PLEDGE OF ALLEGIANCE.Everyone recited the Pledge of Allegiance. ROLL CALL.A roll call vote was taken and the following Council members were present: Don Bailey,Jr.,Nick Gruber,Monica Lihs,Dan Lugar and Terry Strain. OPEN FORUM.None. AGENDA ADDITIONSIDELETIONS.Councilwoman Lihs would like Item l3A,l3B,and l3C regarding the REAP Grant for the School's Journey into Ecology deleted from the agenda until the City Attorney has a chance to review the legalities. Motion by Councilman Bailey,seconded by Councilman Lugar,to accept the FYE Annual Audit.The Mayor asked for a roll call vote:Ayes:Bailey,Lugar,Lihs,Strain and Gruber.Nays:None.Motion carried 5 to O. KEN HOPPER -PERMANENT STATUS.Motion by Councilman Gruber,seconded by Councilman Bailey,to put Ken Hopper on permanent status.The Mayor asked for a roll call vote:Ayes:Gruber, Bailey,Strain,Lugar and Lihs.Nays:None.Motion carried 5 to O. City Attorney Paul Huscher stated the Council should look at setting a policy for sidewalk bonds in new developments .. The Mayor asked the Council if they should or should not look at approving of the Final Plats items #10, #11 and #12 because one (1)Council meeting had not been skipped after being at the Planning and Zoning Commission. Motion by Councilman Gruber,seconded by Councilman Strain,to move on items #10,#11 and #12.The Mayor asked for a roll call vote:Ayes:Gruber,Strain,Lugar,Bailey and Lihs.Nays:None.Motion carried 5 to O. SUNRISE MEADOWS FINAL PLAT.The Planning and Zoning Commission has approved the Final Plat of Sunrise Meadows subject to park land dedication and a future date or the equivalent in money.All the necessary bonds have been submitted to the City and reviewed by the City Attorney and City Engineer. The plat of Sunrise Meadows has twenty-three (23)residential lots.When the entire subdivision is completed in approximately ten (10)years,it will have approximately 290 lots. Motion by Councilman Gruber,seconded by Councilman Lugar,to approve the Final Plat Sunrise Meadows subject to the park dedications.Resolution #95-8.The Mayor asked for a roll call vote:Ayes: Gruber,Lugar,Bailey,Lihs and Strain.Nays:None.Motion carried 5 to O. RESOLUTION 95-8 RESOLUTION ACCEPTING THE FINAL PLAT OF SUNRISE MEADOWS PLAT 1 -A SUBDIVISION OF THE CITY OF WAUKEE,IN DALLAS COUNTY IOWA WHEREAS,Downing Development Ltd,has presented the Final Plat of Sunrise Meadows -Plat 1,and the Waukee Planning and Zoning Commission approved this Final Plat on October 24,1995;and WHEREAS,the City Council has found this subdivision to be in conformance with its comprehensive plan; WHEREAS,the City Council has found that the final plat has met the requirements under section 354.8 of 4 the Code of Iowa; )WHEREAS,the City of Waukee,at the regular council meeting on November 6,1995,considered the Final Plat for Sunrise Meadows -Plat 1,Waukee,Iowa,Dallas County. WHEREAS,a letter has been submitted dedicating a parcel of land for park dedication as per the requirements of the City's Subdivision Ordinance. NOW,THEREFORE,be it resolved that the Final Plat for Sunrise Meadows -Plat 1 is hereby approved on this sixth day of November,1995. ENTERPRISE BUSINESS PARK FINAL PLAT.The Planning and Zoning Commission has approved the Final Plat of Enterprise Business Park subject to the City receiving a pledge dedicating park land.All the necessary bonds have been submitted to the City and have been reviewed by the City Attorney and City Engineer. There are seven (7)lots in Plat 1,one of which is already being built upon by PDQ -Parts Delivered Quickly.This development will not generate additional dollars until the TIF moneys have been paid out or the TIF district is over -20 years. Motion by Councilman Strain,seconded by Councilman Gruber,to approve the Enterprise Business Park Plat I final plat,subject to the City receiving a pledge dedicating park land.The Mayor asked for a roll call vote:Ayes:Strain,Gruber,Lihs,Bailey and Lugar.Nays:None.Motion carried 5 to O.Resolution #95-9. COUNTRY CLUB WOODS FINAL PLAT.Country Club Woods Plat 4 lies just West of