'TIleNovember2,1992 WaukeeCity Council regular meeting was called to order at 7:05 P.M.
by Mayor Floyd Rosenkranz with Bob Barrett present and taking minutes.
Roll call was taken and the following Councilmenwere present:DonBailey,Jr.,Ray Clark,
Frank Duroy,Nick Gruber and Curtis Scott.
Staff and guests present were:Paul E.Huscher,Brian Redshaw,Dan White,Scott 'TIlomas,
Toni Lestina,Jim DeWitt,Jr.,Dianna Van Zee,Chuck Christianson,Mark Gruber,Steve
Pierce,Brad Curtis,DonHenson,Bart Weller,Marsha Schmidt,Dorothy Tate,DennyDcl.mage,
John Kursitus,Bob Underberg,Doralyn Underberg,EdwardDeck,Marlyn Thompsonand Richard
Margulies.
Approval of 10/14 and 10/19 Minutes.'TIle10/19 minutes should be corrected to show the
proper spacing after Brian's name in the 7th paragraph.Motion by CouncilmanGruber and
seconded by CouncilmanBailey to approve the minutes of the October 14,1992 and October
19,1992 Council meetings as corrected.Motion carried 5 to O.
Agenda l\dditions.Ordinance amending the commerical grain drying gas rate was added as
agenda item #25A.
Guests:
Dorothy Tate -Utility HookupFees.Dcrothy explained the circumstances that led to the
disconnecting of gas service to her property,Goldust Lounge,and asked that the reconnect
fee that she paid be refunded.After discussion,motion by CouncilmanScott and seconded
by CouncilmanBailey to refund the $50.00 reconnect fee paid by Dcrothy Tate.A roll
call vote was called,and the following Councilmenvoted:Ayes:Clark and Scott.Nayes:
Bailey,Duray and Gruber.Motion failed 2 to 3.
Jim 'TIlompson-Alley Vacation.Marlyn Thompsonpresented a petition requesting the alley
between 8th and 9th Streets between Walnut and Locust Streets be closed to traffic except
to residents of the block and utility service vehicles.After discussion the matter was
referred to the City Attorney to research procedures and costs involved in vacating the
alley and reverting ownership to abutting property owners.
DonHenson -Fire Department.Bart Weller requested Council permission to remove the
non-supporting brick wall between the fire trucks in the bay area for safety reasons and
for greater maneuverability of fire and rescue apparatus.Motion by CounciJ.manDuray
and seconded by CouncilmanClark to proceed with removal of the wall in coordination with
Harry.Motion carried 5 to O.
Open Forum.Bart Weller,Chairmanof Board of Adjustment,spoke to the Council about
concerns about the building inspector or zoning administrator or building permit
application process failing to detect building setback errors,the houses being built,
the mortgage companies finding the errors and variance appeals being brought to the
Board of Adjustment.Bart requested that in the future the people requesting a Board
of Adjustment hearing be furnished with the City Ordinance detailing Board of Adjustment
powers and appeal process.Motion by CouncilmanDuroy and seconded by CouncilmanBailey
to include the notice to builders in the City of Waukee,drafted by Paul,with every
building permit application.Motion carried 5 to O.
Mark Cunninghamasked about restoration of property after the gas line installation is
completed along 6th Street.
Final Plat of Windfield Plat 1.Motion by CouncilmanBailey and seconded by Councilman
Duroy to approve Resolution #232Ato accept public improvementsutility easements of
Windfield Plat 1.'TIleMayorput the question upon the motion and the roll being called,
the following namedCouncilmenvoted:Ayes:Bailey,Clark,Duroy,Gruber and Scott.
Nayes:none recorded.Motion carried 5 to O.
Motion by CouncilmanDuroy and seconded by CouncilmanGruber to approve Resolution #232B
approving the storm water detention easement and the storm water surface flowage easement.

FY 92-93 Budget 1ImendmentHearing.TIle Mayor stated that now is the time and place set
to consider the proposed FY92-93 Budget Amendmentto allow for repair of the Fire
\,",Station roof.Brian stated that no written or oral objections had been received at City
I."Hall.The Mayor asked if anyone from the audience wished to canment,either pro or con,
on the proposed budget amendment.Hearing no comments,Councilman Scott moved and
Councilman Clark seconded to adopt Resolution No.233 to approve amending FY92-93 Budget
by adding $5,441.00 to CommunityProtection.TIle Mayor put the question on the motion

Comprehensive Plan 1Imendrrents.After discussion and review of plan revisions,Councilman
Scott moved and Councilman Gruber seconded to adopt Resolution No.234 to approve the
preliminary draft of the Comprehensive Development Plan as amended.The Mayor put the
question on the motion and the following named Councilmen voted:Ayes:Bailey,Clark,
Duroy,Gruber and Scott.Nayes:None recorded.Motion carried 5 to O.

