Guests and staff present were:Dave Brown and Brian Redshaw,
Dave Brown of Northern Natural Gas Co.made a presentation to the
City Council regarding the status of rate cases RP82-71 and RP85-206.
He also discussed the status of FERC Order 436.He indicated that
the stipulation and agreement had been filed on October 11 and the
waiver granted September 27.
Moved by Brown,second by Stork,to approve the execution of the
letter agreement as proposed by Northern.Carried 5 toO.
Moved by Tovrea,second by Hoifeldt,to approve the execution of the
GS-l service agreements as proposed.Carried 5 to O.
Moved by Brown,second by Tovrea,to adjourn at 7:45p.m.Carried

The regular meeting of the Waukee City Council was called to order
on November 11,1986 at 7:30 p.m.by Mayor Gordon Christianson.
A roll call was held and all Councilmen were present except Jerry
Brown.

CATIONS TOWERS IN THE CITY OF WAUKEE,IOWA.

Section 1.THERE SI~LL BE ADDED TO THE WAUKEE MUNICIPAL CODE,
CHAPTER 221 AS FOLLOWS:
221.1 Comm1micaton Towers.Communication Towers constructed
in the City of Waukee,Iowa,shall meet all of the following
requirements:
a.Maximum tower height to be 45 feet from tip to ground
level.Antenna and mast on the tower must conform to sound
engineering practices.Guy wires are to be installed per
manufacturer's recommendations on applicable models.
b.Guy wire supports and anchors are to be located one
foot inside property boundaries or utility easement,and of -
design to conform to current methods recommended by manufac-
turer's specifications or other applicable requirements.
c.An anti-climbing apparatus is to be installed to pre-
vent unauthorized ascension on all communication towers except
All Band Vertical Antennas.
d.Tower height plus five feet shall not exceed angular
distance from base to overhead lines or permanent neighboring
domicile.Exception:Towers with guy wires that are rated
for collapsible distance,the collapsible distance plus five
feet may be used.
e.If the tower is located near a recreation area,shelter
buildings will be considered as permanent domiciles.
f.Each location is permitted one tower over 14 feet only.
g.All towers shall be erected or maintained to the rear
of the main building,except in'those instances when the sub-
ject property is a cul-de-sac or corner lot where the side yard
is larger than the rear yard in which case a permit may be re-
quested for a side yard tower location.
h.The tower is to be grounded per manufacturer's recomm-
Endations.
i.All towers shall be constructed in compliance with
the Uniform Building Code as amended.
j.A certificate of insurance shall be obtained and furn":'
ished to the City of Waukee,Iowa,by the person constructing
a communication tower or the owner of the property on which
the tower is located,showing compliance w~th this ordinance
with $200,000.00 liability coverage and a notarized affadavit
by the owner showing that the tower was installed per manufac-
turer's specifications.
221.2 Penalty.Any person,firm or corporation violating
any provisions of this ordinance shall be guilty of a simple
misdeameanor and upon convictiqn thereof shall be punished
by a fine not exceeding one hundred dollars ($100.00),or
imprisonment not exceeding thirty (30)days.Each day upon
which such violation occurs after notice shall constitute a
separate Violation.
221.3 Severability.If any section,provlslon or part of
this ordinance shall be adjudge invalid,or unconstitutional,
such adjudication shall not affect the validity of the ord-
inance as a whole or any section,provision or part thereof
not adjudged invalid or unconstitutional.

Roger Buffington reported that the street work was completed but
there was a consensus that there was a question on the quality of
material used for the slurry coat.He recommended approval of
change order #1 and a partial payment on the slurry coat.
Moved by Tovrea,second by Gruber,to approve change order #1 and
pay estimate #3.Carried 4 toO.
The Streets Committee is to meet in the near future and report
back to the Council at the next regular meeting on street work
to be done next year.
Parking in Mary Ann Estates Plat #1 was discussed.Paul Huscher
was directed to draw up an ordinance amendment to allow parking
on the north side of Laurel Street and the east side of 3rd Street
in 11ary Ann Estates and to allow parking on the north side of,
Northview in Northview Estates.

