A roll call was taken and the following Councilmen were present: Gruber,Brown and Hoifeldt.Absent:Scott.Brian J.Redshaw was present and taking minutes. Guests and staff at this meeting were:Beth Dalbey,Ji!!lThompson, Ben Phillips,Tom Tovrea,Marvin Berger,Paul Huscher,Hannah 'Jeil, JiB Berner,Terry Lutz,Kurt Sorenson,Bart Weller,Jerry Searle, Cecil Reynolds,Don Henson,Larry-Oetting,Roger Buffington,Chet Chedester,Tim Wagner,Virginia Clark,Randy Foster,Arnold Borchers, Kelly Lint,Bill Hikesch,Dick Applegate and Brian Redshaw. Jim Berner represented the l'JaukeeFire Department concerning the building fund.$5000.00 was !!ladeby the FireBen's Associates on the street dance.Cecil Reynolds spoke about the need for a new fire'station.The consensus of the Council was to have the proposal included with the FY 89-90 budget proposal. Tom Tovrea spoke to the Council regarding a change from I-way to 2-way direction on Park Road (east &west) Octboer 18,1988-~-cont ;295 Chet Chedester spoke to the Council regarding his Utilitv Board petition.His original petition required a vote at the next regular City election which would be November,1989.Hr Chedester submitted an amended petition with 22 signatures on it requiring the proposal to be put on the ballot at the next special City election or within 90 days,whichever is first. Hoved by Hoifeldt,second by Brown,to appoint Larry Oettinf,to fulfill Floyd Rosenkranz'unexpired term,ending 12-31-91.'A roll call vote was taken as follows: Ayes:Gruber,Brown,Hoifeldt Nays:None recorded Absent:Scott The oath of office was administered to Larry W Oetting. lioved by Gruber,second by Oetting,to set November 22 at 7:00 p i m, at the 1>JaukeeHigh School gymnasium for a hearing on the Utility Board question.Hiddle School as alternate site.Carried 4 to 0, (It was later determined that 7:30 p.m.was a better time to schedule this hearing). Harvin Berger of Hartens &Co.,P.C.presented the FY 87-88 financial audi t to the Council.He sugges ted that "Void after 90 days"be printed on accounts payable checks,headings be corrected on accounts receivable reports,Community Opportunities payments problem be corrected,annual gross salaries be published,separate City Clerk and City Administrator positions,and minute entries for the public purpose served by flower and Christmas turkey purchases.Frank Hoifeldt suggested that the giving of Christmas turkeys to full- time employees be inserted in the Employee Benefit handbooks. lioved by Oetting,'second by Gruber,to approve the FY 87-88 financial audit as presented.Carried 4 to O. RESOLUTION NO.88 Setting date for public hearings on designation of the Waukee Urban Renewal Area dn on urban renewal plan and project October 18,1988---cont WHEREAS,studies have been conducted which show the desirability of designating a portion of the City of Waukee as the Waukee Urban Renewal Area,pursuant to the provisions of Chapter 403,Code of Iowa; and IffiEREAS,a proposal has been submitted to the Council under which an area within the boundaries set out in Exhibit A would be designated an urban renewal area;and WHEREAS,this Council is deisrous of obtaining as much information as possible from the residents of the City before making this designation;and \ffiEREAS,a proposed urban renewal plan for a project within that proposed designated area has been prepared and it is now necessary that a date be set for public hearings on the designation of the area and on that plan and project; NOH,THEREFORE,Be It Resolved by the City Council of the City of Waukee,Iowa,as follows: Section L This Council will meet at the City Hall,IJaukee,Iowa, on the 8th day of November,1988,at 7:30 o'clock p.m.,at which time and place it will hold public hearings on the designation of the pro- posed Haukee Urban Renewal Area described in the preamble hereof and on the proposed urban renewal plan and project for said Area. Section 2.The City Clerk shall publish notice of said hearings, the same being in the form attached hereto,which publication shall be made in a legal newspaper of general circuclation in Haukee,which publication shall be not less than four (4)nor more than twenty (20) days before the date set for hearings. Section 3.The proposed urban renewal plan is hereby submitted to the City's Planning and Zoning Commission for review and recoliEend- ations,as required by Section 403.5,Code of Iowa. Passed and approved this 