HomeMy WebLinkAbout1991-08-26-Special Minutes-39- The Special meeting of the Waukee City Council was called to order at 7:35 P.M.on Monday,August 26,1991 at the Waukee City Hall.Mayor Floyd Rosenkranz was presiding. Marilyn F.Deets,Treasurer,was present and taking minutes. Roll was taken and the following Councilmen were present: Gruber,Barrett,Scott,Bailey Clark, Moved by Clark,second by Bailey,to approve the bill presentation in the amount of $37224.42.Motion carried 5 to 0. Matters regarding annexation pending before the City Development Board Paul Huscher informed the Councel as to the outcome of the meeting of the City Development Board on Wednesday,August 21st.Stated that a Public hearing was set for September 10,1991,to consider the contiguity of the territory in the voluntary petitions.Also a Public hearing was set for October 8,1991,at the Waukee High School to consider the voluntary petitions.Mr.Huscher stated the City of Clive filed a complaint as to the contiguity of our voluntary petitions.Mr. Huscher stated that all papers are in order. Joint Westside Storage Project Brian Redshaw,City Administrator,and Marilyn Deets,Treasurer,met with Tom Mehl, Fiscal Agent,pertaining to debt limits for the Westside Storage Project.No decision was made at this time. Matters Regarding the Golden Grinder Chief of Police,Larry Phillips,stated that matter was turned over to the Attorney General's office and they will bring the matter in front of the State Liquor Commission.The Commission will then rule either to suspend or revoke the Golden Grinder's Liquor License. Councilman Gruber introduced an Ordinance entitled:"AN ORDINANCE AMENDING CHAPTER 405 OF THE WAUKEE MUNICIPAL CODE OF WAUKEE, IOWA,BY PROVIDING FURTHER PROHIBITED AREAS OF PERSONS BODIES IN ANY PUBLIC PLACE OR IN ANY PLACE WHERE SUCH EXPOSURE IS SEEN BY ANOTHER PERSON OR PERSONS LOCATED IN ANY PUBLIC PLACE." It was moved by councilman Clark,and seconded by Councilman Barrett,that the Ordinance entitled:"AN ORDINANCE AMENDING CHAPTER 405 OF THE WAUKEE MUNICIPAL CODE OF WAUKEE,IOWA,BY PROVIDING FURTHER PROHIBITED AREAS OF PERSONS BODIES IN ANY PUBLIC PLACE OR IN ANY PLACE WHERE SUCH EXPOSURE IS SEEN BY ANOTHER PERSON OR PERSONS LOCATED IN ANY PUBLIC PLACE,"be now read by the City Clerk.The Mayor put the question on the motion,and the roll being called,the following named Councilmen voted: Ayes: Nays: Motion Clark,Scott, None recorded carried 5 to 0 Gruber,Bailey,Barrett ORDINANCE 2146 ,AN ORDINANCE AMENDING CHAPTER 405 OF THE WAUKEE MUNICIPAL CODE OF WAUKEE,IOWA,BY PROVIDING FURTHER PROHIBITED AREAS OF PERSONS BODIES IN ANY PUBLIC PLACE OR IN ANY PLACE WHERE SUCH EXPOSURE IS SEEN BY ANOTHER PERSON OR PERSONS LOCATED IN ANY PUBLIC PLACE. Section 1.Section 405.1(A)(1)of the Code of Ordinances of the City of Waukee,Iowa,is hereby amended by deleting the following: 1."A woman's nipple,the aerola thereof,or full breast, e)(cept as necessary in the breast-feeding of a baby." and inserting in lieu thereof as follows: 1."A woman's nipple,the aerola thereof,or any portion of the female breast at or below the nipple thereof, except as necessary in the breast-feeding of a baby." Section 2.Effective Date. effect after its final passage, This ordinance shall be in approval,and pUblication as required by law.-40- It was moved by Councilman Gruber,and seconded by Councilman Bailey,that the rule that an ordinance must be received and filed at two meetings prior to the meeting when final action is taken or,if published in summary,be received and filed at one meeting prior to the meeting of final action,be dispensed with. (S)Floyd Rosenkranz,Mayor ATTESTED, (S)Brian J.Redshaw,City Clerk/Administrator Kathy Manning and Larry Stanley presented the Council with a petition containing 4B0 signatures opposing the entertainment being conducted at the Golden Grinder Lounge.They asked for the Councils support in ending this type of entertainment in the City of Waukee.