Mayor Chedester with Toni Lsstina taking minutes.
Pledge of Allegiance.Everyone in attendance recited the Pledge of Allegiance.
A roll call vote was taken and the following City Council members were present:Don
Bailey,Jr.,Frank Duray,Nick Gruber,Monica Lihs and Terry Strain.
The following people attended the meeting:John Wesselmann,John Shoemann,
John Kursitis,Jim Conlin,Kurt Scolt,Lisa Henken,Dan McKinney,Dale Hilgenberg,
Helene Bergren,Herb Perry,Pat Perry,Marsha Knaack,Linda Mack,Jeff Downing,
Toni Lestina,Kurt Rueckel,Mrs.Biersma,Jim Phillips,Muriel Boone,Tom Davis and
Jerry Brown.
Open Forum:
Dale Hilgenberg,325 Northview Drive,representing the Waukee Jaycees explained
the 4th of July activities.The activities are scheduled as follows:
9:00am parade lineup at the Waukee High School;
10:00am parade begins at High SChool and concludes at the Waukee
Middle School after a trip by the triangle;
Noon Fun Day begins at the Waukee Centennial Park just south of the
High School.The time is approximate and will depend on when the
parade ends;
5:00pm BBQ dinner;
Fireworks are at dusk,displayed by the Waukee Fire Department.
Dan McKinney,650 -2nd Street,has been having problems with the apartment
owners (property to rear and south of his property).Dan claims the owners of the
apartments are tearing up his property and throwing tree branches on top of his truck
and boat.
Councilman Bailey introduced the new Library Board members they are Joel Smith,
Lisa Honken,and Judy Phipps.They will need to be put on the agenda so the City
Council can vote to appoint these new members.
Consent Agenda.Motion by Councilman Bailey,seconded by Councilwoman Lihs,
Gruber,to approve the consent agenda which would include the bill presentation and
the public funds custodial agreement with Brenton Trust.The Mayor asked for a roll

6/5/95 and 6/7/95 City Council Minutes.Motion by Councilman Duray,seconded by
Councilwoman Lihs,to approve with the following amendments:
6/5/95 -Motion to accept the Library report should be amended to Motion by
Councilman Gruber,seconded by Councilman Duroy to appoint Joel Schmidt and
Lisa Honken as city representatives and Judy Phipps as the rural representative to the
Ubrary Board;and to accept the Library report as presented.
6/7/95 -amend the second to last paragraph to read Councilwoman Lihs.

Open Burning Ordinance.Councilman Duroy introduced AN ORDINANCE TO
AMEND CHAPTER 212,WAUKEE MUNICIPAL CODE,RESTRICTION OF OPEN
BURNING WITHIN THE CITY LIMITS OF THE CITY OF WAUKEE,IOWA,BY
DELETING CHAPTER 212 AND INSERTING IN LIEU THEREOF REVISED AND
SUBSTITUTED ORDINANCE RESTRICTING OPEN BURNING WITHIN THE CITY
LIMITS OF THE CITY OF WAUKEE,IOWA.

Motion by Councilman Gruber,seconded by Councilman Strain,to set a Public
Hearing date of July 10,1995 for the Open Burning Ordinance.The Mayor asked for a

Warrior Lane Improvements.All the residents along Warrior Lane up to Meredith Drive
will be notified that the improvement to Warrior Lane will be done in late July when the
Enterprise Business Park closes Warrior Lane to pave their portion.
Hiring of WaterlWastewater Superintendent.Motion by Councilman Gruber,seconded
by Councilman Bailey,to hire Robert Herrick currently the Building/Grounds
Superintendent as WaterlWastewater Laborer d,ue to his skills and work ethic.The
Mayor asked for a roll call vote:Ayes:Gruber,Bailey,Lihs,Duroy and Strain.Nays:
None.Motion carried 5 to O.
Pay Scale -WaterlWastewater Superintendent.There are currently no wage scales
for any employees or positions.The proposed wage scale reflects a person not

having the required certificates.When and if Bob gets his certificates,he would get
paid at a different wage scale (to be determined).
Motion by Councilman Strain,seconded by Councilman Gruber,to set a starting wage
at $9.50 per hour to start with additional steps.The Mayor asked for a roU caU vote:

