The regular meeting of the Waukee City Council was called to order at 7:00
P.M.,on Tuesday,June 11,1991 at the Waukee City Hall.Mayor Floyd
Rosenkranz was presiding.
Marilyn F.Deets,City Treasurer,was present and taking minutes.
Roll was taken and the following councilmen were present:Clark,Scott,
Gruber,Barrett,and Bailey.
Moved by Bailey,second by Clark to approve the minutes of 5/3,and 5/14.
Motion carried 5 to 0.
Dennis Felt The City Council proposed $1500.00 with no contingencies for
the easement.The letter was declined with a counter offer of $2500.00

Jerry Oliver.Mr.Oliver with Civil Engineering representing Bill Knapp
II.Asked for waiver of the dry sewer ordinance for plat being planned on
University Avenue.He stated that lots are in excess of 1 acre.If
ordinance is not waived,he will wait to develop the area.Mr.Steven
Grubb and Rick Ross were also present.They do not see the area being
sewered anytime in the near future.

Mark Gruber Mr.Gruber presented the council with a petition that would
allow a woodworking shop next to Olson Brothers/Sinlair.The City
Administrator and the City Attorney will draft a conditional Ordinance that
will fit the situation.
Claude Ramsey A request from Mr.Ramsey to save the trees in the way of
the sewer line.The City Council stated they would look into alternatives
and do their best to save the trees.
Tom Mehl Presented the Council with options for funding the sewer
project.
RESOLUTION NO.174
Resolution providing for the issuance of warrants in connection with
the construction of the 1990 Industrial Park Utility Improvements,contract
2 -Sewers,Lift Station,Force Main and Water Main Project.
WHEREAS,the City Council of the City of Waukee,Iowa (the "City"),has
authority to issue warrants for the purpose of defraying costs in
connection with the construction of the 1990 Industrial Park Utility
Improvements,Contract 2 -Sewers,Lift Station,Force Main and water Main
Project (hereinafter referred to as the "Project").and
June 11,1991
WHEREAS,to pay for authorized costs of the Project,it is
necessary to issue warrants in the aggregate principal amount of
$1,030,000,pursuant to the provisions of Section 384.57 of the
Code of Iowa.
NOW,THEREFORE,It Is Resolved by the City Council of the City of
Waukee,Iowa,as follows:
Section 1.The City Clerk is authorized and directed to
issue $1,030,000,Warrants,at a discount of $10,300 (the
"Warrants"),as authorized by Section 384.57 of the Code of Iowa,
to Ruan Securities Corporation,Des Moines,Iowa (the
"Purchaser"),to be payable from such fund or funds of the City
as are legally available for such purpose,including,but not
limited to,proceeds from the sale and issuance of General
Obligation Bonds,Water Revenue Bonds and/or Sewer Revenue Bonds,

the futuce Net Revenues of the Municipal SanitacY Sewec System
and the Municipal Watecwocks System of the City,and pcoceeds of
govecnmental gcants andloc loans as may be obtained by the City.
The waccants shall be signed by the Mayoc and attested by the
City Cleek with the seal of the City Affixed and deliveced to the
afocesaid Pucchasec,shall be dated as of the date of theic
delivecy to the Pucchasec,shall matuce on June 1,1992,shall
be in the denomination of $5,000 each,oc any integcal multiple
theceof,and shall beac intecest at the cate of Five and Eighty-
Hundcedths Peccent (5.80%)pee annum,payable on Novembec 1,
1991 and June 1,1992,except as the pcovisions heceinaftec set
fOcth with cespect to cedemption pcioc to matucity may be oc
become applicable heceto.
Section 2.The Waccants shall be in substantially the focm
as attached to this cesolution and shall be payable as to
pcincipal and intecest in accocdance with the teems set fOcth
thecein.
Section 3.The City shall maintain as confidential the
cecocd of identity of ownecs of the Waccants,as pcovided by
Section 22.7 of the Code of Iowa.
Section 4.The City Cleek is heceby designated as the
Registcac and Paying Agent with cespect to the Waccants.
Section 5.The City cesecves the eight to pcepay the
Waccants in whole oc in pact on any date pcioc to matucity upon
teems of pac and acccued intecest.The Waccants may be called in
pact in one oc moce units of $5,000.If less than the entice
Pcincipal amount of any Waccant in a denomination of moce that
$5,000 is to be cedeemed,the Registcac will issue and delivec to
the cegisteced ownec theceof,upon succendec of such ociginal
Waccant,a new Waccant oc Waccants,in any authocized
denomination,in a total aggcegate pcincipal amount equal to the
uncedeemed balance of the ociginal Waccant.Notice of such
cedemption as afocesaid identifying the Waccant oc Waccants (oc