- It was moved by Councilman Clark,and seconded by Councilman Barrett,that the Ordinance ehtitled:"AN ORDINANCE TO AMEND SECTION 301.16 (A)(5)OF CHAPTER 301,WAUKEE,MUNICIPAL CODE. AN OROINANCE AMENDING SECTION 301.16 (A)(5)PROVIDING FOR AN ADDITIONAL PERMITTED USE AS A RETAIL BUSINESS OR SERVICE ESTABLISHMENT IN THE "C-1"CO~1MUNITY COMMERCIAL DISTRICT,"be now read by the City Clerk.The Mayor put the question on the motion,and the roll being called,the following named Councilmen voted: Ayes:Scott,Bailey,Barrett,Clark, Nays,None recorded Abstain:Gruber Motion carried 4-0-1 It was moved by Councilman Scott,and seconded by Councilman Bailey,that the rule that an ordinance must be received and filed at two meetings prior to the meeting when final action is taken or,if published in summary,be received and filed at one meeting prior to the meeting of final action,be dispensed with. AN ORDINANCE AMENDING SECTION 301.16 (A)(5)PROVIDING FOR AN ADOITIONAL PERMITTEO USE AS A RETAIL BUSINESS OR SERVICE ESTABLISHMENT HI THE "C-l"COMMUNITY COMMERCIAL DISTRICT,"be now put upon its final passage and adoption.The Mayor put the question on the final passage and adoption of said Ordinance,and the roll being called,the following named Councilmen voted: Ayes:Bailey,Clark,Barrett,Scott -41- Nays,None recorded Abstain,Gruber Motion carried 4-0-1 Whereupon,the Mayor declared said Ordinance duly adopted and passed,and signed his approval to said Ordinance. ORDINANCE 2147 AN ORDINANCE TO AMENO SECTION 301.16 (A)(5)OF CHAPTER 301, WAUKEE,MUNICIPAL CODE.AN ORDINANCE AMENDING SECTION 301.16 (A) (5)PROVIDING FOR AN ADDITIONAL PERMITTED USE AS A RETAIL BUSINESS OR SERVICE ESTABLISHt1ENT IN THE "C-1"COMtWNITY COMMERCIAL DISTRICT. BE IT ORDAINED by the Council of the City of Waukee' Section 1. Municipal Code, paragraph, Section 301.16 (A)(5)of Chapter 301,Waukee is hereby amended by adding the following (fff)"Wood specialty shop in which not less that 20% of the building or structure on the property is devoted to retail sales of the wood specialties created in the shop;and in which no more than four persons are employed." Section 2.Effective Date. effect after its final passage, required by law. (S)Floyd Rosenkranz,Mayor ATTEST, (S)Brian J.Redshaw,Clerk/Administrator The Mayor stated that this is the time and place for the FY 91/92 budget amendment hearing for the purchase of a fire truck chassis.He asked if there were any questions or comments.None were noted.He then asked if any questions or comments were received by the Clerk.None were noted.Public hearing was then closed. Moved by Bailey,second by Gruber to adopt a Resolution approving the FY 91/92 budget amendment in the amount of 5224.00 for the purchase of a fire truck chassis.Roll Call, Ayes,Barrett,Clark,Scott,Gruber,Bailey Nays,None recorded Motion carried 5 to 0 Economic Development Incentives-Developer requested the City purchase property with T.I.F.financing in order for them to locate in the City of Waukee.Discussion was held and it was a consensus of the Council that they do not want to subsidize land acquisition. Moved by Scott,second by Clark to adopt a Resolution providing utilities to the specific property line and assistance with Industrial Revenue Bonds with a decision by the developer to either use T.I.F.or tax abatement.Roll Call, Ayes,Gruber,Scott,Barrett,Bailey,Clark Nays,None recorded Motion carried 5 to 0. 1991 Leaaue Convention Moved by Gruber,second by Bailey to send Brian Redshaw to the League Convention in Cedar Rapids, September 11 -13.Motion carried 5 to 0. Mayor Rosenkranz informed the Council that he signed the D.O.T. permit for Kiewitt Technologies for a utility easement along Highway 6. -42- Moved by Clark,second by Barrett to approve the payment to Wicks in the amount of $3446.00.Motion carried 5 to 0. Moved by Clark,second by Gruber,to appoint John Grisso to the Library Board of Trustees with the term to expire June 30,1992, to replace Philanna Grier.Motion carried 5 to 0. Industrial Council Proposal Industrial Council presented a bid of $4500.00 for doing a employee handbook with job descriptions. Council felt bid was out of line and requested bids from other companies. Fire Department Building Design Preliminary draft of the Fire Station Plan was presented to the Council by a representative of Voorhees Design Consultants.Fire Department requested permission of the Council to display designs at the Pancake breakfast.Council gave its approval. Sugar Creek Golf Course No representative was present. Council stated they must appear before the Planning &20ning Commission before any work can be done. Moved by Gruber,second by Scott to adjourn at 9,15 P.M. carried 5 to 0. Motion ATTEST,
