The September 20,1993 Waukee City Council regular meeting was called to order at 7:06 P.M.
by Mayor Floyd W.Rosenkranz with Bob Barrett taking minutes.
Roll was taken and the following Councilmen were present:Don Bailey,Jr.,Ray Clark,
Frank Duray,Nick Gruber and Curt Scott.

Section 1.SumpPumps and Footing Drains -Requi.relrent.Sumppumps and footing
drains shall be required in all construction where the foundation is in excess of 42"in
depth.The sump pumps and footing drains shall be installed pursuant to the standard
specifications for streets and utility improvements as adopted by the City of Waukee.
If a foundation is to be less than 42"in depth,the construction is only required to
have footing drains as long as the footing drains gravity flow to the storm sewer line.
If the footing drains don't gravity flow to the sewer line,the construction is required
to have a sump pump.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this
ordinance shall be adjudged invalid or unconstitutional,such adjUdication shall not
affect the validity of the ordinance as a whole or any section,provision,or part of
thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final
passage,approval and publication as provided by law.

Approve Plans &Specs -Alice's Road TIF Pl:oject.The Mayor announced this was the time
and place set for hearing and inspection of bids for the proposed 1993 Alice'S Road
Grading and Paving Irrprovements Project.
Upon investigation,it was found that no persons had appeared and filed objections
to the proposed plans,specifications or contract for or cost of such 1993 Alice's Road
Grading and Paving Irrprovements Project.Councilman Clark introduced the following
resolution and moved its adoption,seconded by Councilman Duroy;and after due consideration
thereof by the Council,the Mayor put the question upon the motion and the roll being
called,the following named Councilmen voted:Ayes:Bailey,Clark,Duroy,Gruber and

Finally approving and confirming plans,specifications and form of contract for the
1993 Alice's Road Grading and Paving Irrprovements Project
WHEREAS,this Council has heretofore approved plans,specifications and form of
contract for the proposed 1993 Alice's Road Grading and Paving Irrprovements Project (the
"Project"),as described in the resolution providing for a notice of hearing on proposed
plans and specifications,proposed form of contract and estimate of cost of the ITcjs::":

and the taking of bids therefor;and
WHEREAS,hearing has been held on objections to the proposed plans,specifications
and form of contract and to the cost of the Project and all objections thereto have been
overruled;

Section 1.The plans,specifications and form of contract referred to in the
preamble hereof are hereby finally approve,and the prior action of the Council approving

Award Contract -Alice's Road TIF Project.The Mayorannounced that bids for the
construction of the 1993 Alice's Road Grading and Paving ImprovementsProject had been
received,opened and read by the City Clerk at 10:00 o'clock a.m.,at the Council Chambers,
City Hall,on September 9,1993,and that this was the time and place set for the
consideration of such bids.
Thereupon,the City Clerk reported the results of the bidding,and the Project
Engineers made their recommendstionsthereon to the Council.The bids received for the

WHEREAS,all of the said bids and proposals have been carefUlly considered,and it
is necessary and advisable that provision be made for the award of the contract for theProject;

and final review for the 1993 Alice's Road Grading and Paving Improverrents Project,
resident review and final review for the 1993 HickmanWest Industrial Park Improvements

THISSECONDAMENDMENTTOAGREEMENT,made and entered into this 20th day of September,1993,
by and between the CITYOFWAUKEE,ICWA,hereinafter referred to as the "OWner",or "City',
party of the first part,and VEENSTRA&KIMM,INC.,a corporation organized and existing
under the laws of the State of Iowa,party of the second 'part,hereinafter refe=ed to as
"Engineers".
SEmNDAMENDMENTTOAGREEMENT
WITNESSETH:THATWHEREAS,the City desires to improve Alice I s Road to serve the urban
renewal district,expand twc local streets to The Ken Bratney Companyand Alexander &
Associates,construct dry sewers to the district for future connection to the municipal
sanitary system,and to extend municipal water service to the district,with said
improvements being refe=ed to as the "Project",and
WHEREAS,in an Agreement dated February 15,1993,the City retained the services of the
Engineers to provide design services for the 1993 HickmanWest Industrial Park Improvements _
Waukee,Iowa project,and
WHEREAS,the plans and specifications for the 1993 Alice's Road Grading and Paving
Improvementsportion of the Project are complete and ready for bidding,and
WHEREAS,the Agreement dated February 15,1993,provided that the fee for general services
during construction,resident review and final review would be included in an amendment
to the Agreement,and
WHEREAS,the City desires to retain the Engineers to provide complete engineering services
during construction of the Project.
NCW,THEREFORE,it is hereby agreed by and between the parties hereto that the Agreement
dated February 15,1993,as amended June 28,1993,is further amendedby the following
additions,deletions and modifications:
1.Under "13.COMPENSATION,"delete paragraph "e"in its entirety and substitute
the following:
"e"The total fee for general services during construction,resident review
and final review for the Project as outlined in "9.PREmNSTRUCTION
CONFERENCE,""10.GENERAL SERVICESDURINGCONSTRUCTION,""11.RESIDENT
REVIEW,"and "12.FINALREVIEW,"for said improvements as outlined in
"a."and "b."of "1.SCOPEOF PROJECT,"shall not exceed the sum of
Seventy-five Thousand Three Hundred and 00/100 Dollars ($75,300.00)."
2.Under "16.SERVICESNOTINCLUDED,"following paragraph "b."add the following:
"Resident review services beyond the expiration of the original construction
contract period are not included in this Second Amendmentto Agreement.
Additional resident review shall be considered "Extra Work."
3.Under"18.TIMEOF COMPLETION,"following paragraph "b."add the following:
"The Engineers shall complete the work outlined in this Second Amendment
to Agreement for the 1993 Alice's Road Grading and Paving Improverrents
portion of Project by the completion of the original construction contract
plus a reasonable time for final completion of the general services during
construction."
Except as modified in this Second Amendmentto Agreement,the terms and provisions of the
Agreement dated February 15,1993,as amended June 28,1993,shall be applicable to work
under this Second Amendmentto Agreement.

executed in duplicate as though each were an original and that there are no other oral
agreements that have not been reduced to writing in this instrument.

to write a letter to the Iowa Finance Authority in regard to the Candleridge Apartments
of Waukee;and discussed the need for an Economic Developnent Director.
Administrator's Report.Brian reported on disputed utility bills;asked about status of
3rd Street sidewalks;will be attending D.O.T.meeting on 9/21 in Des Moines;the Waukee
Soccer Club asked for permission for Soccer Connection to have a tent in Centennial Park
in conjunction with the Waukee Soccer Tournament on September 25th and 26th.Motion by
Councilman scott and seconded by Councilman Duray to approve a Soccer Connection tent in
Centennial Park on September 25th and 26th.Motion carr-ied 5 to 0;the Council restated
its support of the soccer tournament and authorized City personnel to furnish picnic
tables and trash cans as needed;and discussed Industrial Park electrical power plans.
Motion by Councilman Duray and seconded by Councilman Bailey to approve the Hickman
West Industrial Park electrical power plans.Motion carried 5 to O.
