Chedester with Toni Lestina taking minutes.IPledgeofAllegiance.Everyone in attendance recited the Pledge of Allegiance.
A roll call vote was taken and the following City Council members were present:Don
Bailey,Jr.,Frank Duroy,Nick Gruber,Monica Lihs and Terry Strain.

Burning Ordinance -3rd Reading.Mayor Chedester read a letter he received from Jane
Olson -840 Ashworth.Motion by Councilwoman Lihs,seconded by Councilman Strain,to I
receive Jane Olson's letter into the minutes.The Mayor asked for a voice vote.Motion
carried 5 to 0.
Pastor Schlaefer -1070 1st Street Place representing some of his church members asked
the Council to please pass the burning ordinance that would allow no burning.

Jim Phillips spoke to the Council in regard to the petition he presented to them at a
earlier meeting.
Marge Grisso -605 -6th Street spoke asking for a compromise by having several weeks in
the spring and several weeks in the fall to burn.
Mayor Chedester suggested that all burn barrels be picked up and disposed of at the time
the Burning Ordinance is passed and adopted.
Motion by Councilman Bailey,seconded by Councilman Gruber,to have the City Clerk read
the open burning ordinance with burining allowed the last week of April and the first
week of May and from October 15th through November 15th with no burning on Sundays.The
Mayor asked for a roll call vote:Ayes:Bailey,Gruber,Strain.Nays:Lihs and Duroy.
Motion carried 3 to 2.Kurt Rueckel,City Administrator,read the Burning Ordinance for
the 3rd time.
ORDINANCE NO.__
AN ORDINANCE TO AMEND CHAPTER 212,WAUKEE MUNICIPAL CODE,RESTRICTION OF OPEN
BURNING WITHIN THE CITY LIMITS OF THE CITY OF WAUKEE,IOWA,BY DELETING CHAPTER 212 AND
INSERTING IN LIEU THEROF REVISED AND SUBSTITUTED ORDINA~CE RESTRICTING OPEN BURNING
WITHIN THE CITY LIMITS OF THE CITY OF WAUKEE,IOWA.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Amendment.Chapter 212,Waukee Municipal Code,Restriction of Open
Burning Within the City Limits of the City of Waukee,Iowa,Chapter 212,is hereby
amended by deleting Chapter 212 and inserting in lieu thereof the following:
Section 212.1 Definition of Terms.
A.Chimney or Stack.Any flue,conduit or duct permitting the discharge
passage of air contaminants into the open air,or constructed or arranged
for this purpose.
B.Open Burning.Any burning of combustible materials wherein the products
of combustion are emitted into the open air without passing through a
chimney or stack.
C.Recreational Fires.Open flames for cooking,heating,recreation and
ceremonies,providing visible emissions.No person shall allow cause or
permit the emission of visible air contaminates of a density or shade
equal to or darker than designated as No.2 on the Ringelmann Chart or
40%capacity into the atmosphere from any equipment internal combustion
engine,premise,fire,open fire or stack.
Section 212.2 Open Burning Prohibited.
No person shall kindle or maintain any bonfire or refuse fire,or burn
inorganic material,any paper or similar combustible debris,including
plants,leaves or vegetable matter,or authorize any such fire to be
kindled or maintained on any private land within the boundaries of the
City of Waukee,except for the burning of plant and vegetable matter
originating on the premises owned or leased by such person,between
April 24th and May 7th,and between October 15th and November 15th,
and except the following:

A.Fire Places and Grills.This ordinance shall not apply to indoor or
outdoor fire places or barbecue grills used solely for entertainment
purposes or the preparation of food for human consumption.)
B.Organic fire in Agricultural Areas.this ordinance shall not apply
to organic fires in agricultural areas zoned A-l as long as there are
no fires within 1,000 feet of any land zoned other than A-i.
C.Variance.Open burning of materials not excepted herein upon
application to and a variance granted by the City Administrator,after
consultation with the Fire Chief of the City of Waukee.Each application
for a variance shall contain the following.
1.The name,address and telephone number of the person submitting
the application or,if such person is a legal entity,the name and
address of the individual authorized to accept service or process
on its behalf and the name of the person in charge of the premises
where such open burning is to be conducted.
2.The type of business or activity involved.
3.The nature of the materials to be burned in the open including the
type,quantity,and method of ignition and estimate of the time
required to complete the open burning is to be conducted.
4.The exact location of the proposed open burning site.j
5.The reason(s)for considering that compliance with the prohibition
of open burning will produce serious hardship without equal or
greater benefits to the public,and the reason why no other
reasonable method or disposal can be used without resulting in a
hazard to health or property.
6.The signature of the person making the application,following the
affirmation that all statements are true and correct.
D.Bonfires.A person may kindle or maintain a bonfire or authorize
such fire to be kindled or maintained,if such person firsts obtains a
permit or the authorization from the Fire Chief of the City of Waukee,
or his authorized agent,if the following conditions are met:
1.Such person is an authorized city employee operating under the
authority of the city to conduct a fire.
2.The purpose of the fire is the instruction of public employees in
the methods of fire fighting.
3.The purpose of the fire is to instruct employees in the methods of
fire fighting on private property used for industrial purpose.I4.The purpose of the fire is for public gatherings under legitmate
sponsorship of civil,fraternal,religious,education,or similar
organization.