18th day of October,1988. The Council interviewed Terry Lutz and Jerry Searle of 11cClure Engineering for FY 88-89 Planning Services. Moved by Gruber,second by Oetting,to receive and file the Utility Board petition.Carried 4 to O. A "Junk Car Ordinance"was discussed by the Council.No action was taken at this time. Councilman Hoifeldt introduced an Ordinance entitled:"AN ORDINANCE HE-ADOPTING THE WAUKEE MUNICIPAL CODE AS THE 1988 WAUKEE MUNICIPAL CODE". It vlaS moved by Councilman Oetting,and seconded by Councilman Hoifeldt,that the Ordinance entitled:"AN ORDINANCE RE-ADOPTING THE HAUKEE MUNICIPAL CODE AS THE 1988 WAUKEE lillNCIPALCODE"be now read by the City Clerk.The Mayor put the question on the motion and the roll being called,the following named Councilmen voted: '.Ayes:.Oetting,Hoifeldt,Brown,Gruber Nays:None recorded Absent:Scott IVhereupon,the Mayor declared the motion duly carried. ORDINANCE NO.4-IOr AN ORDINANCE RE-ADOPTING THE WAUKEE t,WNICIPAL CODE AS THE 1988 WAUKEE MUNICIPAL CODE. Be It Ordained by the Council of The City of Waukee, Iowa: §l02.1.Adoption.The City Council having found the Waukee Municipal Code,as amended to the 11th day of October,1988,as now edited and compiled,to be adequate.as the municipal code of the municipal corporation of the Clty of Waukee,Iowa,the Ci ty Counci 1 does hereby re-adopt the Waukee Municipal Code as the 1988 Waukee Hunicipal Code. 298 October 18,1988~~cont §l02.2.Official Copy.An official copy,bear- ing the signature of the mayor and certificate of the City Clerk as to its adoption and pUblication is on file in the office of the City Clerk,together with standard codes adopt- ed by reference in this code. .§l02.3.Public Copies.Loose-leaf copies of thIS code shall be kept in the City Clerk's office available for pUblic inspection and for sale at cost to the public. §l02.4.Distribution.Copies of this code shall be deposited as follows:one copy with the State Law Library,one copy in the Waukee Library,one .cSPy with "Dallas County News"and one copy with the .J(])L::::::;,radiostation. §l02.5.Amendments.All general ordinances of the City Council passed hereafter shall be in the form of an additio?or amendment to the 1988 Waukee Municipal Code,and shall Include proper references to chapter and section to maintain the orderly codification of ordinances. §l02.6.Effective Date.This ordinance and adopted code shall be in ful force and effect from and after the passage and approval and pUblication of this ordinance, as provided by law. It was moved by Councilman Hoifeldt,and seconded by Councilman Brown,that the rule that an ordinance must be received and filed at two meetings prior to the meeting when final action is taken or, if published in summary,be received and filed.at one meeting prior to the meeting of final action,be dispensed with.The 11ayor put the question on the motion,and the roll being passed, the following named Councilmen voted: Ayes:Gruber,Brown,Hoifeldt,Oetting Nays:None recorded Absent:Scott Whereupon,the Mayor declared the motion duly carried. BE IT ORDAINED by the Council of the City of Waukee: Section 1.Section 203.2 of Chapter 203 Waukee Muncipal Code,is hereby amended by.deleting said section and insert- ing in lieu thereof the following: §203.2 Water Rates.Water shall be furnished at the following monthly rates per meter within the city limits: First 3,000 gallons or lesser amount per month $13.00 per month (minimum monthly bill ) Allover 3,000 gallons $.00325 per gallon per month All users outside the City of Waukee will be charged per month minimum and on€<,Hie Ol'W half times the above nated rates per meter.4-~o ~.Ob $19.50 desig- Section 2. effect after its required by law. Carried 4 to O. The City Council referred the Hickman Access Ordinance to Paul Huscher for presentation at a later meeting. Moved by Gruber,second by Oetting,to approve change order #2 in amount of ($24,649.34)and pay.as.t.Lmat;etflO in amount of $7210.50 for C L Carroll Construction.Carried 4 to O. Pay estimate #2 in amount of $8571.66 and change order #2 in amount of $963.60 for Des Moines Asphalt was presented concerning the 1988 Street Project.The Council chose to take no action on these items pending resolution of problems concerning East St. 300 October 18,1988---cont Moved by Brown,second by Oetting,to pay the 5%retainage of $2899.91 to A &L Underground for the 1988 Southfork gas project.
