APRIL 9,1991
The Regular meeting of the Waukee City Council was called to order at 7:08
P.M.,on Tuesday,April 9th,1991 at the Waukee Public Library.Mayor
Floyd Rosenkranz was presiding.
Marilyn F.Deets,City Treasurer,was present and taking minutes.
Roll was taken and the following councilmen were present:
Clark,Scott,Gruber,Bailey,Barrett
Moved by Gruber,second by Clark to approve the minutes of 3/7 with the
word Construction on the bottom of page 259 changed to Constitution,3/12
subject to an itemized bill presentation,and 3/25.Motion carried 5 to 0.

Tim Massey,Municipal Supp1y-Mr.Massey presented information regarding
the automated meter reading system.
Moved by Gruber,second by Scott to approve the proposal from Municipal
Supply in the amount of $25150.50 for the automated meter reading system.
Motion carried 5 to 0.
Jea nie McReynolds-Presented a list of questions from residence of
Green Hill Estates.

3.Road Maintenance
4.School Bussing
Council stated that Police Department is currently patrolling the area.At
this time the City is unable to commit to a time table for running
utilities to the area.City needs to see which way the annexation battle
goes.The Road is private property.If owner wants to work With the City
Engineer to bring the road up to specification and deed the road to the
City,the City may take over the maintenance.
Lloyd Royer-Waukee Business Association is planning the Fall Festival
for September 21st.Requested reservation of the Triangle and to have the
streets blocked around 9:00 A.M.
Moved by Clark,second by Scott to reserve the Triangle for September 21st
and to block the streets for the Fall Festival.Motion carried 5 to 0.

and Fun Days.Requested the
Police Department.
Jaycees are planning a 4th of July parade
use of the Park and blocking of streets by the

the 4th of July Fun Days,and to authorize Police to help With the Parade.

Discussion was held on running a gas main extension up University from

Matters Regarding Annexation Before the City Development Board -City
Attorney,Paul Huscher,stated that we have thirty days to respond to theCourt.
Councilman Clark Introduced the Sanitary Sewer Ordinance Amendment.
It was moved by Councilman GrUber,and seconded by Councilman Scott,that
the Ordinance entitled:"AN ORDINANCE TO AMEND SECTION 303.161 OF CHAPTER
303,WAUKEE,MUNICIPAL CODE.AN ORDINANCE AMENDING SECTION 303.161
PROVIDING FOR PERCOLATION TESTS REQUIRED BY THE DALLAS COUNTY HEALTH

DEPARTMENT AS WELL AS THE CITY'S ENGINEER,AND FURTHER PROVIDING FOR DRY
SEWERS WHERE PUBLIC SANITARY SEWER IS NOT AVAILABLE."Be now read by the

ORDINANCE NO.
AN ORDINANCE TO AMEND SECTION 303.161 OF CHAPTER 303,WAUKEE,
MUNICIPAL CODE.AN ORDINANCE AMENDING SECTION 303.161 PROVIDING FOR
PERCOLATION TESTS REQUIRED BY THE DALLAS COUNTY HEALTH DEPARTMENT AS WELL
AS THE CITY'S ENGINEER,AND FURTHER PROVIDING FOR DRY SEWERS WHERE PUBLIC
SANITARY SEWER IS NOT AVAILABLE.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 303.161 of Chapter 303,Waukee Municipal Code,is
hereby amended by deleting the follOWing paragraph:
"Where a public sanitary sewer is not available,the minimum lot areas
shall conform to the reqUirements of Section 303.130 of this
ordinance.The sUbdivider shall make,or cause to be made,
percolation tests of the soil as required by the City's Engineer.
These tests shall be the basis for design of individual sanitation
facilities."
And inserting in lieu thereof as follows.
"Where a public sanitary sewer is not available,the minimum lot areas
shall conform to the reqUirements of Section 303.130 of this
ordinance.The subdivider shall make,or cause to be make,
percolation tests of the soil as required by the Dallas County Health
Department and City's Engineer.These tests shall be the basis for
design of individual sanitation facilities.Dry sewer shall be
provided in addition to other sanitation facilities unless this
requirement shall have been waived by the City Council upon
recommendation of the commission."
Section 2.Effective Date.This ordinance shall be in effect after
its final passage,approval,and publication as required by law.

