Agenda Additions.Delete item #18 and item #19.Add Planning &Zoning Report as item #18.The Mayor asked for a voice vote.Motion carried 5 to 0,on a voice vote. Open Forum.None. Ruan Securities -Short Term Financing to Long Term.Tom Mehl,Ruan Securities, distributed several documents to the Council.After a lengthy question and answer session, Councilman Duroy made a motion,seconded by Councilman Gruber,to have the Mayor sign a letter of intent and the last 3 years of the general obligation callable.The Mayor asked for a roll call vote:Ayes:Duroy,Gruber,Lihs,Strain,and Bailey.Nays:None.Motioned carried 5 to O. Motioned by Councilman Duroy,seconded by Councilman Lihs,to set a Public Hearing for December 19,1994 for Resolution #325.The Mayor asked for a roll call vote:Ayes:Duroy, Lihs,Bailey,Strain,and Gruber.Nays:None.Motion carried 5 to O. RESOLUTION NO.325 To fix a date for a public hearing on a loan agreement in the principal amount of $440,000 WHEREAS,the City of Waukee,in the County of Dallas,State of Iowa (the "City), proposes to enter into a loan agreement (the "Loan Agreement")in the principal amount of $440,000 pursuant to the provisions of Section 384.24A of the Code of Iowa for the purpose of paying costs in the connection with the 1993 Alice's Road Grading and Paving Improvements Project;the Mary Ann Estates Drainage Improvements Project;and the 1993 Street Program,including the refunding of outstanding Warrants previously issued to pay costs in connection therewith,and it is necessary 10 fix a date of meeting of the Council at which it is proposed to take action to enter into the Loan Agreement and to give notice thereof as required by such law; NOW,THEREFOR,Be it Resolved by the City Council of the City of WaUkee,Iowa as follows: Section 1.This Council shall meet on the 19th day of December,1994,at the City Hall,in the City,at 7:00 o'clock p.m.,at which time and place a hearing will be held and proceedings will be instituted and action taken to enter into the Loan Agreement. Section 2.The City Clerk Pro Tem is hereby directed to give notice of the proposed action on the Loan Agreement setting forth the amount and purpose thereof,the time when I ---I -102 - and place where the said meeting will be held by publication at least once and not less than 4 nor more than 20 days before the meeting,in a legal newspaper which has a general circulation in the City.The notice shall be in substantially the following form: NOTICE OF PROPOSED ACTION TO INSTITUTE PROCEEDING TO ENTER INTO A LOAN AGREEMENT AND BORROW MONEY IN THE PRINCIPAL AMOUNT OF $440,000 (GENERAL OBLIGATION) The City Council of the City of Waukee,Iowa,will meet on the 19th day of December, 1994,at the City Hall,in the City,at 7:00 o'clock p.m.,for the purpose of instituting proceedings and taking action to enter into a loan agreement (the "Loan Agreement")and borrow money in the principal amount of $440,000 for the purpose of paying costs in connection with the 1993 Alice's Road Grading and PaVing Improvements Project;the Mary Ann Estates drainage Improvements Project;and the 1993 Street Program,including the refunding of outstanding Warrants previously issued to pay costs in connection therewith. The Loan Agreement is proposed to be entered into pursuant to authority contained in Section 384.24A of the Code of Iowa.The Loan Agreement will constitute a general obligation of the City and will be payable from taxes levied upon alltaxabte property in the City. At the aforementioned time and place,oral and written objections may be filed or made to the proposal to enter into the Loan Agreement.After receiving objections,the City may determine to enter into the Loan Agreement,in which case,the decision will be final unless appealed to the District Court within fifteen (15)days thereafter. Allest: Mayor City Clerk Pro Tem -103 - Guests: Tom McClure -Newsletter Proposal.Tom McClure presented the Council I with a typed proposal to include the City Newsletter in his weekly publication.Tom explained how he arrived at the cost and would be a substantial savings to the City .. Motion by Councilman Strain,seconded by Councilwoman Lihs,to receive Mr. McClure's proposal.Mr.McClure's proposal will be given to the New City Administrator to look over.The mayor asked for a roll call vote:Ayes:Strain,lihs, Duroy,Bailey and Gruber.Nays:None.Motion carried 5 to O. Councilman Strain presented the Council with a report.IMotionbyCouncilmanStrain,seconded by Councilman Bailey,to approve the purchase of park equipment at a cost of $29,030.00.This will be taken out of the Park Equipment fund.The equipment will be delivered around March 15th.The Mayor asked for a roll call vote:Ayes:Strain,Bailey,Duroy,Lihs and Gruber.Nays:none. Motion carried 5 to O. The Council would like all the volunteers available for help installing the park equipment. Personnel Committee -Selection Committee Update.Councilman Strain and Councilwoman Lihs updated the Council on the progress of the Selection Committee. Motion by Councilman Duroy,seconded by Councilwoman Lihs,to receive the Selection Committee report.The Mayor asked for a voice vote.The motion carried 5 to 0,on a voice vote. Library Report -Bailey.Councilman Bailey will have the Library report at the next Council Meeting. Linda Mack spoke to the Council requesting approval to advertise to sell come miscellaneous items.Motion by Councilman Bailey,seconded by Councilman Strain, to allow Linda Mack to advertise and sell the mise items.The Mayor asked for a roll call vote:Ayes:Bailey,Strain,Gruber,Duroy and Uhs.Nays:None.Motion carried 5 to O. Public Safety -Locust