4th Street,4th Street from Northview to Ashworth Drive,Ashworth Drive from 4th Street
to 6th Stret,and 6th Street from Ashworth Drive to Locust Street,and requested the

Duroy,seconded by Councilwoman Lihs,to approve the street closing and the $750.00

Ron informed the Council about plans for the Fifth Annual Street Dance being planned
for July 16th and asked that Ashworth and Walnut between 5th and 6th Streets be closed

of a Class B Beer Permit for this day,Motion by Councilman Duroy,seconded QY
Councilman Gruber,to approve both the street closing and the beer permit requests to
accommodate the Jaycees annua.L street dance on July 16,1994.The Mayor put the

KEN PUNCERELLI -WIWFLOlJER VALLEY.Ken Puncerelli,representing Steve R.Grubb,
appeared before the Council requesting a two-step rezoning of 55 acres along Boone
Drive and University Avenue from A-I (Agricultural District)to R-l (single family
residential district)and from R-l to R-5 (Planned unit development district),
explained the planned development and answered questions,discussed sanitary sewer,the
land use designation in relationship to surrounding land use plans and traffice from
the development.

7:00 P.M.at City Hall for the rezoning hearing.The Mayor put the question on the

KURT SOIADE -A-I ZOOllG QUESTICNi.Mr.Schade addressed the Council expressing
concerns about height restrictions in A-I Districts limiting out building to a maximum
of 14 ft;about sanitary sewer accessibility;and aout water service.
The Council directed the City Attorney to review and revise the height restrictions on
out buildings in A-I districts for consideration at the next Council meeting.
WAYNE ERI:MAN -XENIA WATER SERVICE.Wayne Erdman asked the Council to release this
property in order that Xenia Water,could provide water service;--City Staff was
directed to prepare a cost estimate to furnish water to Wayne and to contract Des
Moines Water Works about servicing this area that is outside the City limits and to
report back to the Council on March 7.'
BILL PRESEN'!'ATIOO/CURRENT CASH BALANCE.Brian updated the Council on the available
cash balances to meet outstanding bills.

4'IH STREET DROP-OFF &PICK-UP OF 5OIooL KIDS.The Mayor has been contacted by two
individuals expressing concern about the methods and procedures of dropping off and
picking up children along 4th Street before and after school.Police Chief Phillips
reported thilt the Police DePartment has'done in the past and continues to do to educate
both the children and parents.Suggei:;it.'Loristo correct the problem included 'making the
streets around the school one-way streets;eliminating parkirig on the west side of 4th
Street,street c=ssing guards,and opening up Locust Street in front of the
middle school for picking up children.This concern will be taken to the School.Board
on March 8th and reported back at the March 21st Council meeting.

SECTION1.f\MENDMENT.Chapter 301,WaukeeMunicipal Code,Zoning Ordinance,is
hereby amendedby insert'ing Section 301.2 after difinition of "SIGN,FREE
STANDING'.'the following:"See Attachment A for Illustrations of sign area and
sign types";and
Deleting Section 301.23 "M-1Light Industrial District"and "M-2Heavy
Industrial District"in its entirety and inserting in lieu thereof the following:
"M-1"LIGHTINDUSTRIALDISTRICT
"SIGNS:As listed and in accordance with the provisions of the schedule and
general regulations below:
A.One "pole or post sign"on each street on which a business abuts;provided,
however,that said "pole sign"shall not have a surface area greater than one
hundred (100)square feet on anyone side thereof and not more than two(2)
sides of said "pole sign"shall be used for advertising purposes,and further
provided that a pole sign located closer than ten (10)feet to the right-of-
way line must be at least twelve (12)feet above grade.The term "pole sign"
as herein defined shall not be deemedto include any sign advertising the
trade name,merchandise or service of any person,firm,or corporation who
pays a consideration for the privilege of placing,maintaining,or using any
portion of said sign to the owner or occupant of the premises upon which said
sign is erected or placed.Said "pole sign"shall not extend over street
right-of-way lines nor otherwise obstruct or impair the safety of pedestrians
or motorists.
B.A "monumentsign"may be substituted in place of a "pole sign"subject to the
requirements set forth for a "pole sign"in A.above.A "monumentsign"shall
not be more than ten (10)feet in height and shall not be located closer than
ten (10)feet to any property line,and shall not obstruct or impair the
safety of pedestrians and mptor~sts.
One (1)on-premises roof sign shall be permitted to a maximumof
two hundred (200)square feet.The back of said sign shall be effectively
shielded from public view by a building wall,by backing the sign against
another sign face,by grouping such signs in clusters to concel the exposed
backs or by painting the exposed back a neutral color.All roof signs must
adhere to the height limitations of this District.
The total area of all signs pertaining to the business conducted in any
building,shall not exceed a total area of three hundred (300)square feet.
No sign shall project more than four (4)feet above the roof line or parpet
where one exists.

50,000 gal water tower and the 200,000 gal water reSeI\loir back into service and
explained the work that was needed,reasons for bring the tower and reservoir back into
service,the costs involved (estimated net cost is $11,629.03),and answered questions.
The Council directed John to review the Water Department budget to determine if this
expenditure could be absorbed this year and to meet with Mike Downeyto discuss time
frames to complete the improvementsand to report back at the March 7th Council Meeting.

Mark Currey stating the rate for the Library should be $.56 per $100.00 payroll.Bob
was directed to contact Mark and to straighten out department billing and to report back
at the March 7th meeting.

UrrLITIES CXMrrTI'EE REPORT.No minutes were ready.CouncilwomanLihs asked that budget
billing procedures be reviewed.Movedby 'CouncilwomanLihs to have Brian and Dianna set
procedures on reviewing budget billing accounts,whether the accounts are reviewed all
in April or on a staggered basis and to report back to the Council.After discussion
the motion was withdrawn because this has ben previously discussed and implemented.
The EmployeeHandbookSection 2.25 provides minimumwater and sewer at no cost to all
full-time employees.At the present time there are some full-time City Employeesthat
are not being billed directly for utilities and therefor are not receiving this benefit.

CITYCLERKRES~IBLITIES.Brian provided copies of the Powers and Duties of City
Clerk,seciont 108.6 of the City Ordinances and asked for direction from the Council as
to what the basis of his performance review will be.The Personnel Committee will be
reviewing all the job descriptions in order to bring them up-to-date.
MAYOR'SREPORT.The Mayor reported that the Preliminary Budget Meeting has been held
and that the next meeting is February 22 and that after finishing th budget the Council
will need to begin considering the Highway6 project ramifications to Local Businesses
and Citizens.
AJ:MINISTRA'lOR'SREPORT.The Council was informed of the lates payout from the Iowa
Trust Totaling $12,177.92.
MIKEMYERS-FINALPLATWINDFIELD II.Movedby Councilman Bailey,seconded by
Councilman Gruber,to approve the easement for Windfield Plat II.The Mayor put.the
question on the motion and the roll being called,the following named Council members
voted:Ayes:Bailey,Duray,Gruber and Lihs.Nays:none.Absent:Strain.Motion

budget at $87,410.The Mayor put the question on the motion and the roll being called,

the proposed FY94-95budget of $2,894,568 for March 14,1994 at 7:00 P.M.at the Waukee