Southfork.Earlier this year a agreement was reached whereby Boone Drive would not be paved until phase two (2)of the project was done. Everything to approve the final plat has been approved except for the performance bond for the street. Although the street has been paved it has not been approved.There is still a patch that will have to be 5 done -the developer has submitted a $2,000 cashier's check for that patch which may cost $500 to do. When fully developed the 29 houses should generate at least $35,000 in general fund property taxes. Approximately,$70,000 per year in city revenues. Motion by Councilman Bailey,seconded by Lugar,to approve Country Club Woods Plat 4 subject to 1)a letter stating Phase 2 is not contingent on the University Trunk Sewer and 2)changing the name of Westwood Drive to Olson Drive.The Mayor asked for a roll call vote:Ayes:Bailey,Lugar,Lihs,Gruber and Strain.Nays:None.Motion carried 5 to O. RESOLUTION 95-10 RESOLUTION ACCEPTING THE FINAL PLAT OF COUNTRY CLUB WOODS -PLAT 4 -A SUBDIVISION OF THE CITY OF WAUKEE,IN DALLAS COUNTY IOWA WHEREAS,Iowa Realty Company has presented the Final Plat of Country Club Woods -Plat 4,and the Waukee Planning and Zoning Commission approved this Final Plat on October 24,1995;and WHEREAS,the City Council has found this subdivision to be in conformance with its comprehensive plan; WHEREAS,the City Council has found that the final plat has met the requirements under section 354.8 of the Code of Iowa; WHEREAS,the City of Waukee,at the regular council meeting on November 6,1995,considered the Final Plat for Country Club Woods -Plat 4,Waukee,Iowa,Dallas County. NOW,THEREFORE,be it resolved that the Final Plat for Country Club Woods -Plat 4 is hereby approved this sixth day of November,1995. REAP GRANT.Motion by Councilwoman Lihs,seconded by Councilman Strain,to have Paul Huscher, City Attorney,contact all governing bodies to set a time and date for a meeting.The Mayor asked for a roll call vote:Ayes:Lihs,Strains,Lugar,Bailey and Gruber.Nays:None.Motion carried 5 to O. STANDARD SPECIFICATIONS.Veenstra &Kimm have prepared a new City of Waukee Standard Specifications book.The staff at the Public Works Department has gone through the spec's and has made a few changes that would serve the city better. Motion by Councilman Bailey,seconded by Councilman Strain,to pass Resolution #95-11 adopting the Standard Specifications,also setting a fee of $30.00 per copy.The Mayor asked for a roll call vote:Ayes: Bailey,Strain,Gruber,Lugar and Lihs.Nays:None.Motion carried 5 to O. RESOLUTION NO.95-11 A RESOLUTION ADOPTING STANDARD SPECIFICATIONS FOR PUBLIC IMPROVEMENTS IN THE CITY OF WAUKEE,IOWA WHEREAS,the City Council of the City of Waukee has determined that certain minimum standards of construction for public improvements are needed and desirable to insure quality control; 6 AND WHEREAS,various Ordinances of the City of Waukee refer to and require specifications standards for construction projects; AND WHEREAS,on November 6th,1995,the City Council directed Veenstra &Kimm,Inc.,and Iowa corporation,referred to as City Engineer in these standard specifications,to prepare standard specifications with such specifications being in accordance with the standards of the industry and complying with sound engineering principles. NOW,THEREFORE,BE IT RESOLVED THAT: 1.The document entitled Standard Specifications For Public Improvements,Waukee,Iowa,is hereby adopted. 2.These Standard Specifications shall be followed and used by the city in considering,permitting,inspecting,and otherwise dealing with the construction of public improvements within the City. 3.These Standard Specifications may be made available to individuals, firms,corporations,or others upon payment of $30.00 to the City, to cover the cost of preparation. 4.These Standard Specifications shall be used for all projects submitted after the date of adoption of this resolution. 5.These Standard Specifications shall be used for all projects submitted after the date of adoption of this resolution. 