Street No Parking Hour Change.Motion by Councilman Duroy,to introduce "AN ORDINANCE TO AMEND CHAPTER 502, WAUKEE MUNICIPAL CODE,PARKING REGULATIONS OF MOTOR VEHICLES WITHIN THE CORPORATE LIMITS OF THE CITY OF WAUKEE,BY AMENDING SECTION 502.4,TO RESTRICT PARKING OF VEHICLES,OTHER THAN FOR SCHOOL BUSSES,ON THE SOUTH SIDE OF LOCUST STREET,EXCEPT ON DESIGNATED LOCATIONS AND AT CERTAIN TIMES DURING CERTAIN HOURS OF THE SCHOOL YEAR.. Motion by Counoilman Bailey,seconded by Councilwoman Lihs,to have said ordinance read by the City Clerk Pro-tem.The Mayor asked for a roll call vote:Ayes: Bailey,Lihs,Strain,Duroy and Gruber.Nays:None.Motion carried 5 to O.Bob read the following ordinance: I -106 - ORDINANCE NO.2196 AN ORDINANCE TO AMEND CHAPTER 501,WAUKEE MUNICIPAL CODE,PARKING REGULATIONS OF MOTOR VEHICLES WITHIN THE CORPORATE LIMITS OF THE CITY OF WAUKEE,BY AMENDING SECTION 502.4,TO RESTRICT PARKING OF VEHICLES,OTHER THAN FOR SCHOOL BUSSES,ON THE SOUTH SIDE OF LOCUST STREET,EXCEPT ON DESIGNATED LOCATIONS AND AT CERTAIN TIMES DURING CERTAIN HOURS OF THE SCHOOL HOURS. BE IT ORDAINED by the Council of the City of Waukee: Section 1.Amendment.Chapter 502,Waukee Municipal Code,Parking Regulations of Motor Vehicles Within the Corporate Limits of the City of Waukee,Iowa, Section 502.4(H),is hereby amended so that the section will read as follows: H.Except for School busses,no parking shall be allowed on the south side of Locust Street. (1)Angle parking is permitted a distance of 134 feet West of Sixth Street on the So uth side of Locust Street. (2)Head-in parking is permitted on the south side of Locust Street between Fourth Street and Fifth Street,except during the hours of &;30A.M.to 3:30 P.M.,Monday through Friday during the School Year. Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3.Severability If any section,provision or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Section 4.Effective Date.This ordinance shall be in effect upon its final passage, approval and publication as provided by law. Utility Committee Report •Lihs. A)Winter shut off policy.Councilman Lihs,spoke to the Council and explained the new policy.Monica has relayed this policy to the Utility Committee. B)Trash Pickup and Curb Side Recycling.Tony from Artistic Disposal spoke briefly to the Council explaining his bid and answer any questions the Council had regarding trash pickup and curb recycling. Councilwoman lihs updated the Council regarding information the Utilities Committee has been gathering to trash pickup and curb side recycling. C)Organic Technologies -Christmas Tree Pickup.fn past years Christmas trees have been picked up by buy a Organic Technologies bag and attach to the Christmas tree.The Council would [ike to look into this matter before making a decision. Treasurer's Report -Cash &Investment Report.Mr.Barrett represented the Council with a Cash &Investment Report. Motion by Councilman Duroy,to have the City Treasurer contact the Auditor's regarding the additional fees charged.This motion failed for lack of a second. Motion by Councilman Strain,seconded by Councilman Gruber,to consider final payment to the Auditor's in the amount of $9,500.00 as payment in fUll.The Mayor asked fora roll call vote:Ayes:Strain,Gruber,Bailey,Lihsand Duroy.Nays:None. Motion carried 5 to O. Councilman Strain announced he would not be able to attend the Mayor and Council Seminar in Alton on December 10,1994.Try to get a refund. Mayor's Report.The Mayor announced there will be 2 people attending the Mayor and Council seminar in Altoona on December 10,1994. The Elementary School will be displaying some of the children's work at several different locations within the Waukee Community. The Mayor sent out some of the ordinance changes that have occurred. The Mayor would like to incorporate the gas and water utilities to be able to work in lowering the water rates. Bratney Letter.Tabled until 12/19/94 meeting.Bob was instructed to gather the information regarding the increase in valuation. Engineer's Report -Hickman Road Trunk Sewer.John Kursitus of Veenstra & Kimm,updated the Council regarding the Hickman Road Trunk Sewer. Motion by Councilman Gruber,seconded by Councilman Duray,to go ahead with the special assessment.Instructing legal Counsel to drawing up petition and waiver.The Mayor asked for a roll call vote:Ayes:Gruber,Duroy,Lihs,Strain and Bailey.Nays: None.Motion carried 5 to O. The Council members gave Mayor Chedester the authority to check with Simmering & Cory regarding grant writing. Planning &Zoning Report -Duray.Councilman Duray presentedlhe Council with a written report. Motion by Councilman Duroy,seconded by Councilwoman Lihs,to accept the Planning &Zoning Report.The Mayor asked for a voice vote.Motion carried 5 to 0,on a voice vote. 1993 Hickman West Improvement Acceptance.Motion by Councilman Duray, seconded by Councilman BaHey,to approve Resolution No.326 accepting the 1993 Hickman West Industrial Park Improvements Project.The Mayor asked for a roll call vote:Ayes:Duray,Bailey,Strain,Gruber and Lihs.Nays:None.Motion carried 5 to O. City Attorney's Report -Huscher. Motion by Councilwoman Lihs,seconded by Councilman Duroy,to enter into closed session pursuant to Iowa Code Section 21.5(c)"To discuss strategy with Counsel in matters that are presently in litigation or where Iiti gation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation".The Mayor asked for a rail call vote:Ayes:Lihs, -109 - Duray,Bailey,Strain and Gruber.Nays:None.Motion carried 5 to O.ITheCouncilenteredintoclosedsessionat10:08pm. The Council came out of closed session at 10:32pm.