Section 212.3 Conditions.
Any permit granted above requires that a reliable water supply,under
pressure,must be available by hose line within 20 feet of the burn site.
Burning may not take place under any circumstances when the wind is in
excess of 15 M.P.H.or any burning bans are in place by the city,county,
or state.
Section 212.4 Control of Fire.
All fires permitted under this ordinance shall be constantly attended and
controlled by a competent person or persons until such fire is entirely
extinguished and no such fire shall be started within thirty (30)feet of
any combustible wall,fence,building,or structure.
Section 212.5 Penalty.
Any person,firm,corporation violating any prOVlSlons of this ordinance
shall be guilty of a simple misdemeanor and upon conviction thereof,shall
be punished by a fine not exceeding one hundred dollars ($100),or
imprisonment not exceeding thirty days.Each day upon which such violation
occurs after a notice shall constitute a separate violation.
Section 212.6 Nuisance.
Any condition which fails to comply with the health standards set forth in the
aforementioned rules may be declared a nuisance by the health officer or by a
council resolution and may be abated in the manner set by ordinance for
health nuisances.
Section 212.7 Severability.
If any section,provision,or part of this ordinance shall be adjudged to be
invalid or unconstitutional,such adjudication shall not affect the validity
of the ordinance as a whole or any section,provision or part thereof not
adjudged invlaid or unconstitutional.
Section 212.8 Effective Date.
This ordinance shall be in effect after its final passage,approval,and
publication as required by law.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the
with the provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this
ordinance shall be adjudged invalid or unconstitutional,such ajudication shall not
affect the validity of the ordinance as a

passage,approval and publication as provided by law.

Motion by Gruber,seconded by Bailey to have Ordinance #2204 entitled "AN ORDINANCE TO
AMEND CH~PTER 212,WAUKEE MUNICIPAL CODE,RESTRICTION OF OPEN BURNING WITHIN THE CITY
LIMITS OF THE CITY OF WAUKEE,IOWA,BY DELETING CHAPTER 212 AND INSERTING IN LIEU

LIMITS OF WAUKEE,IOWA,put upon its final passage and adoption.The Mayor asked for a
roll call vote with the following members voting AYE:Gruber,Bailey.Nays:Strain,
Lihs,Duroy.The motion failed 2-3.
Hickman Road TDJnk Sewer Update.Jeff Downing spoke to the Council explaining that
the developers are still trying to put together an agreement on doing Phase I of the
Hickman Trunk Sewer Project privately.
Motion by Councilman Duroy,seconded by Councilman Gruber,to allow Downing Development
to proceed with the first 1/4 mile privately at the Developers expense.They will work
with V &K regarding inspections and the Developers will assume all the cost of J
engineering and design fee for the first 1/4 mile of the project.The Mayor asked for a
roll call vote:Ayes:Duroy,Gruber,Lihs,Bailey and Strain.Nays:None.Motion
carried 5 to 0.
Request To Waive Sewer Hook-up Requirement.The Mobile Home Park has requested that
they not be forced to connect into the Hickman Road Trunk Sewer as soon as it is built.
They are willing to pay their portion at this time.
Motion by Councilman Bailey,seconded by Councilman Duroy,to allow the following l)five
(5)years before connection is mandatory;2)hook-up when new addition is set up;3)
hook-up when lagoons need replacing,expanding or modifications.The Mayor asked for a
roll call vote:Ayes:Bailey,Duroy,Lihs,Gruber and Strain.Motion carried 5 to 0.
Landshark Estates Plat Review.Landshark Estates is a subdivision about a half mile
north of the northern most part of the City,north of Meredith between North 10th Street
and Warrior Lane.This is outside the City's Comprehensive Plan.
The Planning &Zoning Commission votes to waive the City's right to review the plans,
because it is in an area that will unlikely ever be annexed into Waukee.
The Subdivision will have a private access road.
Motion by Councilman Bailey,seconded by Councilman Strain,to waive the City's right to
review the plat.The Mayor asked for a roll call vote:Ayes:Bailey,Strain,Gruber,.1
Duroy and Lihs.Nays:None.Motion carried 5 to 0.