1Passedandapprovedthis6thdayofNovember,1995,by the City Council of the City of Waukee,Iowa. PURCHASE GAS METERS.With the development going on and the access to get gas meters limited, we need to order 300 gas meters (estimated on spring and early summer demanded).The gas meters will be purchased from American Meters for a purchase price of $83.90 per meter or $25,170.00. Motion by Councilman Gruber,seconded by Councilman Lugar,to approve the purchase of 300 gas meters at $83.90 per meter or $25,170.00.The Mayor asked for a roll call vote:Ayes:Gruber,Lugar, Lihs,Strain and Bailey.Nays:None.Motion carried 5 to o. PURCHASE WATER METERS.With the development going on and the chance to purchase a larger amount of water meters at a discounted price for quantity,John Wesselmann,Public Works Director, would like permission to purchase 200 water meters from Municipal Supply for $69.85 each.This will save the City approximately $860.00. Motion by Councilman Strain,seconded by Councilwoman Lihs,to approve the purchase of 200 water meters at $69.85 per meter or $$13,970.00.The Mayor asked for a roll call vote:Ayes:Strain,Lihs, Lugar,Gruber and Bailey.Nays:None.Motion carried 5 to O. SALE OF EQUIPMENT -WESTERN SNOW PLOW.The Public Works Department would like permission to sell the old Western Snow Plow.This snow plow came with the purchase of the 1979 4X4 Parks truck,The truck barely runs without the plow attached let alone trying to push snow with it.John would suggest selling the plow for a fair price and reinvesting the money into something the Public Works Department needs.I 7 Motion by Councilman Lugar,seconded by Councilwoman Lihs,to give John permission to sell the Western Snow Plow by silent bid,receiving bids for 2 weeks and reserving the right to turn down all bids. PURCHASE NEW TRENCHER.The Public Works Department would like permission to purchase a new trencher for $21 ,900.00 and trailer for $1,900.00 a total of $23,800.00. Motion by Councilman Lugar,seconded by Councilwoman Lihs,to purchase a new Case Model 460 trencher with trailer and include the Municipal Trade Program.The Mayor asked for a roll call vote:Ayes: Lugar,Lihs,Bailey,Strain and Gruber.Nays:None.Motion carried 5 to O. RECYCLING AT MOBILE HOME PARK.Councilman Bailey introduced "AN ORDINANCE AMENDING CHAPTER 213A OF THE MUNICIPAL CODE OF THE CITY OF WAUKEE,PROVIDING FOR THE ASSESSING OF FEES OR CHARGES FOR THE COLLECTION,PROCESSING AND MARKETING OF SOLID WASTE AND RECYCLABLE MATERIALS WITHIN THE CITY LIMITS OF THE CITY OF WAUKEE,IOWA,BY AMENDING SECTION 213A3©THEREOF TO INCLUDE MOBILE HOME PARKS WITH MULTIFAMILY DWELLINGS CONTAINING FOUR (4)OR MORE UNITS HAVING A COMMERCIAL TYPE OF CONTAINER THAT MAY BE MECHANICALLY EMPTIED. Motion by Councilman Bailey,seconded by Councilman Gruber,to have ordinance amending chapter 213B read for the first time,title only.The Mayor asked for a roll call vote:Ayes:Bailey,Gruber,Lugar and Strain.Nays:Lihs.Motion carried 4 to 1. Councilman Bailey introduced "AN ORDINANCE PROVIDING FOR MANDATING RECYCLING PROGRAMS AT MULTIFAMILY DWELLINGS OF FOUR OR MORE UNITS AND MOBILE HOME PARKS WITHIN THE CITY OF WAUKEE AND ESTABLISHING PENALTIES FOR VIOLATIONS BY DELETING CHAPTER 213B,WAUKEE MUNICIPAL CODE,AND ADOPTING IN LIEU THEROF THE FOLLOWING. Motion by Councilman Bailey,seconded by Councilman Gruber,to have ordinance providing for mandating recycling programs 213B read for the first time,title only.The Mayor asked for a roll call vote: Ayes:Bailey,Gruber,Lugar and Strain.Nays:Lihs.Motion carried 4 to 1. MAYOR'S REPORT.Mayor Chedester briefly discussed the following items:A)Open Burning;B) Performance Bond for Windfield Streets;C)Dick Applegate -appointment to the Planning and Zoning Commission;and D)City Hall computers. PLANNING AND ZONING COMMISSION REPORT.Motion by Councilman Strain,seconded by Councilman Bailey,to accept the P &Z report.The Mayor asked for a voice vote.Motion carried 5 to O. LIBRARY REPORT.Motion by Councilman Bailey,seconded by Councilman Strain,to approve the Library Report.The Mayor asked for a voice vote.Motion carried 5 to O.
