The long term agreement with U.S.Gas Marketing was tabled until
the Utilities Committee can look it over.
The 12"4th Street water line extension,East Street projects and

The regular meeting of the Waw~ee City Council was called to order
at 7:36 p.m.on August 8,1989 by Mayor Floyd Rosenkranz.
All Councilmen were present except Gruber.

Briari Redshaw advised the Council of a correction to the July 11 minutes
of the total of the bill presentation from $38,467.33 to $40,887.59.
Moved by Hoifeldt,second by Brown,to approve July 11 minutes as
corrected.Carried 4 to O.
Cecil Reynolds,Fire Chief,reported on the progress of the street
dance to be held August 12.He also expressed interest in forming a
safety committee on·the fire department with input from the Council
and the possibility of coverage for the 3 day waiting period on injuries
before Horlman's Comp takes over.Th i,s is to be investigated further.
Reynolds will report back to the Council at the next regular meeting.
Don Henson reported on the meeting with the Township Trustees about
the attack truck.The Trustees gave their approval and he asked for
Co~ncil approval to finalize specs and order.

Dick Schwartz spoke to the Council regarding water line extension
to his property and the Steele property,which are in the City
limits.Chris Bourne,Bill Giles,Dan Harren and Dallas Hakeman ,
who are not in the City limits,also expressed a desire for water
service.Mr Schwartz also presented a letter with questions regard-
ing a water line extension.A letter is to be sent to Warren and
Hakeman regarding annexation.No action was taken at this time.
Tom McClure requested permission to build a house on his lot at
7th &Locust,leaving the present house until the new one is
constructed then tearing it down.

OF WAUKEE,IOliiTA,DEFINING THE LUUTS AND POINTS OF ACCESS,THE USE
OF THE LUUTED ACCESS FACILITIES,AND THE RESTRICTIONS ON PARKIllG.
Be it ordained by the City Council of WaLkee,Iowa:
Section 1.Definition of a Controlled Access Facil-i!Y.For the purposes of this Chapter,a controlled
access f aci li ty is def ined as a highway or s tree t espec-
ially des igned for through traff Ic ,and over,from o r to
which oW0ers or occupants of abutting land or other per-
sons have no right or easement or only a controlled right
or easement of access,light,air,c r view by reason of
the fact that their property abutts Lpon such contrclled-
access facility or for any other reasen.
Section 2.Authoritv to Establish Controlled Access
Facili ties.The provisions to this Chapter relating to
control of access,shall be deemed an exercise of the po-
lice power of the City of Waukee pursLant to Chapter 306A,
Code of Iowa,as amended.

the center line of sueh access facilities being deseribec
as follows:

A.Iowa Highway 6 from a point 1320'wes t;of the
center line of East Street at its intersection with Iowa
Highway 6,east at intervals of 1320'to the east city
limits;and west from a point 1320'west of East Street at
600'intervals to the west city limits.
B.University Avenue from a point on the center line
of Ashworth Drive at its intersection with University
Avenue east at intervals of 1320'to the east city lim-its.
Section 4.Right of Access Limited.No person shall
have any right of egress or ingress to,from or across the
controlled access facility hereinbefore established ex-
cept,at existing points of access,or at such points as
may be hereafter jointly established by the Iowa Depart-
ment of Transportation and the City of Waukee.The exist-ing points of access are:IUNIVERSITYAVENUE
A.Stationing along University Avenue:
The centerline intersection of University Avenue and Ashworth
Drive is Station 34+50.Stationing increases from West to

Section 5.Points of Access Defined.The points of
access shall consist of access ways from abutting property
to the adjacent traffic lane or roadway and their location
shall be expressed in terms of "stations",each reoresent-

the center line of the controlled access facility from the
points of reference stated above.SLch measurements shall
refer to the center of the access vlays wh i ch shall be a
~aximum of 18 feet for agricultural pLrposes and a maximum
of 35 feet in width for commercial purposes,and 80 feet
in width for public street purposes.
Section 6.Exceptions.The foregoing controlled access
facilities shall be subject to possible future public street
access openings as approved by the Iowa Department of Trans-
portation and the City Council on said Iowa Highway 6.Said
access points may be located no closer than one-foLrth (1/4)
of one mile intervals on Iowa Highway 6.
Section 7.Unlawful Use of Facilities.

through an opening provided for that purpose and the
dividing curb or dividing section or dividing line
which separates said service road from the controll-
ed access facility property.

Section 8.Park.inq Restricted.The parking of vehicles
on or along controlled access facilities restricted as fol-lows;
a .Iowa Highway no.6.Parking of any nature is pro-
hibited on Iowa Highway 6 on both sides from the
west city limits to the east city limits.This in-
eludes all port ions of the highway inc 1ud ing the
traveled portion as well as the shoulders.

The Christian Church withdrew their request for a zoning change
of their property.No action was taken.
The long term agreement with U.S.Gas Marketing was discussed.A
majority of the Utilities COIDIDitteerecommended this agreement.
Kurt Garst of USGM answered questions.He will have parts of
the contract rewritten and resubmit.
Al Munsterman report on negotiation with Dr.Dakovich on utility
easements and right-oi-way.

to name Harry Jones as Public Works Supervisor and to hire 2 main-

was also presented.

A water/sewer school,set for September 5 and 6,was discussed.
It was decided to send 1 maintenance employee to water school
and another to sewer school.
