BE IT ORDAINED by the City Council of Waukee,Iowa: That the following described real estate be (Central Business District)to R-3 (Multi-FamilySection1. rezoned from C-2 Res idential). Lots 3,4,5,and 6 of Block 9 of First Addition,Waukee,Dallas County,Iowa Section 2. effect after its required by law. Effective Date.This ordinance shall.be in final passage,approval,and publication as Passed by the Council this 8th day of May,1990 and approved this 8th day of May,1990. The City Council took no action to exclude the Harmon Priel voluntary annexation petition as approved on May 8,1990. RESOLUTION NO. 174 Extending the maturity date of outstanding warrants issued for the purpose of defraying costs in connection with the ~onstruction of the city's NW 162 Street Paving ?roject -1989 WHEREAS,the city of Waukee,Iowa (the "City"),has previously authorized the issuance of warrants in the aggregate principal amount of $110,000 (hereinafter referred to as the "Warrants")bearing interest at the rate of Seven and Three- quarters Per Cent (7 3/4%)per annum for the purpose of defraying costs in connection with the construction of the ci'cy's NW 162 street Paving Project -1989 (hereinafter referred to as the "Project");and ' WHEREAS,the Warrants were made payable on or before June 1, 1990;and WHEREAS,the city intends to refund the Warrants through the issuance of bonds or notes,but the refunding proceeds will not be available 'to the City by June 1,1990;and WHEREAS,the owners of the Warrants are in agreement to extend their maturity date to September 1,1990,on the condition that accrued interest on the Warrants be paid on June 1,1990, and that the Warrants will continue to bear interest at the rate of Seven and Three-quarters Per Cent (7 3/4%)per annum from June 1,1990,to their maturity on September 1,1990; NOW,THEREFORE,Be It Resolved by the City of Waukee,Iowa, as follows: section 1.The maturity date of the Warrants is hereby extended to september 1,1990.The accrued interest on the Warrants shall be paid on June 1,1990,and the Warrants shall continue to bear interest at the rate of Seven and Three-quarters Per Cent (7 3/4%)per annum from June 1,1990,to their maturity. ,Section 2.The City Council hereby reserves the right to prepay the amount represented by the Warrants individually at any time p£ior to the maturity thereof with accrued interest to the date of such payment,all as authorized by applicable Laws of the State of Iowa. section 3.The Mayor and City Clerk are hereby authorized and directed to enter into Whatever legal documents are required by the owners of the Warrants to effectuate the provisions of this resolution.
