on l1arch 7,1989 at 7:00 p.m.~l1ayor Floyd Rosenkranz.
A roll call was held and the following Councilmen were present:

p.m.for FY 89-90 budget hearing at City Hall.Carried 3 toO.
An informal discussion was held concerning Hannah Weil's accrued
vacation.This item will be placed on the agenda for March 14.
l1ayor Rosenkranz spoke to the Council regarding the use of utility
reserve funds for the purchase of equipment.
Jack Wearmouth spoke to the Council regarding annexation and
planning.

on l1arch It+,1989 at 7:30 p vm.by Hayo r pro-tern,Jerry Brown.
A roll call was held and all Councilmen were present except
Gruber and l1ayor Rosenkranz.

Hoved by Scott,secorid by Hoifeldt,to approve the minutes of February

Gary Nail of the Farmer's Co-op Elevator spoke to the Bouncil in reference
to the Co-op running a water line north from Ashworth at their expense
and dedicate it back to the City.Brian Redshaw is to research this
further and get back to Mr.Nail.
Hr.Nail also offered Co-op labor and materials for cleaning up the
triangle--fertilizing,seeding and dandelion control.The Counc i L
authorized this work.
Jeff Logsden spoke to the Council in reference to the Dallas County
bike trail.They have.received DNR approval.The Waukee to Adel
section will be completed in 1989 with the complete project to be com-
pleted by 1990.Hr.Logsden asked the Council if they would maintain
a staging area in Waukee.
Verle Smith was not present as was on the agenda.
Brian Redshaw explained Brad Lathrop's request to build a house north
of Cherry St.The ordinance requires that a lot have a40'street
right-of-way and he would need a 20'exclusive eaSement.

DEFINITION;AND BY ADDING TO THE DEFINITIONS,THE DEFINITION

Be it ordained by the City Council of Waukee,Iowa:
Section 1.Section 301.3 of the Code of Ordinances of
the City of Waukee,Iowa,is hereby amended by deleting "JUNK
YARD"and the text following "Junk Yard"and inserting the
following definitions in alphabetical order:
JUNK YARD.Any place not f u Ll.y enclosed in a
building,excluding a salvage yard,which is used
in whole or in part for .the storage or deposit of
junk encompassing either (a)an area of two hundred
(200)square feet or more,or (b)two (2)or more
inoperable motor vehicles,or used parts and mater-
ials thereof,which taken together equal the bulk
of two (2)or more motor vehicles.
INOPERABLE VEHICLE.Any motor vehicle,recrea-
tional vehicle,boat,trailer or semitrailer which
lacks a current registration or cnmponent part
which renders the vehicle unfit for legal use.
JUNK.All old or scrap copper,brass,lead,or
any other non-ferrous metal;old rope,rags,bat-
teries,paper,trash,rubber debris,was te,used
lumber or salvaged wood;dismantled or inoperable
vehicles,machinery and appliances or parts of such
vehicles,machinery or appliances;iron,steel,or
other old or scrap ferrous material;old discarded
glass,tinware,plastic,or old discarded household
goods or hardware.

INFRACTION,OFFICER,AND REPEAT OFFENSE.
Be it ordained by the City Council of Waukee,Iowa:
Section 1.Section 103.1 of the Code of Ordinances
of the City of Waukee,Iowa,is hereby amended by inserting
after subsection "Un thereof the following:
V.Municipal infraction:Except those provi-
sions specifically provided under state law
as a felony,an aggravated misdemeanor,or a
serious misdemeanor or a simple misdemeanor
under Chapters 687 through 747 of the 1987
Iowa Code,the doing of any act prohib ited
or declared to be unlawful,an offense,or a
misdemeanor by the Code of Ordinances,City
of Waukee,or any ordinance or code herein
adopted by reference,or an omission or
failure to perform any act or duty required
by the Code of Ordinances,City of Waukee,
or any ordinance or code herein adopted by
reference,is a "municipal infraction"and
is punishable by civil penalty as provided
herein.
W.Officer:The term officer shall mean any
employee or official authorized to enforce
the Code of Ordinances of the City of Waukee
as designated by resolution of the City
Council of the City of Waukee.
X.Repeat offense.A recurring violation of