Matters Regarding Armexation Pending Befrxre the City DeveloplEIlt Board.Paul was directed
to respond to the City Development Board concerning the Urbandale annexation petition and
to contact surrounding property owners to update them of proceedings.
Atlantic Bottling Waterline Agreanent.Final agreement has been reached and signatures
are now being secured.TIle remaining question ,of where to deposit the funds will be
resolved soon.
Facilities Review Meeting.TIle Mayor,Councilman and department heads will meet at City
Hall at 3:00 P.M.Saturday November7th to tour all City Facilities.
Alice's Road Waterline Agreanent.After discussion,it was moved by Councilman Bailey
and seconded by Councilman Clark to approve the plans and specifications for the Alice'S
Road Waterline.TIle Mayor put the question on the motion and the following named
Councilmen voted:Ayes:Bailey,Clark,Duroy,Gruber and Scott.Nayes:None recorded.
Motion carried 5 to O.
Movedby Councilman Clark and seconded by Councilman Scott to approve the contract bid of
$24,930 for the Alice's Road Waterline Project.The Mayor put the question on the motion
and the following named Councilmen voted:Ayes:Bailey,Clark,Duroy,Gruber and Scott.

l'urrp Maintenance Agreanent.After discussion,it was moved by Councilman Duroy and
seconded by Councilman Gruber to approve the lift station pumpmaintenance agreement with
Pollution Control Systems for $493.00 per year.Motion cerxaed 5 to O.
Final Pay Estimate -Van Hallen &Associates.Steve Pierce reported that the Sixth
Street Water Main Extension Project is completed and recorrmends final payment be made
to Van Hauen &Associates in the amount of $3154.00.Motion by Councilman Duroy and
seconded by Councilman Clark to approve final pay estimate of $3154.00 to Van Hauen &
Associates.Motion ca=ied 5 to O.
Motion by Councilman Gruber and seconded by Councilman Clark to accept the Sixth Street
Water Main Extension Project.Motion cerr.ied 5 to O.
Board of lIdjustment lIppointment.Motion by Councilman Duroy and seconded by Councilman
Bailey to appoint TomDemandto the Board of Adjustment.Motion carried 5 to O.
Board of lIdjustment Decision.Decision making procedure and appeals procedure of the
Board of Adjustment was reviewed.

Contract Meter Reading.A bid was received to contract out the monthly reading of gas
and water meters.This information will be reviewed by the Council.
Gas Realig:rnrent Q;>tions.This information was reviewed and refe=ed to the Utilities
Committee for their 11/7/92 meeting.
utilities OJmnittee -Duray.Printed minutes of the 9/12/92 meeting were distributed.
Planning &Zoning -Bailey.A meeting was held 10/14/92 to consider Candleridge and a
meeting is scheduled for 11/2 to consider Windfield.
Parks OJmnittee -SCott.The recreation trail connection with Clive in Southf=k was
discussed and will be explored.John Thorn was appointed to the Parks OJmnittee.
Mayor's Report.A reception at City Hall at 10:00 A.M.on 11/10/92 is being planned.
1\dministrator's Report.Heating of the new maintenance building was discussed.
Gas Rate OJ:dinance.Councilman Clark introduced an ordinance entitled "Ordinance No.2164.
An Ordinance Amending Chapter 202,.-WaukeeMunicipal Code,Providing Rates For Gas
Furnished Users By The Municipal Gasworks Distribution System Of The City Of Waukee,
Iowa,As To Commerical Grain Drying."
It was moved by Councilman Gruber and seconded by Councilman Duray that the'aforementioned
ordinance be read by the City Clerk.The Mayor put the question on the motion and the

It was moved by Councilman Gruber and seconded by Councilman Clark that the statutory
rule requiring said ordinance to be considered and voted on for passage at two Council
meetings prior to the meeting at which it is to be finally passed be suspended.The
Mayor put the question on the mction and the roll being called,the following named
Councilmen voted:Ayes:Bailey,Clark,Duroy and Gruber.Nayes:Scott.Motion carried
4 to 1.Whereupon the Mayor declared the mction duly carried.

Kurt Atha -1015 4th Street.Kurt explained that his house was built encrouching 6~
feet into the public utility easement along the south boundary of his property.Paul
explained the options available to the Council.After discussion,motion by Councilman
Clark and seconded by Councilman Bailey to adopt the position that the City recognizes
the existenance of a structure upon the public utility easement at 1015 4th Street and
will not exercise legal remedies of the encroachment.The Mayor put the question upon
the motion and the roll being called,the following named Councilman voted:Ayes:Bailey,
Clark,Duroy and Gruber.Nayes:None recorded.Absent:Scott.Motion carried 4 to O.

Michael Wolff asked that the building permit process be reviewed with emphasis on
timely review,accurate information and courteous response.