Mandatory Connection to Sewer Ordinance.As previously discussed,this ordinance
would allow private developments with functional wastewater lagoons systems to
delay connection to the City's sewer system for up to 5 years until such development is
expanded,or the lagoons require replacement,expansion,or modification.
Councilman Duroy introduced AN ORDINANCE TO AMEND CHAPTER 204,WAUKEE
MUNICIPAL CODE,PROVIDING FOR REGULATION OF SANITARY SEWER
DISTRICT,MANDATORY CONNECTfONS,BY AMENDING SECTION 204.11,
MANDATORY CONNECTIONS TO PROVIDE AN EXTENSION OF TIME FOR
MANDATORY CONNECTION TO T1iE SANITARY SEWER SYSTEM FOR
DEVELOPMENTS WITH ESTABLISHED FUNCTIONAL,WASTEWATER LAGOON

AN ORDINANCE TO AMEND CHAPTER 204,WAUKEE MUNICIPAL CODE,
PROVIDING FOR REGULATION OF SANITARY SEWER DISTRICT,MANDATORY
CONNECTIONS,BY AMENDING SECTION 204.11,MANDATORY CONNECTIONS
TO PROVIDE AN EXTENSION OF TIME FOR MANDATORY CONNECTION TO THE
SANITARY SEWER SYSTEM FOR DEVELOPMENTS WITH ESTABLISHED
FUNCTIONAL WASTEWATER LAGOON TREATMENT SYSTEMS.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 204.11 of Chapter 204,Waukee Municipal Code,Regulation
of the Sanitary Sewer District,is amended by adding thereto the following:
and provided further that private development with established functional
waste water lagoon treatment systems shall have five (5)years subsequent
to the date that the City has approved and accepted a public sewer system
which directly or indirectly serves the said premises or until an expansion
of said private development or until said lagoon requires replacement,
expansion,or modification,whichever first occurs,in which to connect said
development to the public sewer system.

so that the section shall read:
Section 204.11.Mandatory Connections.The owners of all residences and
business establishments intended or used for human habitation,occupancy or use
that are within the sewer district created by this ordinance and whose premises now or
hereafter are directly or indirectly served by the public sewer system,shall and must
connect their sewage facilities to the public sewer system within and not later than
twelve (12)months subsequent to the date that the City has approved and accepted
said public sewer system which directly or indirectly serves the said premises and all
of such owners shall within the aforedescribed time install sanitary toilet facilities if
such establishments are not presently so served.Provided,however,this section shall
not apply to playgrounds or parks,and buildings thereon which are not regularly
inhabited,and which are remote and not serviceable by gravity flow sewer,which may
be served by septic tank,holding tank,or other sewage disposal facility approved by
the Council;and provided further that private development with established functional
waste wateriagoon treatment systems shall have five (5)years subsequent to the date
that the City has approved and accepted a public sewer system which directly or
indir~ctly serves the said premises or until an expansion of said private development
or until said lagoon requires replacement,expansion or modification,whichever first
occurs,in which to connect said development to the public sewer system.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.ISection3.Severability Clause.If any section,provision or part of this ordinance
shall be adjudged invalid or unconstitutional,such adjudication shall not affect the
validity of the ordinance as a whole or any section,provision,or part thereof not
adjudged invalid or unconstitutional.

passage,approval and publication as provided by law.

Wage Increases FYE 1996.In this year's budget monies were budgeted for salary
increases including the creation of wage scales.
JOb description are currently being modified and updated,from there wage scales will
be created which will have step increases.
In the interim,Kurt Rueckel would recommend adding $0.36 to each employees hourly
rate which is the equivalent of 748.80 a year,or $31.20 a pay check.When the pay
scales are presented to the City Council in a few months,this increase will be
incorporated in it.This increase will cost the City about $12,000 a.vear,
Motion by Councilman Strain,seconded by Councilman Duroy,to pass increases of
$0.36 per hour to be incorporated into the wage scale.
Public Hearing Mobile Home Park Ordinance.this ordinance is amending the
provisions of the Zoning Ordinance pertaining to setbacks and separation of
buildings/structures in "R-6"or Mobile Home Parks.
The major concern of the Mobile Home Park are that with 20 foot setback there is not
enough room for two 76 foot homes back to back,with 16 foot separations in the back
(strict current interpretation)or 10 foot (logical interpretation).
This change makes the setbacks at 15 feet and cleans the wording to allow for 10 foot
separations in the back.
Curtis Scott·slated that he thought that this ordinance would not allow enough space
between two mobile homes.
Tom Davis would like put into the record that slabs that have been poured have been
approved by City Officials.
Councilman Gruber introduced AN ORDINANCE TO AMEND CHAPTER 301 OF
WAUKEE MUNICIPAL CODE,ZONING ORDINANCE OF THE CJTY OF WAUKEE,

