Section 1.lIMENIMENT.Section 218.1,Waukee Municipal Code is hereby amended by adding thereto the words,"and no person shall plant or place any tree or shrub in the publicly owned property or right-of-way,or allow any dirt or other material to move from said parking or right-of-way into the travelled portion of any street or highway,"so that section 218.1 shall read as follows: §218.1 Abutting Property Owner To Maintain Sidewalks and Parkings.The abutting property owner shall maintain sidewalks,parkings and all other property outside the lot and property line and inside the curb lines upon the public streets;except that the property owner need not remove diseased trees or dead wood on the publicly owned property of right-of- way;and no person shall plant or place any tree or shrub in the publicly owned property or right-of-way,or allow any dirt or other material to move from said parking or right-of-way into the travelled portion of any street or highway. Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3.Severability Clause.If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Oouncilwoman Lihs arrived at 8:05 P.M. Highway 6 Discussion.Based on the input from businesses located along Highway 6, moved by Councilman Gruber,seconded by Councilman Bailey,to approve Resolution #303 and to send a letter to the Iowa Department of Transportation asking for the changes the businesses and City feel are necessary:elimination of the raised median through the commercial district within the City limits and have a center turn lane providing access to all businesses;provide a stacking left-turn lane at all medican cuts;move the bike trail to railroad right-of-way and City easements away from Highway 6;and do not completely close down Highway 6 for 3 years of construction by rather do the construction in phases and provide access to businesses during construction.The Mayor asked for a roll call vote:Ayes:Bailey,Gruber,Lihs and Strain.Nays:none. ClJ:dinance Rezoning A-I To R-S -3rd Reading.Ken Puncerelli,representing Stephen Grubb,requested that this item be withdrawn from consideration until all Council merribers are present at the next meeting.Councilman Strain asked that consideration of this item be delayed until the Council receives information on the cost of extending a trunk sanitary sewer along University and has an opportunity to review.This information is expected to be available before the May 16 Council meeting.Mr. Puncerelli agrees that this is a reasonable request.Brian will apprise Mr.Puncerelli if all Council merribers will not be present at the May 16 meeting or if the sanitary sewer information is not available early enough that the Council could consider the Wildflower rezoning and would need to delay this item until the June 6 Council meeting. Mayor's Report.The Mayor:restated the need to keep up-to-date on the Highway6 widening project;reported the WaukeeBooster Club wants to construct a new concession stand south of the football field served by a septic system but the present ordinance will not allow a septic system on property serviced by the City sanitary sewer system or reasonably accessible to the property.John Wesselmannwill work with the Booster Club to attempt to find a solution. Paul reported his research determined that City-wide trash collecting would not require a franchise.Specifications for services desired could be formulated by the Utility Comnittee and released for bids and the cost be included on the monthly utility bills. Councilman Bailey reported on a letter from Police Chief Phillips regarding a phone call from Elementary School Prinicipal Lisa Major advising him that Bonnie Hyda was asking when a 4th Street Comnittee meeting was going to be held and that Lisa advised that the was not the committee chairperson and it was not her place to do so.Larry advised Lisa the he was going to contact Don.WhenDon attended the School Board Meeting the matter was going to be turned over to the Elementary School Advisory Comnittee and apparently Lisa doesn't want any part in it.Den called Bonnie Hyda and talked to her about it.
