Paperwork was not received for Still Well Class C liquor license
and cigarette permit so no action was taken on this item.
After a discussion,the Council directed the City Administrator
to talk with Joe Brick and James McNabb regarding an easement through
their properties.

October 1,1987
A special City Council meeting was called to order at 6:45 p.m.
on October 1,1987 by Hayor Gordon Christianson.Brian J Redshaw
was present and taking minutes.Ray Clark and Roger Buffington
were also present.
The City Council discussed a proposed easement with Dorothy Allen
Rowe and Donald Allen for the water main project.
Moved by Tovrea,second by Gruber,to set October 31 from 6:00 to
8:00 p.m.for Begger's Night.Carried 3 toO.
Brian Redshaw indicated that there was a potential nroblem with a
building permit for a garage at 2nd and Ashworth.There was a
possible encroachment of this garage on City right-of-way.
Moved by Gruber,second by Tovrea,to have 2nd and Ashworth surveyed.
Carried 3 to O.

The regular City Council meeting was called to order on October
13,1987 at 7:30 p i m,by Hayor pro-tern,Jerry Brown.
A roll call was taken and the following Councilmen were present:
Gruber,Tovrea,Stork,and Hoifeldt.Absent:Mayor Christianson
Guests and staff at this meeting were:Larry Phillips,John Cravens,
Ben Phillips,Paul E Huscher,Virginia Clark,Wesley (Jr)Swallow,
Tom Haynie,Roger Buffington,Bart Weller,Rick Ross,Dick Applegate,
Nick Gruber and Brian Redshaw.
Moved by Gruber,second by Hoifeldt,to approve the minutes of
September 8,15,22 and October 1 with the following corrections:
1)Change date from September 9 to September 8 in the minute book.
2)Change bill presentation to total $50,489.9L"adding Intoximeters
for 152.00 and American Water Works for $53.00.

Chet Chedester spoke to the Council regarding paved parking for
the.Waukee Baptist Church.Brian Redshaw advised the Council that
Pastor Tom Demand had contacted him prior to the meeting indicating
that the church had agreed to install the improvements and had let
a contract with Grimes Asphalt on October 12.

Whereupon,the Hayor pro-tem declared the resolution duly adopted
as follows:
RESOLUTION NO.62
Resolution providing for the issuance of Warrants in connection
with the construction of the Waukee,Iowa-Wastewater Lagoon Expan-
sion Project-1987.
·WHEREAS,the City of Waukee,Iowa,has authority to issue·
Warrants for the purpose of defraying costs in connection with the
construction of the Waukee,Iowa-Wastewater Lagoon Expansion Pro-
j ect-1987 (hereinafter referred to as the "Proj ect");and
WHEREAS,to pay for authorized costs of the Project it is
necessary to issue Warrants in an aggregate amount of $700,000,
pursuant to the provision of Section 384.57 of the Code of Iowa;
·NOW,THEREFORE,It Is Resolved by the City Council of Waukee,
Iowa,as follows:
·Section 1.The Clark is authorized and directed to issue
"\.;rarrants(the "Warrants"),as authorized by Section 304.57 of the
Code of Iowa,to R.G.Dickinson &Co,Des Moines,Iowa,in the
aforementioned amount,to be drawn on any fund or funds from
which payment for such Project may be made,including but not
limited to,cash on hand,the proceeds of the sale of General
Obligation Bonds,the proceeds of the sale of Sewer Revenue Bonds,
and/or the Future Net Revenues of the Hunicipal Sanitary Sewer
of the City.Said Warrants shall be signed by the Hayor and
attested by the Clerk with the seal of the City affixed and deliv-
ered to the aforesaid,and shall be dated as of their delivery
to the purchaser,be in the denomination of $5,000 each,or any
integral multiple thereof,bear interest at the rate of seven
and one-half per cent (7.50%)per annum,and mature on May 1,
1989,unless prepaid in accordance with their terms.
Section 2.The Warrants shall be in substantially the form
as attached to this resolution and shall be payable as to prin-
cipal and interest in accordance with the terms set forth therein.
Section 3.The City shall maintain as confidential the record
of identity of owners of these warrants,as provided by Section
22.7 of the Code of Iowa.
Section 4.The Clerk is hereby designated as the Registrar
and'Paying Agent with respect to said Warrants.
Section 5.It is the intention of the City that interest on
the'Warrants be and remain excludable from gross income of the
recipients thereof for federal income tax purposes pursuant to

the appropriate provlslons of the Internal Revenue Code of 1986,
as amended,and the Treasury Regulations in effect with respect
thereto (all of the foregoing herein referred to as the "Internal
Revenue Code".In furtherance thereof the City covenants to
comply with the provisions of the Internal Revenue Code as they
may from time to time be in effect or amended and further covenants
to comply with applicable future laws,regulations,published
rulings and court decisions as may be necessary."to insure that
the interest on the Warrants will remain excludable from gross
income of the recipients thereof for federal income tax purposeso
Any and all of the officers of the City are hereby authorized and
directed to take any and all actions as may be necessary to comply
with the covenants herein contained.
The City hereby designated the vJarrants as "Qualified Tax
Exempt Obligations"as that term is used in Section 265(b)(3)(B)
of the Internal Revenue Code.
Section 60 All resolutions or orders or parts thereof in
conflict herewith be and the same are hereby repealed,to the
extent of such conflict.

($2383.00),and accept the East Street Water Main Project as

and accept the 1987 Street Project performed by Des Moines Asphalt.

After due consideration and discussion,Council Member Gruber
introduced and moved the adoption of the resolution next herein
set out,the same being a resolution approving executed contract
and performance and/or payment bonds for the Waukee,Iowa-Waste-
water Lagoon Expansion Project-1987.The motion was seconded by
Council Member Tovrea and passed with record vote as follows:

Approving contract and performance and/or payment bonds for the
Waukee,Iowa-Wastewater Lagoon Expansion Project-1987
WHEREAS,the City Council of the City of Waukee,Iowa,has
heretofore awarded a contract as follows:

"Project")and fixed the amount of the performance and/or payment
bonds to be furnished by such contractor,and instructed and auth-

behalf of the City subject to the approval of the Council;and
WHEREAS,the said contract has been duly signed by the con-
tractor and by the Mayor and City Clerk,and upon examination by
this Council the same appears to be in proper form;and
WHEREAS,the contractor has filed satisfactory performance
and/or payment bonds in the required amount,as follows:

NOW,THEP~FORE,IT IS RESOLVED by the City Council of the
City of Waukee,Lowa ,as follows:
Section 1.The aforementioned contract and performance
and/or payment bonds be and the same are hereby approved and
declared to be binding upon the parties thereto.
Section 2.All resolutions or parts of resolutions in
conflict herewith be and the same are hereby repealed to the
extent of such conflict.

The Personnel Committee presented their recommendations for
a proposed maintenance department uniform purchase and a pro-
posed Waukee City Employee Work Clothing Policy.
Moved by Hoifeldt,second by Brown,to select Option
cost of $304.80 per full time maintenance employees.

Brian Redshaw presented the proposed easements for the water
and gas.line improvements to the east side of Waukee.The
agreement with William Turf Farms and Dr.Donald Berg was still
in the mail for final signatures.Dr Dakovich's easement will
be receicved on October 14,
Moved by Tovrea,second by Stork,to authorize the Mayor and City
Clerk to execute the water and gas line easements and make pay-
ments of $264.00 to Donald Allen and $264.00 to Dorothy Rowe.

Rick Ross of Tomrik,Inc.requested that the City pay the diff-
erence between 8"and 12"water main within the Southfork devel-
opment.The additional cost of these improvements is $7945.00.
Moved by Tovrea,second by Stork,to approve the payment of the
cost difference between 8"and 12"water main in the amount of
$7945.00.Carried 4 to l--Gruber voting No.
Moved by Hoifeldt,second by Tovrea,to enter into contract with
KAL Inc.for the drafting of plans and specs for the High Pressure
Gas Main Project in the amount of $4000.00.Carried 5 toO.
A hearing for the proposed amendment to the FY 87-88 budget was
held as published in the Dalla s County News.~1ayor pro-tern,Jerry
Brown,asked for questions.or comments and none were received.

Section 1.Following notice published September 24,1987 and
the public hearing held October 13,1987,the current budget
(as previously amended)is amended as set out herein and in the

Brian Redshaw presented a proposal from Northway Well &Ptimp Co
for the repair of the backup pump for Well #1 in the amount of
$1548.15,The Council directed him to go back to the contractor
and cLar Lfy the wording on the agreement.
Brian Redshaw presented the following bid from Northway Well &
Pump for pulling ,Jell #1 at a rate of $52,00 per hour for 2 men
and $22.00 per hour for shop rate.The Council directed him to
have the electrical breakers checked first.
Brian Redshaw presen~ed'his recommendation for a proposed City
Hall copier purchase.He indicated that he had looked at a
dozen copiers and this was the best buy for the money,

of a Panasonic FP-3030 plain paper copier from Midwest Office
Technology at a price of $3495.00 to include 3 bottles of toner
and a service agreement at a cost of $535.00.The service agree-
ment would include drum replacement and copies over 60,000 would
be billed at a rate of $.008 per copy with a maximum increase
of 10%per year,Carried 4 to l--Tovrea voting No.
Brian Redshaw presented a letter from Alan Kiene requesting
water service south of University Ave.The City Council referred
the matter to the Utilities Committee with consideration being
given to an establishment of an outside City limits rate,
Mavadby Tovrea,second by Gruber,to close Park Road on October
29,1987.Carried 5 to O.
Brian Redshaw presented a proposal to purchase a reconditioned
gas meter for the Middle School at a cost of $1500.00.The City
Council directed him to contact Rockwell International for a
quotation on a new turbine gas meter,
Mayor pro-tern,Jerry Brown,read the following proclamation:

Mayor Gordon Christianson has declared Wednesday,October 21,1987
as Waukee Reading Day.All Waukee citizens are encouraged to
spend 15 minutes sometime during the day for leisure reading.