AN ORDINANCE AMENDING CHAPTER 103.4 OF THE CODE OF
ORDINANCES OF THE CITY OF WAUKEE,IOWA,BY ADDING THERETO
SUBSECTIONS "B"AND "C"PROVIDING FOR PENALTIES AND ALTERN-
ATIVE RELIEF,AND CIVIL CITATIONS FOR HUNICIPAL INFRACTIONS
IN CONFORMITY WITH SECTION 364.22,CODE OF IOWA,AS AMENDED.
Be it ordained by the City Council of Waukee,Iowa:
Section 1.Section 103.4 of the Code of Ordinances
of the City of Waukee,Iowa,is hereby amended by designating
the first subdivision as "A",and by adding as subsections
"Bn and "Cn thereof so that §103.4 will read as follows:
A.Standard Penalty.Unless another penalty
is expressly provided by the municipal code
for any particular provision,section or
chapter,any person failing to perform a
duty,or obtain a license required by,or
violat ing any provis ion of that code,or
any rule or regulation adopted or issued in
pursuance thereof,or any provision of any
code adopted therein by reference,shall be
guilty of a simple misdemeanor,and upon
conviction,be sub j e c t;to a fine of not
more than one hundred dollars ($100)or
imprisonment not to exceed thirty (30)
days.Whenever the fines or costs imposed
are not paid,the person convicted may be
committed to jail until the fine and costs
are paid,not exceeding thirty (30)days.
B.A municipal infraction is punishable by a
civil penalty as provided in the following
schedule,unless a specific schedule of
civil penalties is provided for specific
offenses elsewhere in the Code.

Each day that a violation occurs or is per-
mitted to exist by the violator constitutes
a separate offense.
Seeking a civil penalty is authorized in
this Chapter does not preclude the City of
Waukee from seeking alternative relief from
the court in the same action.
C.Any officer authorized by the City to en-
force the Code of Ordinances may issue a
civil citation to a person who commits a
municipal infraction.
The citation may be served by personal ser-
vice or by certified mail,return receipt
requested.
A copy of the citation shall be sent to the
Clerk of the Dallas County District Court.
The citation shall serve as notification
that a civil offense has been committed and
shall contain the following information:
1.The name and address of the defendant.
2 •The name or description of the infrac-
tion attested to by the officer issuing
the citation.
3.The location and time of infraction.

bill for gas valve repair,Carried 4 to O.
Joe Brick spoke to the Council in reference to individual meters
at the trailer court.The Utilities Committee recommended not to
put in individual meters unless the trailer court distribution syste8
was brought up to date and dedicated back to the City.This Datter
was referred back to the Utilities Committee.
Glen Sparks of G &B Auction requested to put a 2nd story on his
building at 600 Ashworth for an apartment,The Zoning Ordinance
states that it is not allowable to have a residence in a business
zone",
Al Munsterman of Snyder &Associates spoke to the Council regarding
the l62nd St,paving project,An estimate cost is $103,100,00,
Council Member Hoifeldt introduced the following resolution herein-
after set out entitled:"Resolution to provide for a notice of
hearing on proposed plans,specifications,proposed form of contract
and estimate of cost for the construction of street improvements,
and the taking of bids therefor,"and moved its adoption,seconded
by Council Member Scott,After due consideration thereof by the
Cuuncil,the Mayor pro-tern put the question on the motion and the

NOW,THEREFORE,Be It Resolved by the City Council of the City ofWaukee,Iowa,as follows:
Section 1.The detailed plans and specifications,notice of
hearing and notice to bidders,form of contract and estimate of cost,
referred to in the preamble hereof be and the same are hereby approved.
Section 2.The Project is necessary and desirable for the City,
and it is in the best interests of the City to proceed toward theconstructionoftheProject.
Section 3.The amolL~t of the bid security to accompany each bid
is hereby fixed at 10%of the amount of the proposal.
Section 4.The ,~th day of April,1989,at7',OO o'clock
~.m.,at the City Hall,Waukee,Iowa,is hereby fixed as the time
and place of hearing on the proposed plans,specifications,form of
contract and estimate of cost for the Project,and also as the time and
place of opening and considering bids previously received by the CityClerkinconnectiontherewith.
Section 5.The City Clerk is hereby authorized and directed to
give notice of the aforementioned hearing and taking of bids by
publication of such notice in a newspaper of general circulation in the
City,which publication shall be made not less than four nor more than
twenty days prior to the time of the said hearing,all in conformity
with Chapters 362 and 384 of the Code of Iowa.The said notice shall
be in the form substantially as attached to this resolution.
Section 6.All provisions setout in the following form of notice
are hereby recognized and prescribed by this Council and all
resolutions or orders or parts thereof,to the extent the same may be
in conflict herewith,are hereby repealed.

The gas installation bill at Denny Dennis'home was tabled until
the next meeting.