IOWA,BY AMENDING SECTION 301.15,"R-6"MOBILE HOME TO PROVIDE FOR
MINIMUM SEPARATION OF MOBILE HOMES AND OTHER BUILDINGS AND
STRUCTURES.)
Motion by Councilman Bailey,seconded by Councilman Gruber,to have an ordinance
to amend 301 of the Waukee Municipal Code read for the first time.The Mayor asked
for a roll call vote:Ayes:Bailey,Gruber,and Duroy.Nays:Lihs and Strain.Motion
carried 3 to 2.Kurt Rueckel,City Clerk,read the ordinance for the first time.

AN ORDINANCE TO AMEND CHAPTER 301 OF WAUKEE MUNICIPAL CODE,
ZONING ORDINANCE OF THE CITY OF WAUKEE,IOWA,BY AMENDING SECTION
3(H.15,"R-6"MOBILE HOME TO PROVIDE FOR MINIMUM SEPARATION OF MOBILE
HOMES AND OTHER BUILDINGS AND STRUCTURES.
BE IT ORDAINED by the Council of the City of Waukee:
Section 1.Section 301.15 "R-6"Mobile Home District of chapter 301,Waukee
Municipal Code,Zoning Ordinance of the City,is hereby amended by deleting Section
301.15(E)(4)and inserting in lieu thereof the following:
The individual mobile home lot shall contain not less than four thousand two hundred 1
seventy-five (4,275)square feet.Each lot shallhave a front yard not less than fifteen
(15)feet in depth as measured from the edge of the surfaced private street to the
closest point of the mobile home.Side and rear yards shall be provided and
maintained so as to provide a minimum separation of at least ten (10)feet at the
nearest point between mobile homes and mobile homes on adjoining lots;and at least
six (6)feet shall be maintained between mobile homes and other buildings or
structures on the same or adjoining lots.
Section 2.Repealer.All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
Section 3.Severability Clause.If any section,provision or part of this ordinance
shall be adjudged invalid or unconstitutional,such adjudication shall not affect the
validity of the ordinance as a whole or any section,provisions,or part thereof not
adjudged invalid or unconstitutional.
Section 4.Effective Date.This Ordinance shall be in effect upon its final passage,
approval,and publication as provided by law.
Zoning Administrator's Fees.As discussed at the last Council meeting,the rate the
Building Inspectors are charging is going down.Because the Zoning Administrator

and the City split the difference between what is charged for a building permit and
whatthe Building Inspectors get,the Zoning Administrator could get a lot of money.
Motion by Councilman Bailey,seconded by Councilman Duray,to have the Zoning
Administrator's fees based on last year's formula.The Mayor asked for a roll call vote:
Ayes:Bailey,Duroy,Lihs,and Strain.Nays;None.Abstain.Gruber.Motion carried 4

Hiring Full Time Building Inspector/Code Enforcement Officer.Depending on how
much development occurs in the City of Waukee,this could be a win or lose situation.
It is also important to remember that you get what you pay for.If the City wants a
quality inspector who knows plumbing,electrical,mechanical,and building codes,it
will have to pay them well.A good qualified person could also take over some of V &
K's duties.
Motion by Councilwoman Lihs,seconded by Councilman Strain,to direct Kurt to bring
options back to the Council.The Mayor asked for a voice vote.Motion carried 5 to O.
Capital Improvements.The Council would like Kurt to gather the estimated costs and
state assistance available pertaining to the preliminary list of the capital improvement
priorities back to the Council.
Motion by Councilman Gruber,seconded by Councilman Ouray,to have the this
information brought to the September 25th City Council meeting.The Mayor asked for
a voice vote.Motron carried 5 to O.
Mayor's Report.The Council spoke to Brian Scheel,655 3rd Street,who attended the
City Council meeting to earn a badge for Citizenship and Involvement in the
Community.Brian asked and was given a copy of the current budget plan.
The Mayor asked about the Fall Grain Drying Rates.He would like to review this rate
with Bill Houston,US Energy Services.
The Waukee Christian Church has invited Mayor Chedester to the July 22nd and 23rd
Ice Cream Social from 7:30pm to 9:00pm.
Councilman Duroy had the following statement read into the record.
It has been a pleasure to serve the community for the last three and one-half years,
through some trying times and some good times.I have witnessed the growth and
changing of the community.One of the things that attracted me to Waukee was the
small rural community close to a thriving metropolis.Now that small town is oaught up
in the spread and growth of the Metropolitan area.The population has doubled in the
short period of time in which I have resided here.This has challenged the City

government to protect the rights of the longtime citizens as well as encourage newgrowth.ISadlythisletteristoannouncemyresignationfromthecitycouncilofWaukee
effective July 1st,1995.
My hope is that I am leaving a city shaping it's future and retaining the heritage of the
past.I have strived to maintain a position that represents the welfare of the people and
the community.I pray that the will of the people and the good of the city will not be
overlooked and allow tunnel vision and personal feelings shape the future of the city.

Administrator's Report.
Metro Bus Surveys -The surveys have finally stopped coming into city hall.We
received almost forty of them and the vast majority want bus service to downtown Des
Moines.We will be summarizing the results in the near future.Monies are not
available for right now,but with this survey,we should have a head start on next year.I
Solid Waste Collection.Before the next Council meeting,we will have started our
solid waste collection/recycling program.Expect problems and complaints.There will
be a lot of minor problems that will have to be resolved,and people will have a lot of
questions,despite our efforts to educate them.
One of the main changes is that the collection days will be changing starting the
second week in July.Half of the City will be done on Thursday and the other half will
be done on Friday.
Annexation of Islands.The City islands in Walnut Ridge were discussed and
preliminarily approved at a meeting of the Development Board tonight..
Clerk's Institute.Kurt Rueckel,City Administrator,will be attending the Municipal
Clerk's Institute from July 10th through JUly 14th,1995.
Job Descriptions.We are almost done with the first draft of the job descriptions.
Hopefully within the next week we will be able to start on the second draft and soon
thereafter the wage scales.

Five Year Budget.One of the major projects that we will be working.on next is a five
(5)year budget.With all of the growth that is expected and the possible need for
additional employees,equipment,and buildings,we need to plan.It win take a couple
of years to refine,but it should really help get us through the growing pains.Most
cities use a five year budget for capital improvements,and a few have a two year
budget for their operating bUdget,but a few have a five year budget for operations.It is
really useful when you are going to grow like we are expected to.
V &K Bills.We sent out a majority of the V &K bills and have received only a few
complaints.

Administrator's Report inclUding the annexation of island and the V &K bills that are
outstanding.The Mayor asked for a voice vote.Motion carried 5 to O.
Public Works Report.
Parks Department.The Public Works department will be putting wood chips around
the benches and bleachers on the girls softball fields within the next few weeks.They
will also be installing posts and putting up black plastic safety fences for the out fields.
They will be establishing more parking areas at the park In order to better facilitate
park usage.The parking areas will be getting some new gravel facelifts next week.
Public Works will be siding the park shed with vertical siding and repainting the sheds
at the park.They will be building some permanent picnic tables around the parks.
Sod will be put around the new playground equipment this coming week.Hopefully
some trees and flower beds will be planted,
Streets Department.As stated in the council agenda packet,we are planning to have
Coon's Trucking haul shale from the old mine to North Warrior lane and create a
base.Then we will be having a firm haul 1800 ton of road gravel to put on top of this
base to create a nice gravel road.The road will be oontinually graded during the
hauling process.
Gas Department.The Gas department has received meters from American Meters.
These meters are direct read meters and the cost per meter is $83.50.
The Gas department is also working on developing a rebate program for our gas
customers.Such as a rebate on the purchase on a new furnace,water heater,stove,
or dryers.We will be presenting a proposal to the Utility Committee in the next month
or two.
The Gas department will be conducting a gas leak survey over the entire town.They

will also be doing large meter calibrations,and cathodic protection surveys.These
surveys will take considerable time to complete.
The gas department has put in new services and moved some services over the past
month.They are currently working on replacing the gas meters at Selectivend.It is an
older meter that does not have any calibration left available and we risk losing gas.
The cost of replacing this meter set is approximately $3,200.
Water Department.The Water department has installed several new meters in new
homes being constructed and we will continue to change out water meters as soon as
Bob Herrick gets his feet on the ground in the water department.
The Water department wHi be spray painting all of the curb stops,and valve box lids
with blue paint to help facilitate locations of the lines.

generator at Hawkeye Antique Acres.The Mayor asked for a roll call vote:Ayes:
