Ken Mitchell spoke to the Council and demonstrated compost recycling fencing.This will be discussed at the next regular meeting. Carolyn \veienith of Iowa Realty spoke regarding co-op advertising promotoing natural gas,housing projects and the City.The city's share would be approximately $280.60 (1 time charge).Chuck Denton of Northern Natural Gas spoke in favor of this type of advertising. Dan Olson,city manager of Clive,and Dennis Spencer of Snyder & Associates spoke in referece to the paving project on l42nd St. Moved by Hoifeldt,second by Scott,to enter into an agreement viith Cl5.ve for $36,300.00 for 954'of paving on 142nd St.at no interest for 10 years,subject to obtaining easement.A roll call vote was held as follows: Ayes:Scott,Uoifeldt,Barrett Nays:None recorded Absent:Gruber,Brown Diane Battani was not present as had been on the agenda. Larry Oetting spoke regarding the 6th Street repair near Cherry. BE IT ORDAINED by the Council of the City of Waukee: 90 June 13,1989---cont Section 1.Section 301.15 of Chapter 301 Haukee Municipal Code,Zoning Ordinance of the City,is hereby amended by deleting therefrom subsection E (4),and in- serting in lieu thereof the following: E.(4 )The individual mobile home lot shall contain not less than four thousand two hundred seventy-five (4,275)square f~et and shall measure at least forty- five (45)by ninety-five (95)feet. Each lot shall have a front yard not les s than twenty (20)feet in depth measured from the edge of the surfaced private street to the closest point of the mobile home.Side and rear yards shall be provided and maintained so as to provide a minimum separation at the nearest point between mobile homes,and other mobile homes on adjoining lots of a t leas t ten (10)feet;and between mobile homes,and other buildings and structures on adjoining lots,of at least six (6)feet;however,side yards as so described shall not be less than five (5)feet,and rear yards as so described shall not be less than eight (8)feet,for any structure.No build- ings or structures shall be placed within twenty (20)feet of the front lot line. AN ORDINANCE ESTABLISHING CONTROLLED ACCESS,AND ESTABLISHING PARKI~G RESTRICTIONS ALONG IOWA HIGHWAY 6 IN THE CITY OF v7AU"CEE:,IOWA,DEFINING THE LUlITS AND POINTS OF ACCESS,THE USE:OF THE LIMITED ACCESS fACILITIES,AND THE RESTRICTIONS O~PARKING. Be it ordained by the City Council of Haukee,Iowa: Section 1.Definition of a Controlled Access Facil-l!Y.For the ~~rposes of this Chapter,a controlled access facility is defined as a highway or street espec- ially designed for through traffic,and over,from or to which owners or occupants of abutting land or other per- sons have no right or easement or only a controlled right or easement of access,light,air,or view by reason of the fact that their property abutts ~pon such controlled- access facility or for any other reason. I I .Iune 13,1989---cont 91 Section 2.Authority to Establish Controlled Access Facilities.The provisions to this Chapter relating to control of access,shall be deemed an exercise of the DO- lice power of the City of Waukee pursuant to Chapter 306A, Code of Iowa,as amended. Section 3.Establishment.There is hereby fixed and established controlled access within the City of Waukee, the center line of such access facilities being described as follows: I A.Iowa Highway 6 from a point 1320'west of the center line of East Street at its intersection with Iowa Highway 6,east at intervals of 1320'to the east city limits;and west from a point 1320'west of East Street at 600'intervals to the west city limits. B.University Avenue from a point on the center line of Ashworth Drive at its intersection with University Avenue east at intervals of 1320'to the east city lim- its. Section 4.Right of Access Limited.No person shall have any right of egress or ingress to,from or across the controlled access facility hereinbefore established ex- cept,at existing points of access,or at such points as may be hereafter jointly established by the Iowa Depart- ment of Transportation and the City of Waukee.The exist- ing points of access are: Section 5.Points of Access Defined.The points of access shall consist of access ways from abutting property to the adjacent traffic lane or roadway and their location shall be expressed in terms of "stations",each represent- ing a distance of one hundred [100]feet measured along the center line of the controlled access facility from the points of reference stated above.Such measurements shall refer to the center of the access ways wh i c n shall be a maximum of 18 feet for agricultural purposes and a maximum of 35 feet in width for commercial purposes I and 80 feet in width for public street purposes. Section 6.Exceptions.The foregoing controlled access facilities shall be subject to possible future public street aCcess openings as approved by the Iowa Department of Trans- portation and the City Council on said Iowa Highway 6.Said access points may be located no closer than one-fourth (1/4) of one mile intervals on Iowa Highway 6. Section 7.Uhlawful Use of Facilities.It shall be un- lawful for any person to: a.Cross Dividing Lines.Drive a vehicle over,upon or across any curb,central dividing section or other separation or dividing line on saie controlled- access facilities. b.Turns.t~ake a left turn or semicircular or \.;-turn except through an opening provided for that purpose, the dividing curb section,separation or line. c.Use of Lanes.Drive any vehicle except in the pro- per lane"provided for that purpose and in that pro- perty direction and to the right of the central di- viding curb,separation section or line. d.Enter facility.Drive any vehicle into controlled access facility from a local service road except through an opening provided for that purpose and the dividing curb or dividing section or dividing line which separates said service road from the controll- ed access facility property. 92 ~1.l;R~13,1989---cont Section 8.Parking Restricted.The parking of vehicles on or along controlled access facilities restricted as fol- lows:. a.Iowa Highway No.6.Parking of any na ture is pro- hibited on Iowa Highway 6 on both sides from the west city limits to the east city limits.This in- cludes all portions of the highway including the traveled portion as well as the shoulders. Sect ion 9.Repealer.All ordinances or parts of ord- inances in conflict with provisions of this Ordinance are hereby repealed. Section 10.Severability ClaLse.If any section,pro- vision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not effect the val- idity of the ordinance as a whole or any section,provision or part thereof not adjUdged inviolate or unconstitutional.