to the cegisteced ownecs theceof at the addcesses shown on the
City's cegistcation books not less that 15 days pcioc to such
cedemption date.All of such Waccants as to which the City

notice as afocesaid shall have been given and fOe the cedemption
of which funds ace duly pcovided,shall cease to beac intecest on
the cedemption date.
Section 6.It is the intention of the City that intecest
on the Waccants be and cemain excluded focm gcoss income fOe
fedecal income tax pucposes pucsuant to the appcopciate
pcovisions of the Intecnal Revenue Code of 1986,as amended,and
the TceasucY Regulations in effect with cespect theceto (all of
the focegoing hecein cefecced to as the "Intecnal Revenue Code").
In fUcthecance theceof,the City covenants to comply with the
pcovisions of the Intecnal Revenue Code as they may fcom time to
time be in effect oc amended and fUcthec covenants to comply with
decisions as may be necessacy to insuce that the intecest on the
Waccants will cemain excluded focm gcoss income fOe fedecal
income tax pucposes.Any and all of the officecs of the City ace
heceby authocized and dicected to take any and all actions as may
be necessacY to comply with the covenants hecein contained.
The Waccants ace heceby designated as "Qualified Tax Exempt
Obligations"as that teem is used in Section 265 (b)(3)(B)of
the Intecnal Revenue Code.
Section 7.All cesolutions oc ocdecs oc pacts theceof in
conflict hecewith be and the same ace heceby cepealed,to the
extent of such conflict.

access from time to time to the safe deposit compartment(s)in
the vaults of the Brenton State Bank (hereinafter called "Bank")
rented in the name of this Corporation,subject to the terms and
conditions of the rental Agreement in effect with such Bank from
time to time,and be it
FURTHER RESOLVED,:That said Bank is hereby authorized and
requested to grant access from time to time to said safe deposit
compartment(s)in accordance with the foregoing resolution until
the authority thereby granted has been revoked and written notice
of such revocation signed by an office of this Corporation has

That before any action shall be taken as to the filing of

plat,shall pay to the clerk of the City of Waukee a fee to cover
costs of the procedure.Under no condition shall said fee or any
part thereof be refunded for failure of said plat to be approved.
The amount of the fee shall be determined in accordance with the
following schedule:
A.AUditor's Plat -twenty dollars ($20.00).
B.Preliminary plat without streets -thirty dollars ($30.00)
plus one dollar ($1.00)per lot.
C.Preliminary plat with streets -forty dollars ($40.00)plus
one dollar ($1.00)per lot
D.Final Plat without streets -twenty dollars ($20.00)plus
one dollar ($1.00)per lot.
E.Final plat with streets,thirty dollars ($30.00)plus one
dollar ($1.00)per lot.
F.All additional costs incurred by the City of Waukee for plat

pay to the City Clerk a filing fee to cover the costs of the
procedure.Under no conditions shall said sum or part thereof be

The amount of the fee shall be determined in accordance with thefollowingfeeschedule:

Mayor presented a letter from the Des Moines Metropolitan Transit
Authority regarding the possibility of the Metro having routes in
Waukee.Asked the Councils opinion on sending out a survey to
see in citizens are interested.Council approved the mailing.

Moved by Scott,second by Clark to aprove the payment of $2,000.00 to Dennis and