Enterprise Business Park Developers Agreement.As previously discussed,the
Developers of this project will be buying the bonds,so if the development does not take
place they will have to come up with the funds -consequently the City has no risk in
that area.
The City will use up $850,000 of its Bonding Capacity and will lose out on tax revenue
for up to 20 years as will the other taxing districts.
The Developers do not want an amortization schedule,but are willing to have the bonds
callable at any time.The interest rate has been set at 6.5%.
Motion by Councilman Gruber,seconded by Councilman Duroy,to

The Development Agreement
DEVELOPMENT AGREEMENT
This Agreement is entered into between the City of Waukee (the "City")and Downing
Development,Ltd.(the "Developer")this __day of ,1995.
WHEREAS,the City has established the Enterprise Business Park Urban Renewal Area (the
"Urban Renewal Area")and has adopted a tax increment ordinance for said Area;and
WHEREAS,the City is willing to provide tax increment financing assistance to the
Developer in order to secure construction of new commercial/industrial building,and
~1HEREAS,the Deve loper intends to develop certain property (the "Property")which is
located within the Urban Renewal Area and which is identified on Exhibit A hereto;and
WHEREAS,it is necessary in the interest of the development of the property,all of
which will be beneficial to the sound growth of the City and to the health,safety &
welfare of its residents,that this development take place,
NOW THEREFORE,the parties hereto agree as follows,
1.The Developer will arrange for the installation of water lines,sanitary sewer
lines,streets,storm sewers,related improvements on the Property (the "Improvements"),
and all development costs,including,but not limited to,those items set out as Exhibit
B hereto,at such locations as are mutually agreed upon by the parties,subject to
inspection of the work by the City,and subject to such covenants as may be requested by
the City prior to beginning construction of the Improvements,the Developer will provide
copies of all engineering documents related to the Improvements to the City.The City
may request reasonable changes in such documents,to insure compliance with any
applicable city ordinances.The Developer will provide a corporate surety bond
guaranteeing maintenance of the Improvements for two years after their completion,which
bond shall show the City as a protected party entitled to enforce its provisions.
2.The City agrees to extend sanitary sewer service to the site during Phase 1 of the
extension of the Hickman Road Trunk Sewer work being done as a special assessment
project.

3.The City agrees to extend gas service to and throughout the site,using the City's
normal procedure of the Owner's up-front payment to the City and the City's
reimbursement back to the Developer as users connect to the service.

4.The Developer hereby agrees to indemnify and hold harmless the City with respect to
any damages,cause of action,or liability which may arise out of or in conjunction with
the installation of the sanitary sewer or gas mains.
5.The Developer agrees to make every effort to develop buildings on the property as
soon as possible to reduce the burden of debt limit to the City.The Developer will
seek financing for a $200,000.00 speculative building as soon as the final plat is
approved and complete construction of the building within 6 months of financing
approval.
6.After recelvlng adequate documentation that the Improvements have been installed to
the satisfaction of the City,the City will deliver to the Developer an Urban Renewal
Tax Increment Revenue bond,in the amount of the total project costs,not to exceed
$852,650.00 (eight hundred fifty-two thousand six hundred fifty dollars),drawing
interest at the rate of 6.5%per annum.The bond will not be a general obligation of
the City,but will be payable solely and only from the incremental property taxes
derived from the Property.The bond will be callable by the City at it's option at any
time.
The factors to be taken into consideration in calculating the total project costs of the J
Improvements shall include:
a)Actual cosntruction cost of the Improvements,as documented by the
Developer to the satisfaction of the City;
b)Engineering and administrative costs of the Developer;
c)Ci ty costs
The Bond will provide that the Developer,or the holder of the Bond,will receive
payments on the Bond on June and December 1 of each year equal to 100%of the
incremental property taxes attributable to the Property which have been received by the
City from the County Treasurer prior to that date.Such payments shall begin December
1st,1997,and continue for the period of time necessary to repay all interest and
principal of the Bond,but not to exceed June 1st,2017.All payments shall be alocated
first to accrued interest and then to unpaid principal.
This Agreement shall be effective as of the date first above written.

