Donald Lee Bailey was presiding. order at 7:09 Mayor Pro-Tem Marilyn F.Deets,Treasurer,was present and taking minutes. Roll was taken and the following Councilmen were present: Gruber,Bailey.Absent:Scott,Mayor Rosenkranz Barrett,Clark, Moved by Clark,second by Gruber,to approve the minutes of 7/9/91,and 7/22/91.Motion carried 4 to 0. Jerry Purdy Mr.Purdy was representing Immanuel Lutheran Church and requested a waiver of the 25'set back for the parking lot.Will appear before the Board of Adjustment on the 19th of August.Stated the Site Plan was tabled by Planning &Zoning.Council stated that they had no jurisdiction. Erwin Jansma Mr.Jansma expressed his concern about the lack of information regarding the sewer project.Stated that the residents area should have been contacted prior to the start of the project. questioned if the area effected would be sodded or seeded.The City Engineer stated that at this point the plan is to seed. in the Also The Mayor Pro-Tem stated that this is the time and place for the public hearing on the re-zoning amendment of Section 301.9 (A)of the Code of Waukee,Iowa.He then asked if there were any questions or concerns.None noted.He asked if the Clerk received any questions or concerns in writing.None noted.Public hearing was then closed. Councilman Clark introduced an Ordinance entitled:"AN ORDINANCE TO AMEND SECTION 301.9(A)OF CHAPTER 301,WAUKEE,MUNICIPAL CODE.AN ORDINANCE Af~ENDING SECTION 301.9(A)PROVIDING FOR AN ADDITIONAL USE IN THE"A-l " AGRICULTURAL DISTRICT OF A MINIATURE GOLF COURSE AND DRIVING RANGE." BE IT ORDAINED by the Council of the city of Waukee: Section 1.Section 301.9(A)of Chapter 301,Waukee Municipal Code,is hereby amended by adding the following paragraph: (11)"'1iniature golf course and driving range placed in the same tract of ground as a full size golf course having at least 9 holes,and a total par of not less than 27.Neither the driving range nor the miniature golf course may be placed within 100 feet of the property boundary line. BE IT ORDAINED by the Council of the city of Waukee' Section 1.Section 301.9(A)of Chapter 301,Waukee Municipal Code,is ~ hereby amended by adding the following paragraph, (11)"~1iniature golf course and driving range placed in the same tract of ground as a full size golf course having at least 9 holes,and a total par of not less than 27.Neither the driving range nor the miniature golf course may be placed within 500 feet of any adjoining Rl or R2 district or within 100 feet of any property boundary line." Section 2.Effective Date.This ordinance shall be in effect after its final passage,approval,and publication as required by law. It was moved by Councilman Clark,and seconded by Councilman Barrett,that the rule that an ordinance must be received and filed at two meetings prior to the meeting when final action is taken or,if published in summary,be received and filed at one meeting prior to the meeting of final action,be dispensed with.The Mayor Pro-T~m put the question on the motion,and the roll being passed,the following named Councilmen voted, Ayes,Clark,Gruber,Barrett,Bailey Absent,Scott Motion carried 4 to 0. It was moved by Councilman Gruber,and seconded by Councilman Clark,that the Ordinance entitled "AN ORDINANCE TO AMEND SECTION 301.9(A)OF CHAPTER 301,WAUKEE,MUNICIPAL CODE.AN ORDINANCE AMENDING SECTION 301.9(A)__ PROVIDING FOR AN ADDITIONAL USE IN THE"A-l "AGRICULTURAL DISTRICT OF A MINIATURE GOLF COURSE AND DRIVING RANGE",be now put upon its final passage and adoption.The Mayor Pro-Tem put the question on the final passage and adoption of said Ordinance,and the roll being called,the following named Councilmen voted, Ayes:Bailey,Barrett,Clark,Gruber Absent,Scott Whereupon,the Mayor Pro-Tem declared said Ordinance duly adopted and passed,and signed his approval to said Ordinance. Moved by Clark,second by Bailey,to approve the purchase of a Fire Truck Chassis from Mid States Truck Sales in the amount of $5623.25. Moved by Clark,second by Gruber,to raise the Library Aide wage from $4.50 to $5.00 per hour effective 07/01/91.Motion carried 4 to 0. The Mayor Pro-Tem stated that this is the time and place for the pUblic hearing on the re-zoning amendment of section 301.16(A)(5)of the Code of Waukee,Iowa.He then asked if there were any questions or concerns.None noted.He asked if the Clerk received any questions or concerns in writing.None noted.Public hearing was then closed. Bob Sommerfield Requested the City provide a Utility Easement along Highway 6 on the North side for placement of a Fiberoptic cable.Council stated that the Mayor had some reservations regarding this project.Stated he would need to discuss this with the Mayor when he returned. Southfork Home Owners Association Council addressed some complaints from some of the home owners.Council stated that the problem with the Street Lights is being handled.Problem with silt in the lake is the home owners problem.City will handle the mud on the road on the south side of the dam. ORDINANCE 2145 AN ORDINANCE AMENDING CHAPTER 10B OF THE CODE OF ORDINANCES OF THE WAUKEE, IOWA,BY ADDING ADDITIONAL POWERS,AND DUTIES OF THE TREASURER. A.Custody of Funds.Be responsible for the safe custody of all funds of the City in the manner provided by law,and council direction,including all funds received or held in custody for any board or commission or agency existing in the City created by Councilor the people including the following. 1.The Treasurer shall keep the record of each fun separate. 2.The Treasurer shall keep an accurate record of all money or securities received by the Treasurer on behalf of the municipality and specify date,from whom,and for what purpose received. 3.The Treasurer shall prepare a receipt in triplicate for all funds received.The Treasurer shall give the original to the party delivering the funds,send the duplicate to the Clerk,and retain the triplicate. 4.The Treasurer shall keep an accurate,separate account of all disbursements,money or property,specifying date,to whom,and from what fund paid. 5.The Treasurer shall immediately upon receipt of monies to be held in his/her custody and belonging to the city,deposit the same in banks selected by the City Council in amounts not exceeding monetary limits authorized by the City Council. B.Reconciliations,Reports.Reconcile the bank statements with the City's books and certify monthly to the council the balance of cash and investments of each fund and amounts received and disbursed. C.Debt Service.Keep a register of all bonds out standing and record all payments made of interest and principal. D.Investments.Advise the Council on investments and shall invest City monies not immediately needed at interest in accordance with Council directives and the requirements of Section 452.10,of the Iowa Code.The treasurer shall determine the anticipated level of bank deposits for making the depository declaration to the State Treasurer as reqUired by Chapter 453 of the Iowa Code.
