asked Kurt Rueckel to schedule a meeting with Jim Conlin,The Building Inspectors,Larry
Phillips and any Council members that can attend.Mr.Rueckel scheduled this meeting
for Monday,January 16,1995 at 8:30am.at City Hall,410 -6th Street.
Liquor License -Yogi's Pub.Motion by Councilman Duroy,seconded by Councilwoman
Lihs,to approve the liquor license for Yogi's Pub.The Mayor asked for a roll call
vote:Ayes,Duroy,Lihs,Bailey,Strain and Gruber.Nays:None.Motion carried 5 to

Designations.
Official Depository.Moved by Councilman Duroy,seconded by Councilwoman Lihs,to
approve Resolution No.328,naming the City approved depositories.The Mayor put the I

Resolved that the City Council of Waukee in Dallas County,
Iowa,approves the following list of financial institutions to
be depositories of funds of the City of Waukee in conformance
with all applicable provisions of the Iowa Code chapters 452
and 453 (1983)as amended by 1984 Iowa Acts,S.F.2220.The
City Clerk/Administrator or Treasurer is hereby authorized
to deposit funds of the City of Waukee in amounts not to
exceed the maximum approved for each respective financial
institution as set out below:

IOWA,BY AMENDING PRINCIPAL PERMITTED USES TO INCLUDE DWELLING UNITS OCCUPIED BY A
MANAGER OR MANAGERS IN RESPONSIBLE CHARGE,FOR ADEQUATE MANAGER OR MANAGERS IN
RESPONSIBLE CHARGE,FOR ADEQUATE CONSIDERATION,OF THE ENTIRE BUSINESS OR BUSINESSES,

AN ORDINANCE TO AMEND CHAPTER 301,WAUKEE MUNICIPAL CODE,ZONING ORDINANCE OF THE
CITY OF WAUKEE,IOWA,BY AMENDING PRINCIPAL PERMITTED USES TO INCLUDE DWELLING UNITS
OCCUPIED BY A MANAGER OR MANAGERS IN RESPONSIBLE CHARGE,FOR ADEQUATE CONSIDERATION,OF
THE ENTIRE BUSINESS OR BUSINESSES,HOUSED IN THE SAME STRUCTURE OWNED BY THE O~rnER OF
THE BUSINESS OR BUSINESSES.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.16 A of Chapter 301,Waukee Municipal Code,Zoning
Ordinance of the city,is hereby amended by adding thereto the following:
(hhh)dwelling units occupied by a manager or
managers in responsible charge,for
adequate consideration,of the entire
business or businesses housed in the same
structure o~med by the owner of the busi-
ness or businesses.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with
the provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,prOVISIon or part of this
ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not
affect the validity of the ordinance as a whole or any section,provision,or part
thereof not adjudged invalid or unconstitutional.
Section 4.Effective Date.This ordinance shall be in effect upon its final
passage,approval and publication as provided by law.

City Attorney Report.Paul Huscher,City Attorney,spoke to the Council regarding the I
situation with the Ken Bratney Company.

process against the Ken Bratney &Co.The Mayor asked for a roll call vote.Ayes:

Paul reported to the Council that trash collection can not offer a franchise,but we can
contract for billing.
Sanitary Landfill.Paul instructed Kurt Rueckel,City Administrator,to contact Mark
Currie,Insurance Associates,regarding all insurance polices from 1970 to 1994.
Park Committee -
ready to be used.
Strain.Councilman Strain announced that the ice rink is frozen and
Mr.Strain reported that several kids used the rink last weekend.
Library Report -Bailey.Councilman Bailey presented the Council with a written
report of the Library meeting.Motion by Councilman Bailey,seconded by Councilman
Duroy,to receive the Library report.The Mayor asked for a roll call vote.Ayes.

Citizen Of The Year Procedures.Mayor Chedester spoke to the Council explaining the
Rules and Procedures used when selecting the Citizen of the Year.They are as follows:

Rules and Procedures
1.The Mayor will appoint a Selection Committee by December 15th.
2.Nominees will be accepted from January 1st thru February 28th.
3.Nominations for Citizen of the Year will be considered for their
dedicated volunteer service to the City,Schools,Civic
Organizations,Churches or Community and on other criteria
developed by the Committee.Selection will not be based
strictly on the number of nominations received for a
particular nominee.
4.Nominations received will become the property of the City
of Waukee and will not be returned.
5.No information regarding nominations will be released.
6.The Selection Committee will review all nominations during
March and report their selection to the Mayor.
7.The Mayor will announce the name of the recipient at the
first Regular Council meeting in April.
8.A reception honoring the Citizen of the Year will be held
on the fourth Monday of April.

Procedures for selecting the Citizen of the Year.The Mayor asked for a voice vote.

are interested in relocating in either Waukee or Grimes.PDQ will be renting a building
from Walters.The cost of the building would be roughly around $500,000.Bob also
received a request for information on constructing a building and the possibility of tax
abatement.

(3)pagers at a cost of $339.00 each for the Fire Department and First Responders.The

Country Club Woods Plat 4.Jerry Oliver,Civil Engineering Consultants,Brad Cooper,)
Civil Engineering Consultants,and Gene Stanborough,Iowa Realty,spoke to the Council
regarding Country Club Woods Plat 4 preliminary plat.There was a lengthy discussion
concerning the pavement of Boone Drive.The Mayor asked for the Street committee,Iowa
Realty,Kurt Rueckel and the Bonding Authorities to schedule a meeting and try to

settle the situation with the paving of Boone Drive.This meeting was scheduled for
Tuesday,January 10,1995 at 4:30pm at City Hall,410 -6th Street.
