The consensus of the City Council was to leave the banking business at Brenton State Bank. Luke Gruber gave the Public Safety report. Joe Stork gave the Utilities report,He discussed using surplus fund for the High Pressure Gas Feeder Main Proj e c t ,Chet Chedester spoke against the proposal and argued against using short term money for capitol improvements,Mr Chedester also discussed the refund "from Northern Natural Gas recently received. Gordon Christianson gave the Mayor's report and used the opportunity to compliment the citizens of Waukee for their Christmas displays. He also questioned the wisdom of continuing the monthly newsletters at an estimated annual cost of $1644.00. A roll call was taken and the following Councilmen were present: Brown,Hoifeldt,and Stork.Absent:Gruber and Rosenkranz. Gruber arrived at 7:06 p.m. Guests and staff present at this meeting were:Roger Buffington, Paul Huscher,Ben Phillips,Rick Ross and Tom Gratias.Brian J. Redshaw was present and taking minutes.Larry Phillips was also present. BE IT ORDAINED by the Council of the City of Waukee: Section 1.Section 303.468 of Chapter 303 lIaukee Municipal Code,Land Subdivision Regulation Ordinance of t~e Ci ty of Haukee,is hereby amended by deleting the first and second paragraph thereof and inserting in lieu thereof the following: §303.46B This requirement may be waived if the SUb- divider will gost a cash or corporate sure- .ty bond or certified check or surety ap- proved by the city council with the City, guaranteeing that said improvements will be constructed within a period of one (1)year from final acceptance of the plat,.such bond to be approved by the Ci ty At torney; however,if surety is posted,final accep- tance of the plat will not constitute final acceptance by the Ci ty of any improvements to be constructed.Improvements will be accepted only after their construction has been completed and inspection by appropri- ate City personnel certifying the improve- ments have been completed in conformance to spec if ications and standards of the Ci ty and Ordinances of the City.No pUblic funds will be expended in the Subdivision until such improvements have been completed and accepted by the City. The amount of the bond or certified check or other surety shall not be less than the estimated cost·of the improvements,.includ- ing all inspection services and tests con- ducted by the Ci ty and the amount of the estimate of the bond or certified check must be approved by the City Engineer. Section 2.Effective Date.This ordinance shall be in effect after its final passage,approval,and publi- cation as required by law. Counc i IvHemhe'r;Hoifeldt ,introduced .the ,resolution entitled "Resolution providing for the issuance of Warrants in Connection with the construc- tion of thE,,'tWaukee,Iowa:-1987 Annexation Area Water Hain Project:, and moved that said resolution be adopted;seconded by Council Hember Stork.After due consideration thereof by the Council,the Hayo r put the question on the motion and the roll being called,the following named Council Hembers voted: Ayes:Bro_vn,Hoifeldt,Stork Nays:None recorded Absent:Gruber and Rosenkranz RESOLUTION NO.70 Resolution providing for the issuance of Warrants in connection with the construction of the Waukee,Iowa -1987 Annexation Area Water Main Project WHEREAS,the City of Waukee,Iowa,has authority to issue Warrants for the purpose of defraying costs in connection with the construction of the Waukee,Iowa -1987 Annexation Area Water Main Project (hereinafter referred to as the "Project");and WHEREAS,to pay for authorized costs of the Project it is necessary to issue warrants in the amount of $325,000,pursuant to the provisions of Section 384.57 of the Code of Iowa; NOW,THEREFORE,It Is Resolved by the City Council of Waukee, Iowa,as follows: Section 1.The Clerk is authorized and directed to issue warrants in the aggregate principal amount of $325,000 (the "Warrants"),as authorized by Section 384.57 of the Code of Iowa,to R.G.Dickinson & Co.,Des Moines,Iowa,in the aforementioned amount,to be payable from such fund or funds of the City as are legally available for such purpose,including but not limited to,the proceeds from the sale of General Obligation ,Bonds and/or the proceeds from the sale of Water Revenue Bonds and/or the future Net Revenues of the Municipal Waterworks System of the City.The Warrants shall be signed by the Mayor and attested by the Clerk with the seal of the City affixed and delivered to the aforesaid,and shall be dated as of their delivery to the purchaser,be in the denomination of $5,000 each,or any integral multiple thereof,bear interest at the rate of Seven and One Half Per Cent (7 1/2%)per annum,and mature on December 1,1988,unless prepaid in accordance with their terms. Section 2.The Warrants shall be in substantially the form as attached to this resolution and shall be payable as to principal and interest in accordance with the terms set forth therein. Section 3.It is the intention of the City that interest on the Warrants be and remain excludable from gross income of the recipients thereof for federal income tax purposes pursuant to the appropriate provisions of the Internal Revenue Code of 1986,as amended,and the Treasury Regulations in effect with respect thereto (all of the foregoing herein referred ~o as the "Internal Revenue Code").In furtherance thereof the City covenants to comply with the provisions of the Internal Revenue Code as they may from time to time be in effect or amended and further covenants to comply with applicable future laws, regulations,published rulings and court decisions as may be necessary ,.-216 January 28,1988--·-c;,,·_·.'~ to insure that the interest on the Warrants will remain excludable from gross income of the recipients thereof for federal income tax purposes. A roll call was taken as follows: Ayes:Gruber,Brown,Hoifeldt,Stork Nays:None recorded Absent:Rosenkranz The City Council discussed the numbering policy for the annexation area.Brian Redshaw indicated that the City of Wallizee's east bound- ary,which touches the City of Clive,is designated at N.W.l42nd St. He recommended that Larry Crane's road which runs adjacent to the Waukee Veterinary Clinic,be designated as l52nd St.and Alice's Road or l'-1ineRoad be designated as l62nd St.He suggested that East St.remain as it is with numbering to begin with 1st St.,as is. The Council discussed an engineering study determining the feasibility of Waukee joining with West Des Moines,Urbandale and Clive in a joint sewer facility near Booneville.The Council directed Roger Buffington to develop a cost estimate and present it at the February meeting. Police Chief,Larry Phillips,discussed the construction of improve~ ments to the police station at a total cost of $6783.56 with $2500.00 already included in the FY 87~88 budget. Moved by Gruber,second by Brown,to set Tuesday,February 9,1988 at 7:30 p.m.for a budget amendment hearing in the amount of $4283.46. Carried 4 to O. Moved by Gruber,second by Brown,to purchase a 1988 Ford Crown Victoria at a cost of $11,730.75 from West Suburban Ford with an extended warranty at an additional cost of $410.00.The total cost of the car will be $12,140.75 to be taken out of the FY 88~89 budget with a July 1 delivery date.Carried 4 to O.
