Pledge of Allegiance.Everyone in attendance recited the Pledge of Allegiance. A roll call vote was taken and the following City Council members were present:Don Bailey,Jr.,Nick Gruber,Monica Lihs and Terry Strain.Councilman Duroy was absent. Open Burning Ordinance -2nd reading.Jim Phillips presented the Council with a petition against the burning ordinance.Jim would like to have a 4 to 6 week period in the fall and a 2 to 3 week period in the spring to burn leaves and yard waste. I Motion by Councilman Gruber,seconded by Councilman Bailey,to accept the Mayor asked for a roll call vote:Ayes:Gruber,Bailey,Lihs and Strain. Motion carried 4 to 0. petition.The Nays:None. Jim Phillips would like to have burning allowed from October 15th to November 15th and have a similar span of time in the spring. Motion by Councilwoman Lihs,seconded by Councilman Strain to have the 2nd reading of the Open Burning Ordinance,title only,by the City Clerk.The ordinance is as follows: ORDINANCE NO._ AN ORDINANCE TO AMEND CH~PTER 212,WAUKEE MUNICIPAL CODE,RESTRICTION OF OPEN BURNING WITHIN THE CITY LIMITS OF THE CITY OF WAUKEE,IOWA,BY DELETING CHAPTER 212 AND INSERTING IN LIEU THEREOF REVISED AND SUBSTITUTED ORDINANCE RESTRICTING OPEN BURNING WITHIN THE CITY LIMITS OF THE CITY OF WAUKEE,IOWA. BE IT ORDAINED by the Council of the City of Waukee: 1Section1.Amendment.Chapter 212,Waukee Municipal Code,Restriction of Open Burning Within the City Limits of the City of Waukee,Iowa,Chapter 212,is hereby amended by deleting Chapter 212 and inserting in lieu thereof the following: Section 212.1 Definition of Terms. A.Chimney or Stack.Any flue,conduit or duct permitting the discharge of passage of air contaminants into the open air,or constructed or arranged for this purpose. B.Open Burning.Any burning of combustible materials wherein the products of combustion are emitted into the open air without passing through a chimney or stack. C.Recreational Fires.Open flames for cooking,heating,recreation,and ceremonies providing visible emissions.No person shall allow cause or permit the emission of visible air contaminates of a density or shade equal to or darker than designated as No.2 on the Ringelmann chart or 40%capacity into the atmosphere from any equipment internal combustion engine,premise,fire,open fire or stack. Section 212.2 Open Burning Prohibited.No person shall kindle or maintain any bonfire or refuse fire,or burn inorganic material,any paper or similar I combustible debris,including plants,leaves or vegetable matter,or authorize any such fire to be kindled or maintained on any private land within the boundaries of the City of Waukee,except the following: -4 - A.Fire Places and Grills.This ordinance shall not apply to indoor or outdoor fire places or barbecue grills used solely for entertainment purposes or the preparation of food for human consumption. B.Organic Fire in Agricultural Areas. organic fires in agricultural areas fires within 1,000 feet of any land This ordinance shall not apply to zoned A-1 as long as there are no zoned other than A-1. C.Variance.Open burning of materials not excepted herein upon application to and a variance granted by the City Administrator,after consultation with the Fire Chief of the City of Waukee.Each application for a variance shall contain the following: 1.The name,address and telephone number of the person submitting the application or,if such person is a legal entity,the name and address of the individual authorized to accept service or process on its behalf and the name of the person in charge of the premises where such open burning is to be conducted. 2.The type of business or activity involved. 3.The nature of the materials to be burned in the open including the type,quantity,and method of ignition and estimate of the time required to complete the open burning is to be conducted. 4.The exact location of the proposed open burning site. 5.The reason(s)for considering that compliance with the prohibition of open burning will produce serious hardship without equal or greater benefits to the public,and the reason why no other reasonable method or disposal can be used without resulting in a hazard to health or property. 6.The signature of the person making the application,following the affirmation that all statements are true and correct. D.Bonfires.A person may kindle or maintain a bonfire or authorize such fire to be kindled or maintained,if such person firsts obtains a permit or the authorization from the Fire Chief of the City of Waukee, or his authorized agent,if the following conditions are met: 1.Such person is an authorized city employee operating under the authority of the city to conduct such a fire. 2.The purpose of the fire is the instruction of public employees in the methods of fire fighting. 3.The purpose of the fire is to instruct employees in the methods of fire fighting on private property used for industrial purpose. 