AN ORDINANCE TO AMEND CHAPTER 303,WAUKEE,MUNICIPAL CODE,
SUBDIVISION ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY
PROVIDING FOR PUBLIC SITE AND OPEN SPACES IN THE CITY OF
WAUKEE,IOWA.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.There shall be inserted as Article XI
Sections 303.183,303.184,the following,and Sections
formerly included as Articles XI,XII,XIII,XIV,XV and
XVI shall be renumbered consecutively following said
insertion:
ARTICLE XI
PUBLIC SITE AND OPEN SPACES
§303.183 Purpose.This ordinance is enacted to
insure that land is properly located and preserved for use
by the public for park and recreational purposes in accor-
dance with future community growth;and to further insure
that the cost of providing the park and recreational sites
and facilities necessary to serve the additional residents
brought into the community through subdivision development
may be most equitably apportioned on the basis of the
additional public requirements created by such subdivision
development.
§303.184.Park Site Dedication,Reservation or
payment In-Lieu-Of Dedication.As a condition of
approval of a final plat of subdivision or a site plat,
each subdivider or developer shall be required to dedicate
land without cost to the City for park and recreational
purposes to serve the immediate and future needs of the
neighborhood,in accordance with the following criteria:
A.Park,Recreation Areas,and Open Space
Dedication.In the design of the SUBDI-
VISION PLAT OR PLANNED UNIT DEVELOPMENT
(PUD),dedication of land for parks and
recreation areas shall be required by the
Planning and Zoning Commission and the City
Council of all subdivisions where sites are
recommended by the Comprehensive Plat or
other governmental agency plans.
B.Dedication of Land"for Park,Recreation
Areas,and Open Space.The amoun t of
land or money required to be dedicated by a

subdivider pursuant to this Article shall
be based on the net area·included in the
subdivision (net area being all land inclu-
ding streets,right-of-way,and public or
private easements),determined by the
following formula for all subdivisions lar-
ger than five acres.The City and subdivi-
der shall agree whether that dedication
shall be land or money.The Ci ty and sub-
divider shall agree upon the location of
the land to be dedicated.If the City and
subdivider do not agree on location the two
parties shall appoint three appraisers to
reach a consensus on the location.The
City shall appoint one appraiser,the sub-
divider shall appoint one appraiser,and the
third appraiser shall be chosen by "lot"
from a list of appraisers in the area.The
decision of the appraisers shall be binding
on all parties.Costs for appraisers would
be equally divided between the City and the
subdi vider.
C.Payments in Lieu of Dedication.Where
dedication is not feasible or recommended by
the Comprehensive Plat or other governmental
agency plan s as determined by the Plann ing
and Zoning Commission a and City Council,
the subdivider shall,in lieu of dedication,
pay to the City a fee equivalent to the val-
ue of the land required for dedication.
Such fee shall be based upon the land value
in a subdivided state.If the City and sub-
divider do not agree on price of land,the
two parties shall appoint three appraisers
to reach a consensus of the price of land.
The City shall appoint one appraiser,the
subdivider shall appoint one appraiser,and
the third appraiser shall be chosen by "lot"
from a list of MAl appraisers in the area.
The decision of the appraisers shall be

After hearing from Nick Gruber,captain of the First Responders,
requesting a change in the First Responder by-laws,it was moved
by Tovrea,second by Hoifeldt,to add the following to the First
Responder by-laws:
There will be a 6 month probation period after coming on the
squad.After passing the probation period,a jacket will be
purchased for that person.
If a person does not complete the 6 month probation period
other than extenuating circumstances,they shall reimburse
First Responders for the amount of their training cost.

Roger Buffington gave the engineering report on the lagoon.He
asked for authority to have Patzig Laboratories do the soil boring.
Moved by Tovrea,second by Hoifeldt,to authorize Snyder &Associates
to hire Patzig Laboratories to do the soil boring.Carried 4 to O.
The storm sewer at 4th &Maple was discussed.
Moved by Gruber,second by Tovrea,to have Roto-Rooter clean the
sewer at 4th &Maple and 2nd &Northview.Carried 4 to O.
Frank Hoifeldt gave the report from Planning &Zoning.They had
recommended annexation of properties surrounded by the city limits.
No action was taken.
Joe Stork gave the Utilities report.
Brian Redshaw gave the Administrator's report.

the Joint Action Feasibility Study through the Northern Municipal
Distributors Group at an approximate cost of $1,000.00.Carried

Scott Thomas,Fire Chief,reported that the fire department does
not want to be responsible for individual gas valves other than
valves to homes or the TBS.The Utilities Committee will check into
this matter and report at the next meeting..

A special meeting of the Ivaukee City Council was called to order
at 7:00 p.m.by Mayor pro-tem Luke Gruber.
A roll call was taken and the following named Councilmen were
present:Brown,Tovrea,Gruber,Hoifeldt and Stork.Mayor Gordon
Christianson was absent.
The following guests and staff were also present:Randy Krohn,
Henry Krohn,Roger Buffington,Gary Sindelar,Paul IIuscher and
Brian Redshaw.
The City Clerk indicated that the Planning &Zoning Commission
on November 18,had approved the final plat for Northview"Estate9
#2.He indicated that the deficiencies in the documents had been
corrected,escrow agreement delivered and checks presented.
The City Engineer indicated that he was satisfied with the plat
documents.
