The regular meeting of the Wawcee City Council was called to order
at 7:03 p,m.on January 10,1989 by Hayor Floyd Rosenkranz.
A roll call of members present:Scott,Gruber,Brown,Hoifeldt,Oetting.
Guests and staff at this meeting were:Rick Ross,Larry Phillips,
Brian Redshaw,Ann Ford,Al l~~~sterman,Paul Huscher,Bob Barrett,
Franz Adawi,Brad Vancil,J Iv Vancil,Don Henson,Jeff Abbas,Hick
Gruber.,Bart Heller,Dale Tripp and Dick Applegate.
Moved by Hoifeldt,second by Gruber,to approve the minutes of December
13 and 27.Carried 5 to O.
Brad Vancil addressed the Council in reference to a skateboard ramp
at the park at an approximately cost of $200,00 which does not
include a paved or wooden surface approach.lir Vancil is to contact
Frank Hoifeldt when plans are obtained and Brian Redshaw is to contactourinsuranceagent.

AN ORDINANCE PROVIDING FOR THE DIVISION OF TAXES LEVIED
ON TAXABLE PROPERTY IN THE WAUKEE URBAN RENEWAL AREA OF THE
CITY OF WAUKEE,IOWA,PURSUANT TO SECTION 403.19 OF THE CODE
OF IOWA.
BE IT ENACTED by the Council of the City of Waukee:
Se ction 1.Purpose.The purpose of.this ordi nance is
to provide for the division of taxes Le v i ed on the t.axable
property in the Waukee Urban Renewal Area of the Cl ty of
Waukee,Iowa,each year by and for the benefit ?f th~st~te,
city,county,school districts or"other"taxlng dlstrlcts
after the effective date of this ordlnance In order to create
a special fund to pay the principal of and interest on loans,
moneys advanced to or indebtedness,inclu~ing bonds ?ropos~d
to be issued by the City of vJaukee to f Ln anc e p r o j e c t s In
such area.
Section 2.Definitions.For use within this ordinance
the following terms shall have the following meanings:
"City"shall mean the City of Waukee,Iowa.

"Urban Renewal Area"shall mean the \'laukeeUrban Renewal
Area of the City of Waukee,Iowa,the boundaries of which are
set out below,such area having been identified in the Urban
Renewal Plan approved by the City Council by resolution adop-
ted on November 8,1988:-

Section 3.Provis ions for Di vi s ion of Taxes Levied on
Taxable Pr~perty in Urban Renewal Area.After the effective
date of thlS ordinance,the taxes levied on the taxable pro-
,pe:ty in the Urban Renewal Area each year by and for the ben-
e f i t;of ,the,State of Iowa,the City,the County and any
school dlstrlct or other taxing district in which the Urban
Renewal Area is located,shall be divided as follows:
(a)that por,tion of the taxes which would be produced
by the rate at WhlCh the tax is levied each year by or for
each of the taxing districts upon the total sum of the
assessed value of the taxable property in the Urban Renewal
Area,as shown on th~assessment roll as of January 1,of the
cal~ndar year precedlng the effective date of this ordinance,
s h a Ll.be allocated to and when collected be paid into the
fund -.for the respective taxing district as taxes by or for
said taxing district into which all other property taxes_are
paid.For the purpose of allocating taxes levied by or for
any taxing district which did not include the territory in
the Urban Renewal Area on the effective date of this ordi-
nance,but to which the territory has been annexed or other-
wise included after the effective date,the assessment roll
as of January 1,of the calendar year preceding the effective
date of this ordinance shall be used in determining the
assessed valuation of the taxable propety in the Urban Renew-
al Area on the effective date.
(b)that portion of the taxes each year in excess of
such amounts shall be allocated to and when collected be paid
into a special fund of the City to pay the principal of and
interest on loans,moneys advanced to or indebtedness,wheth-
er funded,refunded,assumed or otherwise,includ ing bonds
issued under the authority of Section 403.9(1),of the Code
of Iowa,incurred by the City to finance or refinance,in
whole or in part,projects in the Urban Renewal Area,except
that taxes for the payment of bonds and interets of each tax-
ing district shall be collected against all taxable property
within the taxing district without limitation by the provi-
sions of this ordinance.Unless and until the total assessed
valuation of the taxable property in the Urban Renewal Area
exceeds the total assessed value of the taxable property in
such area as shown by the assessment roll referred to in sub-
section (a)of this section,all of the taxes levied and col-
lected upon the taxable property in the Urban Renewal Area
shall be paid into the funds for the respective taxing dist-
ricts as taxes by or for said taxing districts in the same
manner as al other property taxes.When such loans,advanc-
es,indebtedness,and bonds,if any,and interest thereon,
have been paid,all money thereafter received from taxes upon
the taxable-property in the Urban Renewal Area shall be paid
into the funds for the respective taxing districts in the
same manner as taxes on all other property.
(c)the portion of taxes mentioned in subsection (b)of
this section and the special fund into which that portion
shall be paid may be irrevocably pledged by the City for the
payment of the principal and interest on loans,advances,
bonds issued under the authority of Section 403.9(1)of the
Code of Iowa,or indebtedness incurred by the City to finance
or refinance in whole or in part projects in the Urban
Renewal Area.

TION,TO PROVIDE THAT NO PROPERTY TAX CREDITS SHALL BE GRANT-
ED AS TO ANY PROPERTY INCLUDED IN ANY URBAN RENEWAL AREA OFTHECITYOFWAUKEE,IOWA.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 215.2 is hereby amended by addingtheretothefollowing:

"Provided,however,no exemption or partial exemption
from taxation shall be granted as to any property within
any urban renewal area of the City of Waukee,Iowa."
Section 215.2 shall now read:
"The City of Waukee,Iowa,hereby provides for a partial
tax exemption from property taxation of the actual value
added to industrial real estate by the new construction
of industrial real estate and the acquisition of or im-
provement to machinery and equipment as assessed as real
estate pursuant to Iowa Code Section 427A.l(1)(e),Code
of Iowa,as amended,within the limits of the City of
Waukee,Iowa.Th is provis ion shall be subj ect to the
definitions and requirements set forth in House File
650;Acts of the 68th General Assembly,1979 Regular
Session of the State of Iowa.Provided,however,no
exemption or partial exemption from taxation shall be
granted as to any property within any urban renewal area
of the City of Waukee,Iowa."

AN ORDINANCE TO AHEND CHAPTER 303,WAUKEE,HUNICIPAL
CODE,AN ORDINANCE PROVIDING RULES,REGULATIONS AND STANDARDS
TO GUIDE LAND SUBDIVISION IN WAUKEE,IOWA,TO PROVIDE FOR
REIHBURSEMENT BY THE CITY OF COSTS ADVANCED BY CONTRACTORS OF
EXPENSES ORIGINALLY PAID BY CONTRACTORS IN SUBDIVISIONS RE-
QUIRING EXTENSIONS OF MAIN GASLINES IN THE ,CITY OF WAUKEE.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 303.167 of Chapter 303 Waukee Munic-
ipal Code,is amended by'substituting therefor the follow-
ing:
The subdivider shall be responsible for the cost
of installing the natural gas system within all
new subdivisions.The necessary piping and
appurtenances shall be installed by the City and
the costs of all material,equipment,and labor
shall be billed to and paid by the subdivider.
Within ninety (90)days of meter installation or
upon permanent occupancy of the principal build-
ing on a lot in the new subdivision,a refund
shall be made to the subdivider,of the costs of
materials and installation of the gas main,pro-
rated as to the ratio of said lot to the total
number of said building lots in the subdivision.
Section 303.167 shall now read:

Larry Oetting had no Utilities Committee report but did report that
damage by a water main break this summer had caused damage to a
dr'Lveway and recommended that the City help repair this drivewav.-."
Al Munsterman gave the proposal on the west end water project.
Moved by Scott,second by Oetting,to have the engineer draw up specs
and plans for the paving of the north 800'of l52nd St.Carried 5 to O.