4.The purpose of the fire is for public gatherings under legitimate sponsorship of civil,fraternal,religious,education,or similar organization. -5 - Section 212.3 Conditions.Any permit granted above required that a reliable 1 water supply,under pressure,must be available by hose line within 20 feet of the burn site.Burning may not take place under any circumstances when the wind is in excess of 15 M.P.H.or any burning bans are in place by the City,county or state. Section 212.4 Control of Fire.All fires permitted under this ordinance shall be constantly attended and controlled by a competent person or persons until such fire is entirely extinguished and no such fire shall be started within thirty (30) feet of any combustible wall,fence,building,or structure. Section 212.5 Penalty.Any person,firm,corporation violating any provisions of this,ordinance shall be guilty of a simple misdemeanor and upon conviction thereof,shall be punished by a fine not exceeding one hundred dollars ($100),or imprisonment not exceeding thirty days.Each day upon which such violation occurs after a notice shall constitute a separate violation. Section 212.6 Nuisance.Any condition which fails to comply with the health standards set forth in the aforementioned rules may be declared a nuisance by the health officer or by a council resolution and may be abated in the manner set by ordinance for health insurances. Section 212.7 Severability.If any section,provision,or part of this ordinance shall be adjudged to be invalid or unconstitutional,such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section 212.8 Effective Date.This ordinance shall be in effect after its final passage,approval,and publication as required by law. J Section 2.Repealer.All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 3.Severability Clause.If any section,prOV1Slon or part of this ordinance shall be adjudged invalid or unconstitutional,such adjudication shall not affect the validity of the ordi.nance as a whole or any section,provision,or part thereof not adjudged invalid or unconstitutional. Section 4.Effective Date.This ordinance shall be in effect upon its final passage,approval and publication as provided by law. Attested:Claire L.Chedester,Mayor Kurt A.Rueckel,City Clerk -6 -I Budget Amendment Hearing.Motion by Councilwoman Lihs,seconded by Councilman Bailey to pass Resolution No.336,a resolution amending the current budget for the fiscal year ending June 30,1995.The Mayor asked for a roll call vote:Ayes,Lihs,Bailey,Strain and Gruber.Nays,None.Motion carried 4 to 0.The summary of the Budget Amendment is as follows: Revenues Intergovernmental Miscellaneous Other 10,930 1,710 1,252,900 Total 1,265,540 ,Expenditures Home &Comm Enviro Human Development Policy &Administration Total Transfer Out (37,000) 32,320 69,500 64,820 47,000 Country Club Woods -Plat 4 Construction Plans.John Kursitis has reviewed the Construction Plans for Country Club Woods Plat 4 and had several concerns. The developers would like to collect a sewer hook-up fee from the Southfork residents and others outside their subdivision since they are designing the sewer to accomodate more than just their plat. Paul Huscher,City Attorney,will check into the developers charging a sewer hook-up fee and bring back to the Council. Motion by Councilman Bailey,seconded Woods Plat 4 Construction Plans.The Gruber,Strain and Lihs.Nays,None. by Councilman Gruber,to approve the Country Club Mayor asked for a roll call vote,Ayes,Bailey, Motion carried 4 to 0. Hickman Trunk Sewer.Motion by Councilman Bailey,seconded by Councilman Strain,to approve the design of the Hickman Trunk Sewer and receive the letter from the Developers desiring their intent to put in the service provided.The developers have agreed to share the costs of the private construction of Phase I of the Hickman Road Trunk Sewer as designed by Veenstra &Kimm Engineers with the following conditions, 1.Midwest Mobile Home Dev.Corp.not be required to hook their development up to the new sewer until the next phase is developed. 2.Any landowners not participating in this private sewer extension be required to reimburse the developers for access to the sewer at the rate of $695 per acre served plus interest at prime plus 2%; 3.The private sewer extension group be allowed to hire an approved engineering firm of their choice for inspection and certification to the city; 4.The City contribute to the project by paying for the design fees of Phase I. Audit Bids -3 Year Contract.The Council authorized Kurt Rueckel to seek Audit Bids at the 3/6/95 council meeting.Requests for proposals were sent to 14 firms and five (5)bids were received,they are as follows: Company 1995 1996 1997 Total Auditor of State $14,300 $14,800 $15,500 $44,600 Martens &Co $16,500 $18,875 $20,000 $55,375 Pollard &Co $6,300 $6,700 $6,900 $19,900 Shull &Co $8,000 $8,000 $8,000 $24,000 Brooks,Ladden PC $14,255 $14,,925 $15,675 $44,855 Pollard &Company was the low bidder,in fees.The City of Huxley was contacted and they are very satisified with the finished report and year long consulting services available from Pollard &Company.The City of Huxley felt Pollard &Company's personnel were competent,offered suggestions for improvement and cared for the well being of the City. the City of Bloomfield was contacted for their experience with Pollard &Company.The City Administrator stated that the first year audit was very well done.The second year audit (FY93-94)field work was completed in October and the draft copy was just reviewed in the past two weeks and was unsure when the completed report would be finished.She felt the company may be over-extending their staff. Shull &Company is the 2nd place low bidder.The City of Indianola was contacted and they also were very satisfied with Shull &Company. Kurt Rueckel,City Administrator had some concerns about the low number of hours proposed by both Pollard &Company and Shull &Company,needed to conduct the audit. Motion by Councilwoman Lihs,seconded by Councilman Gruber,to to seek Computer Bids.The Mayor asked for a roll call vote: Bailey and Strain.Nays:None.Motion carried 4 to 0. authorized Kurt Rueckel Ayes:Lihs,Gruber, Authorization to Purchase Bunker Gear.The Fire/Rescue Departments have discussed budgets and total money left for the 94/95 budget year and calculated that there is enough money left to purchase up to 8 sets of new bunker gear out of the current budget. Motion by Councilman Gruber,seconded by Councilman Strain,to accept the bid from Feld Fire Equipment at $625.00 per set.Purchasing 9 sets of bunker gear at a total cost of $5,625.00.The Mayor asked for a roll call vote:Ayes:Gruber,Strain,Bailey and Lihs.Nays:None.Motion carried 4 to 0. Sewer Cleaning Proposals.John Wesselmann,Public Works Director,sought quotes to have several thousand feet of sanitary sewers cleaned and televised.He would also like to have some of the storm sewers cleaned out also. Motion by Councilman Gruber,seconded by Councilman Bailey,to allow Sewer Cleaning done at $0.35/ft and televising to be done at $0.50/ft by Municipal Pipe Tool,Co.Inc., at a cost not to exceed $18,000.The Mayor asked for a roll call vote:Ayes:Gruber, Bailey,Strain and Lihs.Nays.None.Motion carried 4 to 0. 2nd Street and 3rd Street Intersections. are in dire need of replacement.Repairs solution.There is approximately $80,000 more money for other repairs also. 2nd Street and intersections on 3rd Street and patches would only be a short term in the RUD funds but we are in need of much Motion by Councilman Bailey,seconded by Councilwoman Lihs,to direct Veenstra &Kimm to work with John Wesselmann,Public Works Director,on specifications for this project. The Mayor asked for a roll call vote.Ayes:Bailey,Lihs,Strain and Gruber.Nays. None.Motion carried 4 to 0. Mayor's Report.Mayor Chedester spoke briefly with the Council on several different topics. Utility Committee Report.Councilwoman Lihs gave a verbal report to the Council and will have a wri"tten report at the June 5th meeting. Attorney's Report.Paul Huscher,City Attorney,spoke briefly with the Council and scheduled a meeting with Kurt Rueckel,Don Bailey amd Mayor Chedester for Wednesday,May 17th at 8:30 pm. -9 - Library Report.A written report was given to all Council members. Motion by Councilman Bailey,seconded by Councilwoman Lihs,to accept the Library report.The Mayor asked for a voice vote.Motion carried 4 to 0. Engineer's Report.John Kursitis updated the Council on several items. Administrator's Report.The hiring process has been started for replacing our Waste/Water Supervisor who has decided to take a job at another employer.We have advertised in the Des Moines Register on Sunday,Monday (for free),Wednesday,and Saturday.Kurt will need to meet with the Personnel Committee in the near future and the City Council to discuss the starting wage for this position. Kurt has decided to recommend to the City Council to change how and when we pay the employees.He will bring this recommendation back to the next City Council meeting after he has had the chance to talk more with the department heads and the employees. Bills have been sent out to a number of developers requesting reimbursement for Veenstra &Kimm bills. Paul has been provided with a large amount of information regarding the landfill issue. Motion by Councilwoman Lihs,seconded by Councilman Gruber,to receive the Administrator's report.The Mayor asked for a voice vote.Motion carried 4 to 0. Public Works Report.The Public Works Employees along with various volunteers deserve a big applause for the work they have been doing on the playground equipment.There is J about two weeks of work left to do on the equipment and grounds to make it presentable to the public. The Public Works Department have done some work on the dugouts and bleachers at the little league fields.They will be putting wood chips around the benches and bleachers on the girls softball fields within the next few weeks. John called Dallas County about putting gravel on North Warrior Lane.They didn't sound very receptive to the idea.The Public Works Department is trying to keep North Warrior Lane graded until the development work is done and the pavement goes in. The Gas Department has decided to buy meters from American Meters.These meters are direct read meters and the cost per meter is $83.50.There has been a order for 100 meters. The Gas Department will be conducting a gas leak survey over the entire town.They will also be doing large meter calibrations,and cathodic protection surveys.A yearly inspection of the regulator stations have been completed. The Gas Department employees,Kurt Garst (U.S.Energy Services,Inc.)Kurt Rueckel and John Wesselmann all met to discuss the long range gas utilities plan for the City of Waukee. Chuck Christianson has tendered his resignation effective May 29,1995. regretfully accepts his resignation and would like to thank him for his him the best luck in his new employment. The City work and wish I -10 - The Water Department will be spray painting all of the curb stops,and valve box lids with blue paint to help facilitate locations of the lines.
