Pledge of Allegiance.Everyone in attendance recited the PJedge of Allegiance. A roll call vote was taken and the following City Council members were present:Don Bailey,Jr.,Nick Gruber,Monica Lihs and Terry Strain. Open Forum: Marsha Schmidt -2806 W Avenue.Marsha is asking that the Council to please go ahead to accept the voluntary annexation petitions.The Mayor stated that this will be talked about later in the meeting. Susan Morrisey -155 Kaylin Drive,requested permission to have a block party on July 15,1995 from 10:00am to 9:00pm.The Council gave their approval for the block party. Dan Fischer -420 Bel-Aire Drive stated he and his wife are in favor of the no burning ban. Brian Scheel -655 3rd Street -inquiring about the City's donation of $750.00 to the Waukee Jaycees for the 4th of July celebration. Mary White -670 Boone Drive -Mary would like to have the Council review the burning ordinance from her home town. Karen McClusky -835 4th Street-Mrs.McClusky would like to discuss the issue of barking dogs during the daylight hours.People put their dogs outside during the day white they are at work.Some of the dogs will bark all day.Mrs.McClusky has notified the Waukee Police and talked to the neighbor.Mrs.McClusky is willing to make a formal complaint Consent Agenda.A)6/19/95 City Council Minutes;B)Salary and Bill Presentation; C)Set Date For Public Hearing -Broderick Zoning Request;D)"The Bank"Liquor License. Motion by Councilman Gruber,seconded by Councilman Bailey,to publish the opening on the council and to receive the 2 written applications.The appointment will be made at the July 24th meeting.The Mayor asked for a roll call vote:Ayes:Gruber, Bailey,Lihs and Strain.Nays:None.Motion carried 4 to O. Motion by Councilman Bailey,seconded by Councilman Gruber,to amend the motion to extend the application time to August 4th by noon and the appointment will be made at the August 7th City Council meeting.The Mayor asked for a roll call vote:Ayes: Bailey,Gruber,Lihs and Strain.Nays:None.Motion carried 4 to O. Open Burning Hearing.The Mayor read the letter from Thelma Inman and the letter from Dorotha Clark. Motion by Councilwoman Lihs,seconded by Councilman Gruber,to receive the two letters.The Mayor asked far a voice vote.Molion carried 4 to O. Tom Davis -Midwest Mobile Home Court.Tom would like to know if it would be possible for the City to allow a person to burn on a certain day.The mobile home park has a burn pile for their residents to use.Tom would like to have approval to burn the pile on a set day or date if the burn ordinance is approved. The Mayor has received a compromise to the burning ordinance.The Mayor read the burn ordinance used in Denver Iowa. Barb Chapman -620 6th Street.Barb would like to express her appreciation to the Council for trying to work out a compromise with the burning ban. 3 July 10,1995 Waukee City Council Minutes IDennisHanes-180 Gray Avenue.When Dennis was the Fire Chief he presented the Utilities Committee with guide lines to follow when considering the burn ordinance to present to the Council. Dan Fischer -420 Bel-Aire Drive.Is in favor of the burn ordinance,if you have several weeks in the year that burning is allowed the City will have a big smoke pot.This would make it worse. Jane Olson -835 Ashworth Drive.Presented the Council with a petition for the burning ban.If you have a family member with a health problem one day of burning is too much.Everyone Jane contacted was in favor of some kind of ban on burning. Jane stated that last Saturday night at 9:00pm she went to put her children to bed and there was so much smoke in their house that their eyes were burning.She went over to her neighbors house and asked for them to put the fire out.There have been several occasions she has confronted people burning objects that should not be burnt. Mary White -670 Boone Drive.Mary did not sign either petition but she did bring the burn ordinance from her home town of Denver Iowa for the Council to read. Motion by Councilman Bailey to introduce "AN ORDINANCE TO AMEND CHAPTER 212,WAUKEE MUNICIPAL CODE,RESTRICTION OF OPEN BURNING WITHIN THE CITY LIMITS OF THE CITY OF WAUKEE,IOWA,BY DELETING CHAPTER 212 AND INSERTING IN LIEU THEREOF REVISED AND SUBSTITUTED ORDINANCE RESTRICTING OPEN BURNING WITHIN THE CITY LIMITS OF THE CITY OF WAUKEE,IOWA".SEE ORDINANCE BOOK. J Motion by Councilwoman Uhs,seconded by Bailey to have Robert Barrett read the ordinance in full.The Mayor asked for a roll call vote:Ayes:Lihs,Bailey,Strain and Gruber.Ayes:None.Motion carried 4 to O. Mayor Chedester read the burning ordinance from Denver,Iowa. The 2nd reading on the Burn Ordinance will be done at the July 24th City Council meeting. Mobile Home Park Ordinance.As discussed before the Mobile Home Park is requesting to change the set backs in both the new and old sections from twenty (20) feet to fifteen (15)feet.The wording also would allow the mobile homes to be 10 feet apart at the rear. Curtis Scott -Midwest Mobile Home Court.Mr.Scott is against the 10 feet rear setback.He presented the Council with pictures showing that the ordinance is not 4 I July 10,1995 Waukee City Council Minutes being followecf that is currently on the books. Mr.Herb Perry -Midwest Mobile Home Court.Mr.Perry stated he has spoke with the Building Inspectors regarding the mobile homes being placed against the current ordinance.The Building Inspectors told him they were instructed by City Officials to allow the 10 foot separation between the mobile homes. This item is to be tabled until the July 24th City Council Meeting.Mayor Chedester will sign off on all building permits before they are approved. Communication Tower Proposal -Objection to:U.S.West is proposing a 350 foot communication tower by exit 117 on 1-80 the entrance to Waukee.Residents in this area are concerned.The Dallas County Planning &Zoning rejected the proposal by one vote,however,U.S.West is appealing to the Board of Supervisors.The tower would be just south of 1-80. Carol Hansen -334 V Court.Mrs.Hansen spoke to the Council representing the residents in this area.The residents do not want this tower. Motion by Councilman Strain,seconded by Councilman Bailey,to direct the City Administrator to express the Councils view that this tower would not go with our comprehensive plan.The Mayor asked for a roll call vote:Ayes:Strain,Bailey,Gruber and Uhs.Nays:None.Motion carried 4 to O. Solid Waste Mobile Home Park.At the July 8th Utilities Committee meeting the representatives for the Mobile Home Park agreed to the curbside and solid waste pickup and would like it to begin on September 1,1995. On Monday,July 10th Mr.Brick has decided against the curbside and solid waste pickup. Councilman Strain made a public statement that no exception will be made for anyone within the City limits of Waukee.. Research is still being done for recycling at apartment complexes .. The snowbirds will not be charged for curbside/solid waste collection only if they have their utilities disconnected and pay $25.00 reconnection fee when they return home. Motion by Councilman Strain,seconded by Councilwoman Lihs,to bill every citizen in Waukee by the contract with no exceptions.The Mayor asked for a roll call vote:Ayes: Strain,and Lihs.Nays:Bailey and Gruber.Motion failed. 5 July 10,1995 Waukee City Council Minutes Councilman Gruber would like the curbside recycling and solid waste for the Mobile Home Park and Apartments to be on the July 24th agenda. Request of Non Resident to have Garbage Collection.Motion by Councilman Bailey, seconded by Councilman Gruber,to allow garbage collection.The Mayor asked for a roll call vote:Ayes:None.Nays:Bailey,Gruber,Lihs and Strain.Motion failed 0 to 4. SHARE Program -Use of Public Buildings.Tabled until the July 24th meeting. Curb Ramp Bids.As part of the Americans with Disabilities Act,the City is required by law to have sidewalk handicap accessible.Concrete Specialities has ground down the curbs and we are in the process of repouring new sidewalks. The Mayor would like to have John Wesselmann seek bids for all the sidewalks to be done. Motion by Councilman Bailey,seconded by Councilman Gruber,to accept the bids from Joe Finn for $1 ,390.00 to pour the curb ramps in the business district.The Mayor asked for a rollcall vote:Ayes:Bailey,Gruber,Lihs and Strain.Nays:None.Motion carried 4 to O. Contract Meter Reading.Last year John Wesselmann brought the proposal of contract J meter reading to the Council.The idea was given a good amount of thought.It was said that the Council would like a local person to be hired to perform these meter readings. Harry Jones has expressed an interest in reading meters for a company that contracts. There would probably be a couple people hired to do this.Paul Huscher and the Attorney's for People's Gas did some work on a contract last year.People's has said that they are still very willing to work out a deal that would satisfy everyone involved. Motion by Councilwoman Lihs,seconded by Councilman Bailey,to consider bids, search for more information and bring back to the Council at the July 24th Council meeting.The Mayor asked for a roll call vote:Ayes:Lihs,Bailey,Strain and Gruber. Request to fill Gas Superintendent &Gas Laborer Position.The City's Gas Superintendent haslett to seek employment elsewhere.The current Assistant,Tim Royer is very interested in accepting the Superintendent's positions. Motion by Councilwoman Lihs,seconded by Councilman Strain,to approve Tim Royer as Gas Superintendent and have John Wesselmann and Kurt discuss the wage scale (retroactive).Also,advertise to fill the Gas Laborer's position.The Mayor asked for a 6 July 10,1995 Waukee City Council Minutes roll call vote:Ayes:Lihs,Strain,Gruber and Bailey.Nays:None.Motion carried 4 t 0 O. Back Hoe Trade In.We are currently on a 2 year municipal program that allows us to trade our backhoe for a new one and only pay $10 per hour.July 14th is the 2 year anniversary date. This is a great opportunity to keep the City's equipment current every 2 years.They have also offer us the opportunity to get this municipal program on a larger trencher which we have bUdgeted for.John Wesselmann will be bringing bids back next month on a larger trencher to help perform more projects. Motion by Councilman Bailey,seconded by Councilman Gruber,to trade in the back hoe for a new one at a cost of $4,500.00 for 450 hours on a hour meter.The Mayor asked for a roll call vote:Ayes:Bailey,Gruber,Lihs and Strain.Nays:None.Motion carried 4 to O. Power Easements Country Club Woods Plat 4.Midwest Power has requested that they be allowed to install undergmund cable,pads,mounted transformers,and hand holes along a ten foot easement on the front of the property, This would make maintenance easier and provide more uniformity with Southfork. Motion by Councilman Bailey,seconded by Councilwoman lihs,to accept the request for a Power Easement.The Mayor asked for a roll call vote:Ayes:Bailey,Llhs,Strain and Gruber.Nays:None.Motion carried 4 to O. Mayor's Report. 1)The Mayor feels there should be some compensation for the quality of water we are receiving.We have not been receiving the quality of water guaranteed to us by the Des Moines Water Works. 2)July 22nd the Christian Church is having a ice cream social for their 1DOth year celebration. 3)There could be a possibility of the Post Office moving. 4)The Mayor visited with Mr.Husted regarding the annexation coming up east of town. Library Report.Councilman Bailey presented the Council with the Library Report. Motion by Councilman Gruber,seconded by Councilman Bailey,to receive the Planning &Zoning report.The Mayor asked for a voice vote.Motion carried 4 to O. Utility Committee Report.Will have written report at the next meeting. Public Work's Report. Use of Generator by Hawkeye Acres.Motion by Councilman Bailey,seconded by Councilwoman Lihs to approve the use of the generator by Hawkeye Acres with a rental fee of $1.00.The generator will be returned on July 24th,if not returned there will be a rental fee of $500.00 per day after July 24th.The Mayor asked for a roll call vote:Ayes:Bailey,Lihs,Strain and Gruber.Nays:None.Motion carried 4 to O. Mayor Chedester vetoed the motion citing his belief that the rental fee was too low. Mayor Chedester provided the Council with a written veto. Motion by Councilman Gruber,seconded by Councilman Strain,to override the veto. The Mayor asked for a roll call:Ayes:Gruber,Strain,Lihs and Bailey.Nays:None. Motion carried 4 to O.1 Attorney's Report -Landfill and Annexation.Motion by Councilwoman Lihs,seconded by Councilman Gruber,to enter into closed session pursuant to Iowa Code Section 21.51 (c)."To discuss strategy with counsel in matters that are presently in-litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation",seconded by Councilman Gruber.The Mayor put the question on the motion and the roll being called,the following named Council members voted:Lihs,Gruber,Bailey and Strain. Nays:None.Motion carried 4 to O. The Council entered closed session at 10:52pm. Council came out of closed session at 11 :21 pm. Motion by Councilman Gruber,second by Councilwoman Lihs,to publish the notice and set the hearing date for 7/31/95 at 7:00pm on the voluntary annexation petitions. Motion by Councilman Gruber,seconded by Councilwoman Lihs,to give Paul 8 July 10,1995 Waukee City Council Minutes Huschsr,City Attorney,to act in the best interest of the city and represent the city on the presentation.The Mayor asked for a roll call vote:Ayes:Gruber,Lihs,Bailey and Strain.Nays:None.Motion carried 4 to O. Motion by Councilwoman Lihs,seconded by Councilman Bailey,to enter into closed session to evaluate the professional competency of an individual whose appointment, hiring,performance or discharge is being considered when necessary to prevent needless and irreparable injury to that individual's reputation and that individual requests a closed session.The Mayor asked for a roll call vote:Ayes:Lihs,Bailey, Strain and Gruber.Motion carried 4 to O. The Council entered closed session at 11 :27pm. The Council carne-out of closed session at 12:10am. Motion by Councilman Bailey,seconded by Councilwoman Lihs,to accept the City Administrator's evaluation.The Mayor askedJor a roll call vote:Bailey,Lihs,Gruber and Strain.Motion carried 4 to O.
