The August 3,1992 Waukee City Council regular meeting was called to order at 7:02 p.m.by
Mayer Pro-tern Donald Bailey with Bob Ba=ett taking minutes.
Roll call was taken and the following Councilmen were present:Don Bailey,Jr,Ray Clark,
Frank Duray,Nick Gruber and Curtis Scott.Mayor Floyd Rosenkranz was absent.
Staff and guests present were:Gilbert Stanley,Jeff Abbas,Don Henson,Bob Underberg,

Approval of July 20th Minutes.Motion by Councilman Clark and seconded by Councilman
Duroy to approve the minutes of July 20,1992 as presented.Motion carried 5 to O.
Bill Presentation.Motion by Councilman Scott and seconded by Councilman Gruber to approve
payment of bills as presented totaling $148,151.87.Motion carried 5 to O.

Open Forum.James De Witt,Jr.,First Responder Captain,spoke to the Council about the
need to replace the department pagers and submitted bids.Jim requested a budget amendment
to allow for the purchase of 7 pagers for the Responders.After discussion,a motion
was made by Councilman Durcy and seconded by Councilman Gruber to set August 11th at 7:30 p.rn,
as the date and time for the public hearing to consider a $900.00 amendment to the
FY92-93 budget.Motion carried 5 to O.
MD Utility 1Iactor Bids.Harry Jones presented and explained bids to replace the
Maintenance Department utility tractor.After discussion,a motion was made by Councilman
Clark and seconded by Councilman Scott to have the present tractor repaired at a cost _
not to exceed $5,000.00.A roll call vote was taken:Ayes:Bailey,Clark,Scott.Nayes:

Councilman Clark to have Ordinance No.2159 entitled "An Ordinance Amending Chapter 213

Commercial Haulers Of Refuse,By Renumbering Paragraphs And By Prohibiting Picking Up Of
Refuse From Alleys"be read for the third time by the City Clerk.The Mayor Pro-tern put

Section 1.§213.3 of the Code of Ordinances of the City of Waukee,Iowa,is hereby
amended by changing the numbering thereof to §213.4 •
Section 2.§213.4 of the Code of Ordinances of the City of Waukee,Iowa,is hereby
amended by changing the numbering thereof to §213.5.
Section 3.§213.5 of the Code of Ordinances of the City of Waukee,Iowa,is hereby
amended by changing the numbering thereof to §213.6.
Section 4.§213.6 of the Code of Ordinances of the City of Waukee,Iowa,is hereby
deleted.
Section 5.Chapter 213 of the Code of Ordinances of the City of Waukee,Iowa,is
hereby amended by inserting as §213.3 the following:
No canmercial hauler shall pick up refuse from any alley within any R-1,R-2,R-3,
R-4,or R-5 Districts in the City of Waukee as defined in the Zoning Ordinance of
the City of Waukee,Iowa;provided,however,this ordinance shall not apply to the
pick up of refuse f.rorrreny municipally owned buildings.
Section 6.Effective Date.This ordinance shall be in effect after its final
passage,approval,and publication as required by law.

the meter shall be suspended immediately,and shall not again be restored until
the owner of the premises shall have paid to the City of Waukee,in addition to
any charges for water used and measured and all other charges previously made,the
sum of $as liquidated damages for water used and not measured,

in addition to any other remedy the City of Waukeemay have for any damage,"so that
subsection G reads as follows:
W.Shelter.The park shelter may be reserved for the exclusive use of groups of
persons or organizations without charge,provided that such requests for
reservations must be made to the administrative officer no later than 8:00 A.M.on the day
of the proposed use of said shelter.No reservations shall be taken between the hours
of 5:00 P.M.Friday and 8:00 A.M.Monday.The administrative officer may refuse to grant
an exclusive reservation to any group,which,in his opinion,is not large enough to fully
utilize the facilities of the shelter.Any person,group,or organization reserving any
shelter shall deposit the sum $15.00 with the administrative office;and if such person,
group or organization fails to leave any shelter in a clean and undamagedcondition,
such person,group or organization shall forfeit such deposit,in addition to any other
remedy the City of Waukeemay have for any damage.Reservations for the shelter shall
be in writing,signed by the administrative officer,and shall be displayed upon request.
Section 2.Effective Date.This ordinance shall be in effect after its final passage,

I:M Water WorksStorage Agreement.Steve Pierce,City Engineer,reported on a meeting
held with Des MoinesWater Worksand discussed Council options on water feeder line
capacity versus ground storage capacity purchase of the water system enhancementsbeing
done by DMWater Worksthat the City of Waukeemust committo for future City needs and
various financing and cost implications.The Council will study the options and
information presented until the next Council Meeting.
Class C Beer Pennit (WaukeePronto Store).Motion by CouncilmanGruber and seconded by
CouncilmanDuray to approve a Class C beer permit for the WaukeePronto Store.The

Long Tenn capital In1proveIrents.CouncilmanClark spoke to the need for the City to begin
long range planning for capital improvements.Motion by CouncilmanGruber and seconded
by CouncilmanClark to direct the City Clerk to meet with TomMehl of Ruan Securities to
gather information on City assessed valuation,bonding capacity,outstanding bonds,and
repayment schedule and to secure any additional information necessary for the Council
to consider.The MayorPro-tem put the question on the motion arid the roll being called,

Water Service Study.This agenda item will be considered by the Utilities Committeeon
8/8/92 and reported back to the Council 8/17/92.
IGIC 5ettlenent Options.TomGorak will be sending a survey to GSmembersto appraise
support for a filing with FERCregarding this issue.
Proposed Gasline Interconnect.The Council received a copy of a letter from MidwestGas
and the City is awaiting information on transportation costs.
Parks Ccmnittee Report.CouncilmanScott reported that the Parks Committeewould like
their duties and responsibilities defined.The Council directed Brian to begin the task
of defining responsibilities of all committees.
Plarming &ZOningReport.CouncilmanBailey reported that RandyFoster had resigned due
to leaving the communityand asked that printed meeting minutes be distributed to
Councilmembers.
Personnel Ccmnittee Report.CouncilmanBailey reported that performance reviews were
completed for Barrett and De Witt and that a draft copy of the employeehandbookhad been
distributed to all employees and that 8/10 was set to review the handbookby the Personnel
Committeeand all City employees.
Matters Regarding Armexation Pending Before the City Developnent Board.No report.
Mayor's Report.CouncilmanClark asked for an update on the Parks Intern and Brian reported.
The City Attorney was asked to contact the parties involved in the Atlantic Bottling
waterline purchase agreement to get it finalized.Motion by CouncilmanScott and seconded
by CouncilmanDuroy to secure bids to correct the drainage problems along 4th Street and
to send this information to KenkoInc along with a deadline to satisfactorily complete
the project.Motion carried 5 to O.
