The regular meeting of the Waukee City Council was called to order
at 7:30 p,m.on May 10,1988 by Mayor Gordon Christianson,

Linda Wilson,of the Walnut Creek area,spoke to the Council re-
garding water to this area.Other residents of this area also
spoke.

to prepare plans and specifications for the Walnut Ridge water

Jerry Brown arrived at 7:52 p.m.
The Mayor asked for any questions or comments relative to the
A-I to M-l rezoning hearing as published in the Dallas County
News.
The owner.of the property,Joe Brick,spoke to the Council and
introduced Jim Tyler,president of Atlantic Bottling.Mr Tyler
explained their operation and proposed plans for the area in
question.They asked for no tax ab a t emerrt,Bill Mains spoke
in opposition,citing the fact that no master plan has been
completed for the newly annexed area.

Wendy Hansen-Wagner of the Waukee Library Board spoke to the
Council regarding a vacancy of the Board since Linda Mack had
resigned to accept the position of part-time librarian.

to a 3 year term commencing July 1,1988.Carried l,to O.
Nick Gruber,captain of the First Responders,requested appro-
priation of $810.00 for Midwestern Electronics King radio.
Moved by Hoifeldt,second by Rosenkranz,to purchase a King radio
for the First Responders,not to exceed $810.00.Carried 4 to O.
Craig Kaom requested permission to build a 30 X 62 building on
the property at 6th &Laurel for storage of his construction
equipment.This matter was referred to Planning &Zoning.
John Eatwell spoke regarding his December gas bill.Due to the
fact that the meter had been misread and was caught up the next
month,no action was taken on this matter.

CODE,REGULATIONS AND LICENSING OF COMMERCIAL HAULERS O~
REFUSE AND PENALTIES FOR VIOLATIONS,BY DELETING PROVIS-
IONS AS TO THE DALLAS COUNTY LANDFILL.
BE IT ORDAINED by the Council of the City of Waukee:
.Section 1.Section 213.3 of Chapter 213 Waukee Muni-
clpal Code,Regulations and Licensing of Commercial Haul-
ers of Refuse and Penalties for Violations,is hereby
amended by deleting the words "and a statement that the
commercial hauler will not haul refuse to the Dallas
County Landfill other than refuse collected in Dallas
County"and shall read as follows:
§2l3.3 Application for License.An application in
wrltlng shall be filed with the City Clerk
for a license under this ordinance.Such ap-
pllcatlon shall set forth the applicant's
name,permanent and local address,bus iness
address,if any,a description and license
number of the vehicle to be used for haUling,
and shall be accompanied by a certification
from an insurance company,authorized to
w r i t.e liability insurance in the State of
Iowa,that such applicant has liability insu-
rance in the minimum amount of $100,000.00
per person,$300,000.00 per dccident,and
$25,000.00 property damage on the vehicle to
be used for haUling.

FINING "BASEMENT"AND PROVIDING THAT THE SAME MAY NOT BE
COUNTED AS A STORY.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.3 of Chapter 301 Waukee Muni-
cipal Code,Zoning Ordinance of the City,is hereby amend-
ed by deleting therefrom the following:
§301.3 BASEMENT.That portion of a building having
part but not more than one-half (1/2)its
height below grade.A basement shall be
counted as a story,if the vertical distance
from the average adjoining grade to its ceil-
ing is over five (5)feet.
And inserting in lieu thereof:

Brian Redshaw asked the Council about hiring high school "help for
the crack filling project during the month of June.
Moved by Gruber,second by Rosenkranz,to hire 4 part-time helpers
for 20 working days to fill cracks in the streets.Carried 4 to O.
After due consideration and discussion,Council Member Gruber intro-
duced and moved the adoption of the resolution next herein set out,
the same being a resolution approving executed contract and perform-
ance and/or payment bonds for the Waukee,Iowa-1988-Elevated Storage
Tank Painting Project.The motion was seconded by Council Member
Rosenkranz and passed with record vote as follows:
