Chedester with Bob Barrett taking minutes.
PLEDGE OF ALLEGIANCE.Everyone recited the Pledge of Allegiance.
ROLL CALL.A roll call vote was taken and the following Council members were present:
Don Bailey,Jr.,Nick Gruber,Monica Lihs,Dan Lugar and Terry Strain.
OPEN FORUM.
Councilman Strain asked about the status of the grant money for a Police Officer.
Motion by Councilwoman Lihs,seconded by Councilman Lugar to have the hiring of a Police
Officer with the Cop's grant put on the October 16th agenda and direct Police Chief Phillips to
attend.The motion was withdrawn,but the issue will still be put on the next agenda with the
chief in attendance.
AGENDA ADDITIONS -AGENDA APPROVAL.
Add item 6C -Parkview Block Party.
Motion by Councilman Gruber,seconded by Councilman Strain to add item 6C.The Mayor
asked for a voice vote.Motion carried 5 to O.

REQUEST TO BUILD -JEFF DOWNING.Downing Development is developing two plats -Enterprise
Business Park and Sunrise Meadows.One building permit has already been issued for a building in
Enterprise Business Park.Jeff is requesting to start construction of at least one new house in Sunrise
Meadows.
Motion by Councilman Bailey,seconded by Councilman Gruber to allow construction to begin on 1 or 2
homes with the understanding that no occupancy permits will be issued nor will the homes be sold until
the approval of the final plat.The Mayor asked for a roll call vote:Ayes:Bailey,Gruber,Strain and Lugar.
Nays:Lihs.Motion carried 4 to 1.
HICKMAN TRUNK SEWER AGREEMENT -BYERS.This is an agreement for the last phase of the
Hickman Trunk Sewer before the pumping station.This section will take the Trunk Sewer just east of
Alice's Road.It will also serve the industrial park area.
HICKMAN TRUNK SEWER AGREEMENT
THIS AGREEMENT is made effective this __day of October,1995,by and between the property
owners on record in the agreement attached by and between Williams Turf Farms ("Byer")and others,and
the City of Waukee ("WaUkee").
1WHEREAS,the Hickman Trunk Sewer (the "Trunk Sewer")is being extended in the summer and fall of
1995,all or a majority of the project to be done by private developers in accordance with the Engineering
Construction Plans completed by Veenstra and Kimm,Inc.and approved by the Waukee City Council,
such work to be inspected by Veenstra and Kimm,Inc.as contracted by the City of Waukee.
Whereas,Byers and others have agreed to privately contract and pay for the completion of the trunk
sewer from 120'east of manhole 12 to the end of phase 2 at a point just east of Alice's Road.
NOW THEREFORE IT IS AGREED AS FOLLOWS;
1.Byers and others hereby agree to reimburse the City of 38.3%of $23,500 in design fees
for Phase I of this project ($9,400).Byers and "Others"also agree to reimburse the City of Waukee for
Engineering Inspection fees to be incurred as the project is being completed,and to be billed to the City of
Waukee in accordance with the provisions in the June 1,1995 letter from Bob Veenstra of Veenstra and
Kimm,Inc.
2.Such payments will be made within (30)days from receipt of the bill from the City.
3.Any amendments to this agreement shall also be in writing and signed by all of the
original Parties hereto.

RECYCLING AT APARTMENTS -3RD READING.Motion by Councilwoman Lihs,seconded by
Councilman Strain to place the Recycling at Apartments Ordinance on the third reading (title only).The
Mayor asked for a roll call vote:Ayes:Lihs,Strain,Lugar,Bailey and Gruber.Nays:None.Motion carried
5 to O.
Motion by Councilwoman Lihs,seconded by Councilman Bailey to put the Recycling at Apartments
Ordinance on its final passage and adoption.The Mayor asked for a roll call vote:Ayes:Lihs,Bailey,
Lugar,Lugar,Gruber and Strain.Nays:None.Motion carried 5 to O.
The Mayor declared the Recycling at Apartments Ordinance duly passed and adopted.
REQUEST TO PURCHASE SMALL RECYCLING BINS.Motion by Councilman Gruber,seconded by
Councilwoman Lihs,to purchase smaller recycling bins to provide to apartment owners.There will be a
charge for replacement bins.The Mayor asked for a roll call vote:Ayes:Gruber,Lihs,Strain and Lugar.
Nays:Bailey.Motion carried 4 to 1.

REQUEST TO PURCHASE GAS PIPE.John Wesselmann explained to the Council that with the various
developments comes a cost to furnish gas materials to be installed.Developers pay the cost of materials
and installation and then get reimbursed as they sell the lots.The City needs to order these materials so
that the materials are delivered in time for installation.
REQUEST TO ACCEPT GAS LINE INSTALLATION.There are numerous developments being
constructed at the same time,the City of Waukee needs to contract the installation of the gas mains.
Motion by Councilman Gruber,seconded by Councilman Strain,to approve the purchase of Gas Pipe at a
cost of $24,529.78.The Mayor asked for a roll call vote:Ayes:Gruber,Strain,Bailey Lihs and Lugar.
Nays:None.Motion carried 5 to O.
The City has 26 service installations on a list with more coming up everyday.John Wesselmann has sent
out bid requests to three (3)contractors.John has received bids from the following two (2)contractors:
Iowa Pipeline -Enterprise Business Park $43,380;Westgate $127,750 and Murphy Brothers -Enterprise
Business Park $36,450;Westgate $86,650.
Motion by Councilman Gruber,seconded by Councilman Lugar to accept the bid from Murphy Brothers at
a cost of $123,100.00 for gas line installations at Enterprise Business Park and Westgate Development.
The Mayor asked for a roll call vote:Ayes:Gruber,Lugar,Strain,Lihs and Bailey.Nays:None.Motion
carried 5 to O.
REVIEW OF V&K REIMBURSEMENT.Kurt Rueckel updated the Council regarding the reimbursement of
V &K bills.The developers for the most part have been very cooperative.Kurt will report back to the
Council at the next meeting.
PRELIMINARY REVIEW -PURCHASING POLICY.Motion by Councilman Lugar,seconded by
Councilwoman Lihs,to table until the October 16th Council meeting.The Mayor asked for a voice vote.

MAYOR'S REPORT.Mayor Chedester updated the Council on the following items:1)Fall Festival;2)
Update on School Grant.
Motion by Councilman Bailey,seconded by Gruber to appoint Mary White to the Board of Adjustment.
The Mayor asked for a roll call vote:Ayes:Bailey,Gruber,Strain,Lihs and Lugar.Nays:None.Motion
carried 5 to O.
The Mayor appointed Tom Wilkerson to the Parks Committee.
PARK COMMITTEE REPORT.Motion by councilman Strain,seconded by Councilman Gruber to accept
the Park Committee Report.The Mayor asked for a voice vote.Motion carried 5 to O.
ADMINISTRATOR'S REPORT.The written report was received.
ATTORNEY'S REPORT.Motion by Councilman Lugar,seconded by Councilwoman Lihs,to enter into
closed session pursuant to the Iowa code Section 21.51(c)"To discuss strategy with Counsel in matters
that are presently in litigation or where litigation is imminent where its disclosure would be likely to
prejudice or disadvantage the position of the governmental body in that litigation".The Mayor asked for a
roll call vote:Ayes:Lugar,Lihs,Bailey,Strain and Gruber.Nays:None.Motion carried 5 to O.
The Council entered into closed session at 9:25pm.
The came out of closed session at 9:48pm
Motion by Councilman Gruber,seconded by Councilman Lugar to adjourn at 9:49pm.Upon voice vote the
motion passed 5 to O.J