Adoption of 1994 Uniform Misc.Codes.Motion by Councilman Strain,seconded by
Councilman Gruber,to direct the City Attorney to draft any codes the City has not
adopted.The Mayor asked for a roll call vote:Ayes:Strain,Gruber,Bailey,Lihs and
Duray.Nays:None.Motion carried 5 to 0.

New Permit/Building Inspector's Fees.The Building Inspectors schedule is recommended
to increase by 5%however,the New Building Codes recommend that the rates be increased
by approximately 45%.This is too excessive and most of the Building Inspector's
clients are adopting the 5%increase.
Motion by Councilman Bailey,seconded by Councilman Duroy,to keep the same permit fee
schedules used in the past and to adopt the new schedule for the Building Inspector's.
The Mayor asked for a roll call vote:Ayes:Bailey,Duroy,Gruber,Strain and Lihs.
Nays:None.Motion carried 5 to 0.
Zoning Administrator's Fee Schedule.In 1993 this fee schedule equated to an average
of over $70.00 per permit,this year and last year,the average was just over $30.00 per
permit.The more houses that are built the greater the average will be.
Kurt Rueckel explained that the current Administrator:has the cost of time away from
his work;driving to the City in his own vehicle with his own gas,the time spent
reviewing the permit;the time driving back to his work;and the attendance at various
meetings.These factors should be considered in determining an appropriate fee.
Motion by Councilman Bailey to set a fee schedule of $40.00 per permit.The motion
failed for lack of a second.

The Mayor asked for this issue to be brought back to the City Council.
MFO Yearly Assessment.The City of Waukee is a member of the Des Moines Area
Metropolitan Planning Organization,MFO.As a member of the MPO we are assessed an
annual per capita fee.
Last year's fee was $0.44 per capita for 2,512 persons or $1,105.28.this year's
request is $0.48 per capita for 3,411 persons or $1,637.28.
Motion by Councilman Bailey,seconded by Councilman Duroy,to approve the request of
$1,637.28 for dues,subscriptions and administration.The Mayor asked for a roll call
vote:Ayes:Bailey,Duroy,Lihs,Gruber and Strain.Nays:None.Motion carried 5 to
0.
Mosquito Spraying.Motion by Councilman Duroy,seconded by Councilman Gruber,to have
Wilson Brothers perform 4 to 5 applications at approximately $400 per application.The
Mayor asked for a roll call vote:Ayes:Duroy,Gruber,Strain,Lihs and Bailey.Nays:
None.Motion carried 5 to 0.
Pay Period Changes.Section 5 "Pay days and Pay Periods"of the handbook for
Employees of the City of Waukee,states "Employees of the City of Waukee are normally
paid semi-monthly on about the 15th and 31st.Paychecks include pay for the two (2)
preceding workweeks."

Kurt Rueckel,City Administrator,is proposing changing the wording to read as follows:I"Employees of the City of Waukee will be paid on the 15th of the month (for the last day
of the proceding month through the 14th)and on the last day of the month (for the 15th
through the 2nd to last day of the mont).Pay checks shall be based upon 86.67 hours.
If the paychecks are affected by a weekend or holiday,the following rules shall apply.
If the 14th or 2nd to last day falls on Friday -Sunday payday will be Monday.

Wastewater Treatment Facility Study.Kurt Rueckel is asking for Council approval to
have Veenstra &Kimm do a study.It is extremely important for the City to plan what it
will have to do before it has no time to do it and have development halted in the future
because of the lack of sewer capacity.
Motion by Councilman Bailey,seconded by Councilman Lihs,to have Veenstra &Kimm
conduct a Wastewater Water study for $3,500.00.The Mayor asked for a roll call vote:
Ayes:Bailey,Lihs,Duroy,Gruber and Strain.Nays:None.Motion carried 5 to 0.
1SwimmingLessons.Last year the City of Waukee bused residents to Adel for swimming
lessons.Residents and non-residents paid $10.00 for two weeks of lessons -once a day.
After evaluating their service,Adel has changed their fee structure.If the City had
to recover its costs it would have to dramatically raise the fees.

The Red Cross Swimm Lessons are scheduled for July 24th through August 4th.

they are a resident of Waukee and $27.30 per child if they are a non-resident.The
Mayor asked for a roll call vote:Ayes:Strain,Duroy,Bailey.Nays:Lihs and Gruber.