the Ordinance entitled."AN ORDINANCE TO AMEND SECTION 303.2 OF CHAPTER
303,WAUKEE,MUNICIPAL CODE.AN ORDINANCE AMENDING SECTION 303.2 TO
PROVIDE FOR REVIEW AND APPROVAL OF SUBDIVISIONS WITHIN TWO MILES OF THE
BOUNDARIES OF THE CITY OF WAUKEE,AND TO INCORPORATE PROVISIONS OF SECTION
409A.9,CODE OF IOWA."Be now read by the City Clerk.The Mayor put the
question on the Motion,and roll being called,the following named

CODE.AN ORDINANCE AMENDING SECTION 303.2 TO PROVIDE FOR REVIEW AND
APPROVAL OF SUBDIVISIONS WITHIN TWO MILES OF THE BOUNDARIES OF THE CITY oj
WAUKEE,AND TO INCORPORATE PROVISIONS OF SECTION 409A.9,CODE OF IOWA.~
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 303.2 of Chapter 303,Waukee Municipal Code,is
hereby amended by deleting the following paragraph:
The purpose of this ordinance is to provide regulations and standards
to guide land subdivision in the City of Waukee and in the area within
two (2)miles of any city limit line of Waukee in order to promote
the public health,safety,convenience and general welfare of the
municipality.It shall be administered to insure the orderly growth
and development and to insure adequate provision for circulation,
utilities and serVices.To these ends the City of Waukee hereby
adopts the provisions and the restrictions of Section 409.14,Code of
Iowa,as amended,and the same is hereby incorporated herein by this
reference.
And inserting in lieu thereof as follows:

conditions for review and approval established by any agreement of the
City and county pursuant to Chapter 28E,or in the event of
overlapping areas with any other city,standards established by
agreement with such city pursuant to Chapter 28E,if such agreement,
or agreements,should differ form the standards and conditions used
for reView and approval of SUbdivisions within the City of Waukee.,--Section 2.Effective Date.This ordinance shall be in effect after
its final passage,approval,and publication as required by law.

BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 216.2 of Chapter 216,Waukee Municipal Code,is
hereby amended by deleting the following paragraph:
"It shall be unlaWful for any.person or persons,corporation or
corporations,partnerships or associations other entities to excavate in,
or remove or disturb any city sidewalk,curb or service in any city street,
alley,sidewalk,public park,or other property of the city including
pUblic areas which have no such sidewalks,curbs or other hard surface,and
city easements,unless such person or persons,corporation or corporations,
partnership or association or other business entity shall first have
obtained a permit from the city authorizing such excavation."
And inserting in lieu thereof as follows:
"It shall be unlawful for any person or persons,corporation or
corporations,partnerships or associations or other entities,except the
city of Waukee,to excavate in,or remove or disturb any city sidewalk,
curb or service in any city street,alley,sidewalk,public park,or other

OF WAUKEE,IOWA,TO PROVIDE FOR FIXING OF FEES AND COSTS BY RESOLUTION OF
THE CITY COUNCIL.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.28 of Chapter 301 Waukee Municipal Code,is
hereby amended by deleting the following paragraph:
"Before any action shall be taken as provided in this part,the party
or parties proposing or recommending a change in the district
regulations or district boundaries shall deposit with the City Clerk
the sum of ten (10)dollars to cover the approximate costs of this
procedure and under no conditions shall said sum or any part thereof,
be refunded for failure of said amendment to be enacted into law."

The City Council shall establish a schedule of fees,charges,and
expenses and a collection procedure for amendment to this zoning
ordinance.The schedUle of fees shall be posted in the office of the

The special meeting of the Waukee City Council was called to order at 7:15 P.M.by Mayor
Floyd W.Rosenkranz.B~ian J.Redshaw was present and taking minutes.
A roll call was taken and the following Councilment were present:Gruber,Bailey,Barrett,

Guests:Steve Pierce-Veenstra &Kirrm,Steve Venard,Bart Weller,Don Henson,Frank Hoifeldt,
Larry Phillips,Ann Ford,Randy Foster,Rick Ross,Mark Casey.
Scott arrived at 7:25 P.M.
Steve Venard of Bishop Engineering presented a revised Preliminary Plat of Westfield.Rick
Ross,developer,also appeared.This came back to the Council after going back to the
Planning &Zoning to look over changes.The P&Z vote was 2-2.Moved by Bailey,second by

Don Henson,Fire Chief,presented a request for a fire hose purchase in the amount of
