Roll was taken and the following Councilmen were present:Don Bailey,Jr.,Ray Clark, Frank Duroy and Nick Gruber.Absent:Curtis Scott. Rod sctmidt -Lot 1 Cherry G1en.Rod asked if a temporary 20 ft access easerrent along the north boundary of his lot was really needed or if the easement could be reduced to 18 ft or maybe 15 ft in order that he could build the house that he desired on his lot. The Council heard reasons for the easement and discussed alternate solutions to provide access to the Broderick/Smith property remaining in Cherry Glen.The property owners were asked to explore the possibility of acquiring an access easement from Eighth Street and to report back to the Council. Street Sweeper Purchase.Harry was instructed to have sweeper specifications ready for the April 19th Council meeting with bids to be opened at the May 3 Council meeting. Fall Festival Dates Ii<Locations.Larry Griggs and Linda Cohen informed the Council that May 8th has been set as the date for the bike trail ride and that a pancake breakfast will be served at the start of the bike trail.The Fall Festival has been scheduled for October 1 &2 and a carvival has been contracted.The Business Association will be working with the school district to accanodate the needs of the carnival. Motion by Councilman Duray and seconded by Councilman Gruber to app=ve the above dates. Motion carried 4 to O. Fire Code Ordinance lIdoption.Don Henson gave the Council information to review- concerning possible changes to the fire code ordinances. Dallas County Mutual Aid 1IgreenEnt.The Dallas County mutual aid agreement is not ready for Council action -lawyers are still reviewing and tinkering with wordage. MPO Membership Resolution.Motion by Councilman Bailey and seconded by Councilman Duzoy to approve Resolution #approving the MPO28E Agreement and approving the payment of $1004.80 membership fee to join the Des Moines Area Met=politan Planning Organization.The Mayor put the question upon the motion,and the roll being called, the following named Councilmen voted:Ayes:Bailey,Clark,DuIDy and Gruber.Nayes:none recorded.Absent:Scott.Motion carried 4 to O. Rural Water _.Fbrbes.Bill Forbes reviewed what the Council expected to be completed in the water service study for the area south of Waukee to the Interstate. Pay Estimate No.1 -Holbrook Construction (N.10th Street).Motion by Councilman Duroy and seconded by Councilman Clark to approve payment of partial payment estimate No.1 for work completed from February 15 to March 19 on the North Teneth Street Water Main Extension in the amount of $21,053.71.The Mayor put the question upon the motion,and the roll being called,the following named Councilmen voted:Ayes:Bailey,Clark,DuIDy and Gruber.Nayes:None.Absent:Scott.Motion carried 4 to O. Park Coomittee Proposals.Motion by Councilman Clark and seconded by Councilman Duroy to close the shelter house from 11-1 to 4-15 beginning 11-1-93.The Mayor put the question upon the motion and the roll being called,the following named Councilmen voted:Ayes:Clark and Duroy ,Nayes:Bailey and Gruber.Absent:Scott.Motion failed 2 to 2.- Motion by Councilman Bailey and seconded by Councilman Gruber to adopt the policy that the restroom facilities may be closed f=m 11-1 to 4-15 depending on weather conditions. Brian asked to attend the gas conference on April 13 &14 in Fairmont MN.Motion by Councilman Clark and seconded by Councilman Duroy to send Brian to the gas conference. Utility -Gruber.CouncilmanGruber reported that at the last meeting:Chuckpresented the lead testing program;the Committeediscussed bill pro rating and decided no change would be recommended. Planning &Zoning -Duroy.Councilman Duroy reported that the Committee discussed: letter of intent to have the bike path cross the new elementary school property;Hickman West Industrial Park;Wildflower Valley;no sprinkling system for the new elementary school;and that Clive is requiring a 16 inch waterline to serve the new school. Administrator's Report.Brian reported on utility bill problems and a proposed use for the former Golden Grinder that would be contrary to zoning restrictions. Guests Francis Ferret -Mary Ann Estates Sidewalks.Francis spcke to the Council about the need for a sidewalk south of Laurel Street between Third and Fourth Streets.Francis was told that the Council had discussed this already and would be pursuing installation of sidewalks. Krause Gentle Corp -Retail Cigarett Permit and SundayBeer Sales.Motion by Councilman Ouroy and seconded by CouncilmanGruber to approve a retail cigarette permit and Sunday Beer Sales priviliege for Krause Gentle Corp doing business as Kum &Go.Motion carried 5 to O. Mary Ann Estates Drainage.Bill Forbes explained three alternative proposals to correct the ponding problem in Mary Ann Estates.The Oouncil delayed taking action until the original plat can be reviewed to determine why this problem exists today. sahu Acres Paving Project.Paul Huscher reviewed the Declaration Of Restrictive Covenants,Conditions and Restrictions Article I as it relate to the upkeep and improvementsto the private streets within the develorrnent•